(1) आन जिजनमयों का संजक्षि नाम खाद्य सुरक्षा और मानक (पैकेलिग और लेबललग) प्रथम संिोधन जिजनयम, 2020 ह ै । (2) यह रािपत्र में आनके प्रकािन की तारीख को प्रित्त होंगे और खाद्य कारोबार चालक को 1 िनिरी 2022 से आन जिजनयमों के सभी ईपबंधों का ऄनुपालन करना होगा। आस जतजथ स े पहले ऄनुपालन स्ट्िैजछिक होगा। 2. खाद्य सुरक्षा और मानक (पकै ेलिग और लेबललग) जिजनयम, 2011 में, जिजनयम 2.4 में, ईप-जिजनयम 2.4.5 के पश्चात, जनम्नजलजखत ईप-जिजनयम को ऄंत:स्ट्थाजपत दकया िाएगा, ऄथावत्:- ‘2.4.6: खाद्य सिे ा प्रजतष्ठानों म ें िानकारी का प्रदिनव .- (1) खाद्य सेिा प्रजतष्ठान जिनके पास केंद्रीय ऄनुज्ञजि हो ऄथिा जिनके दस या ईससे ऄजधक जनगवम हो िे ईनके द्वारा बेचे िान े िाले प्रत्येक खाद्य पदाथव का कैलोरीफ मूल्य (दकलो कैलोरी में प्रजत सर्विग और सर्विग मात्रा) मैन्यू काड व या बोडों या पुजस्ट्तका पर खाद्य पदाथों के समक्ष प्रदर्वित करेंगे। आसके ऄजतठरक्त, प्रजत ददन औसत ियस्ट्क के जलए 2000 दकलो केलोरी उिाव की अिश्यकताओं पर संदभव िानकारी स्ट्पष्ट रूप से और प्रमुख रूप स े प्रदर्वित की िाएगी। (2) खाद्य सेिा प्रजतष्ठान मने ू काड व या बोड व या बकु लेट पर प्रदर्वित खाद्य पदाथों के समक्ष नीच े जनर्ददष्ट िानकारी प्रदर्वित करेंगे:- (क) भोिन में एलिी से संबजं धत िानकारी; यदद खाद्य जनम्नप्रकार के ह।ैं (i) लस युक्त ऄनाि; यानी, गेह,ं राइ, िौ, िइ, ितवनी या ईनके सकं ठरत ईपभेद और आन के ईत्पाद; (ii) क्रस्ट्टेजियन और ईनके ईत्पाद; (iii) दधू और दधू ईत्पाद; (iv) ऄंड े और ऄंड े के ईत्पाद; (v) मिली और मिली ईत्पाद; (vi) मूंगफली के पेड़ के नट और ईनके ईत्पाद; (vii) सोयाबीन और ईनके ईत्पाद; (viii) 10 जम.ग्रा. / दकग्रा या ऄजधक की सांद्रता में सल्फाआट: परंत ु दक एलिी को प्रतीकों को समझने के जलए असान द्वारा जचजत्रत दकया िा सकता है। (ख) िाकाहारी या मांसाहारी संबंधी लोगो; (3) ये ईपबंध जनम्नजलजखत पर लागू नहीं होंगे: (क) आिेंट कैटरसव और फूड सर्विस पठरसर िो कैलेंडर िर्व में साि ददनों से कम समय तक चलते ह ैं (लगातार या लगातार नहीं)। (ख) स्ट्ि-सेिा मसालों िो जनःिुल्क ह ैं और मन्ै यू पर सूचीबद्ध नहीं ह।ैं (ग) ग्राहक के ऄनुरोध के ऄनसु ार जििेर् ऑडरव अआटम या संिोजधत भोिन और मेनू मद।[भाग III—खण् ड 4] भारत का रािपत्र : ऄसाधारण 3 (4) खाद्य सेिा प्रजतष्ठान ईप-जिजनयमन 2.2.2 के खंड (3) के तहत जनर्ददष्ट पोर्ण संबंधी िानकारी और ईप- जिजनयम 2.4.4 के खंड (18), (25), (38), (46), (47) और (48) के तहत जनर्ददष्ट जिजिष्ट अिश्यकताए,ं यदद लागू हो, प्रदान करेंगे। िैजिक खाद्य या सामग्री स े संबंजधत िानकारी, यदद दािा दकया िाता ह,ै तो बुकलेट या हडैं अईट के रूप में या ईनकी िेबसाआट पर ऄनुरोध पर ईपभोक्ताओं को ईनके द्वारा बचे े गए खाद्य पदाथों के जलए भी प्रदान करेंगे: परंत ु दक पच्चीस प्रजतित का जिचलन पोर्ण संबंधी सचू ना घोर्णा के मामले में सहन दकया िा सकता ह।ै (5) इ-कॉमसव खाद्य कारबार प्रचालकों से संबंजधत खाद्य कारबार प्रचालक से खंड (1), (2) और (4) में संदर्वभत िानकारी प्राि करेंगे और िहां भी लागू हो, ईनकी िेबसाआट पर ईपलब्ध कराएगं े। (6) प्राजधकरण समय-समय पर आन जिजनयमों में जिजनर्ददष्ट अिश्यकताओं का पालन करन े के जलए ऄन्य खाद्य सेिा प्रजतष्ठानों को भी जनर्ददष्ट कर सकता ह।ै ’ ऄरुण लसघल, मुख्य कायवपालक ऄजधकारी [जिज्ञापन-III/4/ऄसा./198/2020] ठटप्पण : मूल जिजनयम, भारत के रािपत्र, ऄसाधारण, भाग III, खंड 4 में ऄजधसूचना संख्याकं फा. स.ं 2- 15015//30/2010, तारीख 1 ऄगस्ट्त, 2011 द्वारा प्रकाजित दकए गए थ े और ईनमें तत्पश्चात ् जनम्नजलजखत ऄजधसूचना संख्यांकों द्वारा संिोधन दकए गए थे :- (i) फा. स.ं 4/15015/30/2011, तारीख 7 िनू , 2013; (ii) फा. सं. पी.15014/1/2011-पी.एफ.ए./एफ.एस.एस.ए.अइ., तारीख 27 िनू , 2013; (iii) फा. सं. 1-83एल./एससीअइ.पैन-ऄजध./एफ.एस.एस.ए.अइ.-2012, तारीख 17 फरिरी, 2015; (iv) सं. 3-16/जिजनर्ददष्टए खाद्य/ऄजधसूचना (खाद्य लेबललग)/एफएसएसएअइ-2014, तारीख 3 मइ, 2016; (v) फा.स.ं 1(94)2015/ऄजधसूचना पी एडं एल/प्रि./एफ.एस.एस.ए.अइ, तारीख 25 मइ, 2016; (vi) सं. 3-14पी /ऄजधसचू ना (न्यूराजस्ट्टकल्स)/एफ़एसएसएअइ -2013, तारीख 13 िुलाइ, 2016 (vii) फा.सं. 1-120(2)/मानक/दकरजणत/एफएसएसएअइ-2015, तारीख 23 ऄगस्ट्त, 2016; और (viii) फाआल सं. अरइिी/11/27/बीइिीओ-लेबललग/एफ़एसएसएअइ-2018, तारीख 24 ददसंबर, 2018।