L.-33004/99 सी.जी.-डी.एल.-अ.-23112020-223259 xxxGIDHxxx CG-DL-E-23112020-223259 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3679] नई ददल्ली, सोमवार, नवम्ब र 23, 2020/ अग्रहायण 2, 1942 No. 3679] NEW DELHI, MONDAY, NOVEMBER 23, 2020/AGRAHAYANA 2, 1942 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 23 नवम् बर, 2020 का.आ. 4181(अ).—भारत सरकार की अजधसूचना द्वारा सड़क पररवहन और राजमाग ग मंत्रालय में अजधसूचना संख्या का. आ. 2334(अ), ददनांदकत 25 अगस्ट्त , 2015 राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के तहत जारी, केंद्र सरकार ने पंजाब राज्य में रा्‍र ीय राजमागग सं. 254 के खडं को पंजाब राज्य सरकार को सपपपद ग कर ददया ह।ै अत: अब, रा्‍र ीय राजमाग ग फीस (दरों का जनधागरण और संग्रहण) जनयम, 2008 के जनयम 3 के साथ परित (जो इसके आग े ‘‘जनयम’’ के रूप म ें उजल् लजखत ह)ै राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत् त िज‍त यों का प्रयोग करते एए, केन्‍द द्रीय सरकार, एतदद्वारा पजं ाब राज्य में रा्‍र ीय राजमागग सं. 254 के जडजाइन दकमी 82.400 स े दकमी 132.300 (मौजूदा दकमी 82.400 स े दकमी 132.300) तक के रामपपरा-मौर-तलवंडी-रमन मंडी खंड़ के पेव् ड िोल्ड र सजहत दो लने के उपयोग के जलए नीचे दी गई ताजलका 1 के कॉलम (1) में जवजनर्दद्‍ ट वाहनों के प्रकार पर 6.102 दकमी लंबाई की जनवल सड़क खंड के जलए आधार दर के 100% और 43.2316 दकमी लंबाई की जनवल सड़क खंड और 5.664 दकमी (0.5664 दकमी लंबाई वाली) की समतपल् य सरं चना लंबाई (60 मी से अजधक लंबाई वाले) के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्दद्‍र आधार दर के 60 प्रजतित पर यांजत्रक वाहनों से फीस उदगृहीत करती ह ै तथा भारतीय रा्‍र ीय राजमागग प्राजधकरण (एनएचएआई) को उसके अजधकाररयों अथवा दकसी िेकेदार के माध् यम से उ‍त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत्:- 5679 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-I वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस दर (रु. म)ें (1) (2) कार, जीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धपरी) 2.20 तीन धपरी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्ट् कर (ईएमई) या बए धपरीय वाहन 3.45 (एमएवी) (चार से छ: धपरी) जविाल आकार के वाहन (सात या अजधक धपरी) 4.20 1. इसके अंतगगत उदगृहीत और संगृहीत की जान े वाली फीस ऐसे पथकर प् लाजा क के जलए जवजनर्दद्‍ ट जनवल सड़क लंबाई हते प जनम्न जलजखत पथकर प ल् ाजा क म ेंदेय और संदेय होगी:- ताजलका-2 पथकर प् लाजा (चनै जे ) की अवजस्ट्थ जत लंबाई (दकमी म)ें जजसके जलए फीस सदं ेय ह ै दर, जजस पर फीस सदं ये ह ै पंजाब राज्य के भिंिडा जजले में िेखपपरा 6.102 दक.मी. ऊपर ताजलका-1 में उजल् लजखत गांव के जनकट रारा-254 के दकमी/चैनेज (बाईपास की लंबाई (लागत > 10 करोड़ रु.) और आधार दरों का चार या 117.200 पर स ंर च न ा क क ी ल ंब ा ई ( > 6 0 म ी ट र ) क ो छ ो ड़ क र अ ज ध क ल ेन क े ज ल ए 1 0 0 % 43.2316 दकमी ऊपर ताजलका-1 में उजल् लजखत (बाईपास की लंबाई (लागत > 10 करोड़ रु.) और आधार दरों का पेव् ड िोल् डरों संरचना क की लंबाई (> 60 मीटर) को छोड़कर सजहत दो लेन के जलए 60% 2. उपयपग‍ त के अजतरर‍त , जनम्न जलजखत फीस प् लाजा (प् लाजा क) पर 60 मीटर से अजधक लंबाई वाली जनम्न जलजखत अवसंरचना क के उपयोग के जलए 10 के समतपल् य गपणक द्वारा ऐसी अवसंरचना क की लंबाई को गणप ा करके राजमागग की समतपल् य लंबाई म ेंअवसंरचना क की लंबाई को पररव्तत करके जनम्न जलजखत फीस भी देय और संदेय होगी:- ताजलका 3 िल्प क प् लाजा का अवस्ट्थ ान(चनै जे ) सड़क की समकक्ष लबं ाई म ें सड़क की समकक्ष दर, जजस पर िल्प क सदं ये ह ै पररव्तत दकए जान ेहते प लंबाई (दकमी म)ें सरं चना क की लंबाई (दकमी म)ें पंजाब राज्य के जजला भिंिडा में 0.5664^ 5.664 ऊपर ताजलका-1 में उजल् लजखत िेखपपरा गांव के पास रारा-254 के आधार दरों का पेव् ड िोल् डरों सजहत दकमी/चैनेज 117.200 पर दो लेन के जलए 60% ^ब् यौरा जनम्न ानपसार ह:ै- चैनेज संरचना का प्रकार लंबाई (दकमी म)ें दकमी यहां से दकमी यहां तक 104.7196 105.2860 आरओबी 0.5664 दकमी कपल 0.5664 दकमी[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 3. गैर-वाजणजज्य क प्रयोजनों के जलए पंजीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ाजा से बीस दकमी की दरू ी के भीतर जनवास करन े वाल ेव् यज‍त के जलए माजसक पास की दर वर्ग 2020-21 के जलए 275.00 रु. (दो सौ पचहत्तर रुपए मात्र) ह ैऔर उ‍त जनयमों के प्रावधानों के अनपसार प्रजतवर् ग संिोधन के अध् यधीन ह।