संिोधन करने के जलए जनम न जलजखत जिजनयम बनाता ह,ै ऄथात ,-
1. (1) आन जिजनयमों का संजक्षि नाम खाद्य संरक्षा और मानक (ऄल् कोहॉजलक पेय) प्रथम संिोधन जिजनयम, 2022

(2) य ेराजपत्र में आनके प्रकािन की तारीख को प्रिृत्त होंगे l
2. खाद्य संरक्षा और मानक (ऄल् कोहॉजलक पेय) जिजनयम, 2018 के,-
(क) जिजनयम 1.2 में, ईप-जिजनयम 1.2.8 के पश्चात, जनम्नजलजखत ईप-जिजनयम ऄंतःस्ट्थाजपत दकया जायेगा,
ऄथा त: -
“1.2.8क ऄल् कोहॉजलक पेय के गैर-ऄल् कोहॉजलक प्रजतरूप से ऄजभप्रेत ह ै गरै -ऄल् कोहॉजलक पेय जजसमें
ऄल्कोहल की मात्रा 0.5% एबीिी से कम या ईसके बराबर हो, यह आथाआल ऄल्कोहल सामग्री को छोड़कर
मूल के संबंजधत ऄल् कोहॉजलक पेय की सभी अिश्यकताओं को परू ा करेगा। आसके ऄजतररि, मूल के
ऄल् कोहॉजलक पेय को दकण्िन की प्रदिया से गुजरना होगा और तत्तपश्चात ईत्पाददत ऄल्कोहल को हटा
ददया जाएगा।”
(ख) ईप-जिजनयम 4.2(1) के पश्चात, जनम्नजलजखत को ऄतं ःस्ट्थाजपत दकया जाएगा, ऄथा त: -
"4.2(2) सुिाजसत बीयर: खाद्य सुरक्षा और मानक (खाद्य ईत्पाद मानक और खाद्य सहयोज्य) जिजनयम,
2011 के ईपबंधों के ऄनुसार सुिास युि बीयर और ऐसी बीयर, बीयर की ऄन्य सभी ऄपक्षे ाओं को पूरा
करेगी जो आन जिजनयमों के ऄधीन यथाजिजनर्ददष्ट हो।”

NOTIFICATION
New Delhi, the 10th June, 2022
F. No. Std/SP-21/T(Alcohol-5).—Whereas the draft Food Safety and Standards (Alcoholic Beverages)
Amendment Regulations, 2021, were published as required by sub-section (1) of section 92 of the Food Safety and
Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F. No.
Std/SP-21/T(Alcohol-3), dated the 22nd November, 2021, in the Gazette of India, Extraordinary, Part III, section 4,
inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of
sixty days from the date on which the copies of the Official Gazette containing the said notification were made
available to the public;
And whereas copies of the said Official Gazette were made available to the public on the 25th November,
2021;
And whereas objections and suggestions received from the public in respect of the said draft regulations have
been considered by the Food Safety and Standards Authority of India;
Now, therefore, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the said
Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the
Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, namely. -
1. (1) These regulations may be called the Food Safety and Standards (Alcoholic Beverages) First Amendment
Regulations, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, -
(a) in regulation 1.2, after the sub-regulation 1.2.8, following sub-regulation shall be inserted, namely: -[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3
“1.2.8a. “non-alcoholic counterpart of alcoholic beverage” means non-alcoholic beverage having alcohol
content less than or equal to 0.5% alcohol by volume, which shall meet all the requirements of respective
alcoholic beverage of origin except the ethyl alcohol content. Additionally, the alcoholic beverage of the
origin must undergo the process of fermentation and the produced alcohol is removed thereafter.’’;
(b) after sub-regulation 4.2(1), following shall be inserted, namely. -
“4.2(2) Flavoured Beer: Beer containing flavours as per the provisions of the Food Safety and Standards
(Food Products Standards and Food Additives) Regulations, 2011 and such beer shall meet all the other
requirements of the beer, as specified under these regulations.”
