(1) इन िनयम> का सिं &@त नाम क,(cid:10)ीय मोटर यान (तृतीय संशोधन) िनयम, 2019 ह ै। (2) इन िनयम> म ,अ(cid:8)यथा उपबिघत के िसवाय, ये राजप+ म ,उनके अिं तम (cid:25)काशन क# तारीख को (cid:25)वDृ त ह>ग े । 1392 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. के(cid:8)(cid:10) ीय मोटर यान िनयम, 1989 (िजस ेइसम ,इसके पMात् मलू िनयम कहा गया ह)ै के िनयम 96 म ,- (क) उप-िनयम (4) के खंड (ii) म, पहले परंतकु के पMात,् िनC निलिखत परंतकु अ(cid:8) त: O थािपत (cid:1)कए जाएंग,े अथा2त :- “पर(cid:8)त ु यह और क# नए मॉडल क# दशा म, 1 अ(cid:25)ैल, 2021 से ही िनPमत2 तथा सभी मॉडल> क# दशा म , 1 अ(cid:25)ैल, 2022 से ही िनPमत2 यानो क# एंटी लॉक SेTकंग एम1 (cid:25)वग 2 के िसवाय STे कंग (cid:25)णाली समय-समय पर यथा संशोिधत, आईएस 15986:2015 या एआईएस: 151:2018, के अनु(cid:26)प होगी : पर(cid:8)त ु यह भी (cid:1)क नए मॉडल क# दशा म, 1 अ(cid:25)लै , 2021 को या उसके पMात ्िनPमत2 तथा सभी मॉडल> क# दशा म, 1 अ(cid:25)लै , 2022 को या उसके पMात ् िनPमत2 यानो क# एम2, एम3, एन1, एन2, एन3 (cid:25)वगV हते ुएंटी-लॉक SेTकंग के िसवाय STे कंग (cid:25)णाली समय-समय पर यथा सशं ोिधत, आईएस 11852:2013, के अनु(cid:26)प होगी : पर(cid:8)त ु यह भी (cid:1)क ऐस े मोटर यानो के (cid:25)वगV को िजनमे आईएस 11852:2013 के अनुसार ए(cid:8) Wूर,स STे कंग (cid:25)णाली परी&ण (टाइप-।। ए टेOट ) लागू ह ैतथा िजनका िनमाण2 1 अ(cid:25)लै , 2022 को या उसके पMात ् (cid:1)कया गया ह,ै उनके िलए समय-समय पर यथा सशं ोिधत, आईएस 11852:2013, म, यथा िविनXदY2 ट ए(cid:8) Wूर,स STे कंग (cid:25)णाली परी&ण (टाइप-।। ए टेOट ) का पालन (cid:1)कया जाएगा : पर(cid:8)त ु यह भी (cid:1)क समय-समय पर यथा सशं ोिधत, आईएस 15986:2015 अथवा एआईएस 151:2018, के अनु(cid:26)प एन1 (cid:25)वग 2 के यानो हते ु ‘एंटी-लॉक STे कंग’ के िसवाय SेTकंग (cid:25)णाली आईएस 11852:2013 क# अपे&ा\ का पालन (cid:1)कया गया समझा जाएगा।” (ख) उन-िनयम 4(क) के परंतकु म ,“मॉडल और” श? द के प] चात् “िबिनPम2त” श? द अंत:O थािपत (cid:1)कया जाएगा; (ग) उप-िनयम (4ख) म,, (i) खंड (ii) म, “को और उसके पMात्” श? द> स ेपूव2 “िबिनPम2त” श? द अंत:O थािपत (cid:1)कया जाएगा; (ii) श?द और अंक> “आईएस: 15986:2015” के Oथ ान पर समय-समय पर यथा संशोिधत “आईएस: 15986:2015 या एआईएस: 151:2018,” श? द और अकं अतं :O थािपत (cid:1)कए जायेग;े (iii) अंत म,, िनCन िलिखत परंतकु अतं :Oथ ािपत (cid:1)कया जाएगा, अथा2त :- “पर(cid:8)त ु नए मॉडल क# दशा म , 1 अ(cid:25)लै , 2021 को या उसके पMात् िनPम2त एम2 (cid:25)वग 2 के यानो तथा सभी मॉडल क# दशा म , 1 अ(cid:25)लै , 2022 से समय-समय पर यथा सशं ोिधत आईएस 11852:2013, के अनु(cid:26)प एंटी- लॉक SेTकंग िसOट म लगाया जाएगा।” (घ) उप-िनयम (5) और उप-िनयम (6) का लोप (cid:1)कया जाएगा । (ङ) उप-िनयम (9) के खंड iv, उप-खंड (घ) म, िनC निलिखत परंतकु अतं :Oथ ािपत (cid:1)कया जाएगा, अथा2त :- “पर(cid:8)त ु नए मॉडल क# दशा म, 1 अ(cid:25)ैल, 2021 स े ही िनPम2त प.रसकं टमय माल और तरल प_े ोिलयम गैस ल े जाने के िलए _ै=ट र-_ेलर स े िभ‘ एम3, एन3 और एन2 (cid:25)वग2 के यानो तथा सभी मॉडल क# दशा म, 1 अ(cid:25)लै , 2022 स ेयानो म ,समय-समय पर यथा संशोिधत आईएस: 11852:2013, के अनु(cid:26)प एंटी-लॉक SेTकंग (cid:25)णाली लगाई जाएगी।” (च) उप-िनयम (9) के पMात् िनCन िलिखत उप-िनयम> को अंत:Oथ ािपत (cid:1)कए जायेगे, अथा2त :- “(10) नए मॉडल क# दशा म ,1 अ(cid:25)लै , 2021 को और उसके पMात् तथा सभी मॉडल क# दशा म ,1 अ(cid:25)लै , 2022 को और उसके पMात ् िनPम2त एम1 और एन1 (cid:25)वग2 के यानो म , य(cid:1)द इले= _ॉिनक िOथराकं िनय+ं ण (cid:25)णािलयां लगाई ह>, तो समय-समय पर यथा सशं ोिधत एआईएस: 122-2016, अपे&ा\ को तब तक पूरा (cid:1)कया जाएगा जब तक (cid:1)क¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 भारत मानक ?