और जबदक, ईि राजपत्र ऄजधसूचना की प्रजतया ाँ 12 जसतंबर, 2019 को जनसाधारण को ईपलब्ध करा दी गईं थीं; और जबदक, ईि प्रारूप जनयमों के संबंध म ेंजनता से कोइ अपजि और सुझाव प्राप्त नहीं हुए थे; ऄतः ऄब केंद्रीय सरकार, माल के ( औ ) ऄजधजनयम, 1999 (1999 का 48) की धारा 87 द्वारा प्रदि िजियों का प्रयोग करते हुए, माल के ( औ ), जनयम 2002 म ें और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै ऄथाधत:- 3897 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. सजं ित्प िीर्कध और प्रारम्भ – (1) आन जनयमों को माल के ( औ ) (संिोधन) जनयम, 2020 कहा जाएगा। (2) य ेराजपत्र में ईनके प्रकािन की तारीख से प्रवृि होंगे। 2. माल के भौगोजलक ईपदिधन (रजजस्ट्रीकरण और संरिण) जनयम, 2002 (आसके पश् चात आसे “ईि जनयम” कहा गया ह)ै , में जनयम 56 को जनम्नजलजखत जनयम से प्रजतस्ट्थाजपत दकया जाएगा: “56. प्राजधकृत ईपयोगकताध - (1) धारा 17 के ऄधीन प्राजधकृत ईपयोगकताध के रजजस्ट्रीकरण के जलए अवेदन भौ.ई. 3 प्ररूप म ें रजजस्ट्रार को दकया जाएगा और साथ म ें एक जववरण देना होगा दक वह भौगोजलक ईपदिधन का ईत्पादक होने का दावा कैसे कर रहा ह।ै (2) ईप-जनयम (1) के ऄंतगधत दकए गए अवेदन की प्रजत को भौगोजलक ईपदिधन के को ऄग्रेजर्त करेगा और रजजस्ट्रार को आससे ऄवगत कराएगा।” 3. मलू जनयम के जनयम 59 के ईप-जनयम (1) म,ें जनम्नजलजखत ईप-जनयम को प्रजतस्ट्थाजपत दकया जाएगा: (1) जहााँ धारा 17 की ईपधारा (3) के ईप खंड (ङ) के ऄधीन जवजनर्ददष्ट ऄवजध के भीतर, जनधल में जवज्ञाजपत या पुनः जवज्ञाजपत अवेदन पर अपजि की कोइ सूचना फ़ाआल नहीं की जाती या जहा ाँ अपजि फ़ाआल की जाती ह ै और वह खाररज कर दी जाती ह,ै वहां रजजस्ट्रार प्राजधकृत ईपयोगकताध को रजजस्ट्टर के भाग ख में दजध करेगा और भौगोजलक ईपदिधन रजजस्ट्री की मुहर के साथ रजजस्ट्रीकरण प्रमाणपत्र जारी करेगा।” 4. मलू जनयम के जनयम 59 के ईप-जनयम (2) म,ें खंड (च) और (छ) का लोप दकया जाएगा। 5. मलू जनयम के जनयम 59 के ईप-जनयम (3) म,ें जनम्नजलजखत का लोप दकया जाएगा: “ य , ” । 6. मलू जनयम की पहली ऄनुसूची में, (क) प्रजवजष्ट 3क को जनम्नजलजखत से प्रजतस्ट्थाजपत दकया जाएगा ऄथाधत: 3क धारा 17, जनयम 56 (1) के ऄधीन भौगोजलक ईपदिधन के 10 भौ.ई. 3 प्राजधकृत ईपयोगकता धके रजजस्ट्रीकरण के जलए अवेदन पर (ख) प्रजवजष्ट 3ख का लोप दकया जाएगा; And whereas, the copies of the said Gazette notification were made available to the public on the 12th September, 2019; And whereas, no objections and suggestions received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 87 of the Geographical Indications of Goods (Registration and Protection) Act, 1999 (48 of 1999), the Central Government hereby makes the following rules further to amend Geographical Indications of Goods (Registration and Protection) Rules, 2002, namely:- 1. Short title and commencement.- (1) These rules may be called the Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2020. (2) They shall come into force from the date of their publication in the Official Gazette 2. In the Geographical Indications of Goods (Registration and Protection) Rules, 2002 (hereinafter referred as the “said rules”), for Rule 56 following Rule shall be substituted, namely:- “56. Authorised User.-(1) An application for registration of authorized user under section 17 may be made to the Registrar in Form GI-3 accompanied by a statement of case as to how the applicant claims to be the producer of the registered geographical indication. (2) A copy of application made under sub-rule (1) shall be forwarded to the registered proprietor of geographical indication and intimate the same to the Registrar.”[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 3. In the said rules, in rule 59 for sub-rule (1), the following sub-rule shall be substituted, namely:- (2) “Where no notice of opposition is filed to an application advertised or re-advertised in the Journal within the period specified under sub-clause (e) of sub-section (3) of Section 17 or where an opposition is filed and it is dismissed, the Registrar shall enter the authorised user in Part B of the register and shall issue a registration certificate with the seal of Geographical Indication Registry”. 4. In the said rules in rule 59, in sub-rule (2), clauses (f) and (g) shall be omitted. 5. In the said rules, in rule 59, in sub-rule (3), the words-: “An unmounted representation of the geographical indication exactly as shown in the form of application for registration thereof at the time of registration shall accompany such request.” shall be omitted. 6. In the said rules, in the FIRST SCHEDULE-, a) for the entry 3A, the following entry shall be substituted, namely:- “ 3A On application for the registration of an authorised user of a registered geographical indication under section 17, 10 GI-3 Rule 56(1) ” b) the entry 3B shall be omitted ; c) for the entry 3C, the following entry shall be substituted, namely:- “ 3B For renewal of an authorised user (sub-section (2) of 10 GI-3 section 18 sub-rule(1) of rule 60) ” 7. In the said rules, in the SECOND SCHEDULE-, a) the following Form number, : “ Request for issuance of a registration GI-3 Section 18(5), rule 59 3B certificate as an authorised user. ” shall be omitted; b) for the Form number “ Section 18(2), GI-3 For renewal of an authorised user 3C rule 60(1) ” the following form number shall be substituted, namely:- “ GI-3 Section 18(2), rule 60(1) For renewal of an authorised user 3B ”6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8.
