फरवरी, 2020 का.अ. 532(ऄ).—यतः केन्द्रीय सरकार न,े राष्ट्रीय राजमाग ग ऄजधजनयम, 1956 (1956 का 48) की धारा 5 के ऄधीन भारत सरकार के सड़क पररवहन एवं राजमागग मंत्रालय द्वारा जारी ऄजधसूचना सं. का.अ. 2004(ऄ), तारीख 30 ऄगस्ट्त 2012 के द्वारा ईत्तर प्रदेि म ें पीलीभीत म ें राजमाग ग संख्या-30 से प्रारम्भ होने वाल ेतथा पूरनपुर, खुटार, गोला गोकरन नाथ, लखीमपुर, आज्जतनगर, नानपारा (रा.रा.-927 पर) बहराइच (रा.रा.-927 पर), बलरामपुर, महाराजगंज को जोड़त े हुए रा.रा.-727 पर पड़रौना म ें समाप्त होन े वाल े माग ग को नया राष्ट्रीय राजमागग संख्या 730 घोजित करत े हुए ईत्तर प्रदेि राज्य सरकार को सौंपा ह।ै ऄतः ऄब, राष्ट्रीय राजमागग िुल्क (दरों का ऄवधारण एवं सग्रं हण) जनयम, 2008 (जजसे आसमें आसके पश्चात ’’जनयम’’ कहा गया ह)ै के जनयम 3 के साथ परित राष्ट्रीय राजमागग ऄजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केन्द्रीय सरकार, पेव्ड िोल्डर यिु दो लेन के 44.132 दक.मी. की जनवल लम्बाइ वाले सड़क खंड के ईपयोग करने के जलए ताजलका-1 के कॉलम 2 में जवजनर्ददष्ट अधार दर का 60 प्रजतित की दर पर ईत्तर प्रदेि राज्य में राष्ट्रीय राजमागग 730 के दक.मी. 38.00 से 82.00 (पूरनपुर-खुटार सेक्िन) तक के खण्ड का ईपयोग करन े के जलए नीच े ताजलका-1 के कॉलम-1 में जवजनर्ददष्ट वाहनों के प्रकार पर भारतीय राष्ट्रीय राजमागग प्राजधकरण को ऄपन े ऄजधकाररयों के माध्यम स े ऄथवा संजवदाकार के माध्यम से ईि िुल्क को संग्रहीत करन े के जलए प्राजधकृत करती ह,ै ऄथागत ् :- 688 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी-1 अधार विग 2007-08 के जलए िल्ु क वाहन का प्रकार की प्रजत दक.मी. अधार दर (रु. में) (1) (2) कार, जीप वैन या हल्के मोटर वाहन 0.65 हल्के वाजणजज्यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धरु ी वाल े वाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या ऄथ गमूववग ईपस्ट्कण (इएमइ) या 3.45 बहु धुरीय वाहन (एमएवी) (4 से 6 धुरी) जविाल अकार के वाहन (7 या ऄजधक धरु ी वाल)े 4.20 1. नीच े ईद्ग्रहीत एवं संग्रहीत िल्ु क, जनम्नजलजखत िल्ु क प्लाजा पर, जवजनर्ददष्ट सड़क की जनवल लम्बाइ हते ु िोध्य और संदेय होगा, ऄथागत ् : सारणी-2 लंबाइ (दक.मी.) जजसके जलए िल्ु क दर, जजस पर, िुल्क संदेय िुल्क प्लाजा का ऄवस्ट्थान (चैनजे ) संदेय ह।ै ह।ै िाहजहॉपुर जजल ेमें जहटौटा गावं के जनकट ईि ताजलका-1 में जडजाआन चैनेज 69.700 (मौजूदा चैनेज 44.132 ईजल्लजखत अधार दर का दक.मी. 69.640) 60 प्रजतित 2. जजस व्यजि का ऄपना यांजत्रक वाहन, गैर-वाजणजज्यक प्रयोजनों के जलए पंजीकृत हुअ हो और वह टोल प्लाजा से बीस दक.मी. तक की दरू ी म ें ही रहता हो, ईसके जलए विग 2019-20 के जलए माजसक पास की दर 265.00 रुपये (दो सौ पैंसि रु. मात्र) होगी और यह जनयमावली के ऄनसु ार प्रत्येक विग संिोधन दकया जाएगा। 3. राजमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत दरों पर जारी दकया जाएगा, ऄथागत ् : सारणी-3 संदेय राजि ऄनुमत एक तरफा यात्राओं की मान्द्यता की ऄवजध ऄजधकतम संख्या एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना दो संदाय के समय से चौबीस घंटे पचास एकल यात्राओं के जलए संदेय िुल्क की पचास संदाय की तारीख से एक मास राजि का दो जतहाइ[भाग II खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 4. जजस जजले में िल्ु क प्लाजा पड़ता ह ै ईस जजले म ें पंजीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के ऄधीन चल रह े वाहनों को छोड़कर) के जलए िल्ु क ईस श्रेणी के वाहन के जलए जवजनर्ददष्ट िल्ु क का 50 प्रजतित होगा, बित े दक ऐसे वाजणजज्यक वाहनों के ईपयोग के जलए कोइ सर्ववस रोड ऄथवा वैकजल्पक सड़क ईपलब्ध न हों। 5. जो यांजत्रक वाहन ऄपनी श्रणे ी के जलए जनधागररत ऄनुज्ञेय भार की ऄपेक्षा ऄजधक भार से लदा हुअ होगा ईसके चालक ऄथवा माजलक ऄथवा प्रभारी व्यजि को ऐसे ऄजधक भार से लदे हुए वाहन को राष्ट्रीय राजमाग गमें प्रवेि कराने के जलए िुल्क संग्रहण एजेंसी को जनयम-10 के ईपजनयम 1ए में जवजनर्ददष्ट के ऄनुसार िुल्क का भगु तान करना होगा और ईसे राजमाग ग खण्ड का ईपयोग करन े की तब तक ऄनुमजत नहीं होगी जब तक दक ऐसे यांजत्रक वाहन से ऄजधक भार को हटा नही ददया जाए। 6. यांजत्रक वाहनों की श्रेणी, ईनके जलए ऄनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्ववस रोड, वैकजल्पक सड़क अदद सजहत सभी पररभािाएं जनयमों म ें जवजनर्ददष्ट पररभािाओं के ऄनुसार होंगी। 7. ईि जनयमों के जनयम 12 के ऄनुसार, ईपयोगकतागओं की जानकारी के जलए िुल्क की दरों को प्रदर्वित दकया जायेगा। 8. उपर सारणी-1 में यथा ईजल्लजखत अधार वि ग 2007-08 के जलए प्रजत दक.