को 8यान म0 रखत े Uए, यह राय दते ी ह ै (cid:4)क उE 3ीप संर4ण जोन अिधसूचना, 2011 का सशं ोधन करन े के िलए उE िनयम? के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन अिधसूचना क(cid:30) अपे4ा से अिभमिु E देना लोक िहत म0 ह ै। 4545 GI/2018 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, के(cid:15)(cid:16)ीय सरकार, पया(cid:23)वरण (सरं 4ण) िनयम, 1986 के िनयम 5 उपिनयम (3) के खंड (घ) के साथ पcठत पया(cid:23)वरण (संर4ण) अिधिनयम, 1986 (1986 का 29) क(cid:30) धारा 3 क(cid:30) उपधारा (1) और उपधारा (2) के खंड (v) 3ारा Gद: शिEय? का Gयोग करते Uए, 3ीप सरं 4ण अिधसूचना, 2011 का िन\िलिखत और संशोधन करती ह,ै अथा(cid:23)त ्:- उE अिधसूचना म0, पैरा III के मद घ म,0- (i) उपमद 1 म0, (i) आईसीआरजडे -I के खंड (क) म,0 उपखंड (v) के प1ात् िन\िलिखत अ(cid:15)तः(cid:11)थािपत (cid:4)कया जाएगा, अथा(cid:23)त ्:- "(vi) िमिडल (cid:11)dेट िसन अंदमान पर 2-लेन के पुल के संिनमाण(cid:23) क(cid:30) अनमु ित एक अपवाद के eप म 0 दी जाएगी, परंत ु सिं नमा(cid:23)ण G(cid:4)Hया के दौरान Gभािवत/काटे गए कOछ वन(cid:11)पित 4े(cid:29) के (cid:15)यनू तम तीन गुणा का कOछ वन(cid:11)पितयां, Gितकराhमक पौधा रोपण 4े(cid:29) म0 कहY अ(cid:15)य(cid:29) (cid:4)कया जाएगा ।"; (ii) उपखंड 4 के आईसीआरजेड-IV म,0 खंड (ग) के प1ात ्िन\िलिखत अ(cid:15)तः(cid:11)थािपत (cid:4)कया जाएगा, अथा(cid:23)त् :- "(घ) िमिडल (cid:11)dेट पर 2-लेन के पुल के सिं नमा(cid:23)ण क(cid:30) अनमु ित एक अपवाद के eप म0 दी जाएगी।"; (iii) उपमद 8 के (cid:11)थान पर, िन\िलिखत अ(cid:15)तः(cid:11)थािपत (cid:4)कया जाएगा, अथात(cid:23) ् :- "(8) इस अिधसूचना के अ(cid:15)तग(cid:23)त िजन पcरयोजना को (cid:11)वीकृित दी गई ह?, ऐसी (cid:11)वीकृत जारी करने क(cid:30) तारीख से सात वष (cid:23)क(cid:30) अविध के िलए िविधमा(cid:15)य होगी : परंतु सिं नमा(cid:23)ण (cid:4)Hया-कलाप, (cid:11)वीकृित जारी करने क(cid:30) तारीख से पाँच वष(cid:23) क(cid:30) अविध के भीतर आरNभ ह?गे और परू े (cid:4)कए जाएंगे और Gचालन? को ऐसी (cid:11)वीकृित जारी (cid:4)कए जाने क(cid:30) तारीख से GारNभ (cid:4)कया जाएगा : परंतु यह और (cid:4)क िविधमा(cid:15)यता को आवेदक 3ारा िविधमा(cid:15)य अविध के भीतर, राAय या संघ राAय4े(cid:29) तटीय जोन Gबंध Gािधकरण 3ारा (cid:11)वीकृित क(cid:30) िविधमा(cid:15)यता के िव(cid:11)तारण के िलए िसफाcरश के साथ सNबl Gािधकरण को आवेदन (cid:4)कए जाने क(cid:30) दशा म0 अिधकतम तीन वष(cid:23) क(cid:30) अविध के िलए िव(cid:11)ताcरत (cid:4)कया जा सकेगा । 8क. अनुmेय (cid:4)Hया-कलाप के िलए कायL:र (cid:11)वीकृित :-" (i) सभी (cid:4)Hया-कलाप, जो इस अिधसूचना के उपबंध? के अधीन अ(cid:15)यथा अनुmेय ह,ै (cid:4)क(cid:15)त ु िजनका संिनमा(cid:23)ण, (cid:11)वीकृित पूव (cid:23) GारNभ हो गया ह,ै को केवल ऐस े मामल? म0 िनयिमतीकरण के िलए िविनnदo(cid:23) समय के भीतर आवेदन (cid:4)कया गया ह ैऔर ऐसी पcरयोजनाI को, जो इस अिधसूचना के उपबंध का उ(cid:6)लंघनकारी ह,ै िनयिमत नहY (cid:4)कया जाएगा । (ii) सNबl तटीय जोन Gबंध Gािधकरण, ऐस े G(cid:11)ताव? के िनयिमतीकरण के िलए िविनnदo(cid:23) िसफाcरश 0 करेगा और यह Gमािणत करेगा (cid:4)क ऐसी िसफाcरश0 करत े समय 3ीप सरं 4ण जोन िविनयम? का उ(cid:6)लंघन नहY (cid:4)कया गया ह ै। (iii) ऐसे मामल? पर, िजसम0 अपिे 4त (cid:11)वीकृित के िबना संिनमा(cid:23)ण GारNभ (cid:4)कया गया ह,ै केवल पया(cid:23)वरण, वन और जलवायु पcरवत(cid:23)न मं(cid:29)ालय 3ारा िवचार (cid:4)कया जाएगा परंतु ऐसे िनयिमतीकरण के िलए अनरु ोध उE मं(cid:29)ालय को 31 िसतNबर, 2018 तक GाT हो जाता ह"ै । [फा. सं. 12-3/2008-आईए-III (भाग)] cरतेश कुमार pसंह, संयुE सिचव¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (cid:1)(cid:1)(cid:1)(cid:1)टटटट(cid:3)(cid:3)(cid:3)(cid:3)पपपपणणणण :::: मूल अिधसूचना भारत के राजप(cid:29), असाधारण, भाग II, खंड 3, उप-खंड (ii) म 0 स.ं का.आ. 20(अ), तारीख 6 जनवरी, 2011 3ारा Gकािशत क(cid:30) गई थी और िन\ानुसार प1ाhवतq संशोधन (cid:4)कए गए : 1. का.आ. 2558(अ), तारीख 22 अग(cid:11)त, 2013 ; 2. का.आ. 1213(अ), तारीख 22 माच(cid:23), 2016 ; और 3. का.आ. 2445(अ), तारीख 31 जुलाई, 2017 । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd August, 2018 S.O. 3840(E).