L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअI.D-E2x7x1x 12020-223365 CG-DL-E-27112020-223365 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3743] नई ददल्ली, बहृ स्ट्प जतवार, नवम्ब र 26, 2020/अग्रहायण 5, 1942 No. 3743] NEW DELHI, THURSDAY, NOVEMBER 26, 2020/AGRAHAYANA 5, 1942 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 26 नवम् बर, 2020 का.आ. 4248(अ).—भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और राजमाग ग मत्रं ालय में अजधसूचना संख्या का. आ. 2219 (अ), ददनांदकत 14 जुलाई, 2017 राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत जारी, केंद्र सरकार ने आंध्र प्रदिे राज्य में रा्‍र ीय राजमागग सं. 42 (कनागंक्आंध्रप्रदेि सीमा से अनंतपुरामु तक) के खंड को आंध्र प्रदेि राज्य सरकार को सुपुद गकर ददया ह । अत: अब, रा्‍र ीय राजमागग फीस (दरों का जनधागरण और संग्रहण) जनयम, 2008 के जनयम 3 के साथ परित (जो इसके आग े ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)। राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रद्‍ त िज‍त यों का प्रयोग करते एए, केन्‍द द्रीय सरकार, एतदद्वारा आध्रं प्रदेि राज्य में रा्‍र ीय राजमागग सं. 42 के अनंतपरु ामु स े मुदीगब् बा खड़ं के जडजाइन दकमी 76.0 स े दकमी 99.971 (चार लेन) और 99.971 से दकमी 133.471 (पेव्ड िोल्ड र सजहत 2 लेन) के उपयोग के जलए नीचे दी गई ताजलका 1 के कॉलम (1) म ें जवजनर्दद्‍ ं वाहनों के प्रकार पर 23.971 दकमी लंबाई की जनवल सड़क खडं के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्दद्‍ ं दर पर और 33.156 दकमी लंबाई की जनवल सड़क खंड और 3.44 दकमी (0.344 दकमी लंबाई वाली) की समतुल् य संरचना लंबाई (60 मी से अजधक लंबाई वाले) के जलए ताजलका 1 के कॉलम (2) में जवजनर्दद्‍ ं आधार दर के 60 प्रजतित पर यांजत्रक वाहनों स े फीस उदगृहीत करती ह । तथा भारतीय रा्‍र ीय राजमाग ग प्राजधकरण (एनएचएआई) को उसके अजधकाररयों अथवा दकसी िेकेदार के माध् यम स े उ‍त फीस के संग्रहण के जलए प्राजधकृत करती ह,। अथागत्:— 5777 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस दर (रु. म)ें (1) (2) कार, जीप, व।न या हल् के मोंर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धुरी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्ट् कर (ईएमई) या बए धुरीय 3.45 वाहन (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उदगृहीत और संगृहीत की जाने वाली फीस ऐसे पथकर प् लाजां के जलए जवजनर्दद्‍ ं जनवल सड़क लंबाई हते ु जनम्न जलजखत पथकर प्ल ाजां में दये और संदेय होगी:— ताजलका-2 पथकर प् लाजा (चन। जे ) की अवजस्ट्थ जत लंबाई (दकमी म)ें जजसके जलए फीस सदं ये दर, जजस पर फीस सदं ये ह । ह। आंध्र प्रदिे राज्य के अनंतपुरामु जजले में 23.971 दकमी ऊपर ताजलका-1 में उजल् लजखत आधार दरों का बथलापल् ली गांव के जनकं रारा-42 चार या अजधक लेन के जलए 100% का दकमी 104.405 33.156 दकमी ऊपर ताजलका-1 में उजल् लजखत आधार दरों का पेव् ड िोल् डरों सजहत दो लेन के जलए 60% 2. उपयुग‍ त के अजतरर‍त , जनम्न जलजखत फीस प् लाजा (प्ल ाजां) पर 60 मींर स े अजधक लंबाई वाली जनम्न जलजखत अवसंरचनां के उपयोग के जलए 10 के समतल्ु य गणु क द्वारा ऐसी अवसंरचनां की लंबाई को गुणा करके राजमाग ग की समतुल् य लंबाई म ेंअवसंरचनां की लंबाई को पररवर्ततत करके जनम्न जलजखत फीस भी दये और संदेय होगी:— ताजलका 3 िल्ु क प् लाजा का अवस्ट्थ ान(चन। जे ) सड़क की समकक्ष लबं ाई म ें सड़क की दर, जजस पर िल्ु क सदं ये ह । पररवर्ततत दकए जान ेहते ुसंरचनां समकक्ष की लंबाई (दकमी म)ें लंबाई (दकमी म)ें आंध्र प्रदिे राज्य के अनंतपुरामु जजले में ऊपर ताजलका-1 में उजल् लजखत आधार बथलापल् ली गांव के जनकं रारा-42 का 0.344 दकमी 3.44 दकमी दरों का पेव् ड िोल् डरों सजहत दो लेन दकमी 104.405 के जलए 60% ^ब् यौरा जनम्न ानुसार ह:।— क्र.सं. च।नेज संरचना का प्रकार लंबाई यहां से (दकमी) यहां तक (दकमी) (दकमी) 1 113.228 113.672 प्रमुख पुल (2एल+पीएस) 0.344 दकमी कुल 0.344 दकमी 3. गर। -वाजणजज्य क प्रयोजनों के जलए पंजीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प् लाजा स े बीस दकमी की दरू ी के भीतर जनवास करने वाल े व् यज‍त के जलए माजसक पास की दर वर् ग 2020-21 के जलए 275.00 रु. (दो सौ पचहत्तर रुपए मात्र) ह । और उ‍त जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध् यधीन ह ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 4. राजमागग खडं पर बएल यात्रां के जलए जनम्न जलजखत दरों पर पास जारी दकए जाएंग,े अथागत—् ताजलका 4 सदं ये राजि अनज्ञु ात एकतरफा यात्रां की अजधकतम व।