अत:, के(cid:7008) (cid:7076)ीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) क(cid:7409) धारा 110 क(cid:7409) उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7004)त शि(cid:6989) तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए के(cid:7008) (cid:7076)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन(cid:7013) निलिखत िनयम बनाती ह,ै अथा(cid:6981)त्:- (1) इन िनयम(cid:7298) का संि(cid:6979)(cid:7009) त नाम क(cid:7286)(cid:7076)ीय मोटरयान (नवां संशोधन) िनयम 2016 ह ै। (2) ये राजप(cid:7074) म(cid:7286) इनके (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7004)त ह(cid:7298)ग े । 4350 GI/2016 (1)(cid:32)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. क(cid:7286)(cid:7076)ीय मोटरयान िनयम,1989, (िजसे इसम(cid:7286) इसके प(cid:7019)च ात् उ(cid:6989) त िनयम कहा गया ह)ै म(cid:7286), िनयम 2 म(cid:7286) खंड (य) के प(cid:7019) चात् िन(cid:7013)न िलिखत खंड अंत:(cid:7021)थ ािपत (cid:7408)कए जाएंग,े अथा(cid:6981)त् :- 2. क(cid:7286)(cid:7076)ीय मोटर यान िनयम, 1989 (िजसे इसम(cid:7286) इसके प(cid:7391)ात् उ(cid:7334) िनयम कहा गया ह)ै के िनयम 2 म(cid:7286), खडं (य़) के प(cid:7391)ात् िन(cid:7388)िलिखत खंड अंत:(cid:7021) थािपत (cid:7408)कए जाएगं े,अथात(cid:6981) ्:- ‘(यक) “मोटर कारवा”ं से िवशेष (cid:7079)योजन के िलए रहने का वास–सुिवधाए ं सि(cid:7013)मिलत करने क(cid:7409) िलए िन(cid:7414)मत एम (cid:7088)ेणी का यान अिभ(cid:7079)ेत ह ै िजसम(cid:7286) कम स े कम िन(cid:7388)िलिखत उप(cid:7021)कर अ(cid:7008)त(cid:7414)व(cid:7397) होग(cid:7286) । (i) सीट(cid:7286) और टेबल ; (ii) सोने क(cid:7409) वास-सुिवधा जो सीट(cid:7298) से संप(cid:7407)रव(cid:7414)तत क(cid:7409) जा सकती ह ै; (iii) खाना पकाने क(cid:7409) सुिवधाए ं; और (iv) भ(cid:7003)डारण सुिवधाए,ं जो रहने के क(cid:6979) के साथ दढ़ृ ता से जड़ु ी ह(cid:7298)गी : परंतु टेबल सहज (cid:7021)थाना(cid:7008)तरणीय होने के िलए प(cid:7407)रकि(cid:7016)पत हो सकेगी । (यख) "सड़क रोगी-वाहन" सड़क रोगी-वाहन िवशेष (cid:7271)प से सि(cid:7343)त और (cid:7088)म द(cid:6979)ता क(cid:7409) दिृ (cid:7397) से प(cid:7407)रकि(cid:7016)पत यान ह ै जो बीमार या (cid:6979)ित(cid:7061)(cid:7021)त (cid:7390)ि(cid:7334)य(cid:7298) के प(cid:7407)रवहन या आपात उपचार के िलए और जब समुिचत (cid:7271)प स े इसम(cid:7286) कम(cid:6981)चा(cid:7407)रवृंद हो उसके अिभिहत दखे भाल (cid:7021)तर के अनु(cid:7272)प प(cid:7407)रवहन के दौरान या जब वह खड़ा हो अ(cid:7021)पताल िच(cid:7408)क(cid:7004)सा दखे भाल (cid:7079)दान करन ेके िलए स(cid:6979)म हो । (यग) "िव(cid:7378)ालय बस" स े िव(cid:7378)ालय जाने वाले बालक(cid:7298) के िलए िवशेष (cid:7271)प से प(cid:7407)रकि(cid:7016) पत और िविन(cid:7414)मत ऐसा यान अिभ(cid:7079)ेत ह ैिजसम(cid:7286) चालक को छोड़कर 13 या(cid:7074)ी और अिधक के बैठने क(cid:7409) (cid:6979)मता हो; (यघ) "िवशषे (cid:7079)योजन यान (एस पी वी)" से (cid:7088)ेणी एल [केवल एआईएस-125(भाग 1)-2014 के अनुपालन म(cid:7286) सड़क रोगी-वाहन क(cid:7409) दशा म(cid:7286) ], एन या टी का ऐसा यान अिभ(cid:7079)ेत ह ै जो, कृ(cid:7004)य(cid:7298) िजसम(cid:7286) िवशषे इंतजाम और/या उप(cid:7021)कर अपेि(cid:6979)त ह,ै का पालन करने के िलए िविन(cid:7416)द(cid:7397) तकनीक(cid:7409) िविश(cid:7397)ताए ंरखता हो ।’। 