L.-33004/99 सी.जी.-डी.एल.-अ.-16102020-222520 xxxGIDHxxx CG-DL-E-16102020-222520 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3225] नई दिल्ली, िुक्रवार, अक्त बू र 16, 2020/आज‍व न 24, 1942 No. 3225] NEW DELHI, FRIDAY, OCTOBER 16, 2020/ASVINA 24, 1942 सड़क पररवहन और रािमाग ग मत्रं ालय अजधसचू ना नई दिल्ली, 16 अक् तूबर, 2020 का.आ. 3637(अ).—भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और रािमागग मंत्रालय म ें अजधसूचना संख्या का. आ. 1098 (अ), दिनांदकत 15 माच,ग 2016 राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत िारी, केंद्र सरकार ने ओजडिा राज्य म ेंरा्‍र ीय रािमाग गसं. 224 के बालांगीर – खोधाग खंड को ओजडिा राज्य सरकार को सुपुि गकर दिया ह।ै अत: अब, रा्‍र ीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 के जनयम 3 के साथ परित (िो इसके आग े उक्त ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)ै राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िजक्त यों का प्रयोग करत े एए, केन्‍द द्रीय सरकार, एतिद्वारा ओजडिा राज्य में रा्‍र ीय रािमाग ग सं. 224/नया रा्‍र ीय रािमाग ग सं. 57 के जडिाइन चैनेि दकमी 140.900 स े दकमी 224.180 (मौिूिा दकमी 140.900 स े दकमी 224.900) तक के अिनीगढा-जमछेली खंड के उपयोग के जलए नीचे िी गई ताजलका 1 के कॉलम (1) म ें जवजनर्ि्‍ग ट वाहनों के प्रकार पर 83.28 दकमी लंबाई की जनवल सड़क खंड के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्ि्‍ग ट आधार िर के 60 प्रजतित पर यांजत्रक वाहनों से फीस उिगृहीत करती ह ै तथा भारतीय रा्‍र ीय रािमागग प्राजधकरण (एनएचएआई) को उसके अजधकाररयों अथवा दकसी िेकेिार के माध् यम से उक्त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत्:- 4965 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-। वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें (1) (2) कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धरु ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथ ग मूववंग उपस्ट् कर (ईएमई) या बए 3.45 धुरीय वाहन (एमएवी) (चार स ेछ: धरु ी) जविाल आकार के वाहन (सात या अजधक धरु ी) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत की िान े वाली फीस ऐसे पथकर प्ल ािां के जलए जवजनर्ि्‍ग ट जनवल सड़क लंबाई हते ु जनम्न जलजखत पथकर प् लािां म ें िये और सिं ेय होगी:- पथकर प्ल ािा (जडिाइन चनै िे ) की लबं ाई (दकमी म)ें जिसके जलए फीस सिं ेय ह ै िर, जिस पर फीस सिं ेय अवजस्ट्थ जत ह ै । नयागढ जिल े म ें रंगामजतया गांव के 83.28 ऊपर ताजलका-1 में जनकट दकमी 190.050 पर उ ज ल् ल ज ख त आ ध ा र ि र ों का 60% 2. गैर-वाजणजज्य क प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ािा स े बीस दकमी की िरू ी के भीतर जनवास करने वाले व् यजक्त के जलए माजसक पास की िर वर् ग 2020-21 के जलए 275.00 रु. (िो सौ पचहत्तर रुपए मात्र) ह ैऔर उक्त जनयमों के प्रावधानों के अनुसार प्रजतवर् ग संिोधन के अध् यधीन ह।ै 3. रािमागग खडं पर बएल यात्रां के जलए जनम्न जलजखत िरों पर पास िारी दकए िाएगं ,े अथागत-् सिं ेय राजि अनज्ञु ात एकतरफा यात्रां की मान्‍दय ता अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए िल्ु क का िो भुगतान के समय से चौबीस घंटे डेढ गुना पचास एकल यात्रां के जलए पचास भुगतान की तारीख से एक मास संिेय िल्ु क की राजि का िो- जतहाई 4. फीस प् लािा जस्ट् थत होन े वाले जिल े म ें पंिीकृत वाजणजज्य क वाहनों (रा्‍र ीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐस े वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल् पक सड़क उपलब् ध न हों । 5. संबंजधत श्रेणी के वाहनों के जलए जवजनर्ि्‍ग ट अनुज्ञेय भार स े अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यजक्त , राष्ट्रीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल सग्रं हण एिेंसी को ऐसी श्रणे ी के वाहनों के प्रवेि जलए, उक्त जनयमों के जनयम 10 के उप-जनयम 1ए म ें जवजनर्ि्‍ग ट फीस के समतुल् य फीस का भुगतान करन े के जलए उत् तरिायी होगा और वह रािमाग ग खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐस े यांजत्रक वाहन स े लिा अजतभार हटाया नहीं िाता।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 6. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनज्ञु ये भार, छूट प्राप् त वाहनों की श्रेणी, सर्वगस रोड, वैकजल् पक सड़क इत् यादि उक्त जनयमों म ें जवजनर्ि्‍ग ट पररभार्ां के अनरूु प होंगी । 7. फीस की िरें उक्त जनयमों के जनयम 12 के अनुसरण म ें प्रयोक्त ां के सूचनाथग प्रिर्िगत करनी होंगी । 8. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुगक् त ताजलका-1 म ें यथा-उजल् लजखत आधार वर् ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक्त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अग्रं ेिी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा । 