ऄनुदान अयोग (यूजीसी) को जिश्वजिद्यालयों में ईच्चतर जिक्षा के मानकों का जनधाारण करन े तथा समन्िय स्ट्थाजपत करने के जलए ऄजधदेजित दकया गया है; जबदक महाजिद्यालय की स्ट्िायत्तता व्यापक गणु ित्तापूणा जिक्षा र ईकृकृटताता के संिधना में महकृिपूणा भूजमका जनभाती ह;ै जबदक अयोग न,े जिश्वजिद्यालय ऄनुदान अयोग ऄजधजनयम, 1956 की धारा 26 द्वारा प्रदत्त िजियों का ईपयोग करते हुएजिश्वजिद्यालय ऄनुदान अयोग (महाजिद्यालयों को स्ट्िायत्तता का दजा ा प्रदान करने तथा स्ट्िायत्त महाजिद्यालयों में मानकों के रखरखाि संबंधीईपाय) जिजनयम, 2018 को ऄजधसूजचत दकया ह;ै र जबदक देि म ेंईच्चतर जिक्षा की गुणित्ता संबंजधत करन ेके जलए महाजिद्यालयों की स्ट्िायत्तता को बढािा देने की अिश्यकता ह।ै आसजलए, ऄब, जिश्वजिद्यालय ऄनुदान अयोग (महाजिद्यालयों को स्ट्िायत्तता का दजाा प्रदान करन े तथास्ट्िायत्त महाजिद्यालयों में मानकों के रखरखाि संबंधी ईपाय) जिजनयम, 2018 का जनितान करते हुए र जिश्वजिद्यालय ऄनुदान 2238 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अयोग ऄजधजनयम, 1956 की धारा 12 के खंड (ञ) के साथ पठठत धारा 26की ईप-धारा (1) के खडं (च) र (छ) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए जिश्वजिद्यालय ऄनुदान अयोग एतदद्वाराजनम्नजलजखत जिजनयम बनाता ह:ै - 1. संजक्षप्त िीर्का , ऄनप्रु योग र प्रितना : - 1.1 आन जिजनयमों को जिश्वजिद्यालय ऄनुदान अयोग (महाजिद्यालयों को स्ट्िायत्तता का दजाा प्रदान करन े र स्ट्िायत्त महाजिद्यालयों में मानकोंके रखरखाि संबंधी ईपाय) जिजनयम, 2023 कहा जाएगा। 1.2 ये जिजनयम ईन सभी महाजिद्यालयों /संस्ट्थानों पर लागू होंगे जो देि के जिश्वजिद्यालयो से संबद्ध ह ै ऄथिा ईनके संघटक महाजिद्यालय ह,ैतथा जो स्ट्िायत्त महाजिद्यालय का दजाा प्राप्त करना चाहतहे ।ैं 1.3 ये जिजनयम अजधकाठरक राजपत्र में ऄजधसूचना प्रकाजितकी जतजथ से प्रभािी होंगे। 2. पठरभार्ाएं: - आन जिजनयमों म,ें जब तक दक संदभा में ऄन्यथा ऄपेजक्षत न हो:— 2.1 "िैक्षजणक पठरर्द" स ेऄजभप्राय स्ट्िायत्त महाजिद्यालय की िैक्षजणक पठरर्द से ह।ै 2.2 "ऄजधजनयम" से ऄजभप्राय जिश्वजिद्यालय ऄनुदान अयोग ऄजधजनयम, 1956 से ह।ै 2.3 "ऄध्ययन मंडल (बोड ाऑफ स्ट्टडीज)से ऄजभप्राय स्ट्िायत्त महाजिद्यालयजिभाग के ऄध्ययन मडं ल से ह।ै 2.4 'महाजिद्यालय' से ऄजभप्राय दकसी ऐसे संस्ट्थान से ह ै जजसे आसी ऄथिा दकसी ऄन्य नाम स े जाना जाए, र जो दकसी जिश्वजिद्यालय से योयतयता प्राप्त करने के जलए दकसी जिश्वजिद्यालय के जनयमों तथा जिजनयमों के ऄनुरूप स्नातक तथा/ऄथिा स्नातकोत्तर तथा/ऄथिा पीएच.डी.प्रोग्राम चलाता ह ै तथा जजसे ऐस े प्रोग्राम/पाठ्यक्रम की जिक्षा प्रदान करने तथा ऄध्ययनरत मौजूदा जिद्यर्थथयों को ऐसी योयतयता प्रदान करन े के जलए ऐसे पाठ्यक्रमों मे जिक्षा प्राप्त करने के जलए सक्षम माना गया ह।ै 2.5 "अयोग" स ेऄजभप्राय जिश्वजिद्यालय ऄनदु ान अयोग (यूजीसी) से ह।ै 2.6 "जित्त सजमजत" से ऄजभप्राय स्ट्िायत्त महाजिद्यालय की जित्त सजमजत से ह।