(1) के ऄधीन जारी की गइ भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की ऄजधसूचना संख्या
का. अ. 3421(ऄ), ददनांक 28 जसतम्बर, 2020, भारत के राजपत्र सं. 3042, ददनांक 30 जसतम्बर, 2020 में प्रकाजित
की गइ थी। आस ऄजधसूचना से संलग्न ऄनुसूची में जिनीर्ददष्ट भूजम में गुजरात राज्य में “कांडला-गोरखपुर पाआपलाआन
पाररयोजना” के ऄंतगजत तालुका घोघंबा, जजला पंचमहाल में पेरोजलयम पदाथ ज के पररिहन हते ु अइ॰एच॰बी॰ प्राआिेट
जलजमटेड द्वारा पाआपलाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार के ऄजजन के ऄपने अिय की घोषणा की थी ;
और ईक्त राजपत्र ऄजधसूचना की सूचना संबजन्द्धत भू-स्ट्िाजमयों को ददनांक 05 निम्बर, 2020 तक ईपलब्ध करा
दी गइ थी;
और सक्षम प्राजधकारी ने ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार को ररपोटज द े दी
ह;ै
और केन्द्रीय सरकार ने, ईक्त ररपोटज पर जिचार करने के पश्चात और यह समाधान हो जान े पर दक ईक्त भूजम

ऄतः ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए
यह घोषणा करती ह ै की आस ऄजधसूचना से संलग्न ऄनुसूची में जिनीर्ददष्ट भूजम में पाआपलाआन जबछाने के जलए ईपयोग के
ऄजधकार का ऄजजन दकया जाए;
और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए, यह
जनदिे दते ी ह ै दक ईक्त भूजम में ईपयोग के ऄजधकार आस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होन े के
बजाए, सभी जिल्लंगमों से मुक्त होकर अइ॰एच॰बी॰ प्राआिेट जलजमटेड में जनजहत होगी;
पेरोजलयम और खजनज पाआपलाआंन ऄजधजनयम,1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए
अइ॰एच॰बी॰ प्राआिेट जलजमटेड पूणजतया ईत्तरदाइ होगा और पाआपलाआन से संबजन्द्धत दकसी भी मामल े पर केन्द्रीय सरकार

NOTIFICATION
New Delhi, the 6th August, 2021
S.O. 3294(E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum and
Natural Gas S. O. No. 3421(E), dated 28 September, 2020, published in the Gazette of the India No-3042 dated 30
September, 2020, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of
Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government
declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for
the purpose of laying “Kandla-Gorakhpur Pipeline Project” for the transportation of LPG in tehsil Ghoghamba,
District Panchmahal in the state of Gujarat by IHB Private Limited.
And whereas copies of the said Gazette notification were made available to the public up to 05 November,

And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government;
And whereas the central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in IHB Private Limited, free from all
encumbrances.
IHB Private Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP
Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to
the pipeline.
