**Policy Analysis Report: Food Safety and Standards (Prohibition and Restriction on Sales) First Amendment Regulations, 2021**
**1. Executive Summary:**
This report analyzes the Food Safety and Standards (Prohibition and Restriction on Sales) First Amendment Regulations, 2021, as published in the Gazette of India on January 13, 2021. This amendment modifies the 2011 regulations concerning the restriction on the use of certain ingredients in food products, specifically addressing the allowable limit of *Khesari dal* in pulses. The key finding is the establishment of a maximum limit of 2 grams of incidentally occurring *Khesari dal* per kilogram of pulses.
**2. Introduction:**
This report aims to provide a comprehensive overview of the Food Safety and Standards (Prohibition and Restriction on Sales) First Amendment Regulations, 2021, based solely on the information provided in the published gazette notification. This analysis is intended to inform stakeholders about the specific changes introduced by this amendment.
**3. Policy Overview:**
This amendment modifies the Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011. The core objective, as inferred from the text, is to regulate the presence of potentially harmful or undesirable ingredients in food products to ensure food safety and protect consumer health.
**4. Background and Rationale:**
This amendment addresses a specific concern related to the incidental presence of *Khesari dal* in pulses. The rationale for this amendment appears to be to mitigate potential health risks associated with excessive consumption of *Khesari dal*, by setting a maximum allowable limit, which implies that *Khesari dal* may pose a risk above certain concentrations.
**5. Key Provisions / Changes:**
This amendment introduces the following change to the Food Safety and Standards Prohibition and Restriction on Sales Regulations, 2011:
* **Specific Part of Original Policy Changed:** Regulation 2.2, relating to the restriction on the use of certain ingredients. Specifically, it adds a sub-regulation after 2.2.1.
* **New Rule/Provision:** Sub-regulation 2.2.2 states that the maximum allowed limit for incidentally occurring *Khesari dal* in pulses shall be no more than 2 grams per kilogram (2g/kg), including other edible grains.
* **Effect of Change:** This amendment sets a quantitative limit on the permissible amount of *Khesari dal* present in pulses. It moves from potentially unregulated presence to a defined threshold for consumer protection and to assist the food processing industry with guidelines.
**6. Target Audience and Stakeholders:**
The target audience and stakeholders directly affected by this amendment include:
* Food producers and processors involved in the production and processing of pulses.
* Food safety regulators and enforcement agencies responsible for monitoring and ensuring compliance with food safety standards.
* Consumers who consume pulses as part of their diet.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Food Safety and Standards Authority of India (FSSAI) is the responsible agency for implementing and enforcing these regulations.
* **Timelines or Procedures:** The amendment came into force on the date of its publication in the Official Gazette, which was January 13, 2021.
* **Specific to Changes:** Compliance with the new limit of 2g/kg of *Khesari dal* in pulses is required from the date of publication. Procedures for testing and verification would likely be the responsibility of food safety officers and accredited laboratories.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to:
* Reduce consumer exposure to potentially harmful levels of *Khesari dal* in pulses.
* Provide clarity and guidance to the food industry regarding acceptable levels of *Khesari dal* contamination.
* Enhance the overall safety and quality of pulses available to consumers.
* Provide a clear, measurable standard for enforcement.
**9. Conclusion:**
The Food Safety and Standards (Prohibition and Restriction on Sales) First Amendment Regulations, 2021, introduces a crucial quantitative limit on *Khesari dal* content in pulses sold in India. This regulatory measure is designed to ensure consumer safety and provides a clear standard for the food processing industry to adhere to. This amendment signifies a commitment to refining existing regulations to address specific food safety concerns and improve public health outcomes.
