सा.का.जन. 56(अ), तारीख 29 िनवरी, 2021 द्वारा प्रकाजित दकए गए थे जिसमें ऐस े सभी व्यजियों से, जिनकी उसस े
प्रभाजवत होने की संभावना थी, उस तारीख स,े जिनको उि अजधसूचना को अंतर्वगष्ट करने वाल े रािपत्र की प्रजतया ं िनता

अतः, अब, केंद्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजियों का
प्रयोग करते हुए, केंद्रीय मोटरयान जनयम, 1989 म ेंऔर जनम्नजलजखत संिोधन करती ह,ै अथातग ् :-
1. सजं िप्त िीर्कग और प्रारंभ - (1) इन जनयमों को केंद्रीय मोटर यान (आठवां संिोधन) जनयम, 2021 ह ै।
(2) इन जनयमों में अन्यथा उपबजं धत के जसवाय, य ेरािपत्र म ेंअंजतम प्रकािन की तारीख को प्रवृत् त होंगे।

2. केंद्रीय मोटर यान जनयम, 1989 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया ह)ै म,ें जनयम 115-कक के पश् चात ्
जनम्नजलजखत जनयम अंत:स्ट् थाजपत दकया िाएगा, अथागत ् :-
"115 कख-सीएनिी, िैव -सीएनिी, एलएनिी स ेचाजलत कृजर् रैक्टरों, पावर रटलरों, सजं नमाणग उपस्ट्कर यानों और सयं िु
हावस्ट्े टरों के जलए मास उत्सिनग मानक -
(I) प्रयोगिील डीिल यान के इंिनों के रूपातं रण द्वारा सपं ररवतनग के जलए
(क) कृजर् रैक्टरों, पावर रटलरों, संजनमागण उपस्ट्कर यानों और संयुि हावेस्ट्टरों के मामले में समर्पगत सीएनिी /
िैव-सीएनिी / एलएनिी संचालन के जलए रेरोदिटेड डीिल इंिन का टाइप अनुमोिन यान के जवजिष्ट मेक
और मॉडल के जलए दिया िाएगा और कृजर् रैक्टरों, पावर रटलरों, सजं नमागण उपस्ट्कर यानों और संयिु
हावेस्ट् टरों के सीएनिी या िैव-सीएनिी या एलएनिी इंिन के जलए मास उत्सिगन मानक इस अपवाि के साथ
दक मापन के आधार पर जनयम 115 कक में जवस्ट् तार से दिए गए अनुसार एचसी (हाइरोकोकाबगन) को
एनएमएचसी (गरै -मीथेन हाइरोकोकाबगन) द्वारा प्रजतस्ट्थाजपत दकया िाएगा के साथ कृजर् रैक्टरों, पावर रटलरों,
सजं नमागण उपस्ट्कर यानों और सयं ुि हावेस्ट्टरों के डीिल इंिनों के जलए लागू प्रचजलत मास उत्सिगन मानकों के
अनुसार अनुमोदित होगा ;
(ख) इन जनयमों के अधीन पार्टगकुलेट मैटर और िजृ ष्टगोचर प्रिर्ू कों (धुएं) के उत्सिगन के जलए िांच लागू नहीं
होगा;
(ग) जवजिष्ट इंिन िमता के जलए यान पर अनुमोदित सीएनिी/िैव सीएनिी/एलएनिी दकट को यान के जवजिष्ट
जनमागण और मॉडल तथा उसी िमता वाले इंिन के साथ लगे इसके वेररएंटों पर लगाया िा सकता है;
(घ) उत् सिगन करने के जलए उपयोग की िाने वाली सीएनिी/िैव-सीएनिी/एलएनिी संयोिन को समय-समय
पर केंद्रीय सरकार द्वारा अजधसजू चत ईंधन जवजनिेिों का अनुपालन करना होगा;
(ड.) िब सीएनिी/िैव -सीएनिी/एलएनिी संचालन के जलए दकए गए हों, तब यांजत्रक रूप से जनयंजत्रत और
इलेक्रॉजनक रूप स ेजनयंजत्रत डीिल ईंधन भरे यानों के जलए पथृ क टाइप के अनुमोिन की आवश्यकता होती ह;ै
(च) "प्रयोगिील" यानों पर रेरोदिटमेंट के जलए टाइप अनुमोिन और सीओपी का उत्तरिाजयत्व दकट जवजनमागता
या आपूर्तगकता गकी होगी । प्रचजलत सीओपी प्रदिया भी लाग ूहोगी;
(छ) प्रजतस्ट्थापन इंिन के जलए सीएनिी या िैव-सीएनिी या एलएनिी का टाइप अनुमोिन प्रमाणपत्र, टाइप
अनुमोिन प्रमाण-पत्र िारी करने की तारीख से तीन वर्ग तक के जलए जवजधमान्य होगा और एक समय में 3 वर् ग
के जलए पुन:नवीनीकरण कराए िाने लायक होगा ;
(ि) ओ.ई. या ‘प्रयोगिील डीिल यान’ के रेरोदिटमेंट के अनुसार सीएनिी/िैव-एनिी/ एलएनिी इंिन (डीिल
इंिन से पररवर्तगत) लग े कृजर् रैक्टर, पावर रटलर, सजं नमागण उपस्ट्कर यानों/संयुि हावेस्ट्टर को टाइप अनुमोिन
प्रिान करने के प्रयोिनाथग िांच अजभकरणों द्वारा नीच ेिी गई सारणी के अनुसार जनम्नजलजखत परिॉरमेंस िा ं की