3. उ(cid:7334) िनयम(cid:7298) के िनयम 108 म(cid:7286), 1 अ(cid:7079)ैल, 2018 को या उसके प(cid:7391)ात्, उप-िनयम (1) के परंतुक के, खंड (iv) के (cid:7021)थान पर िन(cid:7388)िलिखत खडं रखा जाएगा, अथा(cid:6981)त ्:- "(iv) रोिगय(cid:7298) के वहन हते ु उपयोग के िलए (cid:7408)कसी रोगी-वाहन म(cid:7286) (cid:7408)फट (cid:7408)कए गए ब(cid:7289)गनी शीशे सिहत (cid:7410)(cid:7011) लकर टाइप क(cid:7409) लाल ब(cid:7004)त ी या एआईएस-125 (भाग-1)-2014 के उपाबंध -1 के अनुसरण म(cid:7286) सड़क रोगी-वाहन पर लगे (cid:7263)ए चेतावनी दीप;" । 4. उ(cid:7334) िनयम(cid:7298) के, िनयम 108 म(cid:7286), उप-िनयम(6) के प(cid:7391)ात्, िन(cid:7388)िलिखत उप-िनयम अ(cid:7008)तः(cid:7021)थािपत (cid:7408)कया जाएगा, अथा(cid:6981)त् :- “(7) भारतीय मानक (cid:7011)यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त(cid:7004)(cid:7021)थानी बी आई एस िविनदश(cid:7287) अिधसूिचत (cid:7408)कए जाने तक, 1 अ(cid:7079)ैल 2018 को और उसके प(cid:7391)ात् सड़क रोगी-वाहन पर लगी (cid:7263)ई ऊपर क(cid:7409) बि(cid:7275)यां (चेतावनी दीप) इसम(cid:7286) िविन(cid:7416)द(cid:7397) सभी (cid:7079)कार के रोगी-वाहन के िलए, समय-समय पर यथा संशोिधत एआईएस:125 (भाग 1)-2014 के अनुसरण म(cid:7286) होगी । 5. उ(cid:6989) त िनयम(cid:7298) के िनयम 119 म(cid:7286), 1 अ(cid:7079)ैल, 2018 को और उसके प(cid:7019) चात्, उपिनयम (3) म(cid:7286) िन(cid:7013) निलिखत पंरतुक अंत:(cid:7021) थािपत (cid:7408)कया जाएगा, अथा(cid:6981)त ् :-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 परंतु सड़क रोगी वाहन(cid:7298) के सायरन(cid:7298) के िलए अपे(cid:6979)ाए,ं जब तक भारतीय मानक (cid:7011)य रू ो अिधिनयम, 1986 (1986 का 63) के अधीन त(cid:7004)(cid:7021) थानी बीआईएस िविनदश(cid:7287) अिधसूिचत नह(cid:7277) (cid:7408)कए जाते ह,(cid:7289) तब तक समय-समय पर यथासंशोिधत एआईएस:125 (भाग 1)-2014 के अनुसार ह(cid:7298)गी ।”। 6. उ(cid:7334) िनयम(cid:7298), म(cid:7286), िनयम 125-ड. के प(cid:7391)ात्, िन(cid:7388)िलिखत िनयम अ(cid:7008)तः(cid:7021)थािपत (cid:7408)कया जाएगा, अथात(cid:6981) ् :- "125च- एल और एम (cid:7088)िे णय(cid:7298) के यान(cid:7298) के सड़क रोगी-वाहन(cid:7298) का (cid:7079)कार अनमु ोदन । भारतीय मानक (cid:7011)यरू ो अिधिनयम, 1986 (1986 का 63) के अधीन त(cid:7004)(cid:7021)थानी भी बी.आई एस िविनदश(cid:7287) अिधसूिचत (cid:7408)कए जान े तक, 1 अ(cid:7079)ैल, 2018 को और उसके प(cid:7391)ात् िविन(cid:7414)मत एम और एस (cid:7088)ेिणय(cid:7298) के सड़क रोगी-वाहन, समय-समय पर यथा संशोिधत एआईएस:125(भाग 1) 2014 के अनुसरण म(cid:7286) ह(cid:7298)गे ।" 125-छ िवशषे (cid:7079)योजन यान(cid:7298) के िलए (cid:7079)कार अनुमोदन.- (1) भारतीय मानक (cid:7011)यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त(cid:7004)(cid:7021)थानी भी आई एस िविनदश(cid:7287) अिधसूिचत (cid:7408)कए जाने तक, 1 अ(cid:7079)ैल, 2018 को और उसके प(cid:7019) चात ् िव(cid:7414)निमत मोटर कारवा ं समय-समय पर यथा संशोिधत एआईएस-124 :2014 म(cid:7286) किथत अपे(cid:6979)ा(cid:7312) के अनुपालन म(cid:7286) ह(cid:7298)गे । (2) भारतीय मानक (cid:7011)यूरो अिधिनयम, 1986 (1986 का 63) के अधीन त(cid:7004)(cid:7021)थानी बीआईएस िविनदश(cid:7287) अिधसूिचत (cid:7408)कए जाने तक उ(cid:7334) मानक(cid:7298) के खंड 0.0 (ख) के अधीन यथा अनु(cid:6980)ात िव(cid:7378)मान यान(cid:7298) पर बनाये गए मोटर कारवां भी समय-समय पर यथा संशोिधत एआईएस-124:2014 के अनुपालन म(cid:7286) ह(cid:7298)गे । 7. उ(cid:7334) िनयम(cid:7298) के, (cid:7079)ा(cid:7271)प 22-क म(cid:7286),- (i) अंक(cid:7298) और अ(cid:6979)र(cid:7298) "125ग" के (cid:7021)थान पर अंक और अ(cid:6979)र "125च, 125छ" अ(cid:7008)तः(cid:7021)थािपत (cid:7408)कए जाएगं े ; (ii) भाग-2 म(cid:7286), - (क) मद 4 और 5 के (cid:7021)थान पर िनि(cid:7388)िलिखत मद (cid:7286) रखी जाएगं ी, अथा(cid:6981)त् :- "*4 बस बॉडी िनमा(cid:6981)णकता (cid:6981) (cid:7079)(cid:7004)यायन (cid:7079)माणप(cid:7074) सं(cid:6990)यांक........................ तारीख....................... तारीख तक िविधमा(cid:7008)य होगा । 5. अनुमो(cid:7408)दत परी(cid:6979)ण अिभकरण (cid:7367)ारा जारी यान बॉडी िनमा(cid:6981)ण (बस सड़क रोगी-वाहन मोटर कारवा ं आ(cid:7408)द) (cid:7079)कार अनुमोदन (cid:7079)माणप(cid:7074) सं(cid:6990)यांक....................तारीख ..........................।''। (ख) (cid:7407)ट(cid:7009) पण के (cid:7021) थान पर, िन(cid:7013) निलिखत (cid:7407)ट(cid:7009) पण रखा जाएगा, अथा(cid:6981)त् :- “(cid:7407)टप् पण:- भाग II, 1 अ(cid:6989) तूबर, 2014 को या उसके प(cid:7019) चात् िविन(cid:7414)मत बस(cid:7298) के नए मॉडल को और 1 अ(cid:6989) तूबर, 2016 को और उसके प(cid:7019) चात् िविन(cid:7414)मत बस(cid:7298) के िव(cid:7378)मान मॉडल(cid:7298) को और (cid:7059)मश: एआईएस 125 (भाग1):2014 और एआईएस 124(भाग1):2014 के लाग ू होने क(cid:7409) तारीख से िविन(cid:7414)मत सड़क रोगी- वाहन(cid:7298) और मोटर कारवां क(cid:7409) दशा म(cid:7286) लागू होगा ” [सं. आरटी-11028/10/2013-एमवीएल] अभय दामले, संयु(cid:7334) सिचव (cid:7407)ट(cid:7009)प ण : मूल िनयम भारत के राजप(cid:7074), असाधारण, भाग II, खंड 3, उपखंड (i) म(cid:7286) अिधसूचना सं(cid:6990)याकं सा.का.िन. 590(अ), तारीख 2 जून, 1989 (cid:7367)ारा (cid:7079)कािशत (cid:7408)कए गए थ े और अिधसूचना स(cid:6990)ं यांक सा.का.िन. 682 (अ) तारीख 12.07.2016 (cid:7367)ारा उनका अि(cid:7008)तम संशोधन (cid:7408)कया गया ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 8th September, 2016 G.S.R. 868(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notifications of Government of India in the Ministry of Road Transport and Highways number G.S.R. 316(E), dated the 23rd April,2015 and number G.S.R. 335(E), dated the 23rd March, 2016, in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which copies of the Gazette containing the said notifications were made available to public; Whereas, copies of the said Gazette notifications were made available to the public on the 23rd April, 2015 and the 23rd March, 2016; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1.(cid:32) (1) These rules may be called the Central Motor Vehicles (Ninth Amendment) Rules, 2016. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, (hereinafter referred to as the said rules) in rule 2, after clause (z), the following clauses shall be inserted, namely:- ‘(za) “Motor Caravan” means a special purpose category M vehicle constructed to include living accommodation which contains at least the following equipment:- (i) seats and table; (ii) sleeping accommodation which may be converted from the seats; (iii) cooking facilities; and (iv) storage facilities, which shall be rigidly fixed to the living compartment: Provided that the table may be designed to be easily removable; (zb) “Road Ambulance” means a specially equipped and ergonomically designed vehicle for transportation and/ or emergent treatment of sick or injured people and capable of providing out of hospital medical care during transit or when stationary, commensurate with its designated level of care when appropriately staffed; (zc) “School Bus” means a vehicle with a seating capacity of thirteen passengers and above excluding driver designed and constructed specially for school going children; (zd) “Special Purpose Vehicle (SPV)” means a vehicle of category L [only in case of Road Ambulance complying to AIS-125 (Part1)-2014], M, N or T having specific technical features in order to perform a function which requires special arrangements and / or equipment.’