मी. िुल्क की अधार दर के अधार पर, यांजत्रक वाहनों से जलए जान े वाले वास्ट्तजवक िुल्क और छूट की गणना भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा खण्ड की पूरी कर ली गइ लम्बाइ के अधार पर की जाएगी और ईि जनयमों के जनयम-5 के ऄनुसार वार्विक तौर पर संिोधन दकया जाएगा तथा ईसे तद्नुसार ऄंग्रेजी और स्ट्थानीय भािा के कम से कम एक-एक समाचार पत्र में प्रकाजित करवाया जाएगा। 9. पररयोजना की ऄनुमाजनत पूंजीगत लागत रु. 205.200 करोड़ ह।ै पूंजीगत लागत म ें पररवतगन हो सकता ह।ै क्योंदक भूजमऄजगन, जनईपयोजगता सेवाओं का स्ट्थान बदलन,े पेड़ों की कटाइ अदद जैसे दियाकलाप ऄभी पूरे दकये जान े ह।ैं ऄंजतम प ूजीगत लागत ऄलग से ऄजधसूजचत की जायेगी। भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा वसूल दकये गये प्रयोिा िल्ु क के जररये प ूजीगत लागत की वसूली का ररकाड ग रखा जायेगा और प ूजीगत लागत की वसूली के बाद लगाये जान े वाले िल्ु क की दरों को 40 TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 3rd February, 2020 S.O. 532(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2004(E) 30 August 2012 issued under section 5 of the National Highways Act 1956 (48 of 1956), the Central Government has declared the entire stretch of highway starting from Pillibhit on NH-30, connecting Puranpur, Khutar, Gola Gokarnnath, Lakhimpur, Isanagar, Nanpara (on NH-927), Bahraich (on NH-927), Balrampur, Maharajganj, and terminating at NH-727 near Padrouna in the State of Uttar Pradesh as NH-730 and entrusted to State Government of Uttar Pradesh; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act,1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the ―Rules‖), the Central Government hereby levies the fee at 60% of the base rate specified in column (2) of the Table 1 for net road length of 44.132 km for use of the two lane with paved shoulder sections on type of Vehicles specified in column (1) of Table 1 below, for the use of Puranpur- Khutar section from design Km 38.00 to 82.00 on the National Highway No.-730 in the State of Uttar Pradesh and authorises National Highway Authority of India to collect, either through its officials (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or 1.05 Mini Bus Bus or Truck (Two Axles) 2.20 Three-Axle commercial Vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicles 3.45 (MAV) (four to six axles) Oversized Vehicles’ (seven or more axles) 4.20 1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza, namely:- TABLE-2 Location of Fee Plaza (Chainage) Length (in Km) for which fee is Rate at which fee is payable payable At Km/Ch 69.700 (design chainage) (existing chainage Km. 44.132 60% of the base rates mentioned in 69.640) near Village Hitouta in Table – 1 above Shahjahanpur District of U.P. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs 265.00 (Rupees Two Hundred Sixty Five Only) for the year 2019-20 and is subject to revision every year as per the provisions of the said rules. 3. For multiple journeys of the highway section, passes shall be issued at the following rates, namely. Table-3 Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for Two Twenty Four hours from the time one way journey of payment Two-third of amount of the fees Fifty One month from date of Payment payable for fifty single journeys 4. Fee for commercial vehicles (excluding vehicles plying under National permits) registered in the district where the fee plaza falls shall be 50% of the specified rates for that category of vehicle provided no service road or alternate road is available for use of such commercial vehicles. 5. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.[भाग II खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules. 7. The fee rates shall be displayed for information of the users in accordance with rule 12 of said rule. 8. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by National Highway Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 9. The estimated capital cost of the project is Rs. 205.200 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately. National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
