यतः, इस (cid:7079)कार हुई िरि(cid:7334) को भरने के (cid:7079)योजन से उप-िनवार्चन कराना ह;ै
अतः, अब, लोक (cid:7079)ितिनिधत्व अिधिनयम, 1951 (1951 का 43) की धारा 147, धारा 39 की उपधारा (1)
और धारा 56 के अनुसरण म(cid:7286), भारत िनवार्चन आयोग एत(cid:7375)ाराः-
(अ) ओिडशा राज्य की िवधान सभा के िनवार्िचत सदस्य(cid:7298) से यह अपेक्षा करता ह ै िक वे 27 मई 2017 से पूवर्
तथा उ(cid:7334) अिधिनयम और त(cid:7373)ीन बनाए गए िनयम(cid:7298) और उनके तहत जारी िकए गए आदशे (cid:7298) के उपबन्ध(cid:7298) के अनुसार
राज्य सभा म(cid:7286) उ(cid:7334) िरि(cid:7334) को भरने के (cid:7079)योजन से एक (cid:7390)ि(cid:7334) िनवार्िचत कर द।(cid:7286)
(आ) उ(cid:7334) िनवार्चन के सबं धं म (cid:7286) :-
(क) नाम िनदश(cid:7287) न करने की अिन्तम तारीख – 15 मई, 2017 (सोमवार) ;
(ख) नाम िनद(cid:7287)शन की संवीक्षा की तारीख – 16 मई, 2017 (मंगलवार) ;
(ग) अभ्यिथर्ताएं वापस लेने की अिन्तम तारीख –18 मई, 2017 (बृहस्पितवार) ;
(घ) वह तारीख िजसको यिद आवश्यक हुआ तो मतदान होगा – 25 मई, 2017 (बृहस्पितवार) ; और

NOTIFICATION
New Delhi, the 8th May, 2017
O.N. 28(E).—WHEREAS, the seat of Sh. Bishnu Charan Das in the Council of States, elected by the elected
members of the Legislative Assembly of the State of Odisha, has become vacant on 21st March, 2017 by the reason of
resignation, before the expiration of his term of office which was up to and including the 1st July, 2022; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of section 147, sub-section (1) of section 39 and section 56 of the
Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby—
(A) calls upon the elected members of the Legislative Assembly of the State of Odisha to elect, before 27th May,
2017, and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a
person for the purpose of filling the said vacancy in the Council of States;
(B) appoints, with respect to the said election;
(a) the 15th May, 2017 (Monday), as the last date for making nominations;
(b) the 16th May, 2017 (Tuesday), as the date for the scrutiny of the nominations;
(c) the 18th May, 2017 (Thursday), as the last date for the withdrawal of candidatures;
(d) the 25th May, 2017 (Thursday), as the date on which a poll shall, if necessary, be taken; and
(e) the 27th May, 2017 (Saturday), as the date before which the election shall be completed;
and
(C) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken on
the date specified above for the election.

New Delhi, the 8th May, 2017
O.N. 29(E).—In pursuance of section 21, and in exercise of the powers conferred by sub-section (1) of
section 22, of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation
with the Government of the State of Odisha, hereby—
(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer; and
(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to
assist the Returning Officer in the performance of his functions; in respect of the bye-election to the
Council of States, to be held in that State in pursuance of the Commission’s Notification, published in the
Gazette of India on 8th May, 2017.
