(1) इन िनयम@ का सिं (cid:21)Vत नाम अमोिनयम नाइ(cid:28)ेट (सशं ोधन) िनयम, 2018 ह।ै (2) ये राजप* म; इनके काशन क(cid:14) तारीख को वXृ त ह@ग।े 2. अमोिनयम नाइ(cid:28)ेट िनयम, 2012 म; (िजसे इसम ;इसके पZात मलू िनयम कहा गया ह)ै िनयम 2 म,;- 5682 GI/2018 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (अ) ख9ड (ध) के (cid:3)थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त:्- ‘‘‘‘(ध) "नौभा]रक” के अतं ग,त कोई ^य ि2 या अिभकरण या फम ,भी होगा जो पोत स ेअमोिनयम नाइ(cid:28)ेट क(cid:14) चढ़ाई और उतराई, अन_ु Vत भ9ड ार गह ृ तक उसके प]रवहन का काय ,करता ह;ै”; (आ) ख9 ड (न) म ;“नौभरण, प]रवहन, भंडारण और उपयोग” शE द@ के (cid:3)थान पर "प]रवतक, और नौभा]रक" शE द रख े जाएंगे। 3. मलू िनयम के िनयम 5 म,; परंतकु का लोप =कया जाएगा। 4. मलू िनयम के, िनयम 6 म,;- (अ) उप-िनयम 2 के ख9ड (क) का लोप =कया जाएगा; (आ) उप-िनयम 5 के ख9ड (ख) के (cid:3)थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त:्- "अमोिनयम नाइ(cid:28)ेट का प]रवहन याि*य@ के िलए चलाए गए या उनक(cid:14) ढुलाई कर रह े=कसी वाहक पोत या वाहन म ; नहG =कया जाएगा।" 5. मलू िनयम के, िनयम 8 म,;- (अ) ख9ड (क) के (cid:3)थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त:्- “(क) वह एक उिचत जलसह थलै े म ;पकै =कया गया हो”; (आ) ख9 ड (ख) के (cid:3)थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त:्- “(ख) थलै ेपर िनयम 9 के उपबधं @ अनसु ार िचिMहत =कया गया हो”;” (इ) ख9ड (ग) म ; “पकै ेज” शEद के (cid:3)थान पर “थलै े” शE द रखा जाएगा; (ई) ख9ड (घ) म ; “पकै ेज” शEद के (cid:3)थान पर “थलै े” शE द रखा जाएगा। 6. मलू िनयम के िनयम 9 म,;- (अ) उप-िनयम (1) म,;- (i) “या आधान” शEद @ का लोप =कया जाएगा; (ii) ख9ड (च) म,; “पकै ेज” शEद के (cid:3)थान पर “थैल”े शE द रखा जाएगा; (iii) ख9ड (ज) म; “नौभरण अिभकता”, शE द@ के (cid:3)थान पर “नौभरक” शEद रखा जाएगा; (आ) उप-िनयम (2) म े“आरएफआईडी” शEद@ के (cid:3)थान पर “रेिडयो d(cid:14)e;सी आइड]; ट=फकेशन िडवाइस” शE द रख ेजाएंग।े 7. मलू िनयम के, िनयम 12 म,;- (अ) उप-िनयम (4) के (cid:3)थान पर िनPन िलिखत उप-िनयम रखा जाएगा, अथा,त:्- “(4) अमोिनयम नाइ(cid:28)ेट भ9ड ारगृह से िनP निलिखत सरु (cid:21)ा द]ूरयां रखी जाएगी अथात, ्:- (क) 30 म]ै (cid:28)क टन से अनिधक अमोिनयम नाइ(cid:28)ेट के भ9 डारण के िलए,- (i) 30 म]ै (cid:28)क टन से अनिधक (cid:21)मता के भ9 डारगृह स े4.5 मीटर; (ii) अमोिनयम नाइ(cid:28)ेट मेf ट टHक स े4.5 मीटर;¹ Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (iii) चारदीवारी से 4.5 मीटर; और (iv) =कसी भी सरं ि(cid:21)त काय ,से 45 मीटर। (ख) 30 मै](cid:28)क टन से अिधक अमोिनयम नाइ(cid:28)ेट के भ9 डारण के िलए,- (i) अMय भ9ड ारगृह स े9 मीटर; (ii) अमोिनयम नाइ(cid:28)ेट मेf ट टHक स े9 मीटर; (iii) चारदीवारी से 9 मीटर और (iv) =कसी भी सरं ि(cid:21)त काय ,से 90 मीटर; (4अ) भ9ड ारगृह या अमोिनयम नाइ(cid:28)ेट मेf ट टHक, अमोिनयम नाइ(cid:28)ेट के िविनमा,ण या संप]रवतन, के पेटीबंदकरण एकक या िव(cid:3)फ ोटक िविनमाण, संय*ं या नाइ(cid:28)स ऑCस ाइड िविनमाण, संयं* के िनकटवतi हो सकता ह,ै =कMत ु उप- िनयम (4) के सभी उपबंध@ का पालन =कया जाएगा; (4आ) सरु (cid:21)ा दरू ी क(cid:14) नाप यथाि(cid:3)थित अमोिनयम नाइ(cid:28)ेट मेf ट टHक या भ9 डारगृह के =कनारे स ेली जाएगी।”; (आ) उप-िनयम (6) म,;- (क) "वग, मीटर ित", शEद@ के पjच ात अंक "1.5" को अंतः(cid:3)थािपत =कया जाएगा; (ख) परंतकु अंक "200", के (cid:3)थान पर अंक "300" रखे जाएगं े। (इ) उप-िनयम (8) के, ख9ड (iii) म;, “दरू ी रखी जाएगी” शE द@ के पj चात “और दो ऐसे अमोिनयम नाइ(cid:28)ेट मेf ट टHक के बीच Mय नू तम एक मीटर क(cid:14) दरू ी बनाई रखी जाएगी” शEद अंतः(cid:3)थािपत =कए जाएंगे। 