का.आ. 2444(अ).—केन् (cid:7076)ीय सरकार ने, भारत सरकार के तत् कालीन पयार्वरण और वन मं(cid:7074)ालय की
अिधसूचना सं. का.आ. 19(अ), तारीख 6 जनवरी, 2011 (िजसे इसम(cid:7286) इसके पश् चात् उक् त अिधसूचना कहा गया ह)ै
(cid:7367)ारा, कितपय तटीय क्षे(cid:7074)(cid:7298) को तटीय िविनयमन खंड के रूप म(cid:7286) घोिषत िकया था और उक् त खंड म(cid:7286) उ(cid:7378)ोग(cid:7298) की
स् थापना करने और उनके िवस् तार, संि(cid:7059)या(cid:7312) तथा (cid:7079)संस् करण(cid:7298) पर िनब(cid:7304)धन अिधरोिपत िकए थे ;
और उक् त अिधसूचना के पैरा 5 के खंड (viii) के अधीन राज् य सरकार या संघ राज् यक्षे(cid:7074) के तटीय खंड
(cid:7079)बंधन (cid:7079)ािधकरण से यह अपेक्षा की जाती ह ै िक वह केन्(cid:7076)ीय सरकार को पणधािरय(cid:7298) से (cid:7079)ाप् त सुझाव(cid:7298) और आक्षेप(cid:7298)
को समािवष् ट करने के पश् चात् अपनी िसफािरश(cid:7298) के साथ (cid:7079)ारूप तटीय खंड (cid:7079)बंध योजना (cid:7079)स् तुत करे ;
और उक् त अिधसूचना के पैरा 5 के खंड (xii) के अधीन, तटीय िविनयमन खंड अिधसूचना, 1991 के
अधीन पहले से ही अनुमोिदत तटीय खंड (cid:7079)बंध योजना(cid:7312) की िविधमान् यता को केन् (cid:7076)ीय सरकार (cid:7367)ारा अिधसूचना सं.
का.आ. 1212(अ), तारीख 22 माचर्, 2016 (cid:7367)ारा 31 जनवरी, 2017 तक िवस्तािरत िकया गया था ;
और तटीय क्षे(cid:7074) (cid:7079)बंध योजना(cid:7312) के तैयार िकए जाने की (cid:7079)ािस् थित का पुनिवर्लोकन करने के पश् चात्, केन् (cid:7076)ीय
सरकार का यह समाधान हो गया ह ै िक उसे तटीय राज् य(cid:7298) और संघ राज् यक्षे(cid:7074)(cid:7298) के िलए, अपनी-अपनी (cid:7079)ारूप तटीय
खंड (cid:7079)बंध योजना(cid:7312) को अनुमोदन हते ु (cid:7079)स् तुत करने हते ु कुछ और अिधक समय की आवश्यकता ह;ै
और पयार्वरण (संरक्षण) िनयमय, 1986 के िनयम 5 के उपिनयम (4) के उपबंध को ध् यान म(cid:7286) रखते हुए,
केन् (cid:7076)ीय सरकार की यह राय ह ै िक यह उक् त अिधसूचना का आगे और संशोधन करने के िलए उक् त िनयम(cid:7298) के िनयम
5 के उपिनयम (3) के खंड (क) के अधीन सूचना की अपेक्षा से अिभमु(cid:7334) करना लोक िहत म(cid:7286) ह ै;

अत:, अब, केन् (cid:7076)ीय सरकार पयार्वरण (सरं क्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (घ)
और उपिनयम (4) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा
(1) और उपधारा (2) के खडं (v) (cid:7367)ारा (cid:7079)दत् त शिक् तय(cid:7298) का (cid:7079)योग करते हुए उक् त अिधसूचना म(cid:7286) िनम् निलिखत और
संशोधन करती ह,ै अथार्त्:-
उक् त अिधसूचना के पैरा 5 के खंड (xii) के स् थान पर िनम् निलिखत खडं रखा जाएगा, अथार्त्:-
“(xii) तटीय िविनयमन खंड अिधसूचना, 1991 के अधीन तत् कालीन पयार्वरण और वन मं(cid:7074)ालय (cid:7367)ारा पहले से ही
अनुमोिदत तटीय क्षे(cid:7074) (cid:7079)बंध योजनाएं 31 जुलाई, 2018 तक या ऐसे समय तक जैसा उक् त अिधसूचना के अधीन
बनाई गई नई तटीय क्षे(cid:7074) (cid:7079)बंध योजना(cid:7312) को इस मं(cid:7074)ालय (cid:7367)ारा अनुमोदन िदया जाता ह,ै इनम(cid:7286) से जो भी पहले हो,
िविधमान् य ह(cid:7298)गी ।”

