Q(cid:15)सागर िFपुरा 20. साभं र झील राज?थान 21. स?थम को(cid:135)ा झील केरल 22. सुरीनसर और मनसर (पKरसर) जdम-ू क9मीर 23. सोमोरीरी जdम-ू क9मीर 24. ऊपरी गंगा उaर ’दशे 25. वेdबनाड़-कोल आ(cid:15)भ(cid:12) ूिम केरल 26. वूलर झील जdम-ू क9मीर [फा. स.ं ज-े 22012/78/2003-सीएस (डS(cid:6)यू) भाग 5] बृजेश िसR का, वैYािनक 'जी'8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 31st March, 2016 G.S.R. 385(E).—Whereas The Central Government had published the Wetlands (Conservation and Management) Rules, 2010 vide notification number G.S.R. 951(E), dated the 4th December, 2010 to regulate various activities within the wetlands in the country; And whereas, the Central Government considers it necessary to supersede the Wetlands (Conservation and Management) Rules, 2010 for effective conservation and management of the wetlands in the country; Whereas the wetlands, vital parts of the hydrological cycle, are lifelines of society on account of their wide ranging ecosystem goods and services such as water supply and purification; waste assimilation; buffering extreme events as floods, droughts, storms and cyclones; groundwater recharge; erosion control; microclimate regulation; and aesthetic enhancement of landscapes and the wetlands also support significant recreational, social and cultural activities, and are a part of our rich cultural heritage and the ecosystems harbor a range of floral and faunal diversity, including several rare, endangered and endemic species, and support complex food chains and the wetlands can help mitigate and adapt to changing climate through their ability to act as carbon sinks, regulate water regimes, prevent erosion and provide habitat to biodiversity under stress; And whereas many wetlands are seriously threatened by reclamation and degradation through drainage and landfill, pollution (discharge of domestic and industrial effluents, disposal of solid wastes), hydrological alterations (water withdrawal and inflow changes) and over-exploitation of their natural resources resulting in loss of biodiversity and disruption in goods and services provided by wetlands; And whereas clause (g) of article 51A of the Constitution stipulates that it shall be the duty of every citizen of India “to protect and improve the natural environment including forests, lakes, rivers and wildlife and to have compassion for living creatures”; And whereas the National Environment Policy, 2006 recognises the ecological services provided by wetlands and emphasizes the need to set up a regulatory mechanism for all wetlands so as to maintain their ecological character, and ultimately support their integrated management; And whereas India is a signatory to the Ramsar Convention on Wetlands, which includes in its ambit a wide variety of habitats, such as marshes, swamps, lakes, coastal lagoons, mangroves, peatlands, coral reefs, and numerous man-made wetlands, such as ponds, salt pans, reservoirs, gravel pits, sewage farms, and canals; And whereas the Central Government is desirous of mainstreaming full range of wetland biodiversity and ecosystem service values in sectoral development planning and decision making based on integrated management approach; And whereas the State Governments and Union territory Administrations need to take into account wetland ecosystem services and biodiversity values within their developmental programming, also taking into cognizance that land and water, two major ecological constituents of wetland ecosystems are enlisted as State subjects within the Constitution; And whereas the conservation and sustainable management of wetland ecosystem goods and services can provide substantial direct and indirect economic benefits to state and national economy; Now, therefore, the following draft of certain rules, which the Central Government proposes to make in exercise of the powers conferred by section 25, read with sub-section (1) and clause (v) of sub-section (2) and sub- section (3) of section (3) of the Environment (Protection) Act, 1986 (29 of 1986), and in supersession of the Wetlands (Conservation and Management) Rules, 2010, is hereby published for information of the public likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration by the Central Government after expiry of a period of sixty days from the date on which copies of this notification as published in the Official Gazette are made available to public. Short title and commencement.—(1) These rules may be called the Wetlands (Conservation and Management) Rules, 2016. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.