ै 4. राजमागग खंड पर बएल यात्रा क के जलए जनम्न जलजखत दरों पर पास जारी दकए जाएंग,े अथागत्- ताजलका 4 सदं ेय राजि अनज्ञप ात एकतरफा यात्रा क की वधै ता अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए िल्प क का डे़ दो भपगतान के समय से चौबीस घंटे गपना पचास एकल यात्रा क के जलए संदेय पचास भपगतान की तारीख से एक मास िपल् क की राजि का दो-जतहाई 5. फीस प् लाजा जस्ट्थ त होन े वाल े जजल े म ें पंजीकृत वाजणजज्य क वाहनों (रा्‍र ीय परजमट के अधीन प्रचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते प जनधागररत दर की 50% होगी, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई स्वस रोड या वैकजल् पक सड़क उपलब् ध न हों । 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्दद्‍ ट अनपज्ञेय भार से अजधक भार लद े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय राजमागग पर अजतभार लदे वाहन के प्रवेि के जलए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, उ‍त जनयमों के जनयम 10 के उप-जनयम 1ए म ें जवजनर्दद्‍ ट फीस के समतपल् य फीस का भपगतान करन े के जलए उत् तरदायी होगा और वह राजमाग ग खडं का प्रयोग करन े के जलए तब तक हकदार नह होगा जब तक ऐसे यांजत्रक वाहन से लदा अजतभार हटाया नह जाता। 7. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनपज्ञेय भार, छूट प्राप् त वाहनों की श्रेणी, स्वस रोड, वैकजल् पक सड़क इत् यादद उ‍त जनयमों में जवजनर्दद्‍ ट पररभार्ा क के अनरूप प होंगी । 8. फीस की दरें उक्त जनयमों के जनयम 12 के अनपसरण म ेंप्रयो‍त ा क के सूचनाथग प्रद्ित करनी होंगी । 9. यांजत्रक वाहनों से फीस की वास्ट् तजवक राजि उपयपग‍ त ताजलका-1 में यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा खडं की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उ‍त जनयमों के जनयम 5 के अनपसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनपसार उसे अंग्रेजी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया जाएगा । 10. पररयोजना की अनपमाजनत पूंजीगत लागत 267.776 करोड़ रू. ह ै । [भूजम अजधग्रहण, सावगजजनक जन सपजवधा क के स्ट् थानांतरण, पड़े ों को काटने आदद कायगकलापों को अभी परू ा दकया जाना ह ै इसजलए, पूंजीगत लागत पररवतनग के अध् यधीन ह ै और अंजतम पूंजीगत लागत को पथृ क रूप स े अजधसूजचत दकया जाएगा]। भारतीय राष्ट्रीय राजमाग ग प्राजधकरण द्वारा प्रयो‍त ा क से वसूल दकए गए िल्प क के जररए पूंजीगत लागत की वसलू ी हो जाने के पश् चात,् लगाए जाने वाले िल्प क की दरों को घटाकर 40% कर ददया जाएगा और उ‍त जनयमों के अनपसार इसमें वा्र्क तौर पर संिोधन दकया जाएगा। [फा. सं. आरडब् ल् य/ूएनएच/12014/1074/2016/पीबी/एनएच-1/जोन-II (पाटग)] जप्रयांक भारती, संयप‍ त सजचव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd November, 2020 S.O. 4181(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways (number S.O. 2334(E) dated the 25th August 2015 issued under Section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch of National Highway No. 254 in the state of Punjab to State Government of Punjab; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 at 100% of the base rate for net road section length of 6.102 km (for the use of four and more lane section) and at 60% of base rate for net road length of 43.2316 km and for equivalent structure length (having length more than 60m) of 5.664 km (having length of 0.5664 km) for the use of two lane with paved shoulders on the type of vehicles specified in column (1) of the Table 1 below of Rampura-Maur-Talwandi-Raman Mandi section from design kilometer 82.400 to kilometer 132.300 (existing km 82.400 to km 132.300) of National Highway number 254 in the State of Punjab and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Base rate of fee per km for the Type of vehicle base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle (MAV) (four to six 3.45 axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 275.00 (Rupees Two Hundred Seventy-Five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table 4 Maximum number of one way Amount Payable Period of validity journeys allowed One and half times of the fee for one way Twenty four hours from the Two journey time of payment Two-third of amount of the fee payable One month from date of Fifty for fifty single journeys. payment 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 267.776 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
