अजधसचू ना नई दिल्ली, 3 अगस्ट्त , 2020 का. आ. 2594(अ).—केन्द्रीय सरकार न े पेरोजलयम और खजनि पाईपलाईन (भूजम म ें उपयोग के अजधकार का अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना सख्ं या का.आ. 3073(अ) तारीख 20 अगस्ट्त 2019, िो भारत के रािपत्र तारीख 27 अगस्ट्त 2019, में प्रकाजित की गई थी द्वारा उस अजधसूचना स े संलग्न अनुसूची में जिजनर्िष्ट भज भूजम म ें कणकाका राय य म ें ”इरुगुर - िेिनगुंथी पाइपलाइन पररयोिना” के अन्द्तगजत पेरोजलयम पररिहन के जलए भारत पेरोजलयम ककपोरिन जलजमाेड (बीपीसीएल) द्वारा पाईपलाईन जबछान े के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपन े आिय की घोषणा की थी ; और उक्त रािपत्र अजधसूचना संख्या का.आ. 3073(अ) तारीख 27 अगस्ट्त 2019, की सूचना संबजधत भु-स्ट्िा जमयों को तारीख 22 निम्बर 2019 तक उपलब्ध करा िी गई थी ; और सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोा ज ि े िी ह ै; 3515 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और केन्द्रीय सरकार ने, उक्त ररपोाज पर जिचार करन े के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम पाईपलाईन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह ै; अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक इस अजधसूचना से संलग्न अनुसूची में जिजनर्िष्ट भज भूजम में पाईपलाईन जबछाने के जलए उपयोग के अजधकार का अिजन दकया िाए ; No. 3073 dated the 20th August, 2019, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (here in after referred to as the said Act), published in the Gazette of India dated the 27th August, 2019, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying a Pipeline “Irugur –[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 Devangonthi” for the transportation of Petroleum Products in the state of Karnataka by Bharat Petroleum Corporation Limited; And whereas copies of the said Gazette notification vide S.O. No. 3073 dated the 20th August, 2019, were made available to the concerned land owner by 22nd November, 2019; And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government; And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Bharat Petroleum Corporation Limited, free from all encumbrances. Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
