की धारा 3 की ईपधारा (1) के ऄधीन जारी की गइ, भारत सरकार के पेरोजलयम और प्राकृजतक गसै मंत्रालय की
ऄजधसूचना संख्या का॰ अ॰ 3897(ऄ), तारीख 28 ऄक्टूबर 2020, भारत के राजपत्र सं० 3438 – तारीख 29
ऄक्टूबर 2020, म ें प्रकाजित की गइ थी, आस ऄजधसचू ना से संलग्न ऄनसु ूची में जिजनर्ददष्ट भूजम में ईत्तर प्रदिे राज्य
में “कांडला-गोरखपुर एल.पी.जी गैस पाआपलाआन पररयोजना हते ु तहसील ज्ञानपुर, जजला भदोही, राज्य ईत्तर
प्रदिे म ें एल.पी.जी गैस के पररिहन हते ु अइ.एच.बी. प्राइिेट जलजमटेड द्वारा पाआपलाआन जबछाने के प्रयोजन के
जलए ईपयोग के ऄजधकार के ऄजजन के ऄपने अिय की घोषणा की थी।
और ईक्त राजपत्र ऄजधसचू ना की सूचना संबजन्द्धत भू-स्ट्िाजमयों को तारीख 17 जनिरी 2021 तक
ईपलब्ध करा दी गइ थी,
और सक्षम प्राजधकारी ने ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार को
ररपोटज द े दी ह,ै
और केन्द्रीय सरकार ने, ईक्त ररपोटज पर जिचार करने के पश्चात और यह समाधान हो जाने पर दक ईक्त
भूजम पाआपलाआन जबछान े के जलए ऄपेजक्षत ह,ै ईसमे ईपयोग के ऄजधकार के ऄजजन करने का जिजनश्चय दकया ह;ै

करते हुए एतद ् द्वारा यह घोषणा करती ह ै दक आस ऄजधसूचना से संलग्न ऄनुसूची म ें जिजनर्ददष्ट भूजम में पाआपलाआन
जबछाने के जलए ईपयोग के ऄजधकार का ऄजजन दकया जाए,

और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत्त िजक्तयों का प्रयोग करते
हुए, यह जनदिे दते ी ह ै दक ईक्त भूजम म ें ईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख से केन्द्रीय
सरकार में जनजहत होने के बजाए, सभी जिल्लंगमो स े मक्तु होकर अइ.एच.बी. प्राइिेट जलजमटेड में जनजहत होगा,
पेरोजलयम और खजनज पाआपलाआन ऄजधजनयम,1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के
जलए अइ.एच.बी. प्राइिेट जलजमटेड पणू जतया ईत्तरदायी होगा और पाआपलाआन से संबजन्द्धत दकसी भी मामल े पर
केन्द्रीय सरकार के जिरुद्ध कोइ दािा या कानूनी कायजिाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 28th July, 2021
S.O. 3124(E).—Whereas by the notification of The Government of the India in the Ministry of
Petroleum and Natural Gas S. O. No 3897 (E) Dated 28 October 2020 published in the Gazette No. 3438
dated 29 October 2020 and under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines
(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the
Central Government declared its intention to acquire the right of user in the land specified in the Schedule
appended to that notification for the purpose of laying “Kandla-Gorakhpur LPG Gas Pipeline Project” for
the transportation of LPG Gas Pipeline in tehsil Gyanpur, District Bhadohi in the state of Uttar Pradesh by
IHB Private Limited.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
And whereas copies of the said Gazette notification were made available to the public up to 17
January-2021.
And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act
submitted his report to the Central Government.
And whereas the Central Government, after considering the said report and on being satisfied that
the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,
the Central Government hereby declares that the right of user in the land specified in the Schedule
appended to this notification is hereby acquired for laying the pipeline.
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the
Central Government hereby directs that the right of user in the said land for laying the pipeline shall instead
of vesting in the Central Government, vest on the date of publication of the declaration in IHB Private
Limited, free from all encumbrances.
IHB Private Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would be against the Central Government on any
matter relating to the pipeline.