धता अवजध सख्ं य ा एकतरफा यात्रा के जलए िुल् क का डेढ़ दो भुगतान के समय से चौबीस घंंे गुना पचास एकल यात्रां के जलए संदये पचास या अजधक भुगतान की तारीख से एक मास िुल् क की राजि का दो-जतहाई 5. फीस प्ल ाजा जस्ट् थत होन े वाले जजले म ें पंजीकृत वाजणजज्य क वाहनों (रा्‍र ीय परजमं के अधीन प्रचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत दर की 50% होगी, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्तवस रोड या व।कजल् पक सड़क उपलब्ध न हों 6. संबंजधत श्रणे ी के वाहनों के जलए जवजनर्दद्‍ ं अनुज्ञेय भार स े अजधक भार लद े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय राजमागग पर अजतभार लद े वाहन के प्रवेि के जलए ंोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, उ‍त जनयमों के जनयम 10 के उप-जनयम 1ए म ें जवजनर्दद्‍ ं फीस के समतुल् य फीस का भुगतान करने के जलए उ्‍ तरदायी होगा और वह राजमागग खंड का प्रयोग करने के जलए तब तक हकदार नहीं होगा जब तक ऐस े यांजत्रक वाहन स े लदा अजतभार हंाया नहीं जाता 7. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूं प्राप् त वाहनों की श्रणे ी, सर्तवस रोड, व।कजल् पक सड़क इ्‍ यादद उ‍त जनयमों म ेंजवजनर्दद्‍ ं पररभार्ां के अनुरूप होंगी 8. फीस की दरें उक्त जनयमों के जनयम 12 के अनुसरण म ें प्रयो‍त ां के सूचनाथग प्रदर्तित करनी होंगी 9. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुग‍ त ताजलका-1 म ें यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूंों की गणना भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा खडं की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनुसार उसे अंग्रजे ी और क्षेत्रीय भार्ा के कम स ेकम एक-एक समाचार पत्र म ें प्रकाजित दकया जाएगा 10. पररयोजना की अनुमाजनत पूंजीगत लागत 260.60 करोड़ रू. ह । [भूजम अजधग्रहण, सावगजजनक जन सुजवधां के स्ट् थानांतरण, पेड़ों को कांन े आदद कायगकलापों को अभी परू ा दकया जाना ह । इसजलए, पूंजीगत लागत पररवतगन के अध् यधीन ह । और अंजतम पूंजीगत लागत को पथृ क रूप से अजधसूजचत दकया जाएगा] भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा प्रयो‍त ां स े वसूल दकए गए िुल्क के जररए पूंजीगत लागत की वसूली हो जाने के पश् चात,् लगाए जाने वाल े िुल् क की दरों को घंाकर 40% कर ददया जाएगा और उ‍त जनयमों के अनुसार इसम ेंवार्तर्क तौर पर संिोधन दकया जाएगा [फा. सं. आरडब् ल् य्ू एनएच-12014्113्2016-एपी्जोन-III (पांग)] जप्रयांक भारती, संयु‍ त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th November, 2020 S.O. 4248(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways S.O. 2219 (E) dated 14th July, 2017 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the National Highway Number 42 ( from Karnataka/Andhra Pradesh border to Ananthapuramu ) as situated within the State of Andhra Pradesh to the State Government of Andhra Pradesh; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 23.971 km and at sixty percent of the rates4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] specified in column (2) of the Table 1 for net road section length of 33.156 km and for equivalent structure length (having length more than 60m) of 3.44 km (having length of 0.344 km) on the type of vehicles specified in column (1) of the Table 1 below of Ananthapuramu to Mudigubba section from design Km. 76.0 to Km 99.971 ( Four Lane) and Km 99.971 to Km 133.471 (2 Lane with Paved Shoulders) of National Highway No. 42, in the State of Andhra Pradesh and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:— Table 1 Base rate of fee per km for the base Type of vehicle year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3.45 or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs.275/- (Rupees Two Hundred and Seventy Five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:— Table 4 Maximum number of one way Amount Payable Period of validity journeys allowed One and half times of the fee for one way Twenty four hours from the time Two journey of payment Two-third of amount of the fee payable for Fifty or more One month from date of payment fifty single journeys. 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 260.60 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
