Executive Summary & Key Takeaways

Executive Summary: This notification concerns toll fees for the Jhansi-Orai section of National Highway 25 (New NH 27) in Uttar Pradesh. It authorizes Prakash Asphaltings and Toll Highways India Limited to collect fees. The notification specifies rates, exemptions, and conditions for toll collection, effective from the commercial operation date (estimated as September 10, 2016) or the date of publication, whichever is later, until the agreement's termination date. Key Points / Main Content: Toll Authorization and Applicability: * Authorizes Prakash Asphaltings and Toll Highways India Limited to collect toll fees on the Jhansi-Orai section (Km 90.300 to Km 225.713) of NH-25 (New NH-27). * Applies to mechanical vehicles using the four-lane section. * Toll collection starts from the declared Commercial Operation Date (COD) by the Authority or the publication date of the notification, whichever is later, until the agreement's termination. Fee Structure: * Base toll rates are defined per vehicle type based on the year 2007-08. * Additional fees apply to bypasses costing more than Rs 10 crore, charged at 1.5 times the base rate. * Fees are also applicable for structures longer than 60 meters, calculated by converting the structure's length into an equivalent road length using an equalization factor of 10. * Specific toll plazas (Km 140.400 near Semri village and Km 187.500 near AIT village) have designated tollable sections and lengths. Exemptions and Discounts: * Monthly passes are available for non-commercial vehicles registered to individuals residing within 20 km of the toll plaza at a rate of Rs. 235.00 for the year 2016-17, subject to annual revision. * Commercial vehicles registered in the district where the toll plaza is located, excluding those with national permits, are subject to 50% of the prescribed fee, provided no alternative service road is available. Overloaded Vehicles: * Vehicles exceeding permissible load limits are not allowed to use the highway until the excess load is removed. * Overloaded vehicles are subject to a penalty of ten times the applicable toll fee. Other Provisions: * Definitions of vehicle categories, permissible loads, exempted vehicles, and alternative roads are as specified in the Rules. * Toll rates must be displayed for user information. * Actual toll amounts and discounts will be calculated by the Authority and published in English and local language newspapers. * Toll rates are subject to annual revision, with a minimum gap of six months between revisions. Financial Aspects: * The project's capital cost to be recovered from the COD (estimated September 10, 2016) is Rs. 910.62 Crore. * After the capital cost is recovered, the user fee will be reduced to 40% of the charged rates. * The capital cost may be reworked if the COD is advanced or postponed by up to 90 days. Impact Analysis: National Highways Authority of India (NHAI): * Impact: Responsible for calculating actual toll amounts and discounts and publishing them. Also responsible for declaring the Commercial Operation Date (COD). * Action Required: Calculate and publish toll amounts, declare COD, and ensure compliance with toll collection rules. Prakash Asphaltings and Toll Highways India Limited (Concessionaire): * Impact: Authorized to collect and retain toll fees. Responsible for operating and maintaining the Jhansi-Orai section. * Action Required: Collect toll fees according to the specified rates and rules, operate and maintain the highway section, and comply with the agreement terms. Highway Users: * Impact: Subject to toll fees for using the Jhansi-Orai section of NH-25 (New NH-27). Toll rates vary based on vehicle type and distance traveled. * Action Required: Pay applicable toll fees, adhere to load restrictions, and be aware of available exemptions and discounts. Residents Near Toll Plazas: * Impact: Eligible for monthly passes at a discounted rate if residing within 20 km of the toll plaza and owning a non-commercial vehicle. * Action Required: Apply for monthly passes to avail of discounted toll rates.