य ूरो अिधिनयम, 2016 (2016 का 11) के अधीन समद]ृ य बीआईएस िविनदशa > को अिधसिू चत नहb कर (cid:1)दया जाता ह।ै (11) नए मॉडल क# दशा म , 1 अ(cid:25)लै , 2021 को और उसके पMात् िनPम2त और सभी मॉडल क# दशा म , 1 अ(cid:25)ैल, 2022 को और उसके पMात् िनPम2त एम1 और एन1 (cid:25)वगV के यानो म, य(cid:1)द Sके सहायता (cid:25)णाली लगाई गई हो, तो यह समय-समय पर यथा संशोिधत एआईएस : 152:2018, के अन(cid:26)प होगी, जब तक (cid:1)क भारतीय मानक ? यरू ो अिधिनयम, 2016(2016 का 11) के अधीन समद]ृ य बीआईएस िविनदशa > को अिधसिू चत नहb कर (cid:1)दया जाता ह ै।” 3. िनयम 96ख म,, पहले परंतकु के पMात,् िनC निलिखत परंतकु को अतं :O थािपत (cid:1)कया जाएगा, अथा2त :- “पर(cid:8)त ु यह और (cid:1)क नए मॉडल क# दशा म, 1 अ(cid:25)लै , 2021 स े ही और सभी मॉडल क# दशा म, 1 अ(cid:25)लै , 2022 को स े ही िनPमत2 एम1 (cid:25)वग2 के यानो म , SेTकंग (cid:25)णाली समय-समय पर यथा संशोिधत आईएस 15986:2015 अथवा एआईएस: 151:2018, के अन(cid:26)ु प होगी और इस ेइस िनयम क# अपे&ा\ क# अनुपालना म ,समझा जाएगा।” [सं. आरटी-11028/19/2017-एमवीएल ] ि(cid:25)याकं भारती,,,, संयु= त सिचव (cid:1)(cid:1)(cid:1)(cid:1)टटटट(cid:3)(cid:3)(cid:3)(cid:3)पप पप णणणण:::: मूल िनयम, भारत के राजप+, असाधारण, भाग II, खंड 3, उपखंड (i) म , अिधसूचना स.ं सा.का.िन. 590 (अ), तारीख 2 जून, 1989 को (cid:25)कािशत (cid:1)कए गए थे और अिं तम बार अिधसूचना सं. सा.का.िन. 1225(अ), तारीख 20.12.2018 के अधीन सशं ोिधत (cid:1)कए गए थ े। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 1st March, 2019 G.S.R. 173(E).— Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R.1229 (E), dated the 24th day of December, 2018, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date of which copies of the Official Gazette containing the draft rules were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 24th December, 2018; And whereas, objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement. -(1) These rules may be called as the Central Motor Vehicles (………. Amendment) Rules, 2019. (2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereafter referred as the principal rules), in rule 96.- (a) in sub-rule (4), in clause (ii) after the first proviso, the following provisos shall be inserted, namely: –4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “provided further that Braking System other than Anti-Lock Brakingfor M1 category of vehicles manufactured, on and from 1stday of April, 2021in the case of new models and 1stday of April, 2022 in case of all models, shall conform to IS 15986:2015 or AIS:151:2018 as amended from time to time: Provided also that Braking System other than Anti-Lock Braking for M2, M3, N1, N2, N3 categories of vehicles manufactured, on and after 1stday of April, 2021 in case of new models and 1stday of