L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअI.D-E1x3x0x 82020-221117 CG-DL-E-13082020-221117 असाधारण EXTRAORDINARY भाग II—खण्ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2412] नई ददल्ली, मगं लवार, अगस्ट्त 11, 2020/श्रावण 20, 1942 No. 2412] NEW DELHI, TUESDAY, AUGUST 11, 2020/SRAVANA 20, 1942 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 10 अगस्ट् त, 2020 का.आ. 2718(अ).—जबदक, भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और राजमागग मंत्रालय म ें अजधसूचना संख्या का.आ. 415(अ), ददनांक 9 फरवरी, 2016, राष्ट्रीय राजमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत जारी, केंद्र सरकार न े तले गं ाना राज्य म ें राष्‍टर ीय राजमाग ग स.ं 163 के हदै राबाद स े प्रारंभ होकर घाटकेिर, यादजगरी, जनगांव, वारंगल, मुलुग,ू इतुरनगरम को जोड़ने वाले (दकमी 18.600 स े दकमी 150.000 हदै राबाद-यादजगरी- वारंगल खंड को छोड़कर) तक खंड को तले गं ाना राज्य सरकार को सुपुद ग कर ददया ह।ै अत: अब, राष्‍टर ीय राजमागग िल्ु क (दरों का जनधागरण और सग्रं हण) जनयम, 2008 के जनयम 3 के साथ परित (जो इसके आगे ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)ै राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत् त िज‍त यों का प्रयोग करत े हुए, केन्‍द द्रीय सरकार, एतद्द्द्वारा तले ंगाना राज्य म ें राष्‍टर ीय राजमागग स.ं 163 के हदै राबाद – भोपालपट्टनम खडं के जडजाइन दकमी 159.00 स े दकमी 165.403 और दकमी 186.00 स े दकमी 214.287 के पेव्ड िोल्डर सजहत दो लेन के उपयोग के जलए 17.303 दकमी लंबाई की जनवल सड़क खंड हते ु ताजलका 1 के कॉलम (2) म ें जवजनर्ददष्‍ट ट दर के साि प्रजतित दर पर और चार लेन अथवा अजधक के खडं के उपयोग के जलए 17.387 दकमी लंबाई की जनवल सड़क खंड हते ु ताजलका 1 के कॉलम (2) म ें जवजनर्ददष्‍ट ट दर के 100 प्रजतित दर पर यांजत्रक वाहनों स े फीस उदगृहीत करती ह ैतथा भारतीय राष्‍टर ीय राजमाग ग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेदार के माध् यम स े उ‍त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत:्- 3674 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-I वाहन का प्रकार आधार वर् गके जलए प्रजत 08-2007 (म ें.रु) दकमी आधार फीस दर (1) (2) कार, जीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धरु ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्ट् कर (ईएमई) या बहु धुरीय 3.45 वाहन (एमएवी) (चार स ेछ: धरु ी) जविाल आकार के वाहन (धरु ी सात या अजधक) 4.20 1. इसके अतं गगत उदगृहीत और सगं ृहीत फीस ऐस े पथकर प् लाजां के अंतगगत जवजनर्ददष्‍ट ट दरू ी हते ु जनम्न जलजखत पथकर प् लाजां म ेंदये और संदेय होगी:- ताजलका-2 पथकर प्ल ाजा की अवजस्ट्थ जत (दकमी 199.052) लबं ाई (दकमी) जजसके जलए दर, जजस पर फीस सदं ये ह ै। फीस सदं ये ह ै तेलगं ाना राज्य के मलु ुग,ू वेकतपुर, मंडल जजलों म ें ऊपर ताजलका-1 म ें उजल्ल जखत 17.303 जवाहरनगर गांव के जनकट रारा-163 के दकमी आधार दरों का 60% 199.052 पर ऊ प र त ा ज ल क ा - 1 म ें उ ज ल् ल ज ख त 17.387 आधार दरों का 100% 2. गैर-वाजणजज्य क प्रयोजनों के जलए पंजीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ाजा स े बीस दकमी की दरू ी के भीतर जनवास करने वाले व् यज‍त के जलए माजसक पास की दर वर्ग 2020-21 के जलए 275.00 रु. (दो सौ पछत्तर रुपए मात्र) ह ै और कजथत जनयमों के प्रावधानों के अनुसार प्रजतवर् ग संिोधन के अध् यधीन ह।ै 3. राजमागग खंड पर बहुल यात्रां के जलए जनम्न जलजखत दरों पर पास जारी दकए जाएंग,े अथागत ् ताजलका-3 सदं ये राजि अनज्ञु ात एकतरफा यात्रां की मान्‍दय ता अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए िुल् क का डेढ़ दो भुगतान के समय स े चौबीस घंटे गुना पचास एकल यात्रां के जलए संदेय पचास भुगतान की तारीख स े एक मास िुल् क की राजि का दो-जतहाई 4. फीस प् लाजा जस्ट्थ त होन े वाल े जजल े म ें पंजीकृत वाजणजज्य क वाहनों (राष्‍टर ीय परजमट के अधीन पररचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रणे ी के वाहन हते ु जनधागररत दर की 50% होगी, बिते दक ऐस े वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्ववस रोड या वैकजल् पक सड़क उपलब् ध न हों । 5. संबंजधत श्रेणी के वाहनों के जलए जवजनर्ददष्‍ट ट अनुज्ञेय भार स े अजधक भार लदे यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय राजमागग पर अजतभार लद े वाहन के प्रवेि के जलए टोल सग्रं हण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार जवजनर्ददष्‍ट ट फीस के समतुल् य फीस का भगु तान करने के जलए उत् तरदायी होगा और वह राजमाग ग खंड का प्रयोग करन े के जलए तब तक हकदार नहीं होगा जब तक ऐस े यांजत्रक वाहन स े लदा अजतभार हटाया नहीं जाता ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 6. