सरकार एवं अन्य के 2006 के ररट याणचका संख्या 365 के णविय में तारीख 6 अगस्त, 2010 के आिशे म,ें केंद्रीय सरकार को
चाय अणिणनयम 1953 (1953 का 29) के उपबंिों के अिीन, णवशेिकर उपखंड 16ख, 16ग, 16घ और 16ड़ के अनुसार,
छ: माह के भीतर अपन ेकानूनी कताव्यों को दियाणन्वत करने का णनिेश िते ी ह ै;
और यत: भारत का माननीय उच्चतम न्यायालय तारीख 21.7.2017 के आिशे द्वारा 2012 के अवमान याणचका
संख्या 16 में णनिशे िते ा ह ै दक तारीख 6 अगस्त, 2010 के उपरोक्त णनिेशों का चार सप्ताह के भीतर अनुपालन दकया जाना
चाणहए ।
अतः अब केंद्रीय सरकार, चाय अणिणनयम 1953, (1953 का 29) की िारा 16ख की उपिारा (1) के खडं (ग) द्वारा
प्रित्त शणक्तयों का प्रयोग करत े हुए असम, पणिम बंगाल, केरल, और तणमलनाडु राज्यों म ें इस अणिसूचना के उपाबंि में
उणल्लणखत चाय सम्पिाओं के कायों की पूिा और समग्र अन्विे ि करने के णलए णनम्नणलणखत तीन पथृ क सणमणतयों के रूप में
णनयुक्त करती ह ै(केरल राज्य के णलए णनयुक्त सणमणत तणमलनाडु के सम्पिाओं को भी समाणवष्ट करेगी) अथाात ् :-

NOTIFICATION
New Delhi, the 7th August, 2017
S.O. 2494(E).—Whereas, the Hon’ble Supreme Court of India in Writ Petition No.365 of 2006 in the matter
of International Union of Food, Agriculture & Ors. versus Union of India and ors. vide order dated the 6th August, 2010
directed the Central Government to carry out their statutory duties under the provisions of the Tea Act, 1953 (29 of
1953) particularly, in terms of sections 16B, 16C, 16D and 16E within a period of six months;
And whereas, the Hon’ble Supreme Court of India in Contempt Petition No.16 of 2012 vide order dated the
21st July, 2017 directed that the aforesaid directions dated the 6th August, 2010 should be complied within four weeks.
Now, therefore, in exercise of the powers conferred by clause (c) of sub-section (1) of section 16B of the Tea
Act, 1953 (29 of 1953), the Central Government hereby appoints the following three separate Committees to make a
full and complete investigation into the affairs of the tea estates given in Annexure to this notification, in the States of
Assam, West Bengal, Kerala and Tamil Nadu (the Committee for Kerala shall cover the tea estates in Tamil Nadu also),
namely:-
For the State of Assam
(i) Shri Sanjio Kumar, Executive Director, Tea Board, Guwahati.
(ii) Shri Chandrashekhar Mitra, Deputy Director, Tea Development, Tea Board, Guwahati.

The terms of reference
The Committees shall make a full and complete investigation into the affairs of the tea estates relating to the

(a) The details of wages, gratuity and provident fund dues being paid and payable to the workers and their
dependents and such other dues as they are under an obligation to pay under any law;
(b) The details about the action initiated by authorities concerned against the management or owners of the
tea estates for non-payment of wages, gratuity and provident fund dues;
The committees shall submit their report within one month from the date of the notification.