िाएगी, अथागत ्:-
िांच संिभग िस्ट्तावेज़ (समय-समय पर यथासंिोजधत)

(i) मास उत् सिगन िांच सड़क पररवहन और रािमागग मंत्रालय/ सीएमवीआर/
टीएपी-115/116 और इस संबंध म ें भारत सरकार द्वारा
समय-समय पर िारी की गई अजधसूचनाएं[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
(ii) इंिन परिॉरमेंस का िांच (सकल िमता-पंखे के भाग IV सड़क पररवहन और रािमाग ग मंत्रालय/
बगैर) सीएमवीआर / टीएपी-115/116 और इस संबंध में भारत
सरकार द्वारा समय-समय पर िारी की गई अजधसूचनाए ं
रटप्पण : (क) मास उत्सिगन िाचं को यथालागू इंिन डाइनेमोमीटर पर दकया िाएगा ।
(ख) केंद्रीय मोटर यान जनयम, 1989 के जनयम 126 में जनर्िष्टग िांच अभकरण के समि टाइप अनुमोिन के जलए प्रस्ट्तुत
यान इन जनयमों के अधीन यथा लागू दिटनेस आवश्यकता का अनपु ालन करना होगा;
(ग) सीएनिी/िैव-सीएनिी/एलएनिी यानों, दकट कंपोनेन््स नके लगाए िाने सजहत की िांच प्रदिया और सुरिा के
मागगजनिेि समय-समय पर यथा संिोजधत उपाबंध IX एआईएस 024 और एआईएस 028 (संिो.1) के अनुसार होंग;े
(घ) िांच अजभकरण, िांच पूरा करेगी और िांच के जलए प्रस्ट्तुत दकए िाने के तीन महीने के भीतर आवश्यक प्रमाण पत्र
िेगी;
(ङ) िांच अजभकरणों से उन मॉडलों और उनके वेररएंटों को बताने की अपेिा की िाएगी जिन पर नए इंिन का
प्रजतस्ट्थापन जवजधमान्य होगा ।
(II) नए समर्पतग सीएनिी/िवै सीएनिी/एलएनिी इंिन द्वारा प्रयोगिील डीिल इंिन का प्रजतस्ट्थापन:
(क) प्रयोगिील डीिल इंिन वाले कृजर् रैक्टरों, पावर रटलसग, संजनमागण उपस्ट्कर यानों और संयुि हावेस्ट्टरों के मामल े
म,ें जिसको संपीजडत प्राकृजतक गैस (जिसे इसमें इसके पश्चात ् सीएनिी कहा गया है) या िैव-संपीजडत प्राकृजतक गैस
(जिसे इसमें इसके पश्चात ् सीएनिी कहा गया ह)ै या एलएनिी (तरलीकृत प्राकृजतक गैस) के साथ यान के जवजिष्ट मके
और मॉडल के जलए टाइप अनमु ोिन प्रिान दकया िाएगा और प्रचजलत मास उत्सिगन मानिडं ों के अनुसार अनुमोदित
दकया िाएगा। उत्सिगन िांच प्रदिया सड़क पररवहन और रािमागग मंत्रालय/ सीएमआरआर/टीएपी-115/116 (समय-
समय पर यथा संिोजधत) और केंद्रीय सरकार द्वारा समय-समय पर लागू काननू के अधीन अजधसूजचत दकए गए
अनुसार होगी । कृजर् रैक्टरों, पावर रटलरों, संजनमागण उपस्ट्कर यानों और संयुि हावेस्ट् टरों के सीएनिी या िैव-
सीएनिी या एलएनिी इंिन के जलए मास उत्सिगन मानक इस अपवाि दक मापन के आधार पर जनयम 115 कक म ें
जवस्ट् तार स े दिए गए अनुसार एचसी (हाइरोकोकाबगन) को एनएमएचसी (गरै -मीथेन हाइरोकोकाबगन) द्वारा प्रजतस्ट्थाजपत
दकया िाएगा, के साथ कृजर् रैक्टरों, पावर रटलरों, संजनमागण उपस्ट्कर यानों और संयिु हावेस्ट्टरों के डीिल इंिनों के
जलए लाग ूप्रचजलत मास उत्सिगन मानकों के समान होगा ;
(ख) जवजिष्ट इंिन िमता के जलए यान पर अनुमोदित सीएनिी या िैव -सीएनिी या एलएनिी प्रजतस्ट्थापन इंिन को
यान के जवजिष्ट मेक और मॉडल और उसी िमता के इंिन वाल ेइसके वेररएंट पर लगाया िा सकता है;
(ग) ऐसे सीएनिी, िैव-सीएनिी, एलएनिी दकट कंपोनेन््स और उसके लगाए िाने सजहत, के जलए िांच प्रदिया और
सुरिा मागिग िगन, उस समय तक, िब तक दक तत्स्ट्थानी बीआईएस जवजनिेिों को अजधसूजचत न दकया िाए, यथालाग ू
और समय-समय पर संिोजधत दकए गए एआईएस 024 और एआईएस 028 संिो. 01 के अनसु ार होंगे;
(घ) उत्सिगन करन े के जलए प्रयक्ु त सीएनिी/िैव-सीएनिी/एलएनिी संयोिन को केंद्रीय सरकार द्वारा समय-समय पर
अजधसूजचत ईंधन जवजनिेिों को पूरा करना होगा;