8. मलू िनयम के िनयम 14 म,; उप-िनयम (1) के (cid:3)थान पर िनP निलिखत उप-िनयम रखा जाएगा, अथात, ्:- “(1) अमोिनयम नाइ(cid:28)ेट के िविनमा,ण, संप]रवत,न, नौभरण, िवlय या उपयोग हते ु कEजा, प]रवहन, आयात या िनया,त हते ु, इन िनयम@ के अंतग,त जारी अनु_िJ के X यके धारक 7ारा अनुसूची 2 के भाग 3 म; िविनnदo ट !प@ म ; अिभलेख रखा जाएगा ता=क अमोिनयम नाइ(cid:28)ेट क(cid:14) जवाबदेही, पहचान और पता लगाना सिु निZत =कया जा सक; और िनयम 50 म; िविनnदoट ािधकारी 7ारा मांग ेजाने पर ऐसे अिभलेख (cid:3) तुत =कए जाए; (1क) अन_ु िJ धारक अमोिनयम नाइ(cid:28)ेट के िविनमाण, , संप]रवत,न, नौभरण, पेटीबंदकरण, िवlय या उपयोग हते ु कEजा, भंडारण, प]रवहन, आयात या िनया,त के संबंध म; िविशिqयाँ, पे(cid:28)ोिलयम तथा िव(cid:3)फोटक सुर(cid:21)ा संगठन क(cid:14) आिधका]रक वेबसाइट म ;उपलEध ऑनलाइन णाली म,; ित=दन के आधार पर िविq करेगा।”; 9. मलू िनयम म;, “अsय ाय 3” के शीष,क के (cid:3)थान पर, िनP निलिखत शीषक, को रखा जाएगा, अथात, ्:- (क) “सुर(cid:21)ा और संर(cid:21)ा बंधन योजना के िलए उपबंध”। 10. मलू िनयम म,; िनयम 15 के, उप-िनयम (1) के (cid:3)थान पर िनPन िलिखत उप-िनयम को रखा जाएगा, अथा,तः-- “(1) अमोिनयम नाइ(cid:28)ेट के िविनमाण, , संप]रवतन, या नौभरण के िलए इu छुक ^ यि2 अनु_ापन ािधकारी और िजला ािधकारी को सरु (cid:21)ा और सरं (cid:21)ा बधं न योजना (cid:3) तुत करेगा।”। 11. मलू िनयम के िनयम 18 म,;- (अ) उप-िनयम (1) के (cid:3)थान पर िनTिलिखत उप-िनयम को रखा जाएगा, अथात, ्:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "(1)अमोिनयम नाइ(cid:28)ेट को आयातक 7ारा केवल थले ेम; आयाितत =कया जाएगा। य=द आवjयक हो, तो आयातक उपयु2 पwे कग के िलए इन िनयम@ के अधीन िविधमाMय अनु_िJ वाले नौभा]रक को ािधकृत करेगा; (आ) उप-िनयम (2) म,; “नौभरण अिभकता,” शEद @ के (cid:3)थान पर “नौभा]रक” शE द रखा जाएगा; (इ) उप-िनयम (3) म,; “नौभा]रक अिभकता,” शE द@ के (cid:3)थान पर “नौभा]रक” शE द रखा जाएगा; (ई) उप-िनयम (4) म,; “अनु_ापन ािधकारी और” शE द@ का लोप =कया जाएगा; (उ) उप-िनयम (5) के खंड (ख) म ; “ !प गड-1” शE द, अ(cid:21)र और अकं के (cid:3)थान पर “ !प ग-1” शE द, अ(cid:21)र और अंक रख े जाएंगे। 12. मलू िनयम म,; िनयम 19 के उप-िनयम (3) के पj चात, िनP निलिखत उप-िनयम अंतः(cid:3)थािपत =कया जाएगा, अथात, ्:- “(4) िनया,तक, Xयके पारेषण के िनया,त पर, जसै े ही भारतीय समूNी पX तन या सीमा स े उसके ेषण करत े ही, मु/य िनयं*क को लदान के िबल क(cid:14) ित और !प द-12 म ;िववरणी (cid:3)तुत करेगा।”। 13. मलू िनयम म,; िनयम 21 के, उप-िनयम (6) म; “भ9 डार गृह” शE द के पj चात “या अमोिनयम नाइ(cid:28)ेट मेf ट टHक” शE द रख े जाएंगे। 14. मलू िनयम म,; िनयम 22 के, उप-िनयम (8) के पj चात, िनP निलिखत उप-िनयम अंतः(cid:3)थािपत =कया जाएगा, अथा,त्:- “(9) अमोिनयम नाइ(cid:28)ेट के प]रवहन म ; लग े यान@ म ; xलोबल पोिजyzग िस(cid:3)टम क(cid:14) सिु वधा उपलEध कराई जाएगी और !प त-4 म ;प]रवहन अन_ु िJ धारक 7ारा िनगरानी क(cid:14) जाएगी।”। 15. मलू िनयम के, िनयम 26 म,; “=कसी भ9 डार गृह म ; और उसस”े शE द@ के (cid:3)थान पर “=कसी भ9 डार गृह या अमोिनयम नाइ(cid:28)ेट मेfट टHक से“ शEद रख ेजाएंगे। 16. मलू िनयम म,; िनयम 27 के, उप-िनयम (2) के ख9 ड (ग), के पj चात िनP निलिखत ख9 ड अतं ः(cid:3)थािपत =कया जाएगा, अथा,त:्- “(घ) अमोिनयम नाइ(cid:28)ेट का कEज ा और उपयोग के िलए अन_ु िJ धारक 7ारा अनुसूची 2 के भाग 3 के !प द -13 म ; पास जारी क(cid:14) जाएगी।”