730 जडजाआन दक.मी. 384.874 स े 420.450 (वतगमान दक.मी. 385.000 से 420.000) (बढ़नी कटाया चौक सेक्िन) तक के खंड के प्रयोग के जलए जनम्नजलजखत ताजलका 1 के कालम (1) म ें जवजनर्ददष्ट वाहनों के प्रकार पर 35.336 दक.मी. की दो लेन/पेव्ड िोल्डर सजहत जनवल सड़क खण्ड लम्बाइ के जलए ताजलका 1 के कालम (2) में जवजनर्ददष्ट अधार दर के जलए 60% की दर पर यांजत्रक वाहन से फ़ीस ईदगृहीत करती ह ै तथा भारतीय राष्ट्रीय राजमागग प्राजधकरण को ईसके ऄजधकाररयों ऄथवा दकसी िेकेदार के माध्यम से ईि फ़ीस के संग्रहण के जलए प्राजधकृत करती ह,ै ऄथागत्:- 5280 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन के प्रकार अधार वर् ग 2007-08 के जलए फीस की प्रजत दक.मी. अधार दर (रु. म)ें (1) (2) कार, जीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणजज्यक माल वाहन, वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धरु ी वाल ेवाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (एचसीएम) या ऄथग मूववग ईपस्ट्कर (इएमइ) या 3.45 बहुधुरीय (एमएवी) (4 से 6 धरु ी वाले) जविाल अकार के वाहन (7 या ऄजधक धरु ी वाल)े 4.20 1. आसके ऄंतगगत ईदगृहीत और सग्रं हीत की जाने वाली फ़ीस ऐसे पथकर प्लाजा के जलए जवजनर्ददष्ट सड़क लंबाइ हते ु पथकर प्लाजा पर देय और संदहे होगी, ऄथागत:- ताजलका -2 पथकर प्लाजा का ऄवस्ट्थान (चनै जे ) लंबाइ (दक.मी. म)ें जजसके जलए दर जजस पर िल्ु क संदये है। िल्ु क सदं ये ह ै राष्ट्रीय राजमाग ग – 730 पर जसद्धाथगनगर जजले म ें 35.336 2 लेन/पेव्ड िोल्डर सजहत 2-लेन के गोल्हौरा गााँव, पो०-िोहरतगढ़, पी०एस० जलए ईि ताजलका - 1 में ईजल्लजखत िोहरतगढ के जनकट जडजाआन दक0मी0 407.750 अधार दर का 60 प्रजतित 2. जजस व्यजि का ऄपना यांजत्रक वाहन, गैर-वाजणजज्यक प्रयोजनों के जलए पंजीकृत हुअ हो और वह िुल्क प्लाजा स े बीस दकलोमीटर तक की दरू ी म ें ही रहता हो, ईसके जलए वर्ग 2020-21 के जलए माजसक पास की दर 275.00/-रूपए (दो सौ पच्चहत्तर रूपए मात्र) होगी और ईि जनयमों के ईपबंधों के ऄनुसार ईसम ें प्रत्येक वर्ग संिोधन दकया जायेगा। 3. राजमागग खडं पर बहुयात्राओं के जलए जनम्नजलजखत दरों पर पास जारी दकए जाएंगे, ऄथातग ् ताजलका-3 संदेय राजि ऄनुमत एकतरफा यात्राओं की वैधता की ऄवजध ऄजधकतम सं या एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना दो भुगतान के समय स े 24 घंटे पचास एकल यात्राओं के जलए भुगतान योग्य पचास भुगतान की तारीख से एक महीना िुल्क की राजि का दो जतहाइ 4. जजस जजले में िुल्क प्लाजा पड़ता ह ै ईस जजले में पंजीकृत वाजणज्यक वाहन (राष्ट्रीय परजमट के ऄधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क ईस श्रेणी के वाहन के जलए जवजनर्ददष्ट िल्ु क का 50 प्रजतित होगा, बिते दक ऐसे वाजणजज्यक वाहनों के ईपयोग के जलए कोइ सर्तवस रोड या वैकजल्पक सड़क ईपलब्ध न हों। 5. जो यांजत्रक वाहन ऄपनी श्रेणी के जलए जनधागररत ऄनज्ञु ये भार की ऄपेक्षा ऄजधक भार से लदा होगा ईसके चालक ऄथवा प्रभारी व्यजि को ऐसे ऄजधक भार से लदे हुए वाहन को राष्ट्रीय राजमागग में प्रविे कराने के जलए िल्ु क सग्रं हण एजेंसी को ईि जनयमों के जनयम 10 के ईपजनयम 1 ए में जवजनर्ददष्ट के ऄनुसार िल्ु क का भुगतान करना होगा और ईस े राजमागग खंड का ईपयोग करन े की तब तक ऄनुमजत नहीं होगी जब तक की ऐसे यांजत्रक वाहन से ऄजधक भार को हटा नहीं ददया जाए।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 6. यांजत्रक वाहनो की श्रणे ी, ईनके जलए ऄनज्ञु ेय भार, छूट प्राप्त वाहनों की श्रणे ी, सर्तवस रोड, वैकजल्पक सड़क अदद सजहत सभी पररभार्ाएं जनयमों में जवजनर्ददष्ट पररभार्ाओं के ऄनुसार होगी। 