L.-33004/99 xxxGIDHxxx सी.जी.-डी.एल.-अ.-27012020-215713 xxxGIDExxx CG-DL-E-27012020-215713 असाधारण EXTRAORDINARY भाग I—खण्ड 3—उप-खण्ड (i) PART I—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 45] नई ददल्ली, िुक्रवार, जनवरी 24, 2020/माघ 4, 1941 No. 45] NEW DELHI, FRIDAY, JANUARY 24, 2020/MAGHA 4, 1941 पयावा रण, वन और जलवाय ुपररवतना मत्रं ालय अजधसचू ना नई ददल् ली, 24 जनवरी, 2020 सा.का.जन. 48(अ).—कजतपय प्ररुप जनयम, अथाात् पयाावरण (संरक्षण) संिोधन जनयम, 2018 भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की अजधसूचना संख यांक 1064(अ), तारीख 24 अक् तूबर, 2018 द्वारा पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उप-जनयम (3) के अधीन यथाअपेजक्षत भारत के राजपत्र, असाधारण में प्रकाजित दकए गए थे, उन सभी व य् जक् तयों से, जजनके उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जजसको उक् त अजधसूचना से युक् त राजपत्र की प्रजतयां जनता को उपलब् ध करा दी गई थीं, साठ ददन की अवजध की समाज‍त के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और उपयुाक् त अजधसूचना से युक् त राजपत्र की प्रजतयां तारीख 25 अक् तूबर, 2018 को जनता को उपलब् ध करा दी गईं थी; और उपयुाक् त अजधसूचना के उत् तर में सभी व् यजक्त यों और पणधाररयों से प्रा‍त आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा सम् यक रुप से जवचार कर जलया गया ह ै। अत: अब केंद्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उप-जनयम (3) के साथ परठत पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 6 और धारा 25 द्वार प्रदत् त िजक् तयों का प्रयोग करते हुए, पयाावरण (संरक्षण) जनयम, 1986 का और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती ह,ै अथाात् :- 1. सजं क्ष‍त नाम और प्रारंभ – (1) इन जनयमों का संजक्ष‍त नाम पयाावरण (संरक्षण) तीसरा संिोधन जनयम, 2019 ह ै। (2) ये राजपत्र में उनके प्रकािन की तारीख को प्रवृत् त होंगे । 458 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. पयाावरण (संरक्षण) जनयम, 1986 की अनुसूची 1 में क्रमसंख यांक 35 और उससे संबंजधत प्रजवज‍ ियों के स्ट् थान पर जनम् नजलजखत क्रम संख यांक और प्रजवज‍ ियां रखी जाएंगी, अथाात्:- क्रम स.ं उद्योग मानदंड मानक 1. 2. 3. 4. ''35 कॉफी उद्योग तत्क ालुि‍ु क प्रसस्ट्ं करण सांद्रण के जलए सीमांत मान, पीएच को छोड़कर जम.ग्रा.ुली. में पी एच 6.5-8.5 बीओडी 3ददन 270 से. 100 (ससचाई के जलए भूजम पर छोड़ने हते ु) नमुचमा पत्र कॉफी प्रसंस्ट् करण पी एच 6.5-8.5 बीओडी 3ददन 270 से. क. रेजखत लैगून में भंडारण 1000 के जलए ख. ससचाई के जलए भूजम पर छोड़ने हते ु 100 रि‍प ण – (i) कच् चे, उपचाररत औरुया मंददत जनस्ट् सारी दक‍ह ीं पररजस्ट् थजतयों के अधीन, चाह े जो भी हो, सतह जल जनकाय में नहीं छोड़ा जाएगा या भू जल को ररचाजा करने के जलए प्रयुक् त नहीं दकया जाएगा । (ii) अपारगम् य रेजखत प्रणाली का जनमााण अच् छी तरह से रेणेणीकृत, उच्च अपारगम् य जम्ी या जजओससथेरिक रेखीय, जजओससथेरिक रेजखत जम्ी (जीसीएल) के रुप में उच् च घनत् व पॉलीएजथलीन (एचडीपीई) या दोनों के संयोजन से दकया जाएगा और 1X10-7 से.मी.ुसे. से कम की पारगम् यता के अपने मूल स्ट् थान को प्रा‍त करेगा । सघन रेजखत जम्ी की न् यूनतम मोिाई 300 जममी. (या दो सघन परतें प्रत् येक की ‍यूनतम मोिाई 150 जममी.) होनी चाजहए । यह सुजनज‍ चत करने हते ु पूणा रेजखत का परीक्षण दकया जाना चाजहए दक यह पारगम् यता मानदडं ों को पूरा करता है । (iii) जनस्ट् सारण भंडारण की सुजवधाएंुलैगूनुस्या वा‍ पीकरण कुंड जन:िुल् क बोडा के साथ नीचे उजल् लजखत धारा, नाला, आदद के जनकि उच् च बा़ स्ट् तर जच‍ ह के ऊपर जस्ट् थत होगा और दरू ी पर जस्ट्थत जल जनकायुधारा से दरू होगा । जन:िुल् क बोडा (सेमी) 60 दरू ी (मी) 100 (iv) जवजनदेि रेजखत प्रणाली और जवजनदेि लैगून को एक वर्ा में प्रा‍ त करना ह ै। [फा. सं. क् यू-15017/26/2007-सीपीडब् ल्य ]ू जजगमेत िक्पा, संयुक् त सजचव रि‍पण: मूल जनयम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में सा.