(िजसे एत!प#ात सबं D दशे भी कहा गया ह)ै के मूल के अथवा वहां से िनया3ितत "सोिडयम नाइFाइट" (िजसे एत!प#ात सबं D व)तु भी कहा गया ह)ै के आयातH के संबंध म(cid:6) पाटनरोधी जाँच शुJ क+ थी और 6 अ9ैल, 2000 क+ अिधसूचना सं. 39/1/99-डीजीएडी Cारा अनंितम पाटनरोधी श(cid:26)ु क लगाने क+ िसफा(cid:29)रश क+ थी। सीमाशु(cid:26)क अिधसूचना सं. 76/2000-सीमाशु(cid:26)क <दनांक 23 मई, 2000 Cारा चीन जन. गण. से सोिडयम नाइFाइट के अयातH पर मलू जाँच म(cid:6) अनंितम पाटनरोधी शु(cid:26)क लगाया गया था। 9ािधकारी Cारा 3 नव>बर, 2000 क+ अिधसूचना Cारा अंितम जाँच प(cid:29)रणाम अिधसूिचत <कए गय े और राज)व िवभाग ने <दनाकं 19 <दस>बर, 2000 क+ अिधसूचना सं. 147/2000-सीमाशु(cid:26)क Cारा संबD दशे से संबD व)त ु पर िन#याRमक 3769 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] पाटनरोधी शु(cid:26)क लगाया था। शु(cid:26)क को लागू करने क+ समय-समय पर समी2ा क+ गई ह ै और अंितम और दसू री िनणा3यक समी2ा के जाँच प(cid:29)रणाम <दनांक 30 जून, 2011 क+ अिधूसचना स.ं 15/4/2010-डीजीएडी Cारा जारी <कए गए थे और उनम(cid:6) संबD देश के मूल के अथवा वहां से िनया3ितत सबं D व)तु के अयातH पर पाटनरोधी शु(cid:26)क को जारी रखने क+ िसफा(cid:29)रश क+ गई। 9ािधकारी क+ िसफा(cid:29)रश के अनुसार के:S सरकार Cारा 17 अग)त, 2011 क+ अिधसूचना सं. 76/2011-सीमाशु(cid:26)क Cारा पाटनरोधी शु(cid:26)क लगाया गया था। दसू री म4याविध समी2ा यािचकाकता3 क+ ओर से पाटनरोधी शु(cid:26)क के Jप म(cid:6) वत3मान बच(cid:6) माक3 Jप से िनधा3(cid:29)रत Jप म(cid:6) प(cid:29)रवत3न करने और पाटनरोधी शु(cid:26)क क+ रािश म (cid:6) वृिD करने के अनुरोध पर क+ गई थी, 9ािधकारी न े <दनांक 15 अVूबर, 2014 क+ अिधसूचना सं. 15/2/2013-डीजीएडी Cारा पाटनरोधी शु(cid:26)क के Jप को बदलते 6ए अंितम जाँच प(cid:29)रणाम अिधसूिचत <कए गए थे। 2. यत: यािचकाकता3 ने अिधिनयम और िनयमावली के अनुसार 9ािधकारी के सम2 एक िविधवत Jप स े साXयां<कत यािचका दायर क+ ह ै िजसम(cid:6) चीन जन. गण. के मूल के अथवा वहां से िनया3ितत सबं D व)त ु के पाटन और घरेलू उZोग को 6ई प(cid:29)रणामी 2ित के जारी रहने या उसक+ पनु रावृित होन े क+ संभावना का आरोप लगाया ह ै और सबं D दशे के मूल क+ अथवा वहां से िनया3ितत सबं D व)तु के आयातH पर लागू पाटनरोधी शु(cid:26)क क+ समी2ा करने और उसे जारी रखने का अनुरोध <कया ह।ै शशशशााााििििममममलललल ददददेशेशेशेश 3. वत3मान िनणा3यक समी2ा जाचँ म(cid:6) संबD दशे चीन जन. गण. ह।ै ििििववववचचचचााााररररााााधधधधीीीीनननन उउउउ(cid:27)(cid:27)(cid:27)(cid:27)पपपपाााादददद औऔऔऔरररर ससससममममाााानननन वववव तततत ुु ुु 4. वत3मान जाँच म(cid:6) िवचाराधीन उRपाद "सोिडयम नाइFाइट" ह।ै "सोिडयम नाइFाइट" एक आ[सीकरण और (cid:29)र\ू]सग एज(cid:6)ट ह।ै यह एक सफेद <^)टलीय पाउडर ह ैिजसका 9योग अिधकांशत: भषे ज उZोगH, रँगाई उZोगH, लुि`क(cid:6)टस, िनमा3ण रसायनH, रबड़ bलो]वग एज(cid:6)ट, हीट Fांसफर सा(cid:26)ट, मांस 9स)ं करण, वcH आ<द म(cid:6) <कया जाता ह।ै संबD व)तु का उRपादन उR9ेरक क+ मौजूदगी म (cid:6) उe तापमान पर नाइFस आ[साइड (NOx गसै ) या अमोिनया से 9ाf नाइ(cid:29)Fक अ>ल का 9योग करके <कया जाता ह।ै नाइFस आ[साइड को सोिडयम नाइFाइट 9ाf करने के िलए काि)टक सोडा/सोडा एश म(cid:6) आगे अवशोिषत <कया जाता ह।ै यह उRपाद गंधरिहत और जल म (cid:6) घुलनशील ह।ै 5. चूं<क 9)त ािवत जाचं एक िनणा3यक समी2ा जांच ह ै इसिलए िवचाराधीन उRप ाद का दायरा मूल जाचं के समान ही ह ै । "सोिडयम नाइFाइट" को सीमाशु(cid:26)क टै(cid:29)रफ अिधिनयम के अ4याय 28 के अंतगत3 सीमाशु(cid:26)क उप- शीष3 स ं 28341010 के अंतग3त वगhकृत <कया जाता ह।ै तथािप, सीमाशु(cid:26)क वगhकरण सांकेितक 9कृित का ह ै और जाँच के दायरे पर <कसी भी 9कार से बा4यकारी नहi ह।