L.-33004/99 सी.जी.-डी.एल.-अ.-23082023-248239 xxxGIDHxxx CG-DL-E-23082023-248239 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 585] नई दिल्ली, मगं लिार, अगस्ट्त 22, 2023/श्रािण 31, 1945 No. 585] NEW DELHI, TUESDAY, AUGUST 22, 2023/SHRAVANA 31, 1945 भारतीय खाद्य सरु क्षा और मानक प्राजधकरण अजधसचू ना नई दिल्ली, 21 अगस्ट्त, 2023 फा. स.ं एसटीडी/एसपी-21/टी(अल्कोहल-4).—खाद्य सरु क्षा और मानक (अल्कोहाजलक पेय) संिोधन जिजनयम, 2022 का प्रारूप खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) की धारा 92 की उप-धारा (1) के अधीन यथापेजक्षत भारत के रािपत्र, असाधारण, भाग 3, खंड 4 म ें भारतीय खाद्य सुरक्षा और मानक प्राजधकरण की अजधसूचना संख्या फा. स.ं एसटीडी/एसपी-21/टी(अल्कोहल-4) तारीख 17 मई, 2022 द्वारा प्रकाजित दकया गया था, जिसम ें उन सभी व्यजियों जिनके उनस े प्रभाजित होने की संभािना थी, उस तारीख स,े जिसको उि अजधसूचना को अंतर्ििष्ट करने िाली रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थी, साठ दिन की अिजध के भीतर आक्षेप और सुझाि आमंजत्रत दकए गए थ;े और उक्त रािपत्र की प्रजतया ाँिनता को 20 मई, 2022 को उपलब् ध करा िी गई थीं; और उक्त प्रारूप जिजनयमों की बाबत पर िनता से प्राप् त आक्षेपों और सुझािों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जिचार कर जलया गया ह;ै अत: अब, भारतीय खाद्य सुरक्षा और मानक प्राजधकरण उक्त अजधजनयम की धारा 92 की उपधारा (2) के खडं (फ) द्वारा प्रित् त िजियों का प्रयोग करते हुए खाद्य सुरक्षा और मानक (अल्कोहाजलक पेय) जिजनयम, 2018 का संिोधन करने के जलए जनम्न जलजखत जिजनयम बनाता ह,ै अथाित,् - 1. इन जिजनयमों का संजक्षप्त नाम खाद्य सुरक्षा और मानक (अल्कोहाजलक पेय) प्रथम संिोधन जिजनयम, 2023 ह।ै 2. ये तारीख 01 माच ि2024 स े प्रिृत होंगे। 5395 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 3. खाद्य सुरक्षा और मानक (अल्कोहाजलक पेय) जिजनयम, 2018 म ें- (1) मॉल्ट या अनाि जहहस्ट्की स े संबंजधत भाग 2 के जिजनयम 2.8 के उप-जिजनयम 2.8.1 म ें खंड (1) के स्ट्थान पर जनम्नजलजखत को रखा िाएगा, अथाित ् - “(1) ससंगल माल् ट जहहस्ट्की दकजण्ित मैि स े प्राप्त एक आसतु उत्पाि ह ै िो जबना दकसी अन्य अनाि को जमलाए ऐस े दकजण्ित िौ का प्रयोग करता ह ै जिसे केिल पॉट स्ट्टील म ें आसजित दकया गया हो एि ं उत्पािन के जलए एकल आसिन का प्रयोग दकया गया हो। (1 क) ससंगल अनाि जहहस्ट्की दकजण्ित मैि स े प्राप्त एक ऐसा आसुत उत्पाि ह ै िो मॉल्ट या मॉल्टरजहत अनाि का प्रयोग करता हो एि ं जिसका उत्पािन एकल आसिन के द्वारा दकया गया हो। ससंगल मॉल्ट जहहस्ट्की म ें एकल मॉल्ट जहहस्ट्की, जमजश्रत (जपसी हुई) मॉल्ट जहहस्ट्की या जमजश्रत (जपसी हुई) अनाि जहहस्ट्की सजम्मजलत नहीं होती ह”ै । (2) भाग 5 म ेंजिजनयम 5.5 के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथाित ् - “5.5 अल्कोहाजलक पेय के लेबल पर दकलो कैलोरी म ें उिा ि की मात्रा के अजतररि दकसी भी प्रकार की पोषण संबंधी सूचना नहीं होगी। ऐसी उिा ि की मात्रा स े संबंजधत घोषणा स्ट्िैजछिक होगी” । िी. कमला िधिन राि, मख्ु य कायिकारी अजधकारी [जिज्ञापन III/4/असा./368/2023-24] रटप्प ण.- मलू जिजनयम भारत के रािपत्र, असाधारण, भाग 3, खडं 4 म ें अजधसूचना स. फा0 स.ं 2/एसए- 24/2009(1)/एफएसएसएआई, तारीख 19 माचि, 2018 द्वारा प्रकाजित दकए गए थ े और जनम्नजलजखत अजधसूचनाओं द्वारा पश्चातिती संिोजधत दकए गए थ े: 1. फा.स.ं एसटीडीएस/एसपी (िल एि ंपेय)/अजधसूचना(1)/एफएसएसएआई-2019, तारीख 18 दिसम्बर, 2020 तथा 2. फा. स.ं एसटीडी/एसपी-21/टी(अल्कोहल-5), तारीख 10 िून, 2022। FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 21st August, 2023 F. No. STD/SP-21/T(Alcohol-4).—Whereas the draft of the Food Safety and Standards (Alcoholic Beverages) Amendment Regulations, 2022 were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number, F. No. Std/SP-21/T(Alcohol-4), dated the 17th May, 2022, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas copies of the said Gazette were made available to the public on the 20th May, 2022; And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, namely: - 1. These regulations may be called the Food Safety and Standards (Alcoholic Beverages) First Amendment Regulations, 2023. 2. They shall come into force on 01st March 2024. 3. In the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, - (1) In Part 2, in regulation 2.8, in sub-regulation 2.8.1 related to Malt or grain whisky, for clause (i) the following shall be substituted, namely, -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 “(i) Single malt whisky is a distillate obtained from fermented mash that uses malted barley without adding any other grain, which is distilled in pot still only and produced in a single distillery. (ia) Single grain whisky is a distillate obtained from a fermented mash that uses malted or unmalted grain, and produced in a single distillery. Single grain whisky shall not include single malt whisky and blended malt whisky or blended grain whisky”. (2) In Part 5, for the regulation 5.5 the following shall be substituted, namely, - “5.5 Alcoholic beverage shall not contain any nutritional information on the label except energy content in kcal. Such declaration related to energy content shall be voluntary”. G.
