वािणि0यक वाहनA के उपयोग के िलए कोई सfवस रोड अथवा वकै ि(cid:6)पक सड़क उपलhध न हो। 7. जो यािं (क वाहन अपनी rेणी के िलए िनधा(cid:25)#रत अनoु ये भार क(cid:31) अपेPा अिधक भार स े लदा Gआ होगा उसके चालक अथवा मािलक अथवा (cid:26)भारी kिD को ऐस े अिधक भार से लद े Gए वाहन को रा(cid:21)ीय राजमाग(cid:25) म 1 (cid:26)वेश करान े के िलए श(cid:6)ु क संBहण एज1सी को उD िनयमA के िनयम 10 के उपिनयम के 1ए के अनसु ार शु(cid:6)क का भुगतान करना होगा और उसे राजमाग(cid:25) ख9ड का उपयोग करन ेक(cid:31) तब तक अनमु ित नहt होगी जब तक (cid:4)क ऐस ेयािं (क वाहन स ेअिधक भार को हटा न (cid:4)दया जाए। 8. यांि(क वाहनA क(cid:31) rेणी, उनके िलए अनoु ेय भार, छूट-(cid:26)ाu वाहनA क(cid:31) rेणी, सfवस रोड, वैकि(cid:6)पक सड़क आ(cid:4)द सिहत सभी प#रभाषाए ंिनयमA म 1िविनRदS प#रभाषा_ के अनुसार हAगी। 9. उD िनयमA के िनयम 12 के अनसु ार, उपयोगकता_(cid:25) क(cid:31) जानकारी के िलए श(cid:6)ु क क(cid:31) दरA को (cid:26)दfशत (cid:4)कया जाएगा। 10. ऊपर सारणी-1 म1 यथा-उि(cid:6)लिखत, आधार वष (cid:25) 2007-08 के िलए (cid:26)ित (cid:4)कलोमीटर शु(cid:6)क क(cid:31) आधार दर के आधार पर, यांि(क वाहनA से िलए जाने वाले वाQतिवक शु(cid:6)क और कटौितयA क(cid:31) गणना (cid:26)ािधकरण /ारा खंडA क(cid:31) परू ी कर ली गई ल(cid:9)बाई के आधार पर क(cid:31) and Highways No. S.O. 1035 (E) dated 7th May, 2010 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.000 to km 94.700 (Gopalganj Chhapra Section) of National Highway No. 85 in the State of Bihar to the National Highways Authority of India (hereinafter referred to as the “Authority”); Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on the type of mechanical vehicles in column (1) at sixty percent of the rates specified in column (2) of the Table 1 for net road length of 73.155 km and for equivalent structure length (having more than 60 m length) of 2.000 km (having length of 0.200 km) and at ninety percent of the base rate for bypass having length of 20.903 km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of two lane with paved shoulders Chhapra Gopalganj section from design km 0.000 (existing chainage 0.000) to design km 94.258 (existing chainage 93.500) of National Highway number 85 in the State of Bihar and authorize the said Authority to The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 265/- (Rupees Two Hundred and Sixty-five only) for the year 2019-20 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle, provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said Rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper, in English and vernacular language. 11. The Capital cost of the project is Rs. 1029.75 crores. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
