And whereas copies of the said Gazette notification were made available to the public up to 20.11.2019; And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government: And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline. And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances. Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline. SOMAKUMAR, Under Secy. अजधसचू ना नई दिल्ली, 26 अक् तूबर, 2020 का.आ. 3853(अ).— केंरीय सरकार ने पेरोजलयम और खजनि पाडपलाडन भभूजम म ें उपयोग के अजधकार का अििन) अजधजनयम 1962 भ1962 का 50) भजिसे डसम ें डसके पश्चात उक्त अजधजनयम किा गया िै) की धारा 3 की उपधारा भ1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ. 1263 तारीख 15 माच ि 2019, िो भारत के रािपत्र संख्या 29 तारीख 14-20 िलु ाई 2019, में प्रकाजित की गई थी, द्वारा उस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िष्टि भूजम म ें ओडिशा राज्य म ें “पारादीप - सोमनाथपुर - हलद् ीआ प्ााँिक्ट पाइपलाईन पाररयोजना”, तिसील- मिाकालपारा, जिला- केंरापड़ा म ें उत् पाि पवरविन के जलए डंजडयन आयल कॉपोरेिन जलजमटेड द्वारा पाडपलाडन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अििन के अपने आिय की घोषणा की थी: और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 15.10.2019 तक उपलब्ध करा िी गई थी, और स्षमम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा भ1) के अधीन केंरीय सरकार को वरपोटि ि े िी ि;ै और केंरीय सरकार न,े उक्त वरपोटि पर जवचार करन े के पश्चात और यि समाधान िो िाने पर कि उक्त भूजम पाडपलाडन जबछाने के जलए अपेज्षमत ि,ै उसमे उपयोग के अजधकार का अिनि करने का जवजनश्चय दकया ि;ै अतः अब, केंरीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा भ1) द्वारा प्रित्त िजक्तयक का प्रयोग करते ुएए यि घोषणा करती ि ै की डस अजधसूचना से सलं ग्न अनुसूची में जवजनर्िष्टि भूजम म ें पाडपलाडन जबछान े के जलए उपयोग के अजधकार का अििन दकया िाए; और केंरीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा भ4) द्वारा प्रित्त िजक्तयक का प्रयोग करते ुएए, यि जनिेि िेती ि ै कि उक्त भूजम में उपयोग का अजधकार डस घोषणा के प्रकािन की तारीख से केंरीय सरकार म ें जनजित िोन े के बिाए, सभी जवल्लंगमो से मक्तु िोकर डंजडयन लयल कॉपोरेिन जलजमटेड म ेंजनजित िोगी। पेरोजलयम और खजनि पाडपलाडन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी ्षमजतपूर्ति के जलए डंजडयन लयल कॉपोरेिन जलजमटेड पणू ति या उत्तरिायी िोगी और पाडपलाडन से सम्बंजधत दकसी भी मामले पर केंरीय सरकार के जवरुद्ध कोई िावा या कानूनी कायिवािी निीं िो सकेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15 6(1) अनसु चू ी डंजडयन लयल कॉपौरेिन जलजमटेड पारािीप - सोमनाथपरु - िल्ि ीआ पाडपलाईन पावरयोिना जिला :- केन्द्र ापारा राज्य :- ओजडिा प्लॉट ्षमत्रे फल क्र.स ं तिसील का नाम गॉव का नाम क्रमाकं िक्ै टेयर एयर वगमि ीटर (1) (2) (3) (4) (5) (6) (7) 1 मिाकालपारा नाजलदिया - 269 7 00 00 01 8 00 03 02 9 00 53 58 [फ. सं. आर-11025 भ11) -2-2019-ओआर-I/ई 29478] पी. सोमाकुमार, अवर सजचव NOTIFICATION New Delhi, the 26th October, 2020 S.O. 3853(E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas 1263 dated 15th March, 2019, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Gazette no 29 on 14th to 20th July, 2019, Part- II, Section 3, Sub Section (ii), the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying “Paradip – Somnathpur - Haldia Product Pipeline”, for the transportation of Petroleum Products in Mahakalapara Tahasil of Kendrapara District in the state of Odisha by Indian Oil Corporation Limited; And whereas copies of the said Gazette notification were made available to the public up to 15.10.2019; And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government: And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline. And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
