## Report on Notification Regarding Petroleum and Minerals Pipeline Acquisition of Right of User in Land **1. Executive Summary:** This report analyzes a notification issued by the Ministry of Petroleum and Natural Gas, Government of India, regarding the acquisition of the right of user in land for laying a petroleum pipeline in Gujarat. The core purpose, as stated in the text, is to facilitate the transport of petroleum via a pipeline to be laid by the Oil and Natural Gas Corporation Ltd. (ONGC). The notification declares the government's intention to acquire the right of user in specified lands and provides a process for affected parties to raise objections. The report finds that the primary stakeholders are landowners and ONGC, with a timeframe of 21 days provided for objections. **2. Introduction:** This report provides an overview and analysis of the notification published by the Ministry of Petroleum and Natural Gas concerning the acquisition of right of user in land for laying a petroleum pipeline in Gujarat. The analysis is based solely on the information provided in the notification text. **3. Policy Overview:** This is a notification under the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962. * **Core Objective:** The core objective, as stated in the text, is to acquire the right of user in land for laying a petroleum pipeline ("43 Flow Line GNDGX TO EPS253") by the Oil and Natural Gas Corporation Ltd. (ONGC) in Gujarat State. The underlying purpose is to facilitate the transport of petroleum. **4. Background and Rationale:** This is a new implementation of the existing act of 1962. The notification indicates that the Central Government deems it necessary in the public interest to lay the specified pipeline. This suggests that the existing infrastructure is insufficient or that a new source of petroleum needs to be connected to existing facilities. The rationale, inferred from the text, is to improve petroleum transport infrastructure in Gujarat. **5. Key Provisions:** The notification establishes the following key provisions: * **Declaration of Intent:** The Central Government declares its intention to acquire the right of user in the land described in the attached schedule for laying the pipeline. * **Right to Object:** Any person interested in the specified land has the right to object to the laying of the pipeline within 21 days from the date of the notification. * **Objection Procedure:** Objections must be submitted in writing to the Competent Authority, Oil and Natural Gas Corporation Ltd., ONGC CAMPUS, ANKLESHWAR ASSET, ANKLESHWAR 390010 GUJARAT. * **Hearing Request:** Objecting parties must specify whether they wish to be heard in person or by a legal practitioner. * **Land Details:** A schedule is provided that describes the specific land parcels (Survey/Block Numbers) in the villages of ACHHOD, MACHHASARA and INTOLA within the Taluka Amod, District Bharuch, State Gujarat where the right of user is to be acquired. It includes the areas of the specified land parcels. **6. Target Audience and Stakeholders:** Based on the text, the primary target audience and stakeholders are: * **Landowners:** Individuals or entities owning land within the specified areas in the villages of ACHHOD, MACHHASARA and INTOLA as listed in the schedule. * **Oil and Natural Gas Corporation Ltd. (ONGC):** The entity responsible for laying the pipeline and the designated "Competent Authority" to receive objections. * **Government of India:** Specifically, the Ministry of Petroleum and Natural Gas, which is responsible for issuing the notification and overseeing the project. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** Oil and Natural Gas Corporation Ltd. (ONGC) is responsible for the pipeline construction and is the designated point of contact for objections. * **Timeline:** A 21-day period is provided for landowners to submit objections from the date of the notification (January 22, 2021). * **Procedure:** Landowners must submit written objections to the specified ONGC address, indicating their preference for a personal hearing or representation by a legal practitioner. **8. Expected Outcomes / Impact:** The likely intended outcomes based on the notification's provisions are: * **Facilitation of Pipeline Construction:** The acquisition of the right of user in the land will allow ONGC to proceed with the construction of the "43 Flow Line GNDGX TO EPS253" pipeline. * **Improved Petroleum Transport:** The new pipeline is expected to improve the transport of petroleum in Gujarat, likely enhancing efficiency and capacity. * **Resolution of Objections:** The objection process allows for addressing concerns of affected landowners before the pipeline construction commences. The impact of this is unknown without additional data, as we cannot determine the number or severity of expected objections. **9. Conclusion:** The notification signifies a step towards expanding petroleum infrastructure in Gujarat by enabling the construction of a new pipeline by ONGC. It is significant as it sets the legal framework for acquiring the necessary land rights and establishes a process for addressing landowner concerns. The notification underscores the government's intent to facilitate petroleum transport in the region while providing a mechanism for affected parties to voice their objections within a specified timeframe.
