(2) ये राजप(cid:7074) म(cid:7286) उनके (cid:7079)काशन क(cid:7409) तारीख से एक वष(cid:6981) प(cid:7019) चात ् (cid:7079)वृ(cid:7004) त ह(cid:7298)गे ।

4. (cid:7021)व त: (cid:7079)माणन.—इन िनयम(cid:7298) के (cid:7079)वृ(cid:7004) त होने क(cid:7409) तारीख को या से िविन(cid:7414)मत या आयाितत घरेल ू और सजावटी प(cid:7286)ट
पर यह कथन करते (cid:7263)ए लेबल लगाया जाएगा (cid:7408)क सीसे क(cid:7409) मा(cid:7074)ा (cid:7079)ित िमिलयन 90 भाग से अिधक नह(cid:7277) ह,ै ऐसा
लेबल (cid:7407)टकाऊ और (cid:7021) प(cid:7020) ट होगा तथा –
(i) लेबल म(cid:7286), यथाि(cid:7021)थ ित, िविनमा(cid:6981)ता या आयातकता(cid:6981) का नाम और पता अंत(cid:7414)व(cid:7020) ट होगा;
(ii) लेबल म(cid:7286), दशे म(cid:7286), यथाि(cid:7021) थित, िविनमा(cid:6981)ण या आयात क(cid:7409) तारीख अंत(cid:7414)व(cid:7020) ट होगी ।
5 नोडल अिभकरण.—(1) इन िनयम(cid:7298) के उपबंध(cid:7298) के काया(cid:6981)(cid:7008) वयन के िलए क(cid:7286)(cid:7076)ीय (cid:7079)दषू ण िनयं(cid:7074)ण बोड(cid:6981), नोडल
अिभकरण होगा ।
(2) इन िनयम(cid:7298) के काया(cid:6981)(cid:7008) वयन म(cid:7286) (cid:7408)कसी वाद या क(cid:7407)ठनाई क(cid:7409) दशा म(cid:7286) मामला नोडल अिभकरण को िनदि(cid:7287) शत (cid:7408)कया
जाएगा ।
(3) नोडल अिभकरण, उसे सभी मामल(cid:7298), िजसके अंतग(cid:6981)त इन िनयम(cid:7298) के काया(cid:6981)(cid:7008) वयन से संबंिधत िववा(cid:7408)दत मामले ह,(cid:7289)
पर सलाह दने े के िलए (cid:7408)कसी सिमित का गठन कर सकेगा ।
6. उ(cid:7004)प ाद(cid:7298) के परी(cid:6979)ण के िलए (cid:7079)ािधकृत अिधकरण.—क(cid:7286)(cid:7076)ीय िव(cid:7378)ुत अनुसंधान स(cid:7021)ं थ ान, बग(cid:7286) लु(cid:7271) और उसके (cid:6979)े(cid:7074)ीय
क(cid:7286)(cid:7076) भोपाल, गवु ाहाटी , हदै राबाद, कोलकाता, नागपुर, नािसक और नोएडा तथा पया(cid:6981)वरण, वन और जलवाय ु
प(cid:7407)रवतन(cid:6981) म(cid:7074)ं ालय (cid:7367)ारा समय-समय पर अिधसूिचत कोई अ(cid:7008)य अिभकरण ऐसे परी(cid:6979)ण(cid:7298) को करने के िलए (cid:7079)ािधकृत
होगा जो यह अवधा(cid:7407)रत करने के िलए आव(cid:7019) यक समझते ह (cid:7289) (cid:7408)क (cid:6989) या उ(cid:7004) पाद म(cid:7286) िनयम 3 म(cid:7286) यथािविन(cid:7416)द(cid:7020) ट (cid:7079)ित
िमिलयन 90 भाग से अनिधक सीसा अंत(cid:7414)व(cid:7020) ट ह ै।
7. अनपु ालन और परी(cid:6979)ण (cid:7079)(cid:7408)(cid:7059)या.—अनुपालन और परी(cid:6979)ण (cid:7079)(cid:7408)(cid:7059)याए ं क(cid:7286)(cid:7076)ीय (cid:7079)दषू ण िनयं(cid:7074)ण बोड(cid:6981) (cid:7367)ारा
(cid:7079)माणन अिभकरण(cid:7298) क(cid:7409) सहायता स े इन िनयम(cid:7298) के (cid:7079)ारंभ होने क(cid:7409) तारीख स े छह मास के भीतर तैयार क(cid:7409) जाएगं ी
और (cid:7079)कािशत क(cid:7409) जाएगं ी ।
8. अ(cid:7021)थ ायी उपबधं .—इन िनयम(cid:7298) के (cid:7079)ारंभ होने क(cid:7409) तारीख से पवू (cid:6981) िविन(cid:7414)मत या आयाितत घरेल ू और सजावटी
प(cid:7286)ट ऐसे (cid:7079)ारंभ होने क(cid:7409) तारीख से दो वष(cid:6981) के िलए िव(cid:7059)य हते ु अनु(cid:6980)ात (cid:7408)कए जाएगं े ।
