## Policy Analysis Report: Food Safety and Standards Labelling and Display Second Amendment Regulations, 2022 **1. Executive Summary:** This report analyzes the Food Safety and Standards Labelling and Display Second Amendment Regulations, 2022, as notified by the Food Safety and Standards Authority of India (FSSAI). This amendment focuses on changes to the labelling requirements for Pan Masala and various types of bread. The key findings highlight new rules regarding warning statement size for Pan Masala and specific composition and nomenclature standards for different types of bread, including minimum specialty ingredient requirements. The amendment aims to provide clearer and more informative labeling for consumers, particularly regarding health risks associated with Pan Masala and the composition of bread products. **2. Introduction:** This report provides an informative analysis of the Food Safety and Standards Labelling and Display Second Amendment Regulations, 2022, based solely on the provided policy text. The analysis focuses on the changes introduced by this amendment, their rationale, and their potential impact on stakeholders. **3. Policy Overview:** * **Amendment to:** Food Safety and Standards Labelling and Display Regulations, 2020. * **Core Objective(s):** Based on the provided text, the core objectives of this amendment are to enhance consumer awareness regarding potential health risks associated with Pan Masala consumption through prominent labeling and to standardize the nomenclature and composition of various bread types to ensure product consistency and inform consumers about their ingredients. **4. Background and Rationale:** This amendment appears to address the need for stricter regulations concerning the labeling of products with potential health risks, specifically Pan Masala, and a desire for greater clarity and standardization in the bread manufacturing industry. The amendment likely aims to reduce the consumption of Pan Masala by highlighting its health risks and to ensure that bread products accurately reflect their ingredients. The focus on minimum ingredient percentages suggests an attempt to prevent misleading labeling practices and ensure consumers receive the products they expect. **5. Key Provisions / Changes:** The Food Safety and Standards Labelling and Display Second Amendment Regulations, 2022, introduce the following specific changes to Schedule II of the Food Safety and Standards Labelling and Display Regulations, 2020: * **Pan Masala Labeling:** * **Original Policy (Inferred):** The previous policy likely had less stringent requirements for warning statements on Pan Masala packaging. * **New Rule:** The warning statement "CHEWING OF PAN MASALA IS INJURIOUS TO HEALTH" must cover 50% of the front-of-pack label. * **Effect of Change:** This change significantly increases the prominence of the health warning, aiming to deter consumers from purchasing and consuming Pan Masala. * **Bread Labeling:** * **Original Policy (Inferred):** The previous policy likely lacked specific standards for the composition and nomenclature of various types of bread. * **New Rule:** The amendment introduces a table specifying the specialty ingredient and the minimum amount of that ingredient (as a percentage of flour) for various bread types, including Whole Wheat Bread, Wheat Bread (or Brown Bread), White Bread, Multigrain Bread, and various Specialty Breads (e.g., Milk Bread, Honey Bread, Cheese Bread). Specific specialty ingredients and their minimum required percentage are defined. * **Effect of Change:** This change standardizes bread labeling, ensuring that products labeled as "Whole Wheat Bread," "Multigrain Bread," or any specialty bread (e.g., "Cheese Bread") contain the minimum specified amount of the key ingredient. This protects consumers from misleading labeling and promotes transparency in bread production. For multigrain bread there is a minimum 10% of grains other than wheat in the 1st year of enforcement and thereafter it shall be 20%. **6. Target Audience and Stakeholders:** The direct target audience and stakeholders affected by these changes include: * **Pan Masala Manufacturers:** They must comply with the new labeling requirements, redesigning their packaging to accommodate the prominent health warning. * **Bread Manufacturers:** They must adhere to the new standards for bread composition and labeling, adjusting their recipes and labeling practices to meet the specified ingredient requirements. * **Consumers:** They are expected to benefit from increased awareness of the health risks associated with Pan Masala and more transparent and accurate information about the composition of bread products. * **Food Safety and Standards Authority of India (FSSAI):** They are responsible for enforcing these regulations. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The Food Safety and Standards Authority of India (FSSAI) is responsible for implementing and enforcing these regulations. * **Timeline:** The regulations come into force on 1st May, 2023. * The Multigrain bread ingredient percentage has a tiered enforcement schedule, increasing one year after enforcement. **8. Expected Outcomes / Impact of Changes:** * **Pan Masala:** The increased prominence of health warnings is expected to reduce Pan Masala consumption and raise public awareness of its harmful effects. * **Bread:** The standardized bread labeling is expected to improve consumer understanding of bread composition, prevent misleading labeling practices, and promote healthier food choices. This may lead to a higher quality of bread products available to consumers, and the reduction of misleading marketing practices. **9. Conclusion:** The Food Safety and Standards Labelling and Display Second Amendment Regulations, 2022, represent a significant step towards enhancing consumer protection and promoting transparency in the food industry. The changes regarding Pan Masala labeling and bread composition standards are likely to have a positive impact on public health and consumer awareness. The successful implementation of these regulations will depend on effective enforcement by the FSSAI and compliance from manufacturers.