का.जन. सं. 844(अ), तारीख 19 नवंबर, 1986 द्वारा प्रकाजित दकया गया था और अजधसूचना सं. सा.का.जन. 952(अ) तारीख 26 ददसम्ब र, 2019 द्वारा अंजतम बार संिोजधत दकया गया था। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 24th January, 2020 G.S.R. 48(E).—Whereas, certain draft rules, namely the Environment (Protection) Amendment Rules, 2018 were published in the Gazette of India, Extraordinary, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules,1986, vide notification of the Government of India in the Ministry ofभाग II खण् ड (i) भारत का राजपत्र : असाधारण 3 Environment, Forest and Climate Change vide number G.S.R. 1064(E), date the 24th October, 2018, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the dated on which copies of the Gazette containing the said notification were made available to the public; And Whereas, copies of the Gazette containing the aforesaid notification were made available to the public on the 25th October, 2018; And Whereas, objections and suggestions received from all persons and stakeholders in response to the aforesaid notification have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules further to amend the Environment (Protection) Rules, 1986, namely:- 1. Short title and commencement.-(1) These rules may be called the Environment (Protection) Third Amendment Rules, 2019. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Environment (Protection) Rules, 1986, in Schedule-l, for serial number 35 and entries relating thereto, the following serial number and entries shall be inserted, namely: - S.No. Industry Parameter Standards 1 2 3 4 ―35 Coffee Instant / Dry Processing Industry Limiting value for concentration in mg/I except for pH pH 6.5 – 8.5 BOD .27 0c 100 3days (for discharge on land for irrigation) Wet / Parchment Coffee Processing pH 6.5 – 8.5 BOD .27 0c 3days A. For storage in lined lagoons 1000 B. For discharge on land for irrigation 100 Note: (i) Raw, treated and / or diluted effluent shall not be discharged into surface water body or used for recharging ground water under any circumstances what so ever. (ii) The non-permeable lining system shall be constructed by using well graded, highly impervious clay or geosynthetic liners such as Geosynthetic Clay Liners (GCL), High-Density Polyethylene (HDPE) or a combination of both and shall achieve an in-situ coefficient of permeability of less than 1x10-7 cm/sec. The compacted clay liner must have a minimum thickness of 300 mm (or two compacted layers of 150 mm minimum thickness each). The finished lining must be tested to ensure that it meets the permeability criteria. (iii) The effluent storage facilities/lagoons/solar evaporation ponds shall be located above high flood level mark of the nearby stream, rivulet, etc. with below mentioned free board and away from any water body/stream at a distance.