। 17. मलू िनयम म,; अsय ाय 7 के शीष,क म,; “अंतरण” शE द का लोप =कया जाएगा। 18. मलू िनयम म,; िनयम 29 के उप-िनयम (1) म,; - (अ) ख9ड (ख) म,; “भ9ड ार गहृ स”े शEद @ के (cid:3)थान पर “अमोिनयम नाइ(cid:28)ेट के” शEद रख ेजाएगं े; (आ) ख9ड (ग) म,; “भ9ड ार गहृ ” शEद @ के पZात, “या टHक म ;िपघला अमोिनयम नाइ(cid:28)ेट” शEद अतं ः(cid:3)थािपत =कए जाएगं े; (इ) ख9ड (घ) म; “भ9ड ार गृह” शEद @ के पjच ात “या टHक म ;िपघला अमोिनयम नाइ(cid:28)ेट” शEद अंतः(cid:3)थािपत =कए जाएगं े। 19. मलू िनयम के, िनयम 30 म,;- (अ) उप-िनयम (1) के (cid:3)थान पर, िनPन िलिखत उप-िनयम रखा जाएगा, अथा,त:्- “(1) अमोिनयम नाइ(cid:28)ेट के िविनमा,ण, संप]रवतन, , नौभरण, िबl(cid:14) हते ु भ9 डारण के िलए कEजा या अमोिनयम नाइ(cid:28)ेट के उपयोग हते ु कEज ा, इन िनयम@ के अधीन अन_ु िJ ाV त करने हते ु =कसी ^ यि2 7ारा िनयम 33 म ; उिfलिखत द(cid:3)त ावेज (cid:3)त ुत कर, ऐसी अनु_िJ जारी करने के िलए सश2 स(cid:21)म ािधकारी स े पूवान, ुमोदन ाVत करना होगा।”; (आ) उप-िनयम (2) म,; “मिज(cid:3)(cid:28)ेट” शEद के (cid:3)थान पर “ ािधकारी” शE द रखा जाएगा;¹ Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 (इ) उप-िनयम (3) म,; शEद और अकं “िनयम 33” के (cid:3)थान पर शEद और अंक “िनयम 34” रखा जाएगा। 20. मलू िनयम के िनयम 31 म,; शEद और अंक, “िनयम 32” के (cid:3)थान पर शEद और अंक, “िनयम 33” रखा जाएगा। 21. मलू िनयम म,; िनयम 33 के, उप-िनयम (2) के खडं (घ) म,; “चाट,]रत अिभयंता” शE द@ के (cid:3)थान पर “आवेदक” शEद रखा जाएगा। 22. मलू िनयम के िनयम 34 म,;- (अ) उप-िनयम (2) के ख9ड (ख) मे “खान सुर(cid:21)ा महािनदशे क” शE द@ के पj चात “या खान सुर(cid:21)ा उप महािनदशे क या खान सुर(cid:21)ा िनदशे क” शEद अंतः(cid:3)थािपत =कए जाएंगे; (आ) उप-िनयम (3) के (cid:3)थान पर िनPन िलिखत उप-िनयम रखा जाएगा, अथा,त:्- “(3) िजला ािधकारी या खानसुर(cid:21)ा महािनदशे क या खानसुर(cid:21)ा उप-महािनदशे क या खानसरु (cid:21)ा िनदशे क 7ारा िविनमा,ण या संप]रवत,न या भ9 डारगृह या टHक म; िपघल े अमोिनयम नाइ(cid:28)ेट के योजन, के िलए जारी =कए गए अनापिR माण प* या िव(cid:3) फोटक िनयम, 2008 के अधीन जारी अना पिR माण-प* के दायरे म; य=द वह (cid:3)थ ान शािमल ह ै जह| य े काय , पहल े स े िव’यमान ह ै तो उसके िलए नए िसरे स े अनापि} ा माण-प* अपेि(cid:21)त नही होगा।”। 23. मलू िनयम म,; िनयम 35 के, उप-िनयम (3) म,; “अनु_ापन ािधकारी” शE द@ के (cid:3)थान पर “िनयं*क या िजला ािधकारी” शEद रख ेजाएंगे। 24. मलू िनयम के, िनयम 36 म,;- (अ) उप-िनयम (4) के (cid:3)थान पर िनPन िलिखत उप-िनयम रखा जाएगा, अथा,त:्- “(4) अन_ु िJ के नवीकरण के िलए X यके आवदे न, अन_ु िJ फ(cid:14)स के साथ ऐस े (cid:3) तुत =कया जाएगा =क वह अनु_ापन ािधकारी या अनु_िJ के नवीकरण के िलए अिधकृत ािधकारी के पास उस तारीख को या उसस े पहले पहुचंॅ जाए, िजस तारीख को अनु_िJ क(cid:14) िविधमाM यता समाV त होती हःै परMत ु य=द परू े द(cid:3) तावेज@ के साथ नवीकरण आवेदन अनु_ापन ािधकारी 7ारा अनु_िJ क(cid:14) िविधमाMय ता समाVत होने के पj चात wकतु उसक(cid:14) िविधमाMय ता समाV त होने के छह माह के भीतर ाVत होता ह;ै और य=द अनु_ापन ािधकारी को यह समाधान हो जाता ह ै =क िवलंब का कारण अनु_िJधारी के िनयं*ण से बाहर था, तो इस िनिमR =कए गए =कसी भी अMय कार,वाई के ितकूल भाव के िबना, एक वष , के अनु_िJ फ(cid:14)स के तुfय िवलंब फ(cid:14)स के भुगतान करने पर नवीकरण =कया जा सकता ह।