अजधजनयम, 1962 (1962 का 50) ( जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया ह ै ) की धारा 3 की उपधारा (1)
के अधीन िारी की गई भारत सरकार के पेरोजलयम एव ं प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 4238(अ)
तारीख 19 नवम्बर, 2020, िो भारत के असाधारण रािपत्र तारीख 26 नवम्बर, 2020, में प्रकाजित की गई थी, द्वारा
उस अजधसूचना से संलग्न अनुसचू ी में जवजनर्िष्टज भूजम में झारखण्ड राज्य के बोकारो एवं रामगढ़ जिले में कोल बेड जमथेन गसै
के पररवहन के जलए ऑयल एण्ड नेचरु ल गैस कॉरपोरेिन जलजमटेड के द्वारा पाईपलाइन जबछाने के प्रयोिन के जलए उपयोग
के अजधकार का अिजन के अपन ेआिय की घोषणा की थी;
और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 14 दिसम्बर 2020, तक उपलब्ध करा िी गई थी ;
और सक्षम प्राजधकार न,े उक्त अजधजनयम की धारा 6 की उपधारा(1) के अधीन केन्द्र सरकार को ररपोटज ि े िी ह ै;
और केन्द्र सरकार न,े उक्त ररपोटज पर जवचार करन े के पश्चात, और यह समाधान हो िाने पर दक उक्त भूजम
पाईपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ;
अतः अब, केन्द्र सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए,
यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जवजनर्िष्टज भूजम म ें पाईपलाइन जबछान े के जलए उपयोग के
अजधकार का अिजन दकया िाए ;

और केन्द्र सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्र सरकार म ें जनजहत होन े के
बिाए, सभी जवल्लंगमों से मक्तु होकर ऑयल एण्ड नेचुरल गैस कॉरपोरेिन जलजमटेड म ेंजनजहत होगा ।
पेरोजलयम और खजनि पाईपलाइन अजधजनयम, 1962 की धारा 10 के अध्यधीन दकसी भी क्षजतपूर्त ज के जलए
ऑयल एण्ड नेचरु ल गैस कॉरपोरेिन जलजमटेड पणू जतया उत्तरिायी होगी और पाईपलाइन स े सम्बजन्द्धत दकसी भी मामले पर

NOTIFICATION
New Delhi, the 13th January, 2021
S.O. 191(E).—Whereas by the notification of the Government of India, Ministry of Petroleum and Natural
Gas S.O. No. 4238(E) dated the 19th November, 2020, issued under sub-section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said
Act), published in the Extraordinary Gazette of India dated the 26st November, 2020, the Central Government declared
its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the
purpose of laying pipeline for the transportation of Coal Bed Methane (CBM) Gas by Oil and Natural Gas Corporation
Limited ;
And whereas copies of the said Gazette notification were made available to the public up to 14th
December,2020;
And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Oil and Natural Gas Corporation Limited,
free from all encumbrances.
Oil and Natural Gas Corporation Limited shall be exclusively liable for any compensation in terms of Section
10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any
matter relating to the pipeline.
