L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअI.D-E1x9x0x 92020-221823 CG-DL-E-19092020-221823 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2838] नई ददल्ली, िुक्रवार, जसतम्ब र 18, 2020/भाद्र 27, 1942 No. 2838] NEW DELHI, FRIDAY, SEPTEMBER 18, 2020/BHADRA 27, 1942 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल् ली, 18 जसतम्ब र, 2020 का.आ. 3186(अ).—भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और राजमाग ग मंत्रालय म ें अजधसूचना संख्या का. आ. 4006(अ), ददनांदकत 06.11.2019, राष्ट्रीय राजमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत जारी, केंद्र सरकार न े महाराष्‍टर राज्य म ें राष्‍टर ीय राजमागग स.ं 548बी को महाराष्‍टर राज्य सरकार को सुपुद ग कर ददया ह।ै अत: अब, राष्‍टर ीय राजमाग ग फीस (दरों का जनधागरण और संग्रहण) जनयम, 2008 के जनयम 3 के साथ परित (जो इसके आगे ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)ै राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त िज‍त यों का प्रयोग करत े हुए, केन्‍द द्रीय सरकार, एतदद्वारा महाराष्‍टर राज्य म ें राष्‍टर ीय राजमागग स.ं 548बी के लोखंडी – सावरगांव – रेनापुर खडं के दकमी 32.225 स े दकमी 66.693 तक और अंबाजगांव बाइपास खंड के दकमी 0.000 स े दकमी 3.815 तक नीच े ताजलका 1 के कॉलम (1) म ें जवजनर्ददष्‍ट ट वाहनों के प्रकार पर 19.390 दकमी जनवल सड़क खंड लंबाई के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्ददष्‍ट ट दर के 60 प्रजतित पर और 15.073 दकमी जनवल सड़क खडं लंबाई के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्ददष्‍ट ट दरों पर तथा दस करोड़ अथवा इससे अजधक लागत के 3.815 दकमी लबाई वाल े बाइपास के जलए आधार दर का डेढ़ गुना दर पर यांजत्रक वाहनों पर फीस उदगृहीत करती ह ै तथा भारतीय राष्‍टर ीय राजमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेदार के माध् यम स े उ‍त फीस के सग्रं हण के जलए प्राजधकृत करती ह,ै अथागत:्- 4338 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-I वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस दर (रु. म)ें (1) (2) कार, जीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धरु ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्ट् कर (ईएमई) या बहु धुरीय 3.45 वाहन (एमएवी) (चार स ेछ: धरु ी) जविाल आकार के वाहन (सात या अजधक धरु ी) 4.20 1. इसके अतं गतग उदगृहीत और संगृहीत फीस ऐस े पथकर प्ल ाजां के अंतगगत जवजनर्ददष्‍ट ट दरू ी हते ु जनम्न जलजखत पथकर प् लाजां म ें दये और सदं ेय होगी:- ताजलका-2 पथकर प्ल ाजा (चनै जे ) की अवजस्ट्थ जत लबं ाई (दकमी म)ें जजसके जलए फीस सदं ेय ह ै दर, जजस पर फीस सदं ेय ह ै रारा-548बी के दकमी 39.250 15.073 दकमी ऊपर ताजलका-1 म ें (जडजाइन चनै ेज), जनकट सेल ू आमला उजल् लजखत आधार दरों का गांव (जजला बीड़) 1 0 0 % 19.390 ऊपर ताजलका-1 म ें उजल् लजखत आधार दरों का 60% 2. उपयुग‍ त के अजतरर‍त , जनम्न जलजखत फीस प् लाजा (प् लाजां) पर 10.00 करोड़ रु. स े अजधक की लागत वाल े जनम्नजलजखत बाइपास के उपयोग के जलए जवजनर्ददष्ट बाइपास की लंबाई के जलए ऐसे टोल प्लाजा हते ु ऊपर ताजलका-1 म ें उजल् लजखत आधार दरों के डेढ़ गणु ा पर जनम्न जलजखत फीस भी दये और संदेय होगी: िल्ु क प्ल ाजा का बाइपास िरूु होन ेवाला पर जमलन े वाला बाइपास की लबं ाई दर, जजस पर अवस्ट्थ ान (चनै जे ) का नाम और लागत जजसके िल्ु क सदं ेय ह ै जलए अजतररक्त िल्ु क सदं ेय ह ै लबं ाई लागत (दकमी (करोड़ रु. म)ें म)ें चार अथवा रारा-548बी के अजधक लेन के दकमी 39.250 जलए ऊपर अंबाजोगइ (जडजाइन चैनेज), 0.00 दकमी 3.815 दकमी 3.815 40.70 ताजलका-1 म ें बाइपास जनकट सेलू आमला उजल् लजखत गांव (जजला बीड़) आ ध ा र द र ों क ा 150%[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 3. गरै -वाजणजज्य क प्रयोजनों के जलए पंजीकृत यांजत्रक वाहन के स् वामी और पथकर प्ल ाजा स े बीस दकमी की दरू ी के भीतर जनवास करने वाले व् यज‍त के जलए माजसक पास की दर वर्ग 2020-21 के जलए 275.00 रु. (दो सौ पछत्तर रुपए मात्र) ह ैऔर उ‍त जनयमों के प्रावधानों के अनुसार प्रजतवर् ग संिोधन के अध् यधीन ह।ै 4. राजमागग खंड पर बहुल यात्रां के जलए जनम्न जलजखत दरों पर पास जारी दकए जाएंग,े अथागत ् सदं ेय राजि अनज्ञु ात एकतरफा यात्रां की मान्‍दय ता अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना दो संदाय के समय स े चौबीस घंटे पचास एकल यात्रां के जलए संदेय िुल् क की पचास संदाय की तारीख स े एक मास राजि का दो-जतहाई 5. फीस प् लाजा जस्ट् थत होन े वाल े जजले म ें पंजीकृत वाजणजज्य क वाहनों (राष्‍टर ीय परजमट के अधीन प्रचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत दर की 50% होगी, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्ववस रोड या वैकजल् पक सड़क उपलब् ध न हों । 