April, 2022 in case of all models, shall conform to IS 11852:2013, as amended from time to time: Provided also that the motor vehicle categories for which Endurance Braking System Test (Type-II A test) is applicable as per IS 11852:2013 and manufactured on and after 1stday of April, 2022 shall comply with the Endurance Braking System Test (Type-II A test) as specified in IS 11852:2013 amended from time to time: Provided also that Braking System other than Anti-Lock Braking for N1 category of vehicles conforming to IS 15986:2015 or AIS 151:2018 as amended from time to time shall be deemed to comply with the requirements of IS 11852:2013.”; (b) in sub-rule 4(A),in the proviso after the words “models and”, the word “manufactured” shall be inserted; (c) In sub-rule (4B), (i) in clause (ii) before the words “on and after”, the word “manufactured” shall be inserted; (ii) for the words and numbers “IS: 15986:2015”, the words and numbers “IS:15986:2015 or AIS:151:2018, as amended from time to time” shall be inserted; (iii) at the end, the following proviso shall be inserted, namely: - “Provided that vehicles of category M2 manufactured on and from 1stday of April, 2021, in case of new models and 1stday of April, 2022, in case of all models, shall be fitted with Anti-Lock Braking System conforming to the IS 11852:2013 as amended from time to time.”. (d) sub-rule (5) and sub-rule (6) shall be omitted. (e) in sub-rule (9) in clause iv, in sub-clause (d), the following proviso shall be inserted, namely: - “Provided that vehicles of category M3, N3 and N2 other than tractor-trailer combination meant for carrying hazardous goods and liquid petroleum gas, manufactured on and from 1st day of April, 2021 in the case of new models and 1stday of April, 2022 in case of all models, shall be fitted with Anti-Lock Braking System conforming to IS: 11852:2013, as amended from time to time.” (f) after sub-rule (9), the following sub-rules shall be inserted, namely: - “(10) M1 and N1 categories of vehicles manufactured on and after, 1stday of April, 2021 in the case of new models and 1stday of April, 2022 in case of all models, and if provided with Electronic Stability Control Systems shall meet the requirements as specified in AIS:133-2016, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). (11) M1 and N1 categories of vehicles if provided with Brake Assist System manufactured, on and after 1stday of April 2021 in the case of new models and 1stday of April, 2022 in case of all models shall conform to AIS: 152:2018 amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”; 3. in rule 96B, after the first proviso, the following proviso shall be inserted, namely: - “Provided further that M1 category of vehicles manufactured on and from 1stday of April,2021 in case of new models and 1stday of April, 2022 in case of all models, having braking system conforming to IS 15986:2015 or AIS:151:2018, as amended from time to time, shall be deemed to comply with the requirements of this rule.”.
