और, 2 ईि राजपत्र की प्रजतयां 26 फरवरी, 2 2020 को जनता को ईपलब्ध करा दी गइ थीं ; और, 2 केंरीय सरकार द्वारा ईक्त प्रारूप जनयमों की बाबत, ऐसे दकन्द् हीं अक्षेपों और सुझावों पर जवचार दकया जाएगा ; ऄतः, 2 ऄब, 2 केन्द्रीय सरकार, मोटर यान ऄजधजनयम, 2 1988 (1988 का 59) की धारा 134क द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, केन्द्रीय मोटर यान जनयम, 2 1989 का और संिोधन करन े के जलए जनम्नजलजखत जनयम बनाती ह, 2ै ऄथागत ्:- 1. संजक्षप्त नाम और प्रारंभ.- (1) आन जनयमों का संजक्षप् त नाम केंरीय मोटर यान (बारहवा ं सिं ोधन) जनयम, 2 2020 ह ै। (2) य ेराजपत्र म ेंऄंजतम प्रकािन की तारीख को प्रवृत् त होंगे । 4606 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंरीय मोटर यान जनयम, 2 1989 में जनयम 167 के प‍ चात ्जनम्न जलजखत खंड ऄत:स्ट् थाजपत दकया जाएगा, ऄथागत ् :-- “ऄध्याय ix - नके व्यजि की जाचं और परीक्षा 168. नके व्यजि के ऄजधकार.- (1) ऐसा व्यजि, जो ऄजधजनयम की धारा 134क के ऄनुसार नेक व्यजि ह,ै के जो ऄजधकार होंगे ईनका ब्यौरा आस ऄध्याय म ें जनजहत ह ैं और ईनके साथ दकसी भी धार्वमकता,राष्ट्रीयता,जाजतगत या लैंजगकता के अधार पर भेदभाव दकए बगैर सम्मानपूवगक व्यवहार दकया जाएगा। (2) एक नेक व्यजि, जजसने दघु गटना के बारे म ें पुजलस को सूजचत दकया ह ै या जो सड़क दघु गटना के पीजडत को ऄस्ट्पताल ल े गया ह,ै को पुजलस या ऄस्ट्पताल द्वारा अग े की दकसी भी अव‍यकता के जलए रूकन े को जववि नहीं दकया जाएगा और ईस े तुरंत स्ट्थान छोड़न ेकी ऄनुमजत होगी। (3) कोइ भी पुजलस ऄजधकारी, कोइ ऄन्द्य व्यजि, नेक व्यजि को ईनका नाम, पररचय, पता या आस प्रकार का ऄन्द्य व्यजिगत ब्यौरा बतान े के जलए बाध्य नहीं करेगा। परंत ु नेक व्यजि स्ट्वेच्छा स े ऄपना नाम, पता और घायल व्यजि (ऄगर जानन े वाला) का नाम पुजलस ऄजधकारी को बता सकता ह।ै परंत ु आसके ऄजतररि, यदद नेक व्यजि स्ट्वेच्छा स े ऄपना नाम या व्यजिगत जववरण बताता ह,ै तो पुजलस ऄजधकारी को ऐसे व्यजि को मामल े का प्रत्यक्षदिी साक्षी बनने के जलए बाध्य नहीं दकया जायेगा और प्रत्यक्षदिी साक्षी बनने का जवकल्प पूरी तरह स ेनेक व्यजि पर जनभगर करेगा। (4) तत्समय प्रवृत्त दकसी ऄन्द्य जवजध में ऄतं र्ववष्ट दकसी बात के होते हुए भी, एक नेक व्यजि, जो दकसी दघु गटना पीजडत को ऄस्ट्पताल पहुचं ाता ह,ै को जनम्नजलजखत के जलए बाध्य नहीं दकया जाएगा: (क) जचदकत्सीय- जवजध मामला प्ररूप के प्रयोजनाथ ग सजहत कोइ भी व्यजिगत ब्यौरा जैसे ईसका नाम, टेलीफोन नंबर और पता बतान े के जलए; (ख) घायल व्यजि को ऄस्ट्पताल म ें दाजखल करवाने के जलए संबंजधत दकसी प्रदिया को पूरा करने के जलए; या (ग) दकसी घायल व्यजि के ईपचार का जचदकत्सीय व्यय वहन करन े के जलए। परंत ु यदद नेक व्यजि ने स्ट्वेच्छा से ऄपना नाम बताया ह ै और यदद वह ऐसा करने की आस प्रकार वांछा करता ह,ै तो ऄस्ट्पताल ऄपन े अजधकाररक पत्र म ें ऐसे नेक व्यजि का नाम, पता, दघु गटना का समय, जतजथ, स्ट्थान और यह पुजष्ट करत े हुए दक घायल व्यजि को ईपयुगि व्यजि द्वारा लाया गया था, के रूप म ेंऄजभस्ट्वीकृजत प्रदान करेगा। परंत ु आसके ऄजतररि एक नेक व्यजि, जो दघु गटना का प्रत्यक्षदिी ह ै और स्ट्वेच्छा स े प्रत्यक्षदिी साक्षी बनाना चाहता ह,ै तो वह जांच प्रदिया म ें सहायता के जलए ऄपन े नाम और पते के ऄलावा प्रत्यक्षदिी साक्षी बनने की रजामंदी भी प्रकट कर सकता ह।ै (5) प्रत्येक ऄस्ट्पताल को प्रवेि या सुस्ट्पष्ट स्ट्थान पर हहदी, ऄंग्रेजी और स्ट्थानीय भाषा म ें एक ऄजधकार-पत्र सावगजजनक करना होगा, जजसमें आस ऄजधजनयम और आसके ऄधीन बनाए गए जनयम नेक व्यजि के ऄजधकारों के बारे में बताया गया हो। 