ै ”; (आ) उप-िनयम (5) म,; “और य=द अनु_िJ क(cid:14) िविधमाMयता क(cid:14) तारीख तक उसके नवीनीकरण के िलए कोई आवेदन ाJ नहG होता तो अन_ु िJ क(cid:14) िविधमाMयता समाJ हो जाएगी” शE द@ का लोप =कया जाएगा; (इ) उप-िनयम (8) के पjच ात िनPन िलिखत उप-िनयम अंतः(cid:3)थािपत =कए जाएगं े, अथात, ्:- “(9) ऐसी कोई भी अनु_िJ का नवीकरण नहG =कया जाएगा य=द अनु_ापन या नवीकरण ािधकारी 7ारा नवीकरण का आवेदन, अनु_िJ के िविधमाM यता समाVत होन ेके छह माह के पj चात ाV त =कया जाता ह।ै (10) अन_ु िJ के िविधमाMय ता समाV त होन े के छह माह के पj चात य=द अनु_िJ नवीकरण हते ु आवेदन ाVत होता ह ै तो उस े नई अन_ु िJ जारी करन े हते ु आवेदन समझा जाएगा और ऐसे मामल े म,; नई अनु_िJ जारी करने हेतु िजला ािधकारी 7ारा जारी अनापिR माण-प* सिहत सभी आवj यक द(cid:3) तावेज, अनु_ापन ािधकारी को (cid:3)त तु =कए जाएगं े।”। 25. मूल िनयम म,; िनयम 51 के उप-िनयम (3) म; “इस िनयम” शE द@ के (cid:3)थान पर शE द, अंक और ~ के ेट “उप-िनयम (2)” रखे जाएंगे।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 26. मलू िनयम के, िनयम 52 म,; “जहॉ हािन अमोिनयम नाइ(cid:28)ेट के रोजमरा, के उX पादन, भ9 डारण, प]रवहन, या उपयोग के दौरान तीकाXम क !प से होन ेवाली हािन क(cid:14) मा*ा स ेअिधक हािन होती ह,ै” शE द@ का लोप =कया जाएगा। 27. मलू िनयम क(cid:14) अनसु ूची 1 के सारणी म ;lम सं/ या 3 के सामन,े (cid:3) तंभ 2 म,;- (अ) मद (क) म ;“या योग” शEद @ का लोप =कया जाएगा; (आ) मद (ख) के (cid:3)थान पर िनPन िलिखत मद रखी जाएगी, अथात, ः- “(ख) =कसी भ9ड ार गृह या टHक म ; िपघल े अमोिनयम नाइ(cid:28)ेट स े 30 म]ै (cid:28)क टन से अिधक अमोिनयम नाइ(cid:28)ेट के िवlय हते ु कEज े म ;रखन ेके िलए अन_ु िJ; या”; (इ) मद (ग) के (cid:3)थान पर िनTिलिखत मद रखा जाएगा, अथात, ्:- “(ग) =कसी िव(cid:3)फ ोटक िविनमात, ा या नाइ(cid:28)स ऑCस ाइड िविनमा,ता इकाई या औ’ोिगक इकाई स े संब(cid:128) भ9 डार गृह या टHक म; िपघले अमोिनयम नाइ(cid:28)ेट स ेउपयोग हते ुआमोिनयम नाइ(cid:28)ेट कE ज ेम ;रखने के िलए अनु_िJ; या”; (ई) मद (घ) म ;“भ9ड ार गृह” शEद @ के पjच ात “3 म]ै (cid:28)क टन से अनिधक” अकं और शE द अंतः(cid:3)थािपत =कए जाएगं े। 28. मलू िनयम के अनसु ूची 2 म,; (अ) भाग-1 क(cid:14), सारणी म,; (cid:3)त ंभ 2 म,; (1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2018. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Ammonium Nitrate Rules, 2012 (hereinafter referred to as the principal rules), in rule 2,- (i) for clause (s), the following clause shall be substituted, namely:- '(s) "stevedore" includes any person or agency or firm which undertakes loading and unloading of Ammonium Nitrate from the ship, its transport to the licensed store house; (ii) in clause (t), for the words “stevedoring, transport, storage and usage”, the words “converter and stevedore” shall be substituted. 3. In the principal rules, in rule 5, the proviso shall be omitted. 4. In the principal rules, in rule 6,- (A) in sub-rule (2), clause (a) shall be omitted; (B) in sub-rule (5), for clause (b), the following clause shall be substituted, namely:- "No Ammonium Nitrate shall be transported in any carriage vessel or vehicle plying for or carrying passengers.". 5. In the principal rules, in rule 8,- (A) in clause (a), the words "or container or is suitably bagged by stevedore or converter” shall be omitted; (B) for clause (b), the following clause shall be substituted, namely:- " (b) the bag is marked in accordance with the provisions of rule 9;"; (C) in clause (c), for the word “packages”, the word “bags” shall be substituted; (D) in clause (d), for the word “packages”, the word “bags” shall be substituted. 