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनज्ञु ेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्ववस रोड, वैकजल् पक सड़क इत् यादद पूवो‍त जनयमों म ें जवजनर्ददष्‍ट ट पररभार्ां के अनुरूप होंगी । 7. फीस की दरें उक्त जनयमों के जनयम 12 के अनुसरण म ेंप्रयो‍त ां के सूचनाथग प्रदर्वित करनी होंगी । 8. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुग‍ त ताजलका-1 म ें यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनुसार उसे अग्रं ेजी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया जाएगा । 9. पररयोजना की अनुमाजनत पजूं ीगत लागत 230.03 करोड़ रू. ह ै । [चूंदक भूजम अजधग्रहण, सावगजजनक जन सुजवधां के स्ट् थानांतरण, पेड़ों को काटने आदद कायगकलापों को अभी परू ा दकया जाना ह ै इसजलए पूंजीगत लागत पररवतगन के अध् यधीन ह ै और अंजतम पूंजीगत लागत को पथृ क रूप स े अजधसूजचत दकया जाएगा।] भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा प्रयोगकतांग स े वसूल दकए गए िल्ु क के जररए पूंजीगत लागत की वसलू ी हो जान े के पश् चात,् लगाए जान े वाले िल्ु क की दरों को घटाकर 40% कर ददया जाएगा और उ‍त जनयमों के अनुसार इसम ें वार्वर्क तौर पर संिोधन दकया जाएगा। [फा. सं. आरडब् ल् य/ू एचवाईडी/जेबी-41/एनएच(ओ)/कोर] जप्रयांक भारती, संयु‍ त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 10th August, 2020 S.O. 2718(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways, Number S.O. 415 (E), dated 9th February 2016 issued under section 5 of the National Highways Act 1956, (48 of 1956), the Central Government has entrusted the National Highway Number 163 starting from Hyderabad, connecting Ghatkesar, Yadadri, Jangaon, Warangal, Mulugu, Eturnagram excluding (km 18.600 to km 150.000 Hyderabad-Yadgiri-Warangal Section) in the State of Telangana to the State Government of Telangana; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on mechanical vehicles at 60% of the rate specified in column (2) of the Table 1 for net road section length of 17.303 km for use of two lane with paved shoulder and at 100% of the rate specified in column (2) of the Table 1 for net road section length of 17.387 km for use of four lane or more of Hyderabad - Bhopalapatnam Section from design kilometer 159.00 to kilometer 165.403 and kilometer 186.00 to kilometer 214.287 of National Highway number 163 in the State of Telangana and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table-1 Type of Vehicle Base rate of fee per km for the base year 2007-08 ( in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or 1.05 Mini Bus Bus or Truck ( Two Axles) 2.20 Three-axle commercial vehicles 2.404 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Heavy Construction Machinery (HCM) or Earth 3.45 Moving Equipment (EME) or Multi axle Vehicle (MAV) ( four to six axles) Oversized Vehicles ( seven or more axles) 4.20 1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s) namely:- Table-2 Location of Fee Plaza (Km Rate at which fee is payable Length (in km) for which Fee is 199.052) payable At Km 199.052 of NH-163 60% of base rates mentioned in near Jawaharnagar village in 17.303 Table-1 above Mulugu, Vekantpur Mandal District of Telangana State 100% of base rates mentioned in Table-1 above 17.387 2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 275/- (Rupees Two hundred and seventy five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 3. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table-3 Amount Payable Maximum number of one way Period of validity journeys allowed One and one-half times of the fee for Two Twenty four hours from the time one way journey of payment Two-third of amount of the fee Fifty One month from date of payable for fifty single journeys payment 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 5. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 7. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 8. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 9. The estimated capital cost of the project is Rupees 230.03 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