ै 2.7 "िासी जनकाय" से ऄजभप्राय स्ट्िायत्त महाजिद्यालय के िासी जनकाय से है, जो न्यास पठरर्द या प्रबंधन बोड ा ऄथिाकायाकाठरणी सजमजत या प्रबंधन सजमजत से जभन्न ह।ै 2.8 "मूल जनकाय" से ऄजभप्राय सोसाआटी रजजस्ट्रीकरण ऄजधजनयम, 1860 के तहतपंजीकृत सोसाआटी, ऄथिाितामानम ें लागूकेंद्रीय या राज्य ऄजधजनयम के तहत स्ट्थाजपत या जनगजमत एक संस्ट्था कॉपोरेट, ऄथिा कंपनीऄजधजनयम, 2013 की धारा 8 केतहत पंजीकरण रस्ट्ट या कंपनी सरकार ऄथिा स्ट्थानीय प्राजधकरण या कोइ जिश्वजिद्यालय (ईनके द्वारा संचाजलत महाजिद्यालय /संस्ट्थान के जलए) स े ह।ै 2.9 "ऄजधसूचना" से ऄजभप्राय जिश्वजिद्यालय ऄनुदान अयोग द्वारा स्ट्िायत्तताका दजाा प्रदान करने के बाद एक महाजिद्यालय को स्ट्िायत्त संस्ट्थान घोजर्त करन े के जलए संबद्ध जिश्वजिद्यालय द्वारा जारी की गइ ऄजधसूचना से ह।ै 2.10 "मूल जिश्वजिद्यालय" से ऄजभप्राय ईस जिश्वजिद्यालय सेह ै जजससे महाजिद्यालय संबद्ध ह ै या जजसका संबंजधत महाजिद्यालय एक संबद्ध सघं टक ह।ै 2.11 "सांजिजधक जनकाय" से ऄजभप्राय स्ट्िायत्त महाजिद्यालय के सांजिजधक जनकाय से ह।ै 2.12 "सांजिजधक पठरर्द" से ऄजभप्राय ईच्चतर जिक्षा के संबंजधत क्षेत्रों म ें गुणित्ता के मानकों को जनधााठरत करन े ऄथिाऄनरु क्षण के जलए तकृसमय लागू दकसी भी जनयम के तहत गठठत जनकाय, जैसे दक तकनीकी जिक्षा के जलए ऄजखल भारतीय तकनीकी जिक्षा पठरर्द (एअइसीटीइ), राष्ट्रीय जचदककृसा अयोग (एनएमसी), भारतीय दन्त पठरर्द (डीसीअइ), राष्ट्रीय ऄध्यापक जिक्षा पठरर्द (एनसीटीइ), भारतीय जिजध पठरर्द (बीसीअइ), भारतीय ईपचया ा (नर्ससग) पठरर्द (अइएनसी), या संसद के ऄजधजनयम के तहत स्ट्थाजपत दकसी ऄन्य जनकाय से ह।ै 2.13 स्ट्थायी सजमजत से ऄजभप्राय3 या ऄजधक सदस्ट्यों िाली एक सजमजत से ह।ै 2.14 अइक्यूएसी से ऄजभप्राय अयोग द्वारा बनाए गए य.ूजी.सी के जिजनयमों र अयोग द्वारा अइक्यूएसी पर जारी ददिाजनदेिोंके ऄनुसार स्ट्िायत्त महाजिद्यालय द्वारा स्ट्थाजपत अंतठरक गुणित्ता अश्वासन प्रकोष्ठस े ह।ै आन ददिाजनदेिों को समय-समय पर संिोजधत दकया जा सकता ह ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 3. स्ट्िायत्त महाजिद्यालय की भूजमका, जनबधं न र ित:ें - सामान्य रूप स े स्ट्िायत्त महाजिद्यालय की भूजमका, जनबंधनएि ं िते र जिजनयमों के प्रािधानों के ऄधीन जनम्नजलजखत होंगी: 3.1 ितामान पाठ्यक्रमों/कायाक्रमों की समीक्षा करना, तथा ऄपने स्ट्ियं के पाठ्यक्रम /ऄध्ययन प्रोग्राम र पाठ्यचयाा की पुनंसरचना,पुनराचना करना तथा जिजहत करना। 3.2 समय-समय पर यथा संिोजधत जडजग्रयों के जिजनदेिन, 2014 के ऄनुसार जिश्वजिद्यालय ऄनुदान अयोगद्वारा जिजनर्ददटता नामों के भीतर नए पाठ्यक्रम/कायाक्रम तैयार करना। 3.3 जिद्यार्थथयों के प्रदिानका मूल्याकं न, परीक्षाओं के संचालन र पठरणामों की ऄजधसूचना की पद्धजतयों को जिकजसत करना। 3.4 पठरणाम घोजर्त करना, ऄंक ताजलका र ऄन्य प्रमाण पत्र जारी करना, हालांदक, मूल जिश्वजिद्यालय द्वारा ईपाजध प्रमाण पत्र पर महाजिद्यालय के नाम के साथ ईपाजध प्रदान की जाएगी। 