L.-33004/99 सी.जी.-डी.एल.-अ.-25092020-221998 xxxGIDHxxx CG-DL-E-25092020-221998 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2947] नई दिल्ली, िुक्रवार, जसतम्ब र 25, 2020/आज‍व न 3, 1942 No. 2947] NEW DELHI, FRIDAY, SEPTEMBER 25, 2020/ASVINA 3, 1942 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 25 जसतम्ब र, 2020 का.आ. 3298(अ).— िबदक, भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और रािमागग मंत्रालय म ें अजधसूचना संख्या का.आ. 4174(अ), दिनांदकत 27 दिसंबर, 2016, राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत िारी, केंद्र सरकार ने तले गं ाना राज्य में जस्ट्तत रा्‍र ीय रािमागग सं. 167 को तेलगं ाना राज्य सरकार को सुपुि गकर दिया ह।ै अत: अब, रा्‍र ीय रािमागग िल्ु क (िरों का जनधागरण और संग्रहण) जनयम, 2008 के जनयम 3 के सात परित (िो इसके आग े ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)ै राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िज‍त यों का प्रयोग करते एए, केन्‍द द्रीय सरकार, एतिद्वारा तले ंगाना राज्य म ें रा्‍र ीय रािमागग सं. 167 के िेडचरे ला – कवलाकुती खंड के जडिाइन दकमी 15.525 से दकमी 62.880 तक पेव्ड िोल्डर सजहत िो लेन के उपयोग के जलए 40.018 दकमी लंबाई की जनवल सड़क खंड और 60 मी से अजधक लंबाई वाल े 2.37 दकमी (0.237 दकमी लंबाई वाली) की समतल्ु य संरचना लंबाई हते ु ताजलका 1 के कॉलम (2) में जवजनर्ि्‍ग ट आधार िर के 60% िर पर तता चार लने अतवा अजधक के खंड के उपयोग के जलए 7.100 दकमी लंबाई की जनवल सड़क खडं हते ु ताजलका 1 के कॉलम (2) म ें जवजनर्ि्‍ग ट आधार िर के 4499 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 100% िर पर यांजत्रक वाहन स े फीस उिगृहीत करती ह ै तता भारतीय रा्‍र ीय रािमागग प्राजधकरण को उसके अजधकाररयों अतवा दकसी िेकेिार के माध् यम से उ‍त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अतागत्:- ताजलका-। (1) (2) वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धरु ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अत ग मूववंग उपस्ट्क र 3.45 (ईएमई) या बए धुरीय वाहन (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धरु ी) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत फीस ऐसे पतकर प्ल ािा क के अंतगगत जवजनर्ि्‍ग ट िरू ी हते ु जनम्न जलजखत पतकर प् लािा क में िेय और सिं ेय होगी:- ताजलका-2 पतकर प्ल ािा की अवजस्ट्त जत (चनै िे ) लबं ाई (दकमी) जिसके जलए फीस िर, जिस पर फीस सिं ेय ह ै सिं ेय ह ै । तेलगं ाना राज्य के महबूबनगर जिले में मु्ानरु गांव के ऊपर ताजलका-1 म ें जनकट रारा-167 के दकमी/च.ै 33.260 पर 40.018 उजल् लजखत आधार िरों का 60% ऊपर ताजलका-1 म ें 7.100 उजल् लजखत आधार िरों का 100% 2. उपयुग‍ त के अजतरर‍त , जनम्न जलजखत फीस प् लािा (प् लािा क) पर 60 मीटर से अजधक लंबाई वाली जनम्न जलजखत अवसंरचना क के उपयोग के जलए 10 के समतल्ु य गणु क द्वारा ऐसी अवसंरचना क की लंबाई को गणु ा करके रािमाग ग की समतुल् य लंबाई म ेंअवसंरचना क की लंबाई को पररवर्तगत करके जनम्न जलजखत फीस भी िेय और संिेय होगी:- ताजलका-3 िल्ु क प्ल ािा का अवस्ट्त ान (चनै िे ) सड़क की समकक्ष लबं ाई म ें सड़क की समकक्ष लबं ाई िर, जिस पर िल्ु क पररवर्ततग दकए िान े हते ु (दकमी म)ें सिं ेय ह ै सरं चना क की लबं ाई (दकमी म)ें तेलगं ाना राज्य के महबूबनगर जिले ऊपर ताजलका-1 में में मु्ानुर गांव के जनकट रारा-167 0.237 2.370 उजल् लजखत आधार के दकमी/चै. 33.260 पर िरों का 60%[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 िो लेन संरचना का ब् यौरा जननानानुसार ह:: - चैनेि क्र. सं. संरचना का प्रकार लंबाई (दकमी में) से दकमी दकमी तक 1 25.297 25.435 मुख्य पुल 0.138 2 34.905 35.004 मुख्य पुल 0.099 कुल 0.237 3. गैर-वाजणजज्य क प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट्व ामी और पतकर प्ल ािा से बीस दकमी की िरू ी के भीतर जनवास करने वाले व् यज‍त के जलए माजसक पास की िर वर्ग 2020-21 के जलए 275.00 रु. (िो सौ पछत्तर रुपए मात्र) ह ैऔर कजतत जनयमों के प्रावधानों के अनुसार प्रजतवर् गसंिोधन के अध् यधीन ह।ै 4. रािमागग खंड पर बएल यात्रा क के जलए जनम्न जलजखत िरों पर पास िारी दकए िाएंग,े अतागत् ताजलका-4 सिं ेय राजि अनज्ञु ात एकतरफा यात्रा क की मान्‍दय ता अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए िल्ु क का डे़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्रा क के जलए संिेय पचास भुगतान की तारीख से एक मास िुल् क की राजि का िो-जतहाई 5. फीस प् लािा जस्ट् तत होने वाले जिले में पंिीकृत वाजणजज्य क वाहनों (रा्‍र ीय परजमट के अधीन पररचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रणे ी के वाहन हते ु जनधागररत िर की 50% होगी, बित े दक ऐस े वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल् पक सड़क उपलब् ध न हों । 