(ड.) सीएनिी या िैव-सीएनिी या एलएनिी इंिन या यान के जलए जनयम 115कक म ें तय दकए गए पार्टगकुलर मैटर
और िजृ ष्टगोचर प्रिर्ू कों (धुएं) के उत्सिगन की िांच लागू नहीं होगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(च) ‘प्रयोगिील’ यानों पर ओईप्रजतस्ट्थापन इंिन और आफ्टरमाकेट प्रजतस्ट्थापन इंिन के जलए टाइप अनुमोिन और
सीओपी का उत्तरिाजयत्व िमिः यान जवजनमागता और प्रजतस्ट्थापन इंिन जवजनमागता या पूर्तगकताग की होगी । प्रचजलत
सीओपी प्रदिया भी लागू होगी;
(छ) प्रजतस्ट्थापन इंिन के जलए सीएनिी या िैव-सीएनिी या एलएनिी का टाइप अनुमोिन, टाइप अनुमोिन प्रमाण-
पत्र िारी करने की तारीख से तीन वर्ग तक के जलए जवजधमान्य होगा और एक समय में 3 वर्ग के जलए पुन:नवीनीकरण
कराए िाने लायक होगा ;
(ि) प्रजतस्ट्थापन सीएनिी/िैव सीएनिी/एलएनिी इंिन लगे कृजर् रैक्टर, पावर रटलर, संजनमागण उपस्ट्कर यान/संयिु
हावेस्ट्टर को टाइप अनुमजत िने े के प्रयोिनाथग िांच अजभकरणों द्वारा नीचे िी गई सारणी के अनुसार जनम्नजलजखत
परिॉरमेंस िांच की िाएगी, अथागत् :-
िांच संिभग िस्ट् तावेि (समय–समय पर यथासंिोजधत)

(i) मास उत् सिगन िांच सड़क पररवहन और रािमागग मंत्रालय/ सीएमवीआर/ टीएपी-
115/116 और इस संबंध में भारत सरकार द्वारा समय-समय
पर िारी की गई अजधसूचनाएं
(ii) इंिन के परिॉरमेंस की िांच (सकल िमता-पंखे के बगैर) भाग IV सड़क पररवहन और रािमागग
मंत्रालय/सीएमवीआर/टीएपी-115/116 िारी सं.3 और इस
संबंध में भारत सरकार द्वारा िारी की गई
अजधसूचनाएं(प्रजतस्ट्थापन सीएनिी/िैव-सीएनिी/ एलएनिी
इंिन का परिॉरमेन् स मूल डीिल इंिन (िमता, टॉकग और
गजत सीमा) के परिॉरमेन् स के बराबर होगा ।
स्ट्पष्टीकरण :-
(क) मास उत्सिगन िांच को यथा लाग ू इंिन डाइनामोमीटर पर दकया िाएगा ।
(ख) जनयम 126 में जनर्िष्टग यानों को िांच अजभकरण के समि टाइप अनुमोिन के जलए इन जनयमों के अधीन यथा लाग ू
दिटनेस आवश्यकता का पालन करना होगा ।
(ग) ऐसे सीएनिी, िैव-सीएनिी, एलएनिी दकट कम्पोनेन््स और उसके लगाए िाने सजहत, के जलए िांच प्रदिया और
सुरिा मागगििगन, उस समय तक िब तक दक तत्स्ट्थानी बीआईएस जवजनिेिों को अजधसूजचत न दकया िाए, समय-समय पर
यथा संिोजधत दकए गए एआईएस 024 और एआईएस 028 (संिो. 01) के अनुसार होंगे ।
(घ) िांच अजभकरण, िांच पूरा करेगा और िांच के जलए प्रस्ट्तुत दकए िान े के तीन मास के भीतर आवश्यक प्रमाण पत्र
प्रिान करेगा ।
(ङ) िांच अजभकरणों से उन मॉडलों और उनके वेररएंटों को जविेर् रूप से बतान े की अपेिा की िाएगी, जिन पर नए इंिन
का प्रजतस्ट्थापन जवजधमान् य होगा ।

G.S.R. 336(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989,
were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of
1988), vide notification of the Government of India in the Ministry of Road Transport and Highways G.S.R 56(E),
dated the 29th January, 2021, in the Gazette of India, Extraordinary, Part II, section (3), sub-section (i)
inviting objections and suggestions from all persons likely to be affected before the expiry of the period of thirty days
from the date on which copies of the official Gazette containing the said notification were made available to the
public;
Whereas, copies of the said official Gazette in which the said notification were made available to the public
on the 29th January, 2021;
And, whereas, no objections and suggestions were received from the public in respect of the said draft rules;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, (59 of 1988),