3.5 स्ट्िायत्त महाजिद्यालयों को मूल जिश्वजिद्यालय को संबद्धता िुल्क का भुगतान करने की अिश्यकता नहीं ह।ै 3.6 अरक्षण के संबंध मेंराज्य सरकार/राष्ट्रीय नीजत के ऄनुरूप प्रिेि के जलए जनयम जनधााठरत करना। 3.7 स्ट्िायत्त महाजिद्यालयऄपने स्ट्ियं के स्ट्तर पर राज्य सरकार/सांजिजधक पठरर्द ् (पठरर्दों) के जनयमोंजैसा दक लागू हो के ऄनुसार ऄपने स्ट्तर पर िल्ु क जनधााठरत कर सकते हैं। 3.8 ऄपनेस्ट्िय ंके िासी जनकाय, ऄकादजमक पठरर्द, जित्त सजमजत र ऄध्ययनमंडल का गठन करना। 3.9 सभी स्ट्िायत्त महाजिद्यालयों म ें िैजक्षक संकाय र प्राचाया की जनयुजि समय-समय पर यथासंिोजधतजिश्वजिद्यालय ऄनुदान अयोग (जिश्वजिद्यालयों र महाजिद्यालयों में जिक्षकों र ऄन्य िैक्षजणक कमाचाठरयों की जनयुजि के जलए न्यूनतम योयतयता र ईच्च जिक्षा में मानकों के रखरखाि के जलए ऄन्य ईपाय) जिजनयम, 2018 जो समय-समय पर संिोजधत हो या आस संबंध में जिश्वजिद्यालय ऄनुदान अयोग द्वारा समय-समय पर ऄजधसूजचत दकन्हीं ऄन्य जिजनयमोंके ऄनुसार की जाएगी। 3.10 महाजिद्यालय को प्रदत्तस्ट्िायत्तता संस्ट्थागत स्ट्तर पर ह ै तथायह अंजिकस्ट्तर पर प्रदत्त नहीं ह ै र आसममे हाजिद्यालय द्वारा प्रदत्तसभी स्ट्तर के कायाक्रम जैसे स्नातक एिं स्नातकोत्तर िाजमलिाजमलहोग ें । स्ट्िायत्तता का दजाा जमलने के बाद महाजिद्यालय द्वारा िुरू दकए गए पाठ्यक्रम स्ट्ित: ही स्ट्िायत्तता के दायरे म ेंअ जाएंगे। 3.11 पीएच.डी. कायाक्रमपूणातः आस संबंध में समय-समय पर ऄजधसूजचत जिश्वजिद्यालय ऄनुदान अयोग के जिजनयमों के ऄनुरूप से पेि दकए जाएगं े। 3.12 प्रारंभ म ेंस्ट्िायत्तता का दजाा आन जिजनयमों के खंड 7 के ऄनुसार पांच या दस िर्ों की ऄिजध के जलए ददया जाएगा। 3.13 आन जनयमों के खंड8 के ऄनुसार अगे पांच या दस िर् ा की ऄिजध के जलए स्ट्िायत्तता के दजे को जिस्ट्तार ददया जाएगा। 4. मलू जिश्वजिद्यालय की भजू मका:- सामान्य रूप स े मलू जिश्वजिद्यालय की भूजमका आन जिजनयमों के प्रािधानों के ऄधीन जनम्नानुसार होगी: 4.1 जिश्वजिद्यालय ऄनुदान अयोग केपोटाल पर स्ट्िायत्तता के जलए महाजिद्यालयके अिेदन की जांच करना र जिश्वजिद्यालय ऄनुदान अयोग के पोटाल पर 30 काया ददिसों के भीतर कारण/ जचकृय सजहत ऄपनी जसफाठरिें देना। यदद मलू जिश्वजिद्यालय य.ू जी.सी के पोटाल पर 30 ददनों की समय सीमा के ऄन्दर कोइ जिाब देन े म ें जिफल रहता ह ै तो यह समझा जाएगा दक जिश्वजिद्यालय को यू.जी.सी द्वारा स्ट्िायत्तता का दजाा प्रदान करने हते ु अिेदन पर कायािाही करने म ेंकोइ अपजत्त नही ह।ै 4.2 जिश्वजिद्यालय ऄनुदान अयोग द्वारा महाजिद्यालय को स्ट्िायत्त दजाा प्रदान करन े के बाद एक स्ट्िायत्त आकाइ के रूप म ें काया करने के जलए 30 ददनों के भीतर ऄजधसूचना जारी करना। 4.3 स्ट्िायत्तता प्राजप्त के बाद महाजिद्यालय स्ट्िायत्तता संबंधी जििेर् सुजिधाओ का ईपभोग करते हुए भी जिश्वजिद्यालय से संबंधता रखेगें। 4.4 स्ट्िायत्त महाजिद्यालय के जिजभन्न सांजिजधक जनकायों में नामांकन करना। 