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 21st August, 2020 F. No. REG-18/Menu Labelling/FSSAI-2018.—Whereas the draft of the Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018, were published as required under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide notification of the Food Safety and Standards Authority of India number No. REG-18/Menu Labelling/FSSAI-2018, dated the 8th October, 2018, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas the copies of the said Gazette were made available to the public on the 15th October, 2018; And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by clause (k) of sub-section (2) of section 92 read with section 23 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, namely:- 1. (1) These regulations may be called the Food Safety and Standards (Packaging and Labelling) First Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the Official Gazette and Food Business Operator shall comply with all the provisions of these regulations by 1st January, 2022. Compliance before this date shall be voluntary. 2. In the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, in regulation 2.4, after sub- regulation 2.4.5, the following sub-regulation shall be inserted, namely:- ‘2.4.6: Display of information in food service establishments.- (1) Food Service Establishments having central license or outlets at ten or more locations shall mention the calorific value (in kcal per serving and serving size) against the food items displayed on the menu cards or boards or booklets and the reference information on calorie requirements shall also be displayed clearly and prominently as “An average active adult requires 2,000 kcal energy per day, however, calorie needs may vary”. (2) Food Service Establishments shall also mention the information specified below against the food items displayed on the menu cards or boards or booklets namely:- (a) information relating to allergens, if food consists of or are made of the following: (i) Cereals containing gluten; i.e., wheat, rye, barley, oats, spelt or their hybridized strains and products of these; (ii) Crustacean and their products; (iii) Milk and milk products; (iv) Eggs and egg products; (v) Fish and fish products; (vi) Groundnut tree nuts and their products; (vii) Soybeans and their products; (viii) Sulphite in concentrations of 10mg/kg or more: Provided that the allergens may be depicted by easy to understand symbols; (b) logo for vegetarian or non-vegetarian. (3) The provisions of this regulation shall not be applicable to the following, namely:- (a) event caterers and food service premises that operate for less than sixty days in a calendar year (consecutively or non-consecutively); (b) self-serve condiments that are free of charge and not listed on the menu; and[भाग III—खण् ड 4] भारत का रािपत्र : ऄसाधारण 5 (c) special-order items or modified meals and menu items as per request of the customer. (4) Food Service Establishments shall also provide nutritional information as specified under clause (3) of sub- regulation 2.2.2, specific requirements specified under clauses (18), (25), (38), (46), (47) and (48) of sub- regulation 2.4.4, if applicable and information relating to organic food or ingredients, if claimed, for the food items sold by them to consumers upon request in the form of booklets or handouts or on their website: Provided that deviation of twenty-five per cent. may be tolerated in case of nutritional information declaration. (5) E-commerce Food Business Operators shall get the information referred to in clause (1), (2) and (4) from respective Food Business Operator and provide on their website wherever applicable.
