रािपत्र, असाधारण, भाग II, खंड 3 उप खंड (i) में प्रकाजित दकए गए थ,े जिसम ें उन सभी व्यजियों से, जिनसे उनसे
प्रभाजवत होने की संभावना थी, उस तारीख से, जिनको उि अजधसूचना से अंतर्वगष्ट रािपत्र की प्रजतयां िनता को उपलब्ध
करा िी गई थी, तीस दिन की अवजध के अवसान से पूवग आक्षपे और सुझाव आमंजत्रत दकए गए थे ;

अतः, अब, केन्द्द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 की उपधारा (1) द्वारा
प्रित्त िजियों का प्रयोग करत े हुए, केन्द्द्रीय मोटर यान जनयम, 1989 का और संिोधन करन े के जलए जनम्नजलजखत जनयम
बनाती ह,ै अथागत ्:-

1. संजक्षप् त नाम और प्रारंभ (1) इन जनयमों का संजक्षप् त नाम केंद्रीय मोटर यान (तीसरा सिं ोधन) जनयम, 2021 ह ै।
(2) इन जनयमों में िैसा अन्द्यथा उपबंजधत ह,ै उसके जसवाय, ये जनयम रािपत्र में उनके प्रकािन की तारीख को प्रवृत् त
होंगे ।
2. केंद्रीय मोटर यान जनयम, 1989 में जनयम 125 के उप-जनयम (9) के पश्चात जनम्नजलजखत उप-जनयम अंत:स्ट्थाजपत
दकया िाएगा, अथागत:् -
“(9अ) उप जनयम (9) में अंतर्वगष्ट दकसी बात के होते हुए भी, नए मॉडलों के मामले म,ें तारीख 01 अप्रलै , 2021 को
और उसके पश्चात, तथा जवद्यमान मॉडलों के मामले म,ें तारीख 31 अगस्ट्त, 2021 को और उसके पश्चात चालक स े
जभन्न, सामन े की सीट पर बैठने वाले व्यजि के जलए एयरबैग दफट दकया िाएगा और ऐसे एयरबैग के जलए यह अपेक्षा,
समय-समय पर यथासंिोजधत एआईएस 145 के अनुसार तब तक के जलए होगी िब तक तत्स्ट्थानी भारतीय मानक
ब्यूरो (बीआईएस), जवजनिेि भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) के अधीन अजधसूजचत नहीं कर
दिये िाते ह।ैं ”

NOTIFICATION
New Delhi, the 2nd March, 2021
G.S.R. 148(E).—Whereas, the draft rules further to amend the Central Motor Vehicles
Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles
Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport
and Highways G.S.R 757(E), dated the 11th December,2020, in the Gazette of India, Extraordinary,
Part II, Section (3), Sub-section (i) inviting objections and suggestions from persons likely to be
affected before the expiry of the period of thirty days from the date on which copies of the Gazette
containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on 11th December,
2020;
And whereas, objections and suggestions received from the public in respect of the said draft rules
have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 110 of the
Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules
further to amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (Third
Amendment) Rules, 2021.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the

2. In the Central Motor Vehicles Rules, 1989, after sub-rule (9) of rule 125, the following sub-rule shall
be inserted, namely:-
“(9A) Notwithstanding anything contained in sub rule (9), vehicles manufactured on and after the 1st Day
of April, 2021, in the case of new models, and 31st day of August, 2021, in the case of existing models, shall
be fitted with airbag for the person occupying the front seat, other than the driver and the requirement for
such airbag shall be as per AIS 145, as amended from time to time, till the corresponding Bureau of Indian
Standards (BIS) specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