4.5 आन जनयमों के कायाान्ियन को सुजिधाजनक बनाना।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 5. राज्य सरकार की भजू मका 5.1 स्ट्िायत्त महाजिद्यालय के जिजभन्न सांजिजधक जनकायों मने ामाकं न करना। 5.2 स्ट्िायत्त महाजिद्यालय राज्य सरकार स े जनजध प्राप्त करन े के जलए पात्र बन े रहगें े जैसा दक स्ट्िायत्तता प्राजप्त के पूि ा म े ऄनुदान, यदद कोइ हो, प्राप्त करते रह ेह।ै 5.3 जनयजमत र सतत अधार पर सभी स्ट्िीकृत संकाय पदों को भरने के प्रयास करना। 6. पात्रता 6.1 दकसी भी जिधा जििेर् के संबद्ध या घटक महाजिद्यालय, चाह े सरकारी, सहायता प्राप्त, अंजिक रूप से सहायता प्राप्त, या गैर-सहायता प्राप्त/स्ट्ि-जित्तपोजर्त, पात्र ह,ैं बिते िे जिश्वजिद्यालय ऄनुदान अयोग ऄजधजनयम की धारा 2 (च) के ऄंतगता अते हों। 6.2 महाजिद्यालय कम से कम 10 िर्ा से ऄजस्ट्तकृि में रहा हो। 6.3 महाजिद्यालय एन.ए.ए.सी द्वारा प्रकृयाजयत हो ऄथिा एन.बी.ए द्वारा कम से कम तीन कायाक्रम (कायाक्रमों) के जलएऄथिा जिश्वजिद्यालय ऄनदु ान अयोग द्वारा सूचीबद्धप्रकृयायन एजेंसी से प्रकृयाजयत /प्राप्तांक प्राप्त हो।तथाजप, यदद महाजिद्यालयसंचाजलतकायाक्रमों की संख्या तीन से कम हो, तो प्रकृयेक पात्र कायाक्रम को एन.बी.ए मानदंडों के ऄनुसार प्रकृयाजयत होनाचाजहए। अिेदन के समय प्रकृयायन की जस्ट्थजत कम स े कम एक िर्ा के जलए िैध होना चाजहए। संघटक महाजिद्यालयों को भी स्ट्ितंत्र रूप से ऄलग से प्रकृयायन प्राप्त करना होगा। 6.4 अयोग आन जिजनयमों के खंड 6.2 र 6.3 से महाजिद्यालय को छूट दे सकता ह,ै बिते िह जनम्नजलजखत फोकस क्षेत्रों में कायाक्रम संचाजलत करना होः • ऄजद्वतीय ऄध्ययन के जिर्य,ईदाहरण के जलए, जििेर् जिक्षा, भारतीय ज्ञान प्रणाली, योग, रक्षा ऄध्ययन • देि की रणनीजतक जरूरतों को पूरा करने िाले कायाक्रम • भारतीय सांस्ट्कृजतक जिरासत के संरक्षण में सलं ग्नता • पयाािरण संरक्षण • कौिल जिकास, खेल, भार्ाओं के जलए समर्थपत • अयोग द्वारा आस प्रकार जनधाठा रत दकसी भी ऄन्य ऄध्ययन के जिर्य /क्षेत्र (क्षेत्रों)। 7. स्ट्िायत्तता का दजा ाप्रदान करना 7.1 आन जनयमों के खडं 6 के ऄनुसार ऄहता ा को परू ा करन े िाला स्ट्िायत्तता प्राजप्त के आच्छुक कोइ भी महाजिद्यालय,िर्ा के दौरान दकसी भी समय जिश्वजिद्यालय ऄनदु ान अयोग केपोटाल परअिेदनकर सकता ह।ै हालांदक, स्ट्िायत्तता प्राजप्त/स्ट्िायत्तता जिस्ट्तार के जलए प्रस्ट्तािों के ईन मामल े म,ें जो आन जिजनयमोंकी ऄजधसूचना से पहल े ही प्राप्त दकए जा चुके ह ैं र जिश्वजिद्यालय ऄनुदान अयोग में जिचाराधीन ह.ैकोइ नया अिेदन दने े की अिश्यकता नहीं होगी, र जिश्वजिद्यालय ऄनुदान अयोग आन जिजनयमों के ऄनुसार ऐसे सभी लंजबत प्रस्ट्तािों पर जिचार करेगा, बितें आन जिजनयमो की ऄजधसूचना के समय छह महीनों के जलए प्रकृयायन िैध ह ै ऄथिा प्रकृयायन की िैधता ऄगर छह महीनो से कम हो तो पुनाप्रकृयायन के जलए अिेदन दकया जा चुका हो। 