और उक्त रािपत्र अजधसूचना की सूचना संबंजधत भू-स्ट्वाजमयों को तारीख 15 जसतम्बर 2020 तक उपलब्ध करा
िी गई थी और अरूण कुमार झा पटना, जबहार ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार

अतः अब केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए
यह घोषणा करती ह ै दक इस अजधसूचना से संलग्न अनुसूची में जवजनर्िष्टज भूजम में पाइपलाइन जबछाने के जलए उपयोग के
अजधकार का अिजन दकया िाए ;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह
जनिेि िेती ह ै दक उक्त भूजम म ेंउपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार म ें जनजहत होन े के
बिाए, सभी जवल्लंगमों से मक्तु होकर इंजडयन ऑयल कापोरेिन जलजमटेड म ेंजनजहत होगी;
पेरोजलयम ओर खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी िजतपूर्तज के जलए
इंजडयन ऑयल कापोरेिन जलजमटेड पूणतज या उतरिायी होगी और पाइपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय

NOTIFICATION
New Delhi, the 10th November, 2020
S.O. 4051(E).—Whereas by the notification of the Government of India in the Ministry of
Petroleum and Natural Gas S.O. No. 1567(E) dated 21st May , 2020, issued under sub-section (1) of
section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of
1962), (hereinafter referred to as the said Act), published in the Gazette of India dated the 21st May, 2020
the Central Government declared its intention to acquire the right of user in the land specified in the
Schedule appended to that notification for the purpose of laying ‘ Proposed Augmentation of Paradip-
Haldia-Durgapur LPG Pipeline and its extension up to Patna and Muzaffarpur’ for the transportation of
L.P.G Product in Circle- Munger & Jamalpur District. Munger in the State of Bihar by Indian Oil
Corporation Limited; And whereas copies of the said Gazette notification were made available to the
Concerned land owner by 15th September 2020.
And whereas Shri Arun Kumar Jha, Competent Authority, Patna (Bihar) has under sub-section (1)
of section 6 of the said Act submitted report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that
the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore,
in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government
hereby declares that the right of user in the land specified in the Schedule appended to this notification is
hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the
Central Government hereby directs that the right of user in the said land for laying the pipeline shall,
instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian
Oil Corporation Limited, free from all encumbrances.

इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा पाइपलाइन जबछान े के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने
आिय की घोषणा की थी ;

And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act

the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,

NOTIFICATION
New Delhi, the 10th November, 2020
S.O. 4053(E).— Whereas, it appears to the Central Government that it is necessary in the public
interest that a pipeline should be laid by the Indian Oil Corporation Limited in Anchals- Barauni and
Mansurchak of Begusarai district in the State of Bihar for ‘Augmentation of Paradip-Haldia-Durgapur
LPG pipeline and its extension upto Patna and Muzaffarpur’ for the transportation of LPG Product;
And whereas, it appears to the Central Government that for the purpose of laying such pipeline, it
is necessary to acquire the right of user in land under which the said pipeline is proposed to be laid and
which is described in the Schedule annexed hereto;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum
and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central
Government hereby declares its intention to acquire the right of user therein;
Any person interested in the land described in the said schedule may, within twenty one days from
the date on which copies of the Gazette of India containing this notification are made available to the
general public, object in writing to the acquisition of the right of user therein for laying of the pipeline
under the land to Shri. Bhubneshwar Mishra, Additional Secretary (Retd.), Govt. of Bihar & Competent
Authority, Indian Oil Corporation Limited, Pipeline Division Barauni Construction Office, BKPL Head
Quarter, Post- Barauni Oil Refinery, District – Begusarai, Bihar – 851114.

अिजन) अजधजनयम 1962 (1962 का 50) ( जिसे इसम ेंइसके पश्चात उक्त अजधजनयम कहा गया ह)ैं की धारा 3 की उपधारा
(1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ.
3069(अ) तारीख 8 जसतम्बर 2020] िो भारत के रािपत्र तारीख 9 जसतम्बर 2020 में प्रकाजित की गई थी द्वारा उस
अजधसूचना से संलग्न अनुसूची में जवजनर्िष्टज भूजम में जबहार राज्य में पारािीप हल्िीया-िगु ाजपुर पाइपलाइन संबर्द्नज
पररयोिना हते ु अंचल- अमरपरु ] रिौन जिला- बााँका एव ं अंचल-िहकुण्ड जिला- भागलपरु राज्य-जबहार में पेरोजलयम
पररवहन के जलए इंजडयन ऑयल कापोरेिन जलजमटेड द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के
अिजन के अपने आिय की घोषणा की थी ;
और उक्त रािपत्र अजधसूचना की सूचना संबंजधत भू-स्ट्वाजमयों को तारीख 15 जसतम्बर 2020 तक उपलब्ध करा
िी गई थी और अरूण कुमार झा पटना, जबहार ने उक्त अजधजनयम की धारा 6 की उपधारा ¼1½ के अधीन केन्द्रीय सरकार को
ररपोटज िे िी ह ै ( और केन्द्रीय सरकार ने उक्त ररपोटज पर जवचार करने के पश्चात ्और यह समाधान हो िाने पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजित ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ।
अतः अब केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा ¼1½ द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह
घोषणा करती ह ै दक इस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िष्टज भूजम म ें पाइपलाइन जबछाने के जलए उपयोग के

और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा ¼4½ द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह
जनिेि िेती ह ै दक उक्त भूजम म ेंउपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार म ें जनजहत होन े के
बिाए, सभी जवल्लंगमों से मक्तु होकर इंजडयन ऑयल कापोरेिन जलजमटेड म ेंजनजहत होगी ।
पेरोजलयम ओर खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी िजतपूर्तज के जलए इंजडयन
ऑयल कापोरेिन जलजमटेड पूणतज या उतरिायी होगी और पाइपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जवरुर्द् कोई वाि िावा या काननू ी कायजवाही नहीं हो सकेगी ।

NOTIFICATION

S.O. 4054(E).— Whereas by the notification of the Government of India in the Ministry of
Petroleum and Natural Gas S.O. No. 3069 (E) dated 8th September , 2020, issued under sub-section (1) of
section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of
1962), (hereinafter referred to as the said Act), published in the Gazette of India dated the 09th September,
2020 the Central Government declared its intention to acquire the right of user in the land specified in the[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15
Schedule appended to that notification for the purpose of laying ‘ Proposed Augmentation of Paradip-
Haldia-Durgapur LPG Pipeline and its extension up to Patna and Muzaffarpur’ for the transportation of
L.P.G Product in Circle- Amarpur, Rajaun District- Banka & Circle- Sahkund District- Bhagalpur in the
State of Bihar by Indian Oil Corporation Limited;
And whereas copies of the said Gazette notification were made available to the Concerned land
owner by 15th September 2020.
And whereas Shri Arun Kumar Jha, Competent Authority, Patna (Bihar) has under sub-section (1)
of section 6 of the said Act submitted report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that
the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,
the Central Government hereby declares that the right of user in the land specified in the Schedule
appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the
Central Government hereby directs that the right of user in the said land for laying the pipeline shall,
instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian
Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section
10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central
Government on any matter relating to the pipeline.