the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989,
namely: —
1. Short title and commencement. - (1) These rules may be called as the Central Motor Vehicles (Eighth
Amendment) Rules, 2021.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the
Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), after rule 115-AA, the
following rule shall be inserted, namely:-
“115AB. Mass emission standards for CNG, Bio-CNG, LNG driven agriculture tractors, power tillers,
construction equipment vehicles and combine harvesters.-
(I) For conversion by modification of engines of In-use Diesel Vehicle
(a) In case of agriculture tractors, power tillers, construction equipment vehicles and combine
harvesters, Type approval for diesel engine retrofitted for dedicated CNG/ Bio-CNG/LNG operation shall
be given for specific make and model of the vehicle, and shall be approved as per the prevailing mass
emission standards applicable for diesel engines of agriculture tractors, power tillers, construction
equipment vehicles and combine harvesters, with the exception that the HC (Hydrocarbon) shall be
replaced by NMHC (Non-Methane Hydrocarbon) on measurement basis, as detailed in rule 115 AA;
(b) Test for particulate matter and emission of visible pollutants (smoke) under these rules shall not
applicable;
(c) CNG/Bio-CNG/LNG kit approved on the vehicle for specific engine capacity can be installed on
specific make and model of vehicle and its variants fitted with the same capacity engine;
(d) The CNG/Bio-CNG/LNG composition used for carrying out emissions shall meet the fuel
specifications as notified by the Central Government from time to time;
(e) Separate type approval is required for mechanically controlled and electronically controlled diesel Fuel
injected vehicles when retrofitted for CNG /Bio-CNG/LNG operation;
(f) For retrofitment on “in-use” vehicles, the responsibility of the Type Approval and COP shall be that of
the kit manufacturer or supplier. Prevailing COP procedure will also be applicable;
(g)The type approval certificate of CNG or Bio-CNG or LNG for replacement engine shall be valid for
three years from the date of the issue of type approval certificate and shall be renewable for three years at a
time;
(h) For the purpose of granting type approval to the agriculture tractor, power tiller, construction equipment
vehicle/combine harvester fitted with CNG/Bio-CNG/LNG engine (converted from Diesel engine) as O.E.
or retrofitment of ‘In-use diesel vehicle’, following performance Tests shall be carried out as per the table

issued by the Government of India in this respect from
time to time
(ii) Engine performance test (gross power -without fan) Part IV MoRTH/CMVR/TAP-115/116 and
notifications issued by the Government of India in this
respect from time to time
Note: (a) The mass emission test shall be carried out on engine dynamometer, as applicable.
