50% होगा बशतg के ऐस े वािणि1यक वाहनC के उपयोग के िलए कोई स>वस(cid:25) रोड अथवा वकै ि(cid:6)पक सड़क उपल_ध न हो । 6. जो यांि’क वाहन अपनी fणे ी के िलए िनधा(cid:25)"रत अनhु ये भार क(cid:31) अपेPा अिधक भार स े लदा Kआ होगा उसके चालक अथवा मािलक अथवा (cid:26)भारी aिJ को ऐस े अिधक भार से लद े Kए वाहन को रा(cid:21)ीय राजमाग(cid:25) म 2 (cid:26)वेश करान े के िलए श(cid:6)ु क संHहण एजस2 ी को ऐसी fणे ी के यांि’क वाहनC के िलए उJ िनयमC के िनयम 10 (1A) के अनसु ार लाग ू शु(cid:6)क का भुगतान करना होगा और उसे राजमाग(cid:25) ख9ड का उपयोग करने क(cid:31) तब तक अनमु ित नहi होगी जब तक (cid:4)क ऐसे यांि’क वाहन स े अिधक भार को हटा नहi (cid:4)दया जाए। 7. यांि’क वाहनC क(cid:31) fेणी, उनके िलए अनुhेय भार, छूट-(cid:26)ाj वाहनC क(cid:31) fणे ी, स>व(cid:25)स रोड, वैकि(cid:6)पक सड़क आ(cid:4)द सिहत सभी प"रभाषाए ंिनयमC म 2िविनSदT(cid:25) प"रभाषा^ के अनुसार हCगी । 8. उJ िनयमC के िनयम 11112222 के अनुसार, उपयोगकता^(cid:25) क(cid:31) जानकारी के िलए श(cid:6)ु क क(cid:31) दरC को (cid:26)द>शत(cid:25) (cid:4)कया जाएगा। 9. ऊपर सारणी-1 म 2यथा-उि(cid:6)लिखत, आधार वष(cid:25) 2007-08 के िलए (cid:26)ित (cid:4)कलो मीटर शु(cid:6)क क(cid:31) आधार दर के आधारपर, यांि’क वाहनC से िलए जाने वाले वा+तिवक शु(cid:6)क और कटौितयC क(cid:31) गणना (cid:26)ािधकरण 0ारा खंडC क(cid:31) परू ी कर ली गई ल(cid:10)बाई के आधार पर क(cid:31) जायेगी और उसम2 उJ िनयमC के िनयम 5 के अनुसार वा>षक(cid:25) तौर पर सशं ोधन (cid:4)कया जाएगा तथा उस,े तदनसु ार, अंHेजी और +थानीय भाषा के कम-से-कम एक-एक समाचार प’ म2 (cid:26)कािशत (cid:4)कया जाएगा। 10. प"रयोजना क(cid:31) अनुमािनत पूंजीगत लागत 158.65 करोड़ cपए ह।ै पूंजी लागत म2 प"रवतन(cid:25) हो सकता ह ै 5य C(cid:4)क भिूम अज(cid:25)न, जन-उपयोिगता सेवा^ का +थ ान बदलने, पेड़C क(cid:31) कटाई आ(cid:4)द जसै े (cid:4)mयाकलाप अभी परू े (cid:4)कए जाने शषे ह L । अिं तम पूंजीगत लागत को अलग से अिधसिू चत (cid:4)कया 6112(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2573(E) dated 11th August 2017, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 154.000 to km 187.000 (Mangalwarpet to Mallampalli Section) of National Highway No. 365 (New) in the State of Telangana to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008, and amended vide GSR 950 (E) Dt. 03.12.2010, GSR 15 (E) Dt. 12.01.2011, GSR 756(E) Dt. 12.10.2011, GSR 778(E) Dt. 16.12.2013, GSR 26(E) Dt. 16.01.2014, GSR 831(E) Dt. 21.11.2014, GSR 02(E) Dt. 29.12.2014, GSR 220(E) Dt. 23.03.2015, GSR 585(E) Dt. 08.06.2016, G.S.R 1114(E) dated 02nd December, 2016, G.S.R. 248(E) dated 14th March,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2017, G.S.R. 427(E) dated 7th May, 2018 and G.S.R. 920(E) dated 25th September, 2018 and its subsequent amendments from time to time for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at 60% of the base rate specified in column (2) in Table 1 below (hereinafter referred to as “base rate”) for net road section length of 32.910 km and for total equivalent length of structure (having more than 60 m length) of 0.900 km (having total length of 0.090 km) on the Type of Vehicles specified in column (1) of Table 1 below for the use Two Lane with paved shoulders Mangalwarpet to Mallampalli Section from km 154.000 to km 187.000 of National Highway number 365 (New) in the State of Telangana and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- TABLE 1 Type of (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving 3.45 Equipment (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The fee levied and collected hereunder shall be due and payable at the following Fee Plaza for net road length specified for such Fee Plaza: Location of Fee Plaza (chainage) Length (in km) for which Fee Rate at which fee is payable is payable At km 169.180 near Muthojipet Village 32.910 60% of the base rates in Warangal District (Excluding length of structure mentioned in Table-1 above > 60m) 2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 255.00 (Rupees Two Hundred Fifty Five only) for the year 2018-19 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one Two Twenty four hours from the way journey time of payment Two-third of amount of the fee Fifty One month from date of payable for fifty single journeys payment 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, as per Rule 10(1A) of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 10. The estimated capital cost of the project is Rupees 158.65 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