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्ि्‍ग ट अनुज्ञेय भार स े अजधक भार लिे यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय रािमागग पर अजतभार लिे वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रणे ी के वाहनों के प्रवेि जलए, कजतत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार जवजनर्ि्‍ग ट फीस के समतुल् य फीस का भगु तान करने के जलए उत् तरिायी होगा और वह रािमाग ग खंड का प्रयोग करन े के जलए तब तक हकिार नह होगा िब तक ऐस े यांजत्रक वाहन से लिा अजतभार हटाया नह िाता। 7. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्वगस रोड, वैकजल् पक सड़क इत् यादि पूव्‍त जनयमों में जवजनर्ि्‍ग ट पररभार्ा क के अनुरूप होंगी । 8. फीस की िरें उक्त जनयमों के जनयम 12 के अनुसरण म ेंप्रयो‍त ा क के सूचनातग प्रिर्िगत करनी होंगी । 9. यांजत्रक वाहनों से फीस की वास्ट् तजवक राजि उपयुग‍त ताजलका-1 में यता-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय रा्‍र ीय रािमाग ग प्राजधकरण द्वारा खंड की परू ी हो गई लंबाई के आधार पर की िाएगी और उस े उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तता तिनुसार उसे अग्रं ेिी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. पररयोिना की अनुमाजनत पिूं ीगत लागत 283.00 करोड़ रू. ह ै । [चूंदक भूजम अजधग्रहण, सावगिजनक िन सुजवधा क के स्ट्त ानांतरण, पड़े ों को काटने आदि कायगकलापों को अभी परू ा दकया िाना ह ै इसजलए पूंिीगत लागत पररवतगन के अध् यधीन ह ै और अंजतम पूंिीगत लागत को पृतक रूप स े अजधसूजचत दकया िाएगा।] प्रयो‍त ा फीस के माध् यम से वसलू की गई पूंिीगत लागत का भारतीय रा्‍र ीय रािमाग ग प्राजधकरण द्वारा ररकॉड ग रखा िाएगा तता पूंिीगत लागत की वसूली के प‍ चात् उिग्राय फीस घटाकर िरों के 40 तक कर िी िाएगी और उक्त जनयमों के अनुसरण में वार्र्गक रूप स े संिोजधत की िाएगी। [फा. सं. आरडब्ल्य/ूएचवाईडी/िेबी:एनएच(ओ)/33/कोर] जप्रयांक भारती, संयु‍ त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 25th September,, 2020 S.O. 3298(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways S.O. No. 4174(E) dated 27th December, 2016 issued under section 5 of the National Highways Act 1956 (48 of 1956) , the Central Government has entrusted the National Highway number 167 as situated within the state of Telangana to the State Government of Telangana ; Now, therefore, in exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the central government hereby levies the fee on mechanical vehicles at 60% of rate specified in Column (2) of the Table 1 for net road section length of 40.018 km and for equivalent length of 2.37 km for structure having length more than 60m (Structure length of 0.237 Km) for the use of two lane with paved shoulder and at 100% of rate specified in Column (2) of the Table 1 for net road section length of 7.100 km for use of four lane or more of Jadcherla- Kalwakurthy Section from design kilometer 15.525 to kilometer 62.880 of National Highway number 167 in the state of Telangana and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table – 1 (1) (2) Base rate of fee per Km for the base year Type of Vehicle 2007-08 (in Rupees) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini 1.05 Bus Bus or Truck (Two axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi axle Vehicle (MAV) (Four to 3.45 Six axles) Oversized Vehicles (Seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.275/- (Rupees Two Hundred and Seventy Five only) for the year 2020-21 which is subject to revision every year as per the provisions of the said rules. 4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:- Table – 4 Maximum number of one way Amount Payable Period of validity journeys allowed One and half times the fee for one Twenty four hours from the time of Two way journey payment Two-third of amount of the fee Fifty One month from date of payment payable for fifty single journeys6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6.The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per the definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9.Based on the base rate of Fee per kilometer for the base year 2007-2008 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10.The estimated capital cost of the project is Rupees 283.00 crores [the capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc., are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