7.2. मूल जिश्वजिद्यालय जिश्वजिद्यालय ऄनदु ान अयोग के पोटला पर स्ट्िायत्तता के दज े के जलए महाजिद्यालय के अिेदन की जााँच करेगा र जिश्वजिद्यालय ऄनुदान अयोग के पोटाल पर अिेदन जमा करन े की जतजथ स े 30 काया ददिसों के भीतर कारणों/ जचकृय के साथ ऄपनी जसफाठरिें देगा। यदद मूल जिश्वजिद्यालय 30 काया ददिसों के भीतर जिश्वजिद्यालय ऄनुदान अयोग के पोटला पर जिाब नहीं दते ा है, तो यह मान जलया जाएगा दक मूल जिश्वजिद्यालय को जिश्वजिद्यालय ऄनुदान अयोग द्वारा स्ट्िायत्तता का दजाा प्रदान करने के जलए अिेदन की कायािाही पर कोइ अपजत्त नहीं ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 7.3 जिश्वजिद्यालय ऄनुदान अयोग की एक स्ट्थायी सजमजत स्ट्िायत्तता का दजाा प्रदान करन े के जलए महाजिद्यालय के अिेदन की जांच करेगी। स्ट्थायी सजमजत की जसफाठरिों पर अयोग द्वारा जिचार दकया जाएगा र आसका जनणाय मूल जिश्वजिद्यालय र महाजिद्यालय को सूजचत दकया जाएगा। 7.4 महाजिद्यालय को एन.ए.ए.सी द्वारा मान्यता प्राप्त होने की जस्ट्थजत में या एन.बी.ए द्वारा कम से कम तीन कायाक्रमों के जलएप्रकृयायन की जस्ट्थजत म;ें या जिश्वजिद्यालय ऄनुदान अयोग द्वारा सूचीबद्ध एजेंसी से प्रकृयाजयत/प्राप्तांक प्राप्त होने की जस्ट्थजत मे िैक्षजणक सत्र प्रारंभ होने से िुरू में पांच िर्ा की ऄिजध के जलए स्ट्िायत्तता दजाा ददया जाएगा;हालांदक, यदद महाजिद्यालय द्वारा संचाजलतकायाक्रमों की संख्या ऄगर तीन से कम ह,ै तो प्रकृयेक पात्र कायाक्रम को एनबीए मानदडं ों के ऄनुसार प्रकृयाजयत होना चाजहए। अिेदन जमा करन े के समय प्रकृयायन का दजा ा कम से कम एक िर् ा के जलए िधै होना चाजहए। 7.5 यदद महाजिद्यालय को न्यूनतम 'ए ' ग्रडे (एन.ए.ए.सी के 4 बबद ुस्ट्केल पर 3.01 र ईससे ऄजधक के स्ट्कोर के साथ) के साथ एन.ए.ए.सी द्वारा प्रकृयाजयत ह,ै ऄथिा कम से कम तीन कायाक्रमों के जलए एन.बी.ए द्वारा 675 के न्यूनतम व्यजिगतस्ट्कोर के साथ, ऄथिा जिश्वजिद्यालय ऄनुदान अयोग द्वारा सूचीबद्ध प्रकृयायन एजेंसी से समानुरूप प्रकृयायन ग्रेड/स्ट्कोर के साथ प्रकृयाजयत हो तो ईस े प्रारंभ म ें िक्षै जणक सत्र की िरूु अत से दस िर्ो के जलए स्ट्िायतता का दजाा ददया जाएगा।हालांदक, यदद महाजिद्यालय द्वारा चलाए जा रह े प्रोग्राम की संख्याऄगर तीन स े कम ह,ै तो एन.बी.ए मानदडं ों के ऄनुसार प्रकृयेक पात्र कायाक्रम को 675 या ऄजधक ऄंक प्राप्त होन े चाजहए। अिेदन जमा करन े के समय प्रकृयायन का दजााकम से कम एक िर् ा के जलए िैध होना चाजहए।; 7.6 यदद जिश्वजिद्यालय ऄनुदान अयोग द्वारा स्ट्िायत्तताका दजाा प्रदान करन े के जलए महाजिद्यालय के अिेदन कोदकसी भी कारण से ऄस्ट्िीकृत कर ददया जाता ह,ै तो महाजिद्यालय जिश्वजिद्यालय ऄनुदान अयोग के पोटाल पर दफर स े अिेदन करने के जलए पात्र होगा, लेदकन यहईसके पहले के अिेदन की ऄस्ट्िीकृजत की जतजथ स े एक िर् ा की ऄिजध से पहल े नहींदकया जा सकेगा। 7.7 एक स्ट्िायत्त महाजिद्यालय, मूल जिश्वजिद्यालय/जिश्वजिद्यालयों के पूिा ऄनुमोदन से ईसी मलू जनकाय द्वारा चलाए जा रह ेऄन्य स्ट्िायत्त महाजिद्यालयो/संस्ट्थानों के साथ जिलय कर सकता ह।