NOTIFICATION
New Delhi, the 31st July, 2017
S.O. 2444(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Environment
and Forests number S.O. 19(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), the Central
Government had declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the
setting up and expansion of industries, operations and processes in the said Zone;
And whereas, under clause (viii) of paragraph 5 of the said notification, the Coastal Zone Management
Authority of a State Government or of a Union territory is required to submit the draft Coastal Zone Management Plan¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3
along with its recommendations to the Ministry of Environment and Forest, after incorporating the suggestions and
objections received from the stakeholders;
And whereas, under clause (xii) of paragraph 5 of the said notification, the validity Coastal Zone Management
Plans already approved under the Coastal Regulation Zone notification, 1991, was extended up to the 31st July, 2017 by
the Central Government vide notification number S.O. 622(E), dated the 23rd February, 2017;
And whereas after the review of the status of preparation of the Coastal Zone Management Plans, the Central
Government is satisfied that it may take some more time for the coastal States and Union territories to submit their
respective draft Coastal Zone Management Plans for approval;
And whereas the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment
(Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under
clause (a) of sub-rule (3) of rule 5 of the said rules for further amending the said notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment
(Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the said
notification, namely:-
In the said notification, in paragraph 5, in clause (xii), for figures “2017”, the figures “2018” shall be substituted.

अनुज्ञात िकया गया था;
और एकीकृत तटीय िविनयमन खंड तथा एकीकृत (cid:7367)ीप (cid:7079)बंध योजना के तैयार करने की (cid:7079)ािस् थित का
पुनिवर्लोकन करने के पश् चात्, केन् (cid:7076)ीय सरकार का यह समाधान हो गया ह ै िक संघ राज् यक्षे(cid:7074)(cid:7298) को अपनी-अपनी
(cid:7079)ारूप एकीकृत तटीय िविनयमन खंड और एकीकृत (cid:7367)ीप (cid:7079)बंध योजना(cid:7312) को अनुमोदन हते ु (cid:7079)स् तुत करने म(cid:7286) कुछ और
अिधक समय लगेगा;
और पयार्वरण (संरक्षण) िनयय, 1986 के िनयम 5 के उपिनयम (4) के उपबंध को ध् यान म(cid:7286) रखते हुए,
केन् (cid:7076)ीय सरकार की यह राय ह ै िक यह उक् त अिधसूचना का आगे और संशोधन करने के िलए उक् त िनयम(cid:7298) के िनयम
5 के उपिनयम (3) के खंड (क) के अधीन सचू ना की अपेक्षा से अिभमु(cid:7334) करना लोक िहत म(cid:7286) ह ै;
अत:, अब, केन् (cid:7076)ीय सरकार पयार्वरण (सरं क्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (घ)
और उपिनयम (4) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा
(1) और उपधारा (2) के खडं (v) (cid:7367)ारा (cid:7079)दत् त शिक् तय(cid:7298) का (cid:7079)योग करते हुए उक् त अिधसूचना म(cid:7286) िनम् निलिखत और

उ(cid:7334) अिधसूचना के पैरा III के खंड (घ) म(cid:7286) शीषर् 5 के अधीन “अविध िजसके िलए एकीकृत तटीय िविनयमन
खंड और एकीकृत (cid:7367)ीप (cid:7079)बंध योजनाएं िविधमान् य ह(cid:7298)गी” से संबंिधत मद (ii) के स् थान पर िनम् निलिखत मद रखी
जाएगी, अथार्त्:-
“(ii) तटीय िविनयमन खंड अिधसूचना, 1991 के अधीन तत् कालीन पयार्वरण और वन मं(cid:7074)ालय (cid:7367)ारा पहले से ही
अनुमोिदत (cid:7367)ीप के िलए तटीय क्ष(cid:7074)े (cid:7079)बंध योजनाएं, िजनके िलए एकीकृत तटीय िविनयमन खंड और एकीकृत (cid:7367)ीप
(cid:7079)बंध योजना तैयार नह(cid:7277) की गई ह,(cid:7289) 31 जुलाई, 2018 तक लागू रहग(cid:7286) ी ।”

expansion of industries, operations and processes in the said Zone;
And whereas, under sub-clause (ii) of heading 5 under item (D) of paragraph III of the said notification, the
validity of the Coastal Zone Management Plans already approved under the Coastal Regulation Zone notification, 1991,¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5
was extended till the 31st July, 2017 by the Central Government vide notification number S.O. 621(E), dated the
23rd February, 2017;
And whereas, after the review of the status of preparation of Integrated Coastal Regulation Zone and Integrated
Islands Management Plan, the Central Government is satisfied that it may take some more time for the Union territories
to submit their respective draft Integrated Coastal Regulation Zone and Integrated Islands Management Plan for
approval;
And whereas, the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment
(Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under
clause (a) of sub-rule (3) of rule 5 of the said rules for further amending the said notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment
(Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the said

In the said notification, in paragraph III, in clause D, under the heading 5 relating to ‘period for which ICRZ and
IIMPs shall be valid’, in item (ii), for the words, figures and letters “used till the 31st July, 2017” the words, figures and
letters “valid till the 31st July, 2018” shall be substituted.