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्ददष्‍ट ट अनुज्ञेय भार स े अजधक भार लदे यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय राजमागग पर अजतभार लदे वाहन के प्रवेि के जलए टोल संग्रहण एजेंसी को ऐसी श्रणे ी के वाहनों के प्रवेि जलए, उ‍त जनयमों के जनयम 10 के उप-जनयम 1ए म ें जवजनर्ददष्‍ट ट फीस के समतल्ु य फीस का भगु तान करन े के जलए उत् तरदायी होगा और वह राजमागग खंड का प्रयोग करन े के जलए तब तक हकदार नहीं होगा जब तक ऐसे यांजत्रक वाहन स े लदा अजतभार हटाया नहीं जाता । 7. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्ववस रोड, वैकजल् पक सड़क इत् यादद पूवो‍त जनयमों म ें जवजनर्ददष्‍ट ट पररभार्ां के अनुरूप होंगी । 8. फीस की दरें उक्त जनयमों के जनयम 12 के अनुसरण म ेंप्रयो‍त ां के सूचनाथग प्रदर्वित करनी होंगी । 9. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुग‍त ताजलका-1 म ें यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा खंड की परू ी हो गई लंबाई के आधार पर की जाएगी और उस े उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनुसार उसे अग्रं ेजी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया जाएगा। 10. पररयोजना की अनुमाजनत पूंजीगत लागत 463.25 करोड़ रू. ह ै । [भूजम अजधग्रहण, सावगजजनक जन सुजवधां के स्ट् थानांतरण, पड़े ों को काटन,े आदद कायगकलापों को अभी परू ा दकया जाना ह ै इसजलए, पूंजीगत लागत पररवतगन के अध् यधीन ह ै और अंजतम पूंजीगत लागत को पृथक रूप स े अजधसूजचत दकया जाएगा]। भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा प्रयोगकतागं स े वसूल दकए गए िुल्क के जररए पूंजीगत लागत की वसूली हो जान े के पश् चात,् लगाए जान े वाल े िल्ु क की दरों को घटाकर 40% कर ददया जाएगा और उ‍त जनयमों के अनुसार इसम ें वार्वर्क तौर पर संिोधन दकया जाएगा। [फा. सं. आरओ/एमयूएम/पी-1137/2016-17/टोल] जप्रयांक भारती, संयु‍ त सजचव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 18th September, 2020 S.O. 3186(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 4006[E] dated 06.11.2019, issued under section 5 of the National Highways Act, 1956 (68 of 1988), the Central Government entrusted the National Highway Number 548B in the State of Maharashtra to the State Government of Maharashtra : Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee(Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the ―rules"), the Central Government hereby levies the fee on mechanical vehicles at sixty percent of the rates specified in column (2) of the Table 1 for net road section length of 19.390 km and at the rates specified in column (2) of the Table 1 for net road section length of 15.073 km and at one and one half times the base rate for bypass having length of 3.815 km costing Rupees Ten crore or more on the type of vehicles specified in column (1) of the Table 1 below of Lokhandi-Sawargaon–Renapur Section from Km 32.225 to Km 66.693 and Ambajgaon Bypass from Km 0.000 to Km 3.815 on National Highway No. 548B in the State of Maharashtra and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three - axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 275.00 (Rupees Two hundred seventy five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rate, namely: Amount Payable Maximum number of one Period of validity way journeys allowed One and half times of the fee for Two Twenty four hours from the one way journey time of payment Two-third. of amount of the fee Fifty One month from date of payable for fifty single journeys payment 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle. 6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the specified in sub – rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load,category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules. 8. The fee rates shall be displayed for information of the users in accordance with Rule12 of the said rules. 9. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned inTable-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated Capital Cost of the Project is Rs 463.25 Cr. [The capital cost of the project is subject to variation as the activities of the land acquisition, utility shifting, tree cutting etc are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of the capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40 % of the rates and shall be revised annually in accordance with the said rules.
