(1) इन जवजनयमों का संजक्षिनाम खाद्य सुरक्षा और मानक (प्रयोगिाला और नमनू ा जवश् लेषण)ण) जद्वतीय संिोधन जवजनयम, 2020 ह।ै (2) ये रािपत्र में इनके प्रकािन की तारीख से प्रवतिय होंग।े 2. खाद्य सुरक्षा और मानक (प्रयोगिाला और नमूना जवश् लेषण)ण) जवजनयम, 2011 म,ें - (I) जवजनयम 2.1 के उप-जवजनयम 2.1.1 और उसके नीच े की सारणी के स्ट्थान पर जनम् नजलजखत रखा िाएगा, अथाात,् - “2.1.1 दकसी आयाजतत वस्ट् तु का नमूना प्राजधक त अजधकारी द्वारा खाद्य सरु क्षा और मानक अजधजनयम, 2006 की धारा 43(1) के अधीन खाद्य प्राजधकरण द्वारा अजधसूजचत दकसी प्रयोगिाला के खाद्य जवश् लषण)े क को जवश् लेषण)ण के जलए भेिा िाएगा।” (II) जवजनयम 2.2 के उप-जवजनयम 2.2.2 के खंड 1 और उसके नीचे की सारणी के स्ट्थान पर जनम् नजलजखत रखा िाएगा, अथाात्,- “2.2.2 राज् य/सं िाजसत क्षत्रे रेफरल प्रयोगिाला खाद्य प्राजधकरण, खाद्य सुरक्षा और मानक अजधजनयम, 2006 की धारा 43(2) के अधीन खाद्य प्राजधकरण द्वारा अजधसूजचत रेफरल प्रयोगिाला के काय ा करने के जलए प्रयोगिालाओं को प्राजधक त करेगा।” (III) जवजनयम 2.3 में खंड 3 के स्ट्थान पर जनम् नजलजखत रखा िाएगा, अथाात,् - “3. खाद्य के नमनू े के ऐसे परीक्षण या जवश्लेषण)ण के जलए संिये फीस समय-समय पर खाद्य प्राजधकरण द्वारा जवजहत दकया िाएगा।” अरुण ससं ल, मुख् य कायाकारी अजधकारी [जवज्ञापन III/4/असा/297/2020-21] नोटः- मूल जवजनयम भारत के रािपत्र, असाधारण में अजधसूचना संख्या फा. सं. 2 15015/30/2010, दिनाकं 1 अगस्ट्त, 2011 द्वारा प्रकाजित दकए गए और पश्चातवती जनम्न अजधसूचना संख्याकों द्वारा सिं ोजधत दकए गएः – (i) फा. स.ं 4/15015/30/2011, दिनांक 8 फरवरी, 2013 और (ii) फा. स.ं 01/लैब और सैंपल एनाजलजसस/रेग/2019, दिनांक 21 िुलाई, 2020।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 15th October, 2020 F.No. 11023/24/2017-QA- Whereas the draft Food Safety and Standards (Laboratory and Sample Analysis) Amendment Regulations, 2019, were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F.No. 11023/24/2017-QA, dated the 4thFebruary, 2019, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas the copies of the said Gazette were made available to the public on the 8th February, 2019; And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 read with section 16 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Laboratory and Sample Analysis) Regulations, 2011, namely:- Regulations 1. (1) These regulations may be called the Food Safety and Standards (Laboratory and Sample Analysis) Second Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Food Safety and Standards(Laboratory and Sample Analysis) Regulations, 2011, (I) in regulation 2.1,for sub-regulation 2.1.1 and table thereunder, following shall be substituted namely:- “2.1.1 The sample of any imported article will be sent by the Authorised Officer for analysis to the food analyst of any of the laboratories notified by Food Authority under section 43(1) of Food Safety and Standards Act, 2006.” (II) in regulation 2.2, for clause 1 in sub-regulation 2.2.2 and table thereunder, following shall be substituted namely:- “2.2.2 State/Union Territory of Referral Laboratory The Food authority shall authorise laboratories to carry out function of referral laboratory that are notified by Food Authority under section 43(2) of Food Safety and Standards Act, 2006.” (III) in regulation 2.3, clause 3 shall be substituted with the following, namely- “3. The fees payable for such test or analysis of sample of food shall be as prescribed by the Food Authority from time to time.” ARUN SINGHAL, Chief Executive Officer [ADVT.