6. In the principal rules, in rule 9,- (A) in sub-rule (1),- (I) the words “or container” shall be omitted; (II) in clause (f), for the word "package", the word "bag" shall be substituted; (III) in clause (h), for the words “stevedoring agent”, the word “stevedore" shall be substituted; (B) in sub-rule (2), for the letters “RFID”, the words “Radio Frequency Identification Device” shall be substituted. 7. In the principal rules, in rule 12,- (A) for sub-rule (4), the following sub-rule shall be substituted, namely:- "(4) The Ammonium Nitrate storehouse shall maintain following safety distances, namely:- (a) for storage of Ammonium Nitrate not exceeding 30 MT,- (i) 4.5 meters from other store house of capacity not exceeding 30 MT; (ii) 4.5 meters from Ammonium Nitrate melt tank;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) 4.5 meters from compound wall; and (iv) 45 meters from any protected works; (b) for storage of Ammonium Nitrate exceeding 30 MT,- (i) 9 meters from other store house; (ii) 9 meters from Ammonium Nitrate melt tank; (iii) 9 meters from compound wall; and (iv) 90 meters from any protected works. (4A) The store house or Ammonium Nitrate melt tank may be adjacent to the bagging unit of the manufacturing or conversion of Ammonium Nitrate or explosives manufacturing plant or nitrous oxide manufacturing plant, but shall observe all the provisions of sub-rule (4). (4B) The safety distance shall be measured from the edge of the store house or Ammonium Nitrate melt tank as the case may be. "; (B) in sub-rule (6),- (i) after the words "one square metre per", the figure "1.5" shall be inserted; (ii) in the proviso, for the figure, "200", the figure "300" shall be substituted; (C) in sub-rule (8), in clause (iii), after the words "protected works", the words “and the distance of minimum one metre shall be maintained between two such Ammonium Nitrate melt tanks” shall be inserted. 8. In the principal rules, in rule 14, for sub-rule (1), the following sub-rules shall be substituted, namely:- "(1) Every person holding a licence granted under these rules for manufacture, conversion, stevedore, possession for sale or use, transport, import or export of the Ammonium Nitrate shall maintain records in the forms specified in Part 3 of Schedule II to ensure accountability, identification and traceability of Ammonium Nitrate and shall produce such records on demand to an authority specified in rule 50. (1A) The licence holder shall enter the particulars on manufacture, conversion, stevedore, bagging, possession for sale or use, transport, import or export of Ammonium Nitrate in the online system made available in the official website of Petroleum and Explosives Safety Organisation on day to day basis.". 9. In the principal rules, in “CHAPTER III", for the heading, the following heading shall be substituted, namely:- “PROVISIONS FOR SAFETY AND SECURITY MANAGEMENT PLAN”. 