169. नके व्यजि की परीक्षा. - (1) तत्समय प्रवृत्त दकसी ऄन्द्य जवजध म ें ऄंतर्ववष्ट दकसी बात के होते हुए भी, यदद कोइ व्यजि ऐसे मामले म ें स्ट्वेच्छा स े प्रत्यक्षदिी बनन े को सहमत ह,ै जजसम ें ईसने एक नेक व्यजि की भूजमका ऄदा की ह,ै तो ईसकी परीक्षा आस जनयम के ईपबंधों के ऄनुरूप की जाएगी। (2) नेक व्यजि की पूछताछ ईनकी सुजवधानुसार समय और स्ट्थान, जैसे अवास या कायग के स्ट्थान, पर की जाएगी और तदनुसार ऄन्द्वेषण ऄजधकारी सादे कपडों म ेंहोंगे। परंतु नेक व्यजि ऄपनी परीक्षा पुजलस थाने म ें करवान े का चयन कर सकता ह ै और ऐसे मामल े म,ें पूछताछ जबना दकसी ऄनुजचत जवलंब के समयबद्ध तरीके से और जहां तक संभव हो एक बार म ें ही पूरी की जाएगी। (3) नेक व्यजि के मामल े में ऄन्द्वेषण ऄजधकारी की भाषा या संबंजधत ऄजधकाररता की स्ट्थानीय भाषा के जसवाय कोइ भाषा बोलता ह,ै ऄन्द्वेषण ऄजधकारी दभु ाषीया की व्यवस्ट्था कराएगा । (4) यदद नेक व्यजि स्ट्वेच्छा स े प्रत्यक्षदिी साक्षी बनना चाहता ह,ै तो ईसे दंड प्रदिया संजहता, 1973 (1974 का 2) की धारा 296 के ऄनुरूप ईनका साक्ष्य िपथ-पत्र पर देने की ऄनुमजत दी जाएगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 परंत ु पुजलस ऄजधकारी को यह सुजनजित करना होगा दक जहां तक संभव हो पूछताछ के दौरान एक ही बार में नेक व्यजि का पूरा बयान या िपथ-पत्र दजग दकया जाए। (5) यदद नेक व्यजि की ईपजस्ट्थजत के मामल े म,ें ऄनुजचत जवलंब, व्यय या ऄसुजवधा के जबना ईपजस्ट्थत नहीं हो सकता ऄथवा ईसकी परीक्षा ईसकी सुजवधानुसार समय और स्ट्थान पर दकया जाना संभव नहीं होता ह,ै तो न्द्यायालय या मजजस्ट्रेट दंड प्रदिया संजहता, 1973 की धारा 284 के ईपबंधों के ऄनसु ार आसके ऄधीन दकए गए अवेदन पर परीक्षा अयोजजत के जलए एक अयोग जनयुि कर सकती ह”ै । (6) ऐसे नेक व्यजि के ईत्पीड़न और ऄसुजवधा को रोकने के जलए ईस नेक व्यजि जो प्रत्यक्षदिी साजक्षयों का चयन करता है की परीक्षा के दौरान वीजडयो कांफ्रेंहसग का व्यापक रूप से प्रयोग दकया जाएगा ।” । [फा. स.ं अरटी-16011/1/2015-अरएस] जप्रयांक भारती, संयुि सजचव रटप्पण : मूल जनयम भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3,ईप- खंड (i) की ऄजधसूचना संख्या सा.का.जन. 590(ऄ), तारीख 2 जून, 1989 को प्रकाजित दकए गए थ े और ऄजधसूचना सा.का.जन. 584(ऄ), तारीख 23.09.2020 द्वारा जपछली बार संिोधन दकया गया था। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th September, 2020 G.S.R. 594(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 141(E), dated the 26th February, 2020 in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, copies of the said Official Gazette were made available to the public on the 26th February, 2020; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 134A of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles (Twelfth Amendment) Rules, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, after rule 167, the following chapter shall be inserted, namely:- “Chapter IX- Examination of Good Samaritan and Enquiry 168. Rights of Good Samaritan. - (1) Any person who is a Good Samaritan, as per section 134A of the Act, shall have the rights detailed under this chapter, and shall be treated respectfully without any discrimination on the grounds of religion, nationality, caste or sex. (2) A Good Samaritan who has informed the police of any accident involving a motor vehicle, or who has transported a victim of an accident involving a motor vehicle to the hospital, shall not be subjected to any further requirements by the police or the hospital, and shall be permitted to leave immediately.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) No police officer or any other person, shall compel a Good Samaritan to disclose his name, identity, address or any such other personal details: Provided that the Good Samaritan may voluntarily choose to disclose his name, address, and name of the injured person (if known) to the police officer: Provided further that, if the Good Samaritan has voluntarily disclosed his name or personal details, the police officer shall not compel such person to become an eye-witness in the case, and choice of becoming an eye-witness shall