9. साधारण शत.(cid:7288)—िन(cid:7013) निलिखत शत(cid:7288) लागू ह(cid:7298)गी, अथा(cid:6981)त:् -
(i) िनयम 3 म(cid:7286) यथािविन(cid:7416)द(cid:7020) ट घरेलू और सजावटी प(cid:7286)ट म(cid:7286) सीसे क(cid:7409) मा(cid:7074)ा से संबंिधत अनबु ंध इन
िनयम(cid:7298) के (cid:7079)वृ(cid:7004)त होने क(cid:7409) तारीख को या से ही िविन(cid:7414)मत या आयाितत उ(cid:7004) पाद(cid:7298) को लागू ह(cid:7298)गे ;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
(ii) (cid:7079)(cid:7004) येक िविनमा(cid:6981)ता या आयातकता(cid:6981) (cid:7079)ितवष (cid:6981) अपने उ(cid:7004) पाद का िनयम 3 म(cid:7286) यथािविन(cid:7416)द(cid:7020) ट सीसे क(cid:7409)
मा(cid:7074)ा के परी(cid:6979)ण अपने उ(cid:7004) पाद को बाजार म (cid:7286) लान े से पूव(cid:6981) िनयम 6 म(cid:7286) व(cid:7414)णत (cid:7408)कसी एक (cid:7079)ािधकृत अिभकरण
से करवाएगा;
(iii) परी(cid:6979)ण करने वाल े अिभकरण परी(cid:6979)ण (cid:7407)रपोट(cid:7300) को स(cid:7004) यापन के िलए और यथापिे (cid:6979)त कार(cid:6981)वाई
के िलए नोडल अिभकरण को (cid:7079)(cid:7021) तुत कर(cid:7286)गे ; और
(iv) नोडल अिभकरण परी(cid:6979)ण (cid:7407)रपोट(cid:7300) क(cid:7409) (cid:7079)ित संबंिधत िविनमात(cid:6981) ा या आयातकता(cid:6981) और पया(cid:6981)वरण,
वन और जलवायु प(cid:7407)रवत(cid:6981)न मं(cid:7074)ालय को दगे ा ।

NOTIFICATION
New Delhi, the 1st November, 2016
G.S.R. 1030(E).—Whereas, the Central Government, in exercise of powers conferred by sub-section (1) of
section 3 and clause (d) of sub-section (2) of section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with
rule 13 of the Environment (Protection) Rules, 1986, published the draft rules namely, the Regulation on Lead contents
in Household and Decorative Paints Rules, 2016 in the Gazette of India, Extraordinary, (cid:32)(cid:105)(cid:100)(cid:101)(cid:118)(cid:101)(cid:110)(cid:109)(cid:98)(cid:117)(cid:32)(cid:114) G.S.R. 409(E),
dated the 8th April, 2016 for inviting objections and suggestions from all persons and organisations likely to be affected
thereby before the expiry of a period of sixty days from the date on which copies of the Gazette containing the said
notification were made available to the public;
And whereas, the copies of the Gazette containing the said notification were made available to the public on the
24th April, 2016 and were also circulated to concerned stake holders whose addresses for communication were available
with the Ministry;
And whereas, the suggestions or objections received in response to the above mentioned draft rules have been
considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 3 and section 6 of the Environment (Protection)
Act, 1986 (29 of 1986), read with rule 13 of the Environment (Protection) Rules, 1986, the Central Government hereby
makes the following rules, namely:-
1.(cid:32) Short title and commencement.—(1) These rules may be called the Regulation of Lead Contents in Household
and Decorative Paints Rules, 2016.