ै 8. स्ट्िायत्तता के दज ेका जिस्ट्तार 8.1 यदद दकसी स्ट्िायत्त महाजिद्यालय कोईसके स्ट्िायत्तता का दजाा पूरा होने के ऄंजतम ददन एन.ए.ए.सी द्वारा ऄथिा एन.बी.ए द्वारा कम से कम तीन कायाक्रमों के जलए प्रकृयायन प्राप्त ह ै ऄथिा िह जिश्वजिद्यालय ऄनुदान अयोग -द्वारा सूचीबद्ध प्रकृयायनएजेंसी सेप्रकृयाजयत ह;ै (यदद महाजिद्यालय द्वारा संचाजलत होन े िाल े कायाक्रमों की संख्या तीन स े कम ह,ै तो प्रकृयेक पात्र कायाक्रम को एन.बी.ए जनयमों के ऄनुसार प्रकृयाजयत होनाचाजहए), तो महाजिद्यालय ऄगल े पांच िर्ों के जलए स्ट्िायत्तताके दजाा के जिस्ट्तार की प्राजप्त के जलए पात्र होगा, बिते महाजिद्यालय ने नीचे के खंड 8.3 में जनधााठरत प्रदक्रया का ऄनपु ालन दकया हो। महाजिद्यालय स्ट्िायत्तता ऄिजध के पूरा होने से कम से कम तीन महीने पहले जिश्वजिद्यालय ऄनुदान अयोग पोटाल पर स्ट्िायत्ता के दज े के जिस्ट्तार के जलए अिेदन करेगा। स्ट्िायत्त महाजिद्यालय स्ट्िायत्ता के दजे के जिस्ट्तार के जलए ऄपन े अिेदन के बारे म ें मलू जिश्वजिद्यालय को भी सूजचत करेगा। जिश्वजिद्यालय ऄनुदान अयोग की स्ट्थायी सजमजत स्ट्िायत्त के दजे के जिस्ट्तार के जलए स्ट्िायत्त महाजिद्यालय के अिेदन की जांच करेगी। स्ट्थायी सजमजत की जसफाठरिों पर अयोग द्वारा जिचार दकया जाएगा र आसका जनणाय मूल जिश्वजिद्यालय र स्ट्िायत्त महाजिद्यालय को सूजचत दकया जाएगा। 8.2 यदद एक स्ट्िायत्त महाजिद्यालय ईसके स्ट्ियत्तता की ऄिजध परू ी होने के ऄंजतम ददन एन.ए.ए.सी के 4-पॉआंट स्ट्केल पर 3.01 र ईससे ऄजधक के स्ट्कोर के साथ न्यूनतम 'ए ' ग्रेड िाला के साथ प्रकृयाजयत ह ै या एन.बी.ए द्वारा कम स े कम तीन प्रोग्राम (प्रोग्रामों) के जलए ऄलग-ऄलग 675 के न्यनू तम स्ट्कोर के साथ या जिश्वजिद्यालय ऄनुदान अयोग द्वारा सूचीबद्ध प्रकृयायन एजेंसी से समनुरूप प्रकृयायन /स्ट्कोर के साथ प्रकृयाजयत ह ै (यदद महाजिद्यालय द्वारा चलाए जा रह े कायाक्रमों की संख्या तीन से कम ह,ै तो एन.बी.ए मानदडं ों के ऄनुसारपात्रकायाक्रम में से प्रकृयेक को 675 या ऄजधक ऄंक प्राप्त हाने चाजहए)तो महाजिद्यालय ऄगले दस िर्ों के जलए स्ट्िायत्तता के दजे के जिस्ट्तार के जलए पात्र होगा, बिते महाजिद्यालय ने नीचे खंड 8.3 में जनधााठरत प्रदक्रया का ऄनपु ालन दकया हो।महाजिद्यालय स्ट्िायत्तता ऄिजध के पूरा होने से कम से कम तीन महीने पहले जिश्वजिद्यालय ऄनुदान अयोग के पोटाल पर स्ट्िायत्तताके दजे के जिस्ट्तार के जलए अिेदन करेगा। स्ट्िायत्त महाजिद्यालय स्ट्िायत्तता के दज े के जिस्ट्तार के जलए ऄपन ेअिेदन के बारे म ें मूल जिश्वजिद्यालय को भी सूजचत करेगा। जिश्वजिद्यालय ऄनदु ान अयोग की स्ट्थायी सजमजत स्ट्िायत्तता के दजे के6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जिस्ट्तार के जलए स्ट्िायत्त महाजिद्यालय के अिेदन की जांच करेगी। स्ट्थायी सजमजत की जसफाठरिों पर अयोग द्वारा जिचार दकया जाएगा र आसका जनणाय मलू जिश्वजिद्यालय र स्ट्िायत्त महाजिद्यालय को सूजचत दकया जाएगा। 