और, उक्त प्रारूप जनयमक की बाबत् िनता से जवजन्द् ट अवजध के भीतर प्रात त आक्षेपक और सुझावक पर कें्ीय
सरकार द्वारा जवचार दकया गया ह ै;
अत:, अब, कें्ीय सरकार, पयावा रण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 6, धारा 8 और धारा
25 द्वारा प्रदत् त िजक्त यक का प्रयोग करत े हुए पररसंकटमय और अन् य अवजि्ट (प्रबंध और सीमापार संचलन) जनयम,
2016 का और संिोधन करने के जलए जनम्न जलजखत जनयम बनाती ह,ै अथाात् :--

1. सजं क्षतत नाम, जवस्ट्त ार और प्रारंभ--(1) इन जनयमक का संजक्षत त नाम पररसंकटमय और अन् य अवजि्ट (प्रबंध और
सीमापार संचलन) जनयम, 2020 ह ै।
(2) य ेरािपत्र में प्रकािन की तारीख को प्रवृत् त हकगे ।
2. पररसंकटमय और अन् य अवजि्ट (प्रबंध और सीमापार संचलन) जनयम, 2016 के जनयम 5 के उपजनयम (2) के खडं
(क), खंड (ग) और खंड (घ) के स्ट् थान पर क्रमि: जनम्न जलजखत खंड रख ेिाएंग,े अथाात:्-
“(क) पररसंकटमय अपजि्ट क के उत् पादन, हथालन, एकत्रीकरण, प्राजत त, िोधन, पररवहन, भंडारण, पुन: उपयोग,
पुनचाक्रण, पुन: प्राजत त, पूव-ा प्रसंस्ट् करण, सह-प्रसंस्ट् करण सजहत उपयोग और जनपटान म ें िाजमल ्रमजमकक की
मान् यता और रजिस्ट् रीकरण सुजनज चत करना;
(ग) पररसंकटमय अपजि्ट क के उत् पादन, हथालन, एकत्रीकरण, प्राजत त, िोधन, पररवहन, भंडारण, पुन:उपयोग,
पुनचाक्रण, पनु :प्राजत त, पूवा-प्रसस्ट्ं करण, सह-प्रसंस्ट् करण सजहत उपयोग और जनपटान म ें िाजमल ्रमजमकक के जलए
औद्योजगक कौिल जवकास कायाकलाप आरंभ करना;
(घ) वार्विक मानीटरी करना और पररसंकटमय अपजि्ट क के उत् पादन, हथालन, एकत्रीकरण, प्राजत त िोधन,
पररवहन, भंडारण, पनु :उपयोग, पनु चाक्रण, पुन:प्राजत त, पूवा-प्रसंस्ट् करण, सह-प्रसंस्ट् करण सजहत उपयोग और
जनपटान में िाजमल ्रमजमकक की सुरक्षा और स्ट् वास्ट् ् य सुजनज चत करना ।”

NOTIFICATION
New Delhi, the 9th October, 2020
G.S.R. 641(E).—Whereas the draft rules, namely the Hazardous and Other Wastes (Management and
Transboundary Movement) Amendment Rules, 2020, were published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 77(E), dated the 31st January, 2020 in the
Gazette of India, Extraordinary Part II, Section 3, Sub-section (ii), dated the 3rd February, 2020 inviting objections and
suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date
on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS the copies of the said Gazette containing the said notification were made available to the
public on the 3rd day of February, 2020;
AND WHEREAS the objections and suggestions received within the specified period from the public in
respect of the said draft rules have been duly considered by the Central Government;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
NOW, THEREFORE, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment
(Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the
Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, namely:-
1. (1) These rules may be called the Hazardous and Other Wastes (Management and Transboundary
Movement) Amendment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, in rule 5, in
sub-rule (2), for clauses (a), (c) and (d), the following clauses shall respectively be substituted, namely:-
“(a) ensure recognition and registration of workers involved in generation, handling, collection, reception,
treatment, transport, storage, reuse, recycling, recovery, pre-processing, utilisation including
co-processing and disposal of hazardous wastes;
(c) undertake industrial skill development activities for the workers involved in generation, handling,
collection, reception, treatment, transport, storage, reuse, recycling, recovery, pre-processing,
utilisation including co-processing and disposal of hazardous wastes;
(d) undertake annual monitoring and to ensure safety and health of workers involved in generation,
handling, collection, reception, treatment, transport, storage, reuse, recycling, recovery, pre-processing,
utilisation including co-processing and disposal of hazardous wastes.”.
