अतः, अब, के’(cid:17)ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क8 धारा 110 Aारा #दO शि>यF का #योग करते हएP , के’(cid:17)ीय मोटर यान
िनयम, 1989 का और संशोधन करने के िलए िन निलिखत िनयम बनाती ह,ै अथा7त ्:--
1. (1) इन िनयमF का संिBVत नाम क(cid:16)(cid:17)ीय मोटर यान (ik¡poka संशोधन) िनयम, 2016 ह ै।
(2) ये राजप* म(cid:16) उनके #काशन क8 तारीख को #वYृ त हFग े।
2. क(cid:16)(cid:17)ीय मोटर यान िनयम, 1989 (िजसे इसम(cid:16) इसके पZात ्उ> िनयम कहा गया ह)ै म(cid:16), िनयम 123 के #थम परंतकु के पZात ्िन निलिखत परंतकु अंतः[थािपत
िकए जाएंग,े अथात7 ्:-
"परंत ुयह िक 1 अ>ूबर, 2016 को या उसके पZात् कोई ह(cid:6)का भार आधान िकसी मोटर साइिकल पर िफट िकया जा सकता ह ैपरंत ुउसे िन निलिखत
अपेBाए ंपरूी करनी हFगी :
(i) आधान का आकार 550 िम.मी. ल बाई, 510 िम.मी. चौड़ाई और 500 िम.मी.उंचाई से अिधक नहH होगा ;
(ii) आधान का भार िजसके अंतगत7 उसक8 मढ़ाई और आधान म(cid:16) वहन िकए जान ेवाला भार भी ह,ै 30 िक.‘ा. से अिधक नहH होगा;
(iii) यिद ऐसा आधान को िपछली सवारी िदM[थान पर िफट िकया जाता ह ैतो िकसी िपछली सवारी को अनcु ात नहH क8 जाएगी :
परंत ुयह िक आधान का भार िजसके अंतगत7 उसक8 मढ़ाई और आधान म(cid:16) वहन िकए जान ेवाला भार भी ह,ै यान िविनमा7ता Aारा िविनिदd7 और
साथ ही िनयम 126 म(cid:16) िनिदd7 जांच एजे’सी Aारा अनमु ोिदत िक.‘ा. सकल यान भार के भीतर अनcु ेय होगा ;

(iv) यिद ऐसा आधान को िपछली सवारी िदक् [थान के पीछे िफट िकया जाता ह ैतो िकसी िपछली सवारी को आसीन होने के िलए अनcु ात नहH िकया
जाना चािहए :
परंत ु यह िक िपछली सवारी का भार और आधान का भार िजसके अंतगत7 उसक8 मढ़ाई और आधान म(cid:16) वहन िकए जाने वाला भार भी ह,ै यान
िविनमा7ता Aारा िविनिदd7 और साथ ही िनयम 126 म(cid:16) िनिदd7 जाचं एजे’सी Aारा अनमु ोिदत िक.‘ा. सकल यान भार के भीतर अनcु ेय होगा ।"

NOTIFICATION
New Delhi, the 2nd May, 2016
G.S.R. 473(E).– Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were
published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification
of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 789(E), dated the
19th October, 2015, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and
suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on
which copies of the said notification containing the draft rules were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 19th October,
2015;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been
considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of
1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules,
1989, namely:-
1. (1) These rules may be called the Central Motor Vehicles (Fifth Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules,1989 (hereafter referred as the said rules), in rule 123, after the first proviso,
the following proviso shall be inserted, namely:-
“Provided that on and after 1st October, 2016, a light weight container may be fitted on a motorcycle
provided it meets the following requirements:
(i) the dimensions of the container shall not exceed 550 mm in length, 510 mm in width and 500 mm in
height;
(ii) weight of the container including its mounting and the load carried in the container shall not exceed
30 kgs;
(iii) if such container is fitted on the pillion rider space, then no pillion rider shall be allowed:¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
Provided that the weight of container including its mounting and the load carried in the container, shall
be within the permissible Gross Vehicle Weight in kg, specified by the vehicle manufacturer and also
approved by the test agency referred to in rule 126;
(iv) if such container is fitted behind the pillion rider space then no pillion rider should be allowed to be
seated:
Provided that the weight of the pillion rider, and weight of the container including its mounting and the
load carried in the container, shall be within permissible Gross Vehicle Weight in kg, specified by the
vehicle manufacturer and also approved by the test agency referred to in rule 126.”.