10. In the principal rules, in rule 15, for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) A person intending to manufacture, convert or stevedore Ammonium Nitrate shall submit Safety and Security Management Plan to the licensing authority and to the District Authority.". 11. In the principal rules, in rule 18,- (A) for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) Ammonium Nitrate shall be imported by the importer only in bagged form and the importer shall authorise stevedore having valid licence under these rules for suitable packing, if required"; (B) in sub-rule (2), for the words “stevedoring agent”, the word “stevedore” shall be substituted; (C) in sub-rule (3), for the words “stevedoring agent”, the word “stevedore” shall be substituted; (D) in sub-rule (4), the words “the Licensing Authority and”, shall be omitted; (E) in sub-rule (5), in clause (b), for the word, letters and figure “Form CE-1”, the word, letter and figure “Form C-1” shall be substituted; 12. In the principal rules, in rule 19, after sub-rule (3), the following sub-rule shall be inserted, namely:- “(4) The exporter shall submit copy of bill of lading and return in Form R-12 to the Chief Controller, on export of each consignment as soon as it is dispatched from Indian sea port or border.". 13. In the principal rules, in rule 21, in sub-rule (6), for the word "storehouse", the words “store house or Ammonium Nitrate melt tank” shall be substituted. 14. In the principal rules, in rule 26, for the words "in and from a storehouse", the words "from a store house or Ammonium Nitrate melt tank" shall be substituted. 16. In the principal rules, in rule 27, in sub-rule (2), after clause (c), the following clause shall be inserted, namely:- "(d) a person holding a licence for possession and use of Ammonium Nitrate shall issue pass in Form R-13 of Part 3 of Schedule II.". 17. In the principal rules, in CHAPTER VII, in the heading, the word “TRANSFER” shall be omitted. 18. In the principal rules, in rule 29, in sub-rule (1),- (A) in clause (b), for the words “from a store house”, the words “of Ammonium Nitrate” shall be substituted; (B) in clause (c), after the word "store house", the words “or Ammonium Nitrate melt in tank” shall be inserted; (C) in clause (d), after the word "store house", the words “or Ammonium Nitrate melt in tank” shall be inserted. 19. In the principal rules, in rule 30,- (A) for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) A person desiring to obtain a licence for manufacture, conversion, stevedore, store for possession for sale or possession for use of Ammonium Nitrate, under these rules, shall obtain prior approval from the authority empowered to grant such licence, by submitting documents mentioned in rule 33."; (B) in sub-rule (2), for the word “Magistrate”, the word “Authority” shall be substituted; (C) in sub-rule (3), for the word and figures “rule 33”, the word and figures “rule 34”, shall be substituted. 20. In the principal rules, in rule 31, for the word and figures “rule 32”, the word and figures “rule 33” shall be substituted. 21. In the principal rules, in rule 33, in sub-rule (2), in clause (d), for the words “Chartered Engineer”, the words “the applicant” shall be substituted. 