—(1) In these rules, unless the context otherwise requires, (a) "Act" means the Environment (Protection) Act, 1986 (29 of 1986); (b) "Authority" means the authority referred to in rule 5; (c) “dredging” means an excavation activity or operation usually carried out atleast partly under water, in shallow sea or fresh water areas with the purpose of gathering up bottom sediments and disposing them off at a different location in an environmentally friendly manner; (d) "National Park" means an area declared as National Park under section 35 or section 38, or deemed to be declared as a National Park under sub-section (3) of section 66, of the Wildlife (Protection) Act, 1972 (35 of 1972); (e) “notified” means notification published in the Gazette by the State Government or Central Government in case of Union territories; (f) "Ramsar Convention" means the Convention on Wetlands signed at Ramsar, Iran in 1971; (g) “Schedule” means the Schedule annexed to these rules; (h) “UNESCO” means the United Nations Educational, Scientific, and Cultural Organisation; (i) "wetland" refers to ecosystems located at the interface of land and water and wherein water plays a dominant role in controlling plant and animal life and associated ecosystem processes and the wetlands mean an area of marsh, peatland or water; natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish or salt, including areas of marine water, the depth of which at low tide does not exceed six meters and includes all inland and coastal waters such as lakes, reservoirs, tanks, backwaters, lagoons, creeks, estuaries and manmade wetlands, but does not include river channels and paddy fields and as notified in the Schedule. (j) "Wildlife Sanctuary" means an area declared as a wildlife sanctuary under the provisions of Chapter IV of the Wildlife (Protection) Act, 1972 (35 of 1972) and shall include an area deemed to be sanctuary under sub-section (4) of section 66, of the said Act. (2) The word and expressions used in these rules and not defined, but defined in the Act, shall have the meanings assigned to them in the Act. 3. Applicability of rules.—These rules shall apply to the following wetlands:- (1) Wetlands categorised as ‘wetlands of international importance’ under the Ramsar Convention as specified in the Schedule. (2) Wetlands notified by the concerned State Governments which are located in their jurisdiction. (3) Wetlands notified by the Central Government based on recommendation of the Union territory Administrations for wetlands located in their jurisdiction. 4. Restrictions of activities in wetlands.—(1) The wetlands shall be conserved and managed in accordance with principle of ‘wise use’ for maintaining their ecological integrity. Note 1: ‘Wise use of wetlands’ is the maintenance of their ecological character, achieved through implementation of ecosystem approaches, within the context of sustainable development. Note 2: ‘Ecological character’ is the combination of ecosystem components, processes and services that characterize a wetland, and provide the necessary conditions for delivering ecosystem services and maintenance of biodiversity. Note 3: ‘Ecosystem approach’ is the strategy for integrated management of land, water and living resources that promotes conservation and sustainable use in an equitable way. (2) The following activities shall be prohibited in wetlands notified under these rules, namely:- (i) reclamation of wetlands, and conversion for non-wetland uses; (ii) any diversion or impediment to natural water inflows and outflows of the wetland; (iii) any activity having or likely to have an adverse impact on ecological character of the wetland: Provided that exceptional cases, any change to the above may be taken up with prior approval of the Central Government. 5. Constitution of Wetland Authority by the State Governments or Union territories.- (1) All State Governments shall set up a State Level Wetland Authority entrusted with affairs related to wetland conservation, regulation and management under the relevant State bye-laws consisting of the following members:-10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) Chief Minister or the Minister In-charge of the Department of Environment and Forests of the State Government; (ii) The Chief Secretary of the State; (iii) The Secretary in-charge of the Department of Forests; (iv) The Secretary in-charge of the Department of Urban Development; (v) The Secretary in-charge of the Department of Rural Development; (vi) The Secretary in-charge of the Department of Water Resources; (vii) The Secretary in-charge of the Department of Fisheries; (viii) The Secretary in-charge of the Department of Irrigation and Flood Control; (ix) The Secretary in-charge of the Department of Tourism; (x) The Secretaries in-charge of the Departments of Revenue and other relevant departments, organisations and institutions; (xi) One expert each in the fields of wetland ecology, hydrology, fisheries and socio-economics; (xii) The Secretary in-charge of the Department of Environment as Member Secretary of the Authority. (2) Based on proposals received from any Union territory, the Central Government shall for the purpose of the conservation and management of wetlands in the Union territory, constitute Wetland Authority for the Union territory consisting of the following members:- (i) Administrator or Chief Secretary or the Minister In-charge of the Department of Environment and Forests of the Union territory; (ii) The Secretary in-charge of the Department of Forests; (iii) The Secretary in-charge of the Department of Urban Development; (iv) The Secretary in-charge of the Department of Rural Development; (v) The Secretary in-charge of the Department of Water Resources; (vi) The Secretary in-charge of the Department of Fisheries; (vii) The Secretary in-charge of the Department of Irrigation and Flood