solely rest with the Good Samaritan. (4) Notwithstanding anything contained in any other law for the time being in force, a Good Samaritan who transports a victim of an accident involving a motor vehicle to the hospital shall not be forced to, (a) disclose any personal information, such as his name, telephone number and address, including for the purpose of the Medico-Legal Case Form; (b) fulfil any procedure related to the admission of an injured person or victim at the hospital; or (c) bear any medical expenses towards the treatment of an injured person or victim: Provided that in case the Good Samaritan has volunteered his name, and if he so desires, the hospital shall provide an acknowledgement to such Good Samaritan, on official letter-pad, mentioning the name of the Good Samaritan, address, time, date, place of occurrence, and confirming that the injured person was brought by the said person: Provided further that, a Good Samaritan who has witnessed the accident and volunteers to become an eye-witness may, in addition to his name and address, also indicate his willingness to become an eye-witness in order to facilitate the investigation process. (5) Every public and private hospital shall publish a charter in Hindi, English and vernacular language, at the entrance or other conspicuous location, and on their website, stating the rights of Good Samaritans under the Act and the rules made thereunder. 169. Examination of Good Samaritan. - (1) Notwithstanding anything to the contrary contained in any other law for the time being in force, if a person has voluntarily agreed to become a witness in the case in which he has acted as a Good Samaritan, he shall be examined in accordance with the provisions of this rule. (2) The examination of a Good Samaritan shall be conducted at a time and place of his convenience, such as his place of residence or business, and the investigating officer shall accordingly be dressed in plain clothes: Provided that the Good Samaritan may choose to have his examination done at the police station, and in such case, the examination shall be conducted in a time bound manner without causing undue delay, and as far as possible, completed in a single examination. (3) In case the Good Samaritan speaks a language other than the language of the investigating officer or the local language of the respective jurisdiction, the investigating officer shall arrange for an interpreter. (4) In case the Good Samaritan has volunteered to become an eye-witness, he shall be permitted to give his evidence on affidavit in accordance with the provisions of section 296 of the Code of Criminal Procedure, 1973 (2 of 1974): Provided that the affidavit of the Good Samaritan, if filed, shall be treated as complete statement, and in case a statement is to be recorded, the complete statement shall be recorded in a single examination. (5) In case the attendance of a Good Samaritan cannot be procured without delay, expense or inconvenience, which under the circumstances of the case would be unreasonable, or the examination is unable to take place at a time and place of his convenience, the Court or the Magistrate may dispense with such attendance and may issue a commission for the examination of[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 the Good Samaritan in accordance with the provisions of section 284 of the Code of Criminal Procedure, 1973 to conduct the examination, on an application made thereunder.
