धारा 92 की उपधारा (1) की अपेक्षा के अनुसार, भारतीय खाद्य सुरक्षा और मानक प्राजधकरण की अजधसूचना
स.ं स्ट्टैंड्स/ऐडीटटव-03/अजधसचू ना/एफएसएसएआई/2018, दिनांक 26 नवम्र्बर, 2018 द्वारा, भारत के रािपत्र,
असाधारण, भाग III, खंड 4 में प्रकाजित दकये गए थे जिसमे उन सभी व्यजियों से जिनको उससे प्रभाजवत होने की
संभावना थी उि अजधसूचना के रािपत्र की प्रजतयााँ िनता को उपलब् ध कराय े िान े की तारीख से तीस दिन की अवजध की
समाजि से पूवव आक्षपे और सुझाव आमंजत्रत दकये गए थे।
और उक्त रािपत्र की प्रजतयााँ िनता को 29 नवम्र्बर, 2018 को उपलब् ध करा िी गई थं;
और उक्त प्रारूप जवजनयम के सम्र्ब्ध म ें िनता स े प्रा् त आक्षेपो और सुझावों पर भारतीय खाद्य सुरक्षा और
मानक प्राजधकरण द्वारा जवचार कर जलया गया ह;ै
अत: अर्ब भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, उक्त अजधजनयम की धारा 92 द्वारा प्रित् त िजियों का
उपयोग करत े हुए खाद्य सुरक्षा और मानक (जवक्रय प्रजतषधे एवं जनर्बंधन) जवजनयम, 2011 में और संिोधन करने के जलए
जनम्न जलजखत जवजनयम र्बनाता ह,ै अथावत:्—

1. (1) इन जवजनयमों का संजक्षि नाम खाद्य सुरक्षा और मानक (जवक्रय प्रजतषेध एवं जनर्बंधन) प्रथम संिोधन
जवजनयम, 2020 ह।ै
(2) यह रािपत्र म ेंइनके प्रकािन की तारीख से प्रवत्त होंगे।
2. खाद्य सुरक्षा एवं मानक (जवक्रय प्रजतषेध एव ं जनर्बंधन) जवजनयम, 2011 म,ें जवजनयम 2.3 म,ें उप-जवजनयम 2.3.14 म,ें
खंड (19) के अतं म,ें जनम्न जलजख त परंतुक को अंतःस्ट्थ ाजपत दकया िाएगा, अथावत-
“पर्तु यह दक यदि ऐसे उत्पाि वेंडडंग मिीन के माध्यम स े र्बेचे िाते है, तो खाद्य सुरक्षा और मानक (पैकेडिंग और
लेर्बडलगं ) जवजनयम, 2011 के जवजनयम 2.4.4(24,25,26,28 और 29) की अपक्षे ाओ के अनुसार कृजत्रम स्ट्वीटनर के
संर्बंध में खाद्य कारोर्बारी जवजिष्ट रूप से वेंडडंग मिीन पर जडस्ट््ल े करेगा और कप या कंटेनर पर जिसमें उत्पाि
परोसा िाता ह ैपर लेर्बल लगायेगा।
स्ट्पष्टीकरण— इस परंतुक के उद्देश्य के जलए, वेंडडंग मिीन म ें वे िाजमल नहं ह ैं िो पहल े से पैक दकए गए पेय और

NOTIFICATION
New Delhi, the 21st July, 2020
No. stds/Additive-3/notification/FSSAI/2018.— Whereas the draft of certain regulations, namely, the Food
Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2018, was published vide
notification of the Food Safety and Standards Authority of India number No. stds/Additive-
3/notification/FSSAI/2018, dated the 26th November, 2018, in the Gazette of India, Extraordinary, Part III, Section 4
as required by sub- section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), inviting
objections and suggestions from persons likely to be affected thereby, within a period of thirty days from the date on
which the copies of the Official Gazette containing the said notification were made available to the public;
And whereas the copies of the said Official Gazette were made available to the public on the 29th November,
2018;
And whereas the objections and suggestions received from the public in respect of the said draft regulations
have been considered by the Food Safety and Standards Authority of India;
Now, therefore, in exercise of the powers conferred by section 92 of the said Act, the Food Safety and
Standards Authority of India hereby makes the following regulations further to amend the Food Safety and
Standards (Prohibition and Restrictions on Sales) Regulations, 2011, namely: —[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
1. (1) These regulations may be called the Food Safety and Standards (Prohibition and Restrictions on Sales) First
Amendment Regulations, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, in regulation 2.3,
in sub-regulation 2.3.14, in clause (19), the following proviso shall be inserted, namely:-
“Provided that if such product is sold through a vending machine, the food business operator shall display
on the vending machine prominently and cause it to be labelled on the cup or container in which the
product is served in respect of artificial sweetener as per the labelling requirements specified under
regulation 2.4.4 (24, 25, 26, 28 and 29) of Food safety and Standards (Packaging and labelling)
Regulations,2011.
Explanation.- For the purpose of this proviso, vending machine does not include those which serve
pre-packaged beverages and food.”
