(अ), तारीख 25th जुलाई , 2018 । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 26th November, 2018 S.O. 5845(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.1533 (E), dated the 14th September, 2006, issued under sub-section (1) and clause (v) of sub-section (2) of section (3) of the Environment (Protection) Act, 1986 read with clause (d) of the sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 (hereinafter referred to as the said notification), the Central Government directed that on and from the date of its publication, the required construction of new projects or activities or the expansion or modernisation of existing projects or activities listed in the Schedule to the said notification entailing the capacity addition with change in process or technology and or product mix shall be undertaken in any part of India only after prior environmental clearance from the Central Government or as the case may be, by the State Level Environment Impact Assessment Authority, duly constituted by the Central Government under sub-section (3) of section 3 of the said Act, in accordance with the procedure specified therein; And whereas, in the said notification, as amended vide S.O. 3067 (E) dated 1st December 2009, in paragraph 10, in sub-paragraph (ii), it has been provided that “It shall be mandatory for the project management to submit half-yearly compliance reports in respect of the stipulated prior environmental clearance terms and conditions in hard and soft copies to the regulatory authority concerned, on 1st June and 1st December of each calendar year”; And whereas, in the Ministry of Environment, Forest and Climate Change, large number of half- yearly monitoring reports which are being received only in hard copy, made it difficult to review and record in the office, and moreover, as an e-governance initiative, the said Ministry is in the process of making the entire environment clearance process and post clearance monitoring online for which soft copies of the half-yearly monitoring reports will be useful; And whereas, in view of the above, the Central Government finds it necessary to amend the said notification, by dispensing with the requirement of notice referred to in clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 regarding inviting objections and suggestions from persons likely to be affected thereby, in public interest; Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v)of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government, after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of the said rule 5, hereby makes the following further amendments in the said notification of the Government of India, in the erstwhile Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O.1533 (E), dated the 14th September, 2006,namely:- In the said notification, in paragraph 10, in sub-paragraph (ii), for the words “hard and soft copies” the words “soft copy” shall be substituted.