. 3. In rule 108 of the said rules, on and after the 1st April, 2018, in sub-rule (1), in the proviso, for clause (iv), following clause shall be substituted namely:- “(iv) the blinker type of red light with purple glass fitted to an ambulance van used for carrying patients or the warning lamps fitted on Road Ambulance in accordance with Annexure-1 of AIS- 125 (Part-1)-2014; ”. 4. In rule 108 of the said rules, after sub-rule (6), the following sub-rule shall be inserted, namely:-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 “(7) On and after the 1st April, 2018, the top lights (warning lamps) fitted on Road Ambulances shall be in accordance with AIS:125 (Part1)– 2014, as amended from time to time, for all types of ambulances specified therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”. 5. In rule 119 of the said rules, on and after 1st April, 2018, in sub-rule (3), following proviso shall be inserted, namely:- “Provided that requirements for sirens of Road Ambulances shall be in accordance with AIS:125 (Part 1)-2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 ( 63 of 1986).”. 6. In the said rules, after rule 125-E, the following rules shall be inserted, namely:- “125F- Type Approval of Road Ambulances of Vehicle categories L and M. - Road Ambulances of categories L and M manufactured on and after the 1st April, 2018, shall be in accordance with AIS: 125 (Part1)–2014 as amended from time to time, for all types of ambulances specified therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). 125-G Type Approval of Special Purpose Vehicles.- (1) The Motor Caravans manufactured on and after the 1st April, 2018, shall comply with the requirements stated in AIS-124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). (2) The Motor Caravans built on the existing vehicles as permitted under the clause 0.0 (b) of the said standard shall also comply with AIS-124:2014, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).”. 7. In Form 22-A of the said rules,- (i) after figures and letter “125C”, the figures and letters “125F, 125G”shall be inserted; (ii) in PART-II,- (a)(cid:32) For items 4 and 5, the following shall be substituted, namely:- “*4. Bus Body Builder Accreditation Certificate Number __________Date ________ valid up to date _____________. 5. Vehicle Body construction (Bus/Road Ambulance/ Motor Caravan /etc.) Type Approval Certificate Number _______________Date _________ issued by the approved Test Agency.” (b) for the Note, the following Note shall be substituted, namely:- “Note:- Part II shall be applicable for new model of buses manufactured on or after the 1st October, 2014 and for the existing models of buses manufactured on and after 1st October, 2016 and in case of Road Ambulances and Motor Caravans manufactured from the date of applicability of AIS-125 ( Part 1): 2014 and AIS-124: 2014 respectively.”.