Control; (viii) The Secretary in-charge of the Department of Tourism; (ix) The Secretaries in-charge of the Departments of Revenue and other relevant departments, organisations and institutions; (x) One expert each in the fields of wetland ecology, hydrology, fisheries and socio-economics; (xi) The Secretary in-charge of the Department of Environment as Member Secretary of the Authority. (3) For the purpose of managing wetlands having multiple issues, the concerned State Government or Union territory Administration may, if required, constitute a specific Wetland Authority. (4) Every Wetland Authority referred in (1) to (3) shall exercise the following powers and perform the following functions, subject to any Central law and policies: (a) prepare an inventory of all wetlands of the State Government or Union territory; (b) identify and prepare a list of wetlands to be regulated under the provisions of the rules; (c) undertake demarcation of the wetland boundaries and preparation of land-use maps using remote sensing and ground truthing; (d) prepare an account of existing rights and tenure; (e) demarcate the direct zone of influence of wetland; (f) notify wetlands to be regulated under these rules; (g) define ecological character for wetland and list out uses of the wetland which are aligned with ecological character; (h) develop a comprehensive list of activities to be regulated to ensure wise use of the site; specify the threshold levels for each; and the mode and method for regulation; (i) develop integrated management plan for each of the notified wetlands, and identify mechanisms for convergence of implementation of the management plan with the existing State development plans and programmes; (j) ensure enforcement of the relevant Acts, rules and regulations and implementation of management action plan, and on annual basis inform the Government on the status of such notified wetlands through a reporting mechanism; (k) coordinate implementation of integrated management plans through various line departments and other concerned agencies; (l) issue necessary directions for conservation and sustainable management of wetlands to the respective implementing agencies; (m) undertake measures for enhancing awareness within stakeholders and local communities on values and functions of wetlands.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 11 6. Process for notification of wetlands.—(1) The concerned State Government or Union territory shall prepare a report for each of the wetland identified for notification, providing:- (a) Detailed geographic delineation of the wetland supported by accurate maps with coordinates; (b) its zone of influence along with a map (accurate and to scale); (c) ecological character description; (d) account of pre-existing rights and privileges, and whether or not consistent or not consistent with the ecological character of the wetland; (e) list of uses permitted within the wetland which are aligned with maintenance of ecological character; (f) list of activities to be regulated, and their corresponding threshold level, and; (g) modalities for enforcement of regulation. (2) (a) Based on the report, the State Authority shall make recommendation to the State Government concerned for notifying the wetlands. (b) In case of Union territory, the Union territory Administration shall make recommendations to the Central Government for notifying the wetlands. (3) The State Government or Central Government (in the case of Union territory) shall, after considering the objections, if any, from the concerned and affected persons, notify the wetlands in the Official Gazette. (4) The concerned State Wetland Authority shall forward a copy of the notification along with a copy of report referred to in sub-rule (1) to the Central Government for its record. 7. Applicability of other laws.- (1) Wetlands within the protected areas of the National Parks and Wildlife Sanctuaries shall be regulated by the provisions of Wildlife (Protection) Act, 1972 (35 of 1972) and the management plans for such wetlands will be prepared on wise use principles and applying guidelines for integrated management. Implementation of management plans shall ensure that traditional uses of wetlands, which are harmonized with its ecological character are not curtailed. (2) Wetlands within the protected or notified forest areas shall be regulated by the provisions of the Indian Forest Act, 1927 (16 of 1972); the Forest (Conservation) Act, 1980 (69 of 1980); and the Environment (Protection) Act, 1986 (29 of 1986) and the management plans for such wetlands shall be prepared on wise use principles and the implementation of management plans shall ensure that traditional uses of wetlands, which are harmonized with its ecological character are not curtailed. (3) Wetlands in coastal areas shall be regulated as per the provisions of the Coastal Regulation Zone Notification, 2011 issued vide S.O. No. 19(E) dated 6th January, 2011 and the management plans for such wetlands shall be prepared on wise use principles and the implementation of management plans shall ensure that traditional uses of wetlands, which are harmonized with its ecological character are not curtailed.