22. In the principal rules, in rule 34,- (A) in sub-rule 2, in clause (b), after the words "Mines Safety", the words "or Deputy Director General of Mines Safety or Director of Mines Safety" shall be inserted; (B) for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) Fresh No Objection Certificate is not required for manufacturer or converter or store house or Ammonium Nitrate melt in tank, which is already existing at the site covered under No Objection certificate issued for the purpose by the District Authority or Director General of Mines Safety or Deputy Director General of Mines Safety or Director of Mines Safety or No Objection Certificate issued under the Explosives Rules, 2008.". 23. In the principal rules, in rule 35, in sub-rule (3), for the words "licensing authority", the words "Controller or District Authority as the case may be" shall be substituted. 24. In the principal rules, in rule 36,- (A) for sub-rule (4), the following sub-rule shall be substituted, namely:- "(4) Every application for the renewal of a licence shall be made so as to reach the licensing authority or the authority empowered to renew the licence on or before the date on which the licence expires: Provided that if the renewal application together with complete documents is received by the licensing authority after the date of expiry of the licence but not later than six months from the date of its expiry; and if the licensing authority is satisfied that the reason for the delay was beyond the control of the licence holder, the licence may, without prejudice to any other action that may be taken in this behalf, be renewed on payment of the late fee equivalent to one year's licence fee."; (B) in sub-rule (5), the words, " and if no application is received till the date of validity of the licence, the licence shall stand expired" shall be omitted; (C) after sub-rule (8), the following sub-rules shall be inserted, namely:- "(9) No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after six months of the date of its expiry. (10) An application for renewal received after six months of the expiry of the licence shall be considered as an application for a new licence and in such case, all the documents required for grant of new licence26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] including No Objection Certificate issued by District Authority shall be submitted to the licensing authority for grant of new licence.". 25. (III) after serial number 9, in the end, for the words “[District Authority]”, the words “[Chief Controller]”, shall be substituted; (IV) for condition (4), the following condition shall be substituted, namely:- "(4) The licence holder and every person employed in or about the stevedore, bag and store premises shall take all due precautions for the prevention of accidents by fire or explosion in the stevedore, bag and store premises and for preventing unauthorised person from having access to such premises or to the Ammonium Nitrate therein and shall abstain from any act whatsoever which tends to cause fire or explosion and is not reasonably necessary for the purposes of work in the stevedore, bag and store premises.";