—WHEREAS by notification of the Government of India in the Ministry of Environment and Forests number S.O.20 (E), dated the 6th January, 2011 (hereinafter referred to as the Island Protection Zone Notification, 2011), the Central Government declared certain coastal stretches of the Middle Andaman, North Andaman, South Andaman and Greater Nicobar and entire area of the other islands of Andaman and Nicobar and the Lakshadweep and their water area upto territorial water limit as the Islands Protection Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes in the said Zone; AND WHEREAS, the Central Government havereceived representations regarding extension of validity of clearance issued under notification, consideration forinclusion of enabling provision of post facto clearance and a proposal for allowing bridges in the Island Coastal Regulation Zone areainvolving mangroves under the said notification; AND WHEREAS, the National Coastal Zone Management Authority in its 32nd meeting held on 1st November, 2017 had also decided to consider this; AND WHEREAS, the Central Government taking into account the above, proposes to make the following amendments to the Islands Protection Zone Notification, 2011; AND WHEREAS, the Central Government, having regard to the provisions of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the said Islands Protection Zone Notification, 2011. NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Islands Protection Zone Notification, 2011, namely:- In the said notification, in paragraph III, in item D, - (i) in sub-item 1.(i) ICRZ-I, in clause (a), after sub-clause (v), the following shall be inserted, namely:- “(vi) construction of 2-Lane Bridge over Middle Strait sin Andaman shall be permitted as an exception, provided that a minimum of three times the mangrove area affected/ cut during the construction process shall be taken up for compensatory plantation of mangroveselsewhere in the region.”; (ii) in sub-item 4.In ICRZ-IV areas, after clause (c), the following shall be inserted, namely:- “(d)construction of 2-Lane Bridge over Middle Strait shall be permitted as an exception.”;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) for sub-item 8, the following shall be substituted, namely:- “(8) The clearance accorded to the projects under this notification shall be valid for aperiod of seven years from the date of issue of such clearance: Provided that the construction activities shall commence within a period of five years from the date of the issue of clearance and the construction shall be completed and the operations be commenced within seven years from the date of issue of such clearance: Provided further that the period of validity may be extended for a maximum period of three years in case an application ismade to the concerned authority by the applicant within the validity period, along with recommendation for extension of validity of the clearance by the concerned State or Union Territory Coastal Zone Management Authority. 8A. Post facto clearance for permissible activities. - (i) All activities, which are otherwise permissible under the provisions of this notification, but have commenced construction without prior clearance, may be considered for regularisation only in such cases wherein the project applied for regularisation within the specified time and the projects which are in violation of the provisions of this notification may not be regularised. (ii) The concerned Coastal Zone Management Authority shall give specific recommendations regarding regularisation of such proposals and shall certify that there have been no violations of the Islands Protection Zone regulations, while making such recommendations. (iii) Cases where the construction have commenced without the requisite clearance, shall be considered only by Ministry of Environment, Forest and Climate Change,providedthat the request for such regularisation is received in the said Ministry by the 31st September, 2018”.
