अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की
उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या
का.आ. 1329 तारीख 11 िुलाई, 2019, िो भारत के रािपत्र संख्या 30 तारीख 21-27 िुलाई 2019, म ें
प्रकाजित की गई थी, द्वारा उस अजधसूचना स े संलग्न अनुसचू ी म ें जवजनर्दिष्ट भूजम म ें ओजडिा राज्य म ें “पारािीप -
सोमनाथपुर - हल्िीआ प्रााँडक्ट पाइपलाईन पाररयोिना”, तहसील- बालासोर, जिला-बालासोर म ें उत् पाि पररवहन
के जलए इंजडयन आयल कॉपोरेिन जलजमटेड द्वारा पाइपलाइन जबछान े के प्रयोिन के जलए उपयोग के अजधकार के
अिजन के अपने आिय की घोषणा की थी:
और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 13.09.2019 तक उपलब्ध करा िी गई थीं,
और सक्षम प्राजधकारी न े उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केंद्रीय सरकार को ररपोट ज ि े िी

और केंद्रीय सरकार न,े उक्त ररपोट ज पर जवचार करन े के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम

अतः अब, केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए
यह घोषणा करती ह ै की इस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्दिष्ट भूजम म ें पाइपलाइन जबछाने के जलए उपयोग
के अजधकार का अिजन दकया िाए;
और केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती ह ै दक उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केंद्रीय सरकार म ें जनजहत
होने के बिाए, सभी जवल्लगं मो से मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड म ेंजनजहत होगी;
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तत के जलए
इंजडयन ऑयल कॉपोरेिन जलजमटेड पणू जतया उत्तरिायी होगी और पाइपलाइन स े सम्बंजधत दकसी भी मामले पर
केंद्रीय सरकार के जवरुद्ध कोई िावा या कानूनी कायजवाही नहीं हो सकेगी

NOTIFICATION
New Delhi, the 23rd January, 2020
S.O. 378(E).—Whereas by the notification of the Government of India in the Ministry of
Petroleum and Natural Gas No. S.O. 1329 dated 11th July, 2019, issued under sub-section (1) of
section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962
(50 of 1962), (hereinafter referred to as the said Act), published in the Gazette No. 30 on 21st to
27th July, 2019, Part-II, Section 3, Sub Section (ii), the Central Government declared its intention to
acquire the right of user in the land specified in the Schedule appended to that notification for the
purpose of laying “Paradip-Somnathpur-Haldia Product Pipeline”, for the transportation of Petroleum
Products in Balasore Tehsil of Balasore District in the state of Odisha by Indian Oil Corporation
Limited;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
And whereas copies of the said Gazette notification were made available to the public up to
13.09. 2019;
And whereas the competent authority has under sub-section (1) of section 6 of the said Act
submitted report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied
that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said
Act, the Central Government hereby declares that the right of user in the land specified in the
Schedule appended to this notification is hereby acquired for laying the pipeline.
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act,
the Central Government hereby directs that the right of user in the said land for laying the pipeline
shall, instead of vesting in the Central Government, vest on the date of publication of the declaration,
in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of
Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the
Central Government on any matter relating to the pipeline.
