NOTIFICATION
New Delhi, the 3rd February, 2016
S.O. 353(E).—Whereas by notification of the Government of India in the Ministry of Road Transport
and Highways number S.O.78 (E), dated 04.02.1999 issued under section 11 of the National Highways
Authority of India, Act 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer
93.000 to kilometer 479.000 of Haryana/Uttar Pradesh Border to Kanpur section of National Highway No. 2
in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the
“Authority”);
And whereas in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48
of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008
& its amendments, the Central Government by notification of Government of India authorized Authority for
levying and collecting fees on mechanical vehicles for use of the stretches as follows:

And whereas, pursuant to the provision of section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority entered into an agreement with M/s Agra Etawah Tollways Ltd. (the
Concessionaire) on 19.01.2012 and in exercise of the powers conferred by section 8A of the National
Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates
and Collection) Rules, 2008 as amended and in supersession of the notification number S.O. No. 894(E) dated
31.03.2009 and S.O. No. 2753(E) dated 21.11.2012 except as respect things done or omitted to be done before
such supersession, the Central Government, vide notification no. S.O. 434(E) dated 22.02.2013, authorized the
Concessionaire for development of Agra-Etawah Bypass section from km 199.660 to km 323.525 on National
Highway No. 2 in the state of Uttar Pradesh on Design, Build, Finance, Operate & Transfer (DBFOT) basis;
And whereas, the Commercial Operation Date was not declared and 6-laning BOT Concession
Agreement has been terminated on 20.05.2014 by the Authority and therefore, the notification no. S.O. 434(E)
dated 22.02.2013 was not implemented;
And whereas, pursuant to the provision of section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority has entered into an agreement on 01.09.2015 (hereinafter referred to as
“said agreement”) with M/s AE Tollway Private Limited having its registered office at IRB Complex,
Chandivali Farm, Chandivali Village, Andheri (East), Mumbai-400 072 (hereinafter referred to as the
“Concessionaire”), the successful bidder for bid submitted on 20.05.2015 for the development of Six laning of
Agra – Etawah Bypass section from Km 199.660 to Km 323.525 on National Highway No. 2 (hereinafter
referred to as the “said section”) in the State of Uttar Pradesh on Design, Build, finance, Operate and Transfer
(DBFOT) basis;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act,
1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection)
Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated
3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R
778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014, G.S.R. 831(E) dated
21st November, 2014, G.S.R. 02(E) dated 29th December, 2014 & G.S.R. 220 (E) dated 23rd March, 2015
(hereinafter referred to as the “said Rules”), and in supersession of the notification bearing No. S.O. 2753 (E)6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
dated 21.11.2012, S.O. 336 (E) dated 07.02.2013 and S.O. 431 (E) dated 22.02.2013 except as respects things
done or omitted to be done before such supersession, the Central Government, having regard to the
expenditure involved in building, maintenance, management and operation of the said section, interest on the
capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between
the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on
mechanical vehicles for the use of the said section at the rate specified below and authorizes the said
Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of
this notification in the Official Gazette, whichever is later, till the termination date as specified in the
agreement.

4. No user fee shall be levied for the delayed period between the Scheduled date of completion (910th day
from the Appointed Date of the 6-lanning project) and the date of actual completion of the project, if it is
delayed. For the purposes of this rule, any provisional completion of the project shall not be treated as
completion of the project.
5. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial
purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 230.00 (Rupees Two
Hundred & Thirty only) for the year 2015-16 and is subject to revision every year as per the provisions of
the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
6. For multiple journeys on the highway section, passes shall be issued at the following rates, namely.

7. Fee for commercial vehicle (excluding vehicles plying under National Permit) registered in the district
where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no
service road or alternative road is available for use of such commercial vehicles.
8. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the
said Rules, shall not be permitted to use the National Highway for crossing the Toll plaza until the
excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge
of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on
the National Highway to the Toll collecting agency, equal to ten times of the fee applicable to such

9. All definitions including category of mechanical vehicles, its permissible load, category of exempted
vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
10. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said
Rules.
11. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual
amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority. The same shall be got published by the Authority in at least one newspaper, each in English
and vernacular language through the Concessionaire and thereafter revised annually in accordance with
the rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided,
however, that such revision shall not be effected until a period of 6 (six) months has elapsed from COD.