8.3 स्ट्िायत्त महाजिद्यालयों को राष्ट्रीय मूल्यांकन र प्रकृयायन पठरर्द/एनबीए/जिश्वजिद्यालय ऄनुदान अयोग की सूचीबद्ध प्रकृयायनएजेंसी द्वारा जारी दकए गए प्रकृयायन प्रमाणपत्र में ईजल्लजखत प्रकृयायन ऄिजध के चरण की समाजप्त से छह महीन े पहले पनु : प्रकृयायन के जलए अिेदन करना अिश्यक ह।ै ईनस्ट्िायत्त महाजिद्यालयों के जलए जजन्होंन े प्रकृयायन ऄिजध के चरणकी समाजप्तसे छह महीने पहले पुनमल्ूा यांकन के जलए अिेदन दकया है रऄगर मान्यता देन े िाली संस्ट्था द्वारा मान्यता प्रदक्रया में जिलंब होता ह,ै तो लगातार आन दोनो प्रकृयायनोके मध्य ऄंतरालकी ऄिजध माफ कर दी जाएगी। जजन स्ट्िायत्त महाजिद्यालयों ने प्रकृयायन ऄिजध समाप्त होन े से छह महीने पहल े पुन: प्रकृयायन के जलए अिेदन नहीं दकया ह,ै ईन्ह ें ऄंजतम प्रकृयायन चक्र की समाजप्तसे एक िर् ा के भीतर प्रकृयायनऄिश्य प्राप्त करना चाजहए, ऄन्यथास्ट्िायत्तता स्ट्ितः ही समाप्त हो जाएगी। 8.4 यदद स्ट्िायत्त महाजिद्यालय ईपरोि खंड 8.1, 8.2 र 8.3 के ऄनुसार अिश्यक प्रकृयायन ग्रडे /स्ट्कोर प्राप्त करने म ें जिफल रहता ह,ै तो ऐस े महाजिद्यालय की स्ट्िायत्तता स्ट्ितः िापस ल े ली जाती है, र स्ट्िायत्तता की िापसी के बादमहाजिद्यालय द्वारा स्ट्िायत्तता माध्यम के तहत कोइ नया नामांकन नहीं दकया जाएगा। आस संबंध में मलू जिश्वजिद्यालय र/या जिश्वजिद्यालय ऄनुदान अयोग से दकसी भी पत्राचार की अिश्यकता नहीं होगी। स्ट्िायत्तता िापस लेने के संबंध में मूल जिश्वजिद्यालय र जिश्वजिद्यालय ऄनुदान अयोग को सूजचत करने की जजम्मेदारी महाजिद्यालय की होगी। हालांदक, स्ट्िायत्तता के दजेकी समाजप्त केिल स्ट्िायत्तता के समय म ें भती दकए गएजिद्यार्थथयों के ऄंजतम बैच के ईत्तीणाहोने के बाद ही प्रभािी होगी। 8.5 ऐसे महाजिद्यालय, जजनकी स्ट्िायत्तता िापस ले ली जाती है, जिश्वजिद्यालय ऄनुदान अयोग के पोटाल पर नइ स्ट्िायत्तता के जलए अिेदन करने के पात्र होंगे, लेदकन यह अिदे न स्ट्िायत्तता िापस लेने की प्रभािी जतजथ से एक िर्ा पहले नहींदकया जा सकेगा। 9.स्ट्िायत्त महाजिद्यालयों की जनगरानी 9.1 महाजिद्यालय की जनयजमत जनगरानी के जलए स्ट्िायत्त महाजिद्यालय में अइ.क्यू.ए.सी की स्ट्थापना की जाएगी। अइक्यूएसी के साथ एक बाहरी सहकमी टीम होगी जजसके सदस्ट्य कम से कम प्रोफेसर पद के 2या ऄजधक सदस्ट्य होंगे जो प्रजतजष्ठत जिक्षाजिद होंगे। स्ट्िायत्त महाजिद्यालय के प्रदिान के संबंध म ें ठरपोट ा महाजिद्यालय की िेबसाआट पर सािाजजनक डोमेन पर भी डाली जाएगी। बाहरी सहकमी समीक्षा िर्ा में कम से कम एक बार अयोजजत की जाएगी। 9.2 स्ट्ियं के द्वारा ऄथिा अइ.क्य.ू ए.सी की बाहरी सहकमी टीम द्वारा प्रजतकूल ठरपोटा के मामले में ऄथिा स्ट्िायत महाजिद्यालय के जिरूद्ध कोइ सूचना/जिकायत प्राप्त होने पर, जिश्वजिद्यालय ऄनुदान अयोग जांच के जलए एक जििेर्ज्ञ सजमजत का गठन करके जनरीक्षण कर सकता ह ै र प्रबंधन को सुनिाइ का ईजचत ऄिसर प्रदान करके ऄजधसूचना के माध्यम से र स्ट्पीककग ऑडार पाठरत करके महाजिद्यालय के स्ट्िायत के दजे को रद्द कर सकता ह।