(b) Vehicles offered for type approval to the testing agency referred in rule 126 of Central Motor
Vehicles Rules, 1989 shall have to comply with fitness requirement as applicable under these rules;
(c) Test procedure and safety guidelines of CNG/Bio-CNG/LNG vehicles, kit components including
installation thereof, shall be as per Annexure IX AIS 024 and AIS 028(rev.1), as amended from time to
time;
(d) The test agency shall complete the test and give necessary certificate within three months of the
same being submitted for test;
(e) Testing agencies will be required to indicate specifically, the models and their variants on which the
replacement of new engine will be valid.
(II) Replacement of In-use Diesel Engine by New dedicated CNG/ Bio-CNG/LNG Engine-
(a) In case of agriculture tractors, power tillers, construction equipment vehicles and combine harvesters having in-
use diesel engine which is replaced with a Compressed Natural Gas (hereinafter referred to as CNG) or Bio-
Compressed natural gas ((hereinafter referred to as Bio-CNG) or LNG (Liquefied Natural Gas), Type approval shall
be given for specific make and model of vehicle and shall be approved as per prevailing mass emission norms.
Emission test procedure shall be as per MoRTH/CMVR/TAP-115/116 (as amended from time to time) and as notified
by the Central Government from time to time under the applicable law. Mass emission standards for CNG or Bio-
CNG or LNG engines of agriculture tractors, power tillers, construction equipment vehicles and combine harvesters
shall be same as the prevailing mass emission standards applicable for diesel engines of agriculture tractors, power
tillers, construction equipment vehicles and combine harvesters, with the exception that the HC (Hydrocarbon) shall
be replaced by NMHC (Non-Methane Hydrocarbon) on measurement basis as detailed in rule 115 AA;
(b) CNG or Bio-CNG or LNG replacement engine approved on the vehicle for specific engine capacity can be
installed on the specific make and model of vehicle and its variants fitted with the same capacity engine;
(c) Test procedure and safety guidelines for such CNG, Bio-CNG, LNG kit components, including installation thereof,
shall be as per AIS 024 and AIS 028 Rev 01 as applicable and amended from time to time, till such time as
corresponding BIS specifications are notified;
(d) The CNG/Bio-CNG/LNG composition used for carrying out emissions shall meet the fuel specifications as
notified by the Central Government from time to time,
(e) Tests for particulate matter and emission of visible pollutants (smoke) stipulated in the rule 115AA shall not be
applicable for CNG or Bio-CNG or LNG engine or vehicle;
(f) For OE replacement engine and aftermarket replacement engine on “in-use” vehicles, the responsibility of the Type
Approval and COP shall be that of the vehicle manufacturer and replacement engine manufacturer or supplier
respectively. Prevailing COP procedure will also be applicable;
(g)The type approval certificate of CNG or Bio-CNG or LNG for replacement engine shall be valid for three years
from the date of the issue of type approval certificate and shall be renewable for 3 years at a time;
(h) For the purpose of granting type approval to the agriculture tractor, power tiller, construction equipment vehicle /
combine harvester fitted with replacement CNG/Bio-CNG/LNG engine, following performance Tests shall be carried
out as per the table given below by the test agencies, namely:-

Explanation:-
a. The mass emission test shall be carried out on engine dynamometer, as applicable.
b. Vehicles offered for type approval to the testing agency referred in rule 126 shall have to comply with fitness
requirement, as applicable under these rules.
c. Test procedure and safety guidelines for such CNG/Bio-CNG/LNG vehicles, kit component including
installation thereof shall be as per AIS 024, AIS 028 (rev.1) as amended from time to time, till such time as
corresponding BIS specification are notified.
d. The test agency shall complete the test and give necessary certificate within three months of the same being
submitted for test,
e. Testing agencies will be required to indicate specifically, the models and their variants on which the
replacement of new engine will be valid.”