9. पररयोिना की अनुमाजनत पिूं ीगत लागत 223.84 करोड़ रू. ह ै । [भूजम अजधग्रहण, सावगिजनक िन सुजवधां के स्ट् थानांतरण, पेड़ों को काटने आदि कायगकलापों को अभी पूरा दकया िाना ह ै इसजलए, पूंिीगत लागत पररवतगन के अध् यधीन ह ै और अंजतम पूंिीगत लागत को पथृ क रूप स े अजधसूजचत दकया िाएगा]। भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा प्रयोक्त ां स े वसूल दकए गए िुल्क के िररए पूंिीगत लागत की वसूली हो िाने के प‍च ात्, लगाए िाने वाल े िुल् क की िरों को घटाकर 40% कर दिया िाएगा और उक्त जनयमों के अनुसार इसम ें वार्र्गक तौर पर संिोधन दकया िाएगा। [फा. स.ं आरडब् ल् य/ू एनएच/12014/51/2014/ओआरएस/(पी-5)/िोन-III भाग] जप्रयांक भारती, संयुक् त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 16th October, 2020 S.O.3637(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1098(E) dated the 15th March,2016 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the Balangir- Khordha section of National Highway number 224 in the State of Odisha to the State Government of Odisha. Now, therefore, in exercise of powers conferred by section 7 of the National Highways Act,1956 (48 of 1956), read with rule 3 of the National highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the said “rules”), the Central Government, hereby levies the fee on the mechanical vehicles at 60% of the base rate specified in column (2) of the Table-1 for net road section of 83.28 km on the type of vehicle specified in column (1) of table-1 below for use of Adenigada-Maichheli section from design chainage from Km 140.900 to 224.180 (Existing Km 140.900 to Km 224.900) on the National Highway No. 224/ New National Highway No. 57 in the state of Odisha and authorises National Highways Authority of India (NHAI) to collect, either through its officials or through contractor, the said fee, namely: - Table-1 Type of Vehicle Base rate of fee per Km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or 1.05 Mini Bus Bus or Truck (Two axles) 2.20 Three-axle commercial vehicle 2.40 Heavy construction machinery (HCM) or Earth Moving Equipment 3.454 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (EMEO) or Multi Axle Vehicle (MAV) (four to Six axles ) Oversized Vehicles (seven or more axles) 4.20 1. The fee to be levied and collected hereunder shall be due and payable at the following Fee Plaza for the net road length specified for such Fee Plaza, namely: - Location of Fee Plaza Length (in Km) for which Rate at which fee is payable (Design Chainage) fee is payable At Km 190.050 near Rangamatia Village 83.28 60% of the base rates in Nayagarh District. mentioned in Table-1 above 2. The rate of monthly pass for a person who owns mechanical vehicle registered for non-commercial purpose and resides within a distance of twenty kilometres from the fee plaza is Rs. 275.00 (Rupees: Two hundred seventy Five Only) for the year2020-21 and is subject to revision every year as per the provisions of said rules. 3. For multiple journey on the highway section, passes shall be issued at the following rates, namely: - Maximum number of one way journeys allowed Amount Payable Period of validity One and half times of the fee for Two Twenty four hours from the time of One way Journey Payments Two-third of amount of the fee Fifty Payable for fifty single journeys One month from date of payment 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 5. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 6. All definitions including category of mechanical vehicle, its permissible load, category of exempted vehicle, service road, alternative road etc. shall be as per definitions specified in the said rules. 7. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 8. Based on the base rate of fee per kilometre for the base year 2007-08 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicle and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 9. The estimated capital cost of the project is Rupees 223.84 Crore .[The capital cost is subject to variation as the activities of Diversion of forest land, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately.] The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