7. ईि जनयमों के जनयम – 12 के ऄनुसार ईपयोगकताओंग की जानकारी के जलए िल्ु क की दरों को प्रदर्तित दकया जायेगा। 8. उपर सारणी-1 में यथा-ईजल्लजखत, अधार वर् ग 2007 -08 के जलए प्रजत दकलोमीटर िुल्क की अधार दर के अधार पर, यांजत्रक वाहनों से जलए जाने वाले वास्ट्तजवक िल्ु क और छूट की गणना भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा खंड की पूरी कर ली गइ लम्बाइ के अधार पर की जाएगी और जनयमों के जनयम-5 के ऄनुसार वार्तर्क तौर पर संिोधन दकया जाएगा तथा ईसे, तदनुसार, ऄग्रं ेजी और स्ट्थानीय भार्ा के कम से कम एक एक समाचार पत्र में प्रकाजित दकया जाएगा। 9. पररयोजना की ऄनुमाजनत पूंजीगत लागत रु 209.10 करोड़ ह।ै भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा वसूल दकय े गय े प्रयोिा िुल्क के जररये पजूं ीगत लागत की वसूली का ररकाडग रखा जायगे ा और पूंजीगत लागत की वसूली के बाद लगाय े जान े वाल े िल्ु क की दरों को 40 प्रजतित कर ददय े जायेगा और ईि जनयमों के ऄनुसार आसमे वार्तर्क तौर पर संिोधन दकया जायेगा। [फा. सं. NH-12014/27/2016/UP/NH-II] जप्रयांक भारती, संयुि सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th October, 2020 S.O. 3887(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.2004 (E) the 30th August, 2012, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch from Km. 385.000 to 420.000 (Barhani Kataya Chowk Section) of National Highway No.730 in the State of Uttar Pradesh to the State Government of Uttar Pradesh; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the ―rules‖), the Central Government hereby levies the fee on mechanical vehicles at 60% Percent of the base rate specified in column (2) of the Table 1 for net road section length of 35.336 km for the use of two lane with paved shoulder section on the type of vehicles specified in column (1) of the Table 1 below of Barhani Kataya Chowk Section from design km 384.874 to design km 420.450 (existing km 385.000 to km 420.000) on National Highway no. 730 in the State of Uttar Pradesh and authorizes the National Highways Authority of India (NHAI) to collect, either through its officials or through a contractor, the said fee, namely:- Table – 1 Types of Vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-Axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3.45 or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non commercial purposes and resides within a distance of twenty kilometers from the Fee plaza is Rs. 275.00 (Rupees Two Hundred Seventy Five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 3. For multiple journeys on the highway section, passes shall be issued at the following rates, namely, Table-3 Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours the time of journey payment Two-third of amount of the fees payable Fifty One month from date of payment for fifty single journeys 4. Fee for commercial vehicles (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternate road is available for use of such commercial vehicles. 5. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules. 7. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 9. The estimated capital cost of the project is Rs. 209.10 crore. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost; the fees leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
