NOTIFICATION
New Delhi, the 7th July, 2017
S.O. 2162(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and
Highways number S.O. 1192 (E) dated 03.12.2001 and S.O. No. 920 (E) dated 28.08.2002, issued under Section 11 of
the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from
km 0.000 to km 35.000 of National Highway No. 79A, km 14.000 to km 182.000 of National Highway No.79
(Nasirabad - Chittorgarh) and from km 114.000 to km 220.000 (Chittorgarh-Udaipur) of National Highway No. 76 in the
State of Rajasthan to the National Highways Authority of India (hereinafter referred to as the “Authority”);
And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956)
read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central
Government by notification of the Government of India authorized Authority for levying and collecting fee on
mechanical vehicles for the use of stretches as follows:
(i) Vide S.O.No. 2049(E) dated 23rd August, 2012 for the section from km 0.000 to km 35.000 of NH-79A and
section from km 15.000 to km 81.000 of NH-79 (total length being 101.000 km) in the State of Rajasthan
(ii) Vide S.O.No. 1783(E) dated 09th August, 2012 for the section from km 81.000 to km 163.900 of NH-79 (total
length being 82.900 km) in the State of Rajasthan
(iii) Vide S.O.No. 505(E) dated 04th March, 2013 for the use of 4 laned Chittorgarh Bypass Section from km
159.000 to km 168.500, taking off at km 168.500 of NH-79 and merging at km 213.000 of NH-76 (total length being
29.600 km) in the State of Rajasthan
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988
(68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s CG
Tollway Pvt. Ltd., 11/B, IRB Complex, Chandivali Road, Saki Naka, Andheri (East), Mumbai -400072 (hereinafter
referred to as the “Concessionaire”), for the bid submitted on 20.09.2016 for the development of Kishangarh-Udaipur-
Ahmedabad section from km 90.000 (design chainage) to km 214.870 (design chainage) (existing chainage from km
69.730 to km 163.950 & from km 0.000 to km 29.600) (hereinafter referred to as the “said section”) of the NH-79 in the
state of Rajasthan to Six lane through Public Private Partnership under NHDP Phase-V on Design, Build, Finance,
Operate and Transfer (DBFOT) basis;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956),
read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 vide G.S.R. 838 (E)
dated the 5th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January,
2011, G.S.R 756(E) dated 12th October,2011 and G.S.R 778 (E) dated 16th December,2013, G.S.R 26(E) dated 16th
January, 2014, G.S.R 831(E) dated 21st November,2014, G.S.R. 2(E) dated 29th December, 2014, G.S.R 220(E) dated
23rd March, 2015 and G.S.R 585(E) dated 08th June, 2016 and in supersession of the Notification Number S.O. No.
2049(E) dated 23rd August, 2012, S.O.No. 1783(E) dated 09th August, 2012 and S.O.No. 505(E) dated 04th March, 2013
except as respect things done or omitted to be done before such supersession, the Central Government, having regard to
the expenditure involved in building, maintenance, management and operation of the said Section of said National6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement
entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on
mechanical vehicles at the rate specified in column (2) of the Table 1 for total equivalent road length of 135.195 km
[including 123.723 km road and 1147.20 m of structures (having length more than 60m) with equivalent length of 11.472
km] (during construction period) and for total equivalent road length of 136.815 km [including 123.543 km road and
1327.20 m of structures (having length more than 60m) with equivalent length of 13.272 km] (after completion of six
laning) for use of four and more lane sections (hereinafter referred to as “base rate”) on the Type of Vehicles specified in
column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the date
of Commercial Operation (COD) or on getting the Completion Certificate or the Provisional Certificate, as the case may
be, from the Authority or publication of this Notification in the Official Gazette, whichever is later, till the termination
date as specified in the agreement. This fee notification shall be effective from the Appointed Date of the BOT project.

3. No user fee shall be levied for the delayed period between the Scheduled date of completion (910 days from the
Appointed Date) and the date of actual completion of the project, if it is delayed. For the purposes of this rule, any
provisional completion of the project shall not be treated as completion of the project.
4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes
and resides within a distance of twenty kilometers from the toll plaza is Rs. 245.00 (Rupees Two Hundred Forty Five
only) for the year 2017-18 which is subject to revision every year as per the provisions of the National Highways Fee
(Determination of Rates and Collection) Rules, 2008.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely;

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the
fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road
is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load
specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the
toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be
entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service
road, alternative road etc. shall be as per definitions specified in the Rules.
9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of
fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of
completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire
in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with
the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be
effected until a period of 6 (six) months has elapsed from COD.
