पाइपलाइन जिछाने के प्रायोजन के जलये उपयोग के अजधकार के अजजन करने के जलए अपने आिय की घोषणा की थी।
और उक्त राजपत्र अजधसूचना की प्रजतयां जनता को उपलब्ध करा दी गयी थी और उक्त अजधजनयम की धारा 6 की
उपधारा (1) के अनुसरण में सक्षम प्राजधकारी ने केंन्द्रीय सरकार को अपनी ररपोटज द ेदी ह।ै
और केंरीय सरकार ने, उक्त ररपोटज पर जिचार करने के पश्चात और यह समाधान हो जाने पर दक उक्त भूजम
पाइपलाइन जिछाने के जलये अपेजक्षत है, उसमे उपयोग के अजधकार का अजजन करने का जिजनश्चय दकया ह।ैं

अत: अि केंरीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रदत्त िजक्तयो का प्रयोग करते हुये
एतद ् द्वारा घोषणा करती ह ै दक इस अजधसूचना से संलग्न अनुसूची मे जिजनर्ददष्ट भूजम मे पाइप लाइन जिछाने के जलये
उपयोग के अजधकार का अजजन दकया जाये।
और केंरीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रदत्त िजक्तयो का प्रयोग करते हुए, यह
जनदिे दते ी ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केंरीय सरकार मे जनजहत होने के
िजाय, सभी जिल्लंगमो से मुक्त होकर इंजडयन ऑयल कापोरेिन जलजमटेड मे जनजहत होगी।
पेरोजलयम और खजनज पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्मत के जलये इंजडयन
ऑयल कापोरेिन जलजमटेड पूणजतया उत्तरदायी होगी और पाइपलाइन से सम्िंजधत दकसी भी मामले पर केंरीय सरकार के
जिरुद्ध कोई िाद दािा या कानूनी कायजिाही नही हो सकेगी ।

NOTIFICATION
New Delhi, the 17th August, 2021
S.O. 3361(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas, published in the Gazette of India No. 2432 Part II, Section 3, Sub-section(ii) dated the 30th June, 2021,
vide S.O No. 2623(E), dated the 18th June, 2021, issued under sub section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land ) Act, 1962 (50 of 1962) (hereinafter referred to as the said
Act) , the Central Government declared its intention to acquire the right of user in the land specified in the schedule
appended to that notification for the purpose of laying pipeline from Tundla Terminal to Kanpur Terminal in the State
of Uttar Pradesh by Indian Oil Corporation Limited for the transportation of petroleum products;
And whereas copies of said Gazette notification were made available to the public; and whereas the
competent Authority has under sub-section (1) of section 6 of the said act, has submitted report to the Central
Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation limited, free from all
encumbrances.
Indian Oil Corporation limited shall be exclusively liable for any compensation in terms of section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceedings would lie against the Central Government on any matter
relating to the pipeline.

Act) , the Central Government declared its intention to acquire the right of user in the land specified in the schedule
appended to that notification for the purpose of laying pipeline from Tundla Terminal to Kanpur Terminal in the state
of Uttar Pradesh by Indian Oil Corporation Limited for the transportation of petroleum products;
And whereas copies of said Gazette notification were made available to the public; and whereas the
competent Authority has under sub-section (1) of section 6 of the said act, has submitted report to the Central
Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation limited, free from all
encumbrances.
Indian Oil Corporation limited shall be exclusively liable for any compensation in terms of section 10 of the

land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation limited, free from all
encumbrances.
Indian Oil Corporation limited shall be exclusively liable for any compensation in terms of section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceedings would lie against the Central Government on any matter
relating to the pipeline.