ै 9.3 स्ट्ििासी महाजिद्यालय जबना चूके ऄपने द्वारा संचाजलत पाठ्यक्रमों की जानकारी, पाठ्यक्रमों केिुल्क, योयतयता सजहत संकाय सदस्ट्यो का जििरण र ईनके यूजनक अइडी, प्रिेि प्रदक्रया, प्रासंजगक बुजनयादी ढांचे का जििरण, स्ट्िायत्त महाजिद्यालय की ऄनसु ंधान गजतजिजधयों के साथ सजििरण पी एच डी म ें नामांदकत जिद्याथी, यदद कोइ हो, तो ईनके नामांकन की जतजथ, िोधजिर्य र पयािेक्षक के नाम साथ ऄपनी िेबसाआट पर ऄपलोड करेगा। 9.4 स्ट्िायत्त महाजिद्यालय ऄपनी िेबसाआट जिश्वजिद्यालय ऄनुदान अयोग द्वारा समय-समय पर ऄजधसूजचत जिजभन्न जिजनयमों में ऄजनिाया रूप से जिजभन्न सजमजतयों/प्रकोष्ठों के सृजन की जानकारी दगे ा। स्ट्िायत्त महाजिद्यालय जनयजमत रूप स े संजिजधक जनकायों की बैठकें अयोजजत करेगा र बैठकों की कायािाहीको महाजिद्यालय की िेबसाआट पर ऄपलोड करेगा। 9.5 स्ट्िायत्त महाजिद्यालय ऐसे िेब पोटालों पर भी ऐसी जानकारी ऄपलोड करेगा जो अयोग द्वारा समय-समय पर जिजनर्ददटता दकए जा सकते ह।ैं 10. नए पाठ्यक्रम िरूु करन ेस ेसबं जं धत मामल े 10.1 एक स्ट्िायत्त महाजिद्यालय, मलू जिश्वजिद्यालय के पूिा ऄनुमोदन के जबना प्रमाणपत्र या जडप्लोमा पाठ्यक्रम िुरू करने के जलए स्ट्ितंत्र होगा। स्ट्िायत्त महाजिद्यालय को आस प्रकार नए पाठ्यक्रम िरूु करने के बारे म ें मूल[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 जिश्वजिद्यालय को सूजचत करना होगा। जहां कहीं भी अिश्यक हो, स्ट्िायत्त महाजिद्यालय र िैधाजनक पठरर्द ् (पठरर्दों) के संबंजधत िैधाजनक जनकायों की स्ट्िीकृजत प्राप्त की जानी चाजहए। प्रमाणपत्र र जडप्लोमा स्ट्िायत्त महाजिद्यालय की मुहर से जारी दकए जाएंगे। 10.2 स्ट्िायत्त महाजिद्यालय,जहां भी अिश्यक हो, स्ट्िायत्त महाजिद्यालय की ऄकादजमक पठरर्द र संबंजधत सांजिजधक पठरर्द ् (पठरर्दों) के ऄनुमोदन से स्नातक र स्नातकोत्तर स्ट्तर पर एक नया जडग्री कायाक्रम िुरू करन े के जलए स्ट्ितंत्र होगा, बिते जडग्री का नाम जिश्वजिद्यालय ऄनदु ान अयोग द्वारा समय-समय पर यथा संिोजधत ईपाजधयो की जिजिटताीकरण के संबंध म ें ऄजधसूचना, 2014के ऄनुरूप होगें। आस प्रकार के पाठ्यक्रम घंटों की संख्या, पाठ्यक्रम की जिर्य िस्ट्तु र मानकों के संदभा में मलू जिश्वजिद्यालय/जिश्वजिद्यालय ऄनुदान अयोग/सांजिजधक पठरर्द द्वारा जनधााठरत न्यूनतम मानकों को पूरा करेंगे, र मलू जिश्वजिद्यालय को आन पाठ्यक्रमों के बारे म ें जिजधित रूप स े सूजचत दकया जाएगा। 10.3 स्ट्िायत्त महाजिद्यालय पीएच.डी. जडग्री मूल जिश्वजिद्यालय की पूि ा स्ट्िीकृजत से िरूु कर सकता ह।ै पीएच.डी. जडग्री कायाक्रम के जलए समय-समय पर ऄजधसूजचत जिश्वजिद्यालय ऄनुदान अयोग केजिजनयमो का मूल जिश्वजिद्यालय/ स्ट्िायत्त महाजिद्यालय द्वारा ऄनुपालन दकया जाना चाजहए। 10.4 स्ट्िायत्त महाजिद्यालय ऄपनी ऄकादजमक पठरर्द के ऄनुमोदन स े ऄपने मौजूदा पाठ्यक्