ै ससससममममाााानननन वववव तततत ुुुु 6. समान व)तु के सबं ध म(cid:6) िनयम 2 (घ) म(cid:6) िनjानुसार kव)था ह:ै- "समान व(cid:7)त"ु का अथ(cid:13) ऐसी व(cid:7)तु ह ै जो भारत म(cid:22) पा(cid:24)टत (cid:26)कए जान े क(cid:29) जाचँ के अधीन व(cid:7)तु के सभी तरह से समान यह उसके जैसी हो या ऐसी (cid:26)कसी व(cid:7)त ु क(cid:29) अनुपि(cid:7)थित म (cid:22) कोई अ%य व(cid:7)त ु जो य&िप सभी तरह स े समान नह’ हो, तथािप उसम(cid:22) जाँच के अधीन व(cid:7)त ु से िब*कुल िमलती-जुलती िवशेषताए ंह/। 7. यािचकाकता 3 ने दावा <कया ह ै <क उनके Cारा उRपा<दत और सबं D दशे से िनया3ितत संबD व)त ु के बीच कोई lात अंतर नहi ह।ै यािचकाकता 3 Cारा उRपा<दत और सबं D दशे स े आयाितत िवचाराधीन उRपाद म (cid:6) भौितक और रासायिनक िवशेषता*, िविनमा3ण 9<^या और 9ौZोिगक+, काय3 और 9योगH, उRपाद िविनदशm नH, क+मत िनधा3रण, िवतरण और िवपणन और व)तु* के टै(cid:29)रफ वगhकरण जैस े मापदडं H क+ दिृ 8 से तुलनीय िवशेषताएं ह।n यािचका लाग ू पाटनरोधी शु(cid:26)क क+ समी2ा करने और उसे जारी रखने के िलए दायर क+ गई ह ै और समान व)त ु का मुo े पर पहले ही पूव3वतh जाँचH म(cid:6) िवचार <कया गया ह।ै पूव3वतh जाँचH म(cid:6) 9ािधकारी ने पहले ही माना ह ै <क घरेलू उZोग Cारा उतपा<दत संबD व)तु सबं D दशे से आयाितत व)त ुके समान व)तु ह।ै घघघघररररेेेेलललल ूू ूूउउउउ(cid:11)(cid:11)(cid:11)(cid:11)ोोोोगगगग औऔऔऔरररर उउउउससससकककक#### ययययोोोो$$$$ययययतततताााा¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 3 8. यह यािचका मn. दीपक नाइFाइट िल., वडोदरा Cारा दायर क+ गई ह।ै दशे म(cid:6) सोिडयम नाइFाइट के तीन और उRपादक ह n - पंजाब कैिमक(cid:26)स एडं फामा3)यू(cid:29)टकल िलिमटेड, नेशनल फpटलाइजर िलिमटेड और राqीय कैिमक(cid:26)स एंड फpटलाइजस3 िलिमटेड। आवेदन म(cid:6) 9)तुत सूचना के अनुसार घटक घरेल ू उZोग का सबं D व)तु के कुल घरेल ू उRपादन म(cid:6) 9मुख िह)सा बनता ह।ै इसके अलावा घटक घरेलू उZोग ने यह घोषणा क+ ह ै<क उसने संबD दशे से न तो िवचाराधीन उRपाद का आयात <कया ह ै और न ही वह संबD दशे म(cid:6) िवचाराधीन उRपाद के <कसी िनया3तक या भारत म (cid:6) सबं D व)तु के <कसी आयातक से संबD ह।n 9ािधकारी नोट करते ह n <क यािचकाकता3 पाटनरोधी िनयमावली के िनयम 2(ख), 5(क) और 5(ख) के अधीन यथाअपेि2त योrयता सबं ंधी अपेि2त मापदडं H को पूरा करता ह ैऔर घरेलू उZोग ह।ै पपपपााााटटटटननननररररोोोोधधधधीीीी शशशश&&ुु&&ुु कककक कककक#### ििििननननणणणणाााायय’’यय’’ कककक ससससममममीीीी((((ाााा कककक#### शशशशु(cid:19)ु(cid:19)ु(cid:19)ु(cid:19)आआआआतततत 9. यत:, िविधवत Jप से साXयां<कत यािचका को 4यान म(cid:6) रखते 6ए और पाटनरोधी िनयमावली के िनयम 23 के साथ प(cid:29)ठत अिधिनयम क+ धारा 9 क (5) के अनुसार, 9ािधकारी एतtारा सबं D दशे के मूल के अथवा वहां स े िनया3ितत संबD व)तु के सबं धं म(cid:6) लागू शु(cid:26)कH को जारी रखने क+ आवuयकता क+ समी2ा करने और इस बात क+ जाँच करन े <क [या ऐसे शु(cid:26)क क+ समािf से पाटन और घरेलू उZोग को 2ित के जारी रहन े या उसक+ पुनरावृिw होने क+ आशंका ह,ै के िलए िनणा3यक समी2ा क+ शुJआत करत े ह।n जजजजााााचचंंचचंं अअअअववववििििधधधध 10. वत3मान जाँच के 9योजनाथ3 जांच क+ अविध (पीओआई) अ9ैल, 2015 से माच3, 2016 तक क+ ह।ै तथािप, 2ित जाँच अविध म(cid:6) अ9ैल 2012 - No. 15/06/2016-DGAD.— Whereas having regard to the Customs Tariff Act, 1975 as amended in 1995 and thereafter (hereinafter also referred as the Act) and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time (hereinafter also referred as the Rules); the Designated Authority (hereinafter also referred as the Authority) initiated anti-dumping investigations on imports of “Sodium Nitrite” (hereinafter also referred as the subject goods), originating in or exported from China PR (hereinafter also referred as the subject country) vide Notification No.39/1/99-DGAD dated 4thNovember1999, and recommended imposition of provisional anti-dumping duty vide Notification No.39/1/99-DGAD dated 6th April 2000.The provisional anti-dumping duty in the original investigation was imposed on imports of Sodium Nitrite from China PR vide customs notification no. 76/2000-Customs dated 23rd May 2000. The final findings were notified by the Authority vide notification dated 3rd November 2000 and the Department of Revenue imposed definitive anti-dumping duties on the subject goods from subject country vide Notification No.147/2000-Customs dated 19th December 2000. The imposition of duty has been reviewed time to time and the last and second sunset review final finding was issued vide Notification No. 15/4/2010 - DGAD dated 30thJune, 2011 and recommended continued imposition of the anti-dumping duty on the imports of the subject goods, originating in or exported from the subject country. As per the recommendations of the Authority, the anti-dumping duty was imposed by the Central Government vide Notification No. 76/2011-Customs dated 17thAugust, 2011. After the second mid-term review conducted at the behest of the petitioner requesting for change in the form of anti-dumping duty from current benchmark form to fixed form and enhancement in the quantum of anti-dumping duties, the Authority notified final findings changing the form of anti- dumping duty vide Notification No. 15/2/2013-DGAD dated 15th October 2014. Duties shall expire on 16th August 2016. 2. WHEREAS, the petitioner has filed a duly substantiated petition before the Authority, in accordance with the Act and the Rules alleging likelihood of continuation or recurrence of dumping of the subject goods, originating in or exported from China PR and consequent injury to the domestic industry and have requested for review and continuation of the anti-dumping duties, imposed on the imports of the subject goods, originating in or exported from the subject country. Country Involved 3. The subject country in the present sunset review investigation is China PR. Product under Consideration and Like Article 4. The product under consideration in the present investigation is “Sodium Nitrite”. Sodium Nitrite is an oxidizing as well as reducing agent. It is a white crystalline powder mostly used in pharmaceutical industries, dye industries, lubricants, construction chemicals, rubber blowing agent, heat transfer salts, meat processing, textiles etc. The subject goods are produced by using nitric acid obtained from nitrous oxide (NOx gas) or ammonia at high temperature in presence of catalysts. The nitrous oxide is further absorbed in caustic soda/soda ash to get sodium nitrite. The product is odorless and soluble in water. 5. Since the proposed investigation is a sunset review investigation, the scope of the product under consideration remains the same as that of the original investigation. Sodium Nitrite is classified under Custom Sub Heading 28341010 of Chapter 28 of the Customs Tariff Act. However, the customs classification is indicative only and is in no way binding on the scope of the present investigation. Like Article 6. Rule 2(d) with regard to like article provides as under: -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] "like article" means an article which is identical or alike in all respects to the article under investigation for being dumped in India or in the absence of such article, another article which although not alike in all respects, has characteristics closely resembling those of the articles under investigation; 7. Petitioner has claimed that there is no known difference in subject goods produced by them and exported from the subject country. The product under consideration produced by the petitioner and imported from the subject country are having comparable characteristics in terms of parameters such as physical & chemical characteristics, manufacturing process & technology, functions & uses, product specifications, pricing, distribution & marketing and tariff classification of the goods. The petition filed is for the review and continuation of the anti-dumping duty in force, and the issue of like article has been already dealt with in the previous investigations. In the earlier investigations, the Authority has already held that the subject goods produced by the domestic industry are like article to the same imported from the subject country. Domestic Industry & Standing 8. The petition has been filed by M/s. Deepak Nitrite Ltd., Vadodara. There are three more producers of Sodium Nitrite in the Country - Punjab Chemicals & Pharmaceuticals Limited, National Fertilizer Limited and Rashtriya Chemicals & Fertilizers Limited. As per information furnished in the application, the production of the constituent domestic producer accounts for major proportion of the total domestic production of the subject goods. Further, the constituent domestic producer has declared that they have neither imported the product under consideration from the subject country, nor are they related to any exporter of the product under consideration in the subject country or to an importer of subject goods in India.The Authority notes that the petitioner fulfils the requisite criteria to satisfy standing and constitutes domestic industry, asrequired under Rule 2(b), 5(a) and 5(b) of AD Rules. Initiation of Sunset Review of Anti-Dumping Duty 9. WHEREAS in view of the duly substantiated petition filed and in accordance with section 9A(5) of the Act, read with Rule 23 of the Anti-dumping Rules, the Authority hereby initiates a Sunset review investigation to review the need for continued imposition of the duties in force in respect of the subject goods, originating in or exported from the subject country and to examine whether the expiry of such duty is likely to lead to continuation or recurrence of dumping and injury to the domestic industry. Period of Investigation 10. The period of investigation (POI) is April 2015 to March 2016 for the purpose of present investigation. The injury investigation period will however cover the periods April 2012-March 2013, April 2013-March 2014, April 2014 - March 2015 and the POI. Procedure 11. The present sunset review covers all aspects of Notification No. 15/4/2010 -DGAD dated 30thJune 2011 (final findings of second sunset review investigation) and Notification No. 15/2/2013-DGAD dated 15th October 2014 (final findings of second mid-term review). 12. The provisions of Rules 6, 7, 8, 9, 10, 11, 16, 17, 18, 19 and 20 of the Rules supra shall be mutatis mutandis applicable in this review. Submission of information 13. Any other interested party may also make its submissions relevant to the investigation in the prescribed form and manner within the time limit set out below. Any party making any confidential submission before the Authority is required to submit a non-confidential version of the same to be made available to the other parties. Time Limit 15. Any information relating to the present review and any request for hearing should be sent in writing so as to reach the Authority at the address mentioned above not later than forty days (40 Days) from the date of issuance of such letter. Any other interested party, whose address is not available, may also submit comments/ information within 40 days from date of publication of this notification. Submission of information on confidential basis 16. In case confidentiality is claimed on any part of the questionnaire response/submissions, the same must be submitted in two separate sets (a)marked as Confidential (with title, index, number of pages, etc.) and (b) other set marked as Non-Confidential (with title, index, number of pages, etc.). All the information supplied must be clearly marked as either “confidential” or “non-confidential” at the top of each page and accompanied with soft copies. 17. Information supplied without any confidential marking shall be treated as non-confidential and the Authority shall be at liberty to allow the other interested parties to inspect any such non-confidential information. Two (2) copies of the confidential version and two (02) copies of the non-confidential version must be submitted by all the interested parties. 18. For information claimed as confidential, the supplier of the information is required to provide a good cause statement along with the supplied information as to why such information cannot be disclosed and/or why summarization of such information is not possible. 19. The non-confidential version is required to be a replica of the confidential version with the confidential information preferably indexed or blanked out /summarized depending upon the information on which confidentiality is claimed. The non-confidential summary must be in sufficient detail to permit a reasonable understanding of the substance of the information furnished on confidential basis. However, in exceptional circumstances, parties submitting the confidential information may indicate that such information is not susceptible to summarization; a statement of reasons why summarization is not possible must be provided to the satisfaction of the Authority. 20. The Authority may accept or reject the request for confidentiality on examination of the nature of the information submitted. If the Authority is satisfied that the request for confidentiality is not warranted or the supplier of the information is either unwilling to make the information public or to authorize its disclosure in generalized or summary form, it may disregard such information. 21. Any submission made without a meaningful non-confidential version thereof or without a good cause statement on the confidentiality claim may not be taken on record by the Authority. The Authority on being satisfied and accepting the need for confidentiality of the information provided; shall not disclose it to any party without specific authorization of the party providing such information. Inspection of public file 22. In terms of rule 6(7) of the Rules, any interested party may inspect the public file containing non-confidential version of the evidences submitted by other interested parties. Non-cooperation 23. In case any interested party refuses access to and otherwise does not provide necessary information within a reasonable period, or significantly impedes the investigation, the Authority may declare such interested party as non- cooperative and record its findings on the basis of the facts available to it and make such recommendations to the Central Government as deemed fit.
