## Policy Analysis Report: Food Safety and Standards Authority of India Transaction of Business and Procedures for the Scientific Committee and Scientific Panels First Amendment Regulations, 2021 **1. Executive Summary:** This report analyzes the Food Safety and Standards Authority of India (FSSAI) Transaction of Business and Procedures for the Scientific Committee and Scientific Panels First Amendment Regulations, 2021. This amendment modifies the 2016 regulations concerning the operational procedures of the FSSAI's Scientific Committee and Scientific Panels. Key changes include adjusting the quorum requirement for meetings and altering the process for circulating the meeting agenda. The amendment aims to improve the efficiency and effectiveness of these scientific bodies. **2. Introduction:** This report provides an overview and analysis of the Food Safety and Standards Authority of India Transaction of Business and Procedures for the Scientific Committee and Scientific Panels First Amendment Regulations, 2021, based solely on the provided policy text. The report outlines the changes introduced by the amendment and its potential impact. **3. Policy Overview:** * **Original Policy:** Food Safety and Standards Authority of India Transaction of Business and Procedures for the Scientific Committee and Scientific Panels Regulations, 2016. * **Core Objective(s):** To amend the existing 2016 regulations concerning the operational procedures for the FSSAI's Scientific Committee and Scientific Panels, aiming to refine their processes and improve their functioning. This is inferred from the title and content of the amendment. **4. Background and Rationale:** This amendment likely seeks to address perceived inefficiencies or shortcomings within the original 2016 regulations related to the functioning of the Scientific Committee and Scientific Panels. Specifically, the change to the quorum (increasing it from one third to two thirds) suggests there may have been issues with obtaining sufficient participation in meetings previously. The alteration to the agenda circulation process may be aimed at improving the preparation and focus of the meetings. **5. Key Provisions / Changes:** This amendment introduces two key changes to the 2016 regulations: * **Change 1: Quorum Requirement** * **Original Regulation:** Regulation 11, subregulation 1 stated the quorum as "one third." * **New Regulation:** The amendment substitutes "one third" with "two third." * **Effect:** This increases the minimum number of members required to be present for a Scientific Committee or Scientific Panel meeting to be valid. The higher quorum likely aims to ensure a broader range of expertise and opinions are considered during deliberations and decisions. * **Change 2: Agenda Circulation** * **Original Regulation:** Regulation 12, subregulation 1 (as implied, since it's being substituted). The specific content of the original regulation is not provided in the text. * **New Regulation:** "The draft agenda of the meetings of the Scientific Committee or Scientific Panels shall be drawn up by the Secretariat in consultation with the Chairperson of the concerned Scientific Committee or Scientific Panel and circulated to members at least ten working days before the meeting." * **Effect:** This clarifies the process for creating and distributing the meeting agenda. It specifies that the Secretariat, in consultation with the Chairperson, is responsible for drafting the agenda. It also mandates that the agenda be circulated to members at least ten working days prior to the meeting, providing them with more time to prepare. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders for these changes are: * Members of the FSSAI's Scientific Committee. * Members of the FSSAI's Scientific Panels. * The Secretariat of the FSSAI. * Potentially, individuals or organizations whose work is reviewed by or relies upon the output of the Scientific Committee and Scientific Panels (e.g., food manufacturers, researchers). **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies:** The FSSAI Secretariat and the Chairpersons of the Scientific Committee and Scientific Panels are directly responsible for implementing the changes related to agenda preparation and circulation. The overall implementation is the responsibility of the FSSAI. * **Timelines or procedures:** The amendment specifies a timeline of "at least ten working days" for circulating the agenda before meetings. * **Specific to changes:** Implementation of the quorum change requires careful monitoring of attendance at meetings to ensure compliance with the new two-thirds requirement. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these changes are: * **Increased participation and representativeness in Scientific Committee and Panel decisions:** The higher quorum requirement should lead to more robust and well-considered recommendations. * **Improved meeting preparation and efficiency:** Providing members with the agenda ten working days in advance should allow them to be better prepared, leading to more focused and productive discussions. * **Enhanced transparency and accountability:** The clarified agenda preparation process potentially promotes greater transparency in the operations of the Scientific Committee and Panels. **9. Conclusion:** The Food Safety and Standards Authority of India Transaction of Business and Procedures for the Scientific Committee and Scientific Panels First Amendment Regulations, 2021, introduces targeted changes to the quorum and agenda circulation procedures for the FSSAI's scientific bodies. These amendments are likely intended to enhance the effectiveness, efficiency, and representativeness of the Scientific Committee and Scientific Panels, ultimately contributing to more informed and robust food safety standards in India. This analysis is limited to the provided text; a more comprehensive understanding would require examination of the original 2016 regulations and related documents.