(2) They shall come into force one year after the date of their publication in the Official Gazette.
2.(cid:32) Definition.—In these rule, unless context otherwise requires, “Household and Decorative Paints” means paints
used as surface coating materials in interior and exterior of buildings, walls, civil structures, any consumer
products meant for household purposes and shall include enamel, primer, interior, undercoating and finishing
colouring materials as prescribed in the Indian Standards for Household and Decorative Paints published by the
Bureau of Indian Standards.
3.(cid:32) Prohibition of use of lead or lead compounds in certain cases.—Any manufacture, trade, import and export of
Household and Decorative Paints (hereinafter referred to as product) containing lead or lead compounds
(calculated as lead metal) in excess of 90 parts per million (0.009 per cent.) of the weight of the total non-volatile
content of the weight of the dried paints film is hereby prohibited.
4.(cid:32) Self certification.—Household and Decorative Paints manufactured or imported on or from the date these rules
come into force shall be labeled stating that the lead contents does not exceed 90 parts per million, such labelling

(i)(cid:32) the label shall contain the name and address of the manufacturer or importer, as the case may be;
(ii)(cid:32) the label shall contain the date of manufacture or import into the country, as the case may be.
5.(cid:32) Nodal agency.—(1) The Central Pollution Control Board shall be the nodal agency for implementation of the
provisions of these rules.
(2)(cid:32)In case of any dispute or difficulty in implementation of these rules, the matter shall be referred to the nodal
agency.
(3)(cid:32)The nodal agency may constitute a Committee to advise it on all matters including the disputed matters, related
to the implementation of these rules.
6.(cid:32) Authorised agencies for testing of products.—The Central Power Research Institute, Bengaluru and its regional
centers at Bhopal, Guwahati, Hyderabad, Kolkata, Nagpur, Nashik and Noida and any other agency notified by
the Ministry of Environment, Forest and Climate Change from time to time shall be authorised to carry out such
tests as they deem necessary for determining whether a product contains lead not exceeding 90 parts per million
as specified in rule 3.
7.(cid:32) Compliance and testing procedures.—The compliance and testing procedure shall be prepared and published by
the Central Pollution Control Board, with the help of certification agencies within six months from the date of
commencement of these rules.
8.(cid:32) Transitory provision.—Household and Decorative Paints manufactured or imported before the date of
commencement of these rules shall be permitted for sale for the next two years from the date of such
commencement.
9.(cid:32) General Conditions.—The following conditions shall be applicable, namely;-
(i)(cid:32) the stipulations relating to contents of lead in the Household and Decorative Paints as specified in rule
3 shall apply to products manufactured or imported on and from the date of coming into force of these rules;
(ii)(cid:32) every manufacturer or importer shall subject its product every year for testing of lead content as specified in
rule 3 before bringing out its product in the market, from any one of the authorised agency mentioned in
rule 6;
(iii)(cid:32) the testing agencies shall submit the test reports to the nodal agency for verification and action as may be
required;
(iv)(cid:32) the nodal agency shall furnish a copy of the test reports to the concerned manufacturer or importer and the
Ministry of Environment, Forest and Climate Change.
