And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement on 21.09.2015 (hereinafter referred to as “said agreement”) with M/s Jalpa Devi Tollways Limited having its registered office Plot No. 5, Inside Govind Narayan Singh Gate, Chuna Bhatti, Kolar Road, Bhopal-462016 (hereinafter referred to as the “Concessionaire”) for the bid submitted on 22.06.2015 for the development of Guna-Biaora Section from km 332.100 to km 426.100 (having design chainage km 97.700 to design chainage km 191.200) on National Highway No. 3 in the State of Madhya Pradesh (hereinafter referred to as the “said section”) to four lane standards as BOT (Toll) on Design, Build, Finance, Operate and Transfer (DBFOT) basis: Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R. 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 1756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014, G.S.R. 831(E) dated 21st November, 2014, G.S.R. 02(E) dated 19th December, 2014 & G.S.R. 220 (E) dated 23rd March, 2015 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of four6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] or more lanes of the said section at the rates specified in column (2) of Table 1 below for net road section length of 84.8896 km and structures (>60 m length) having length of 0.8104 km (equivalent length of 8.104 km) and at one and half times the base rate specified in column (2) of Table 1 below for the use of bypasses, costing Rupees ten crore or more, having total net length of 7.800 km on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement; The rate of monthly pass for local personal traffic is Rs. 245.00 (Rupees Two Hundred and Forty Five Only) for the year 2017-18 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journey on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty or more One month from date of payment fifty single journeys or more 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway for crossing the Toll plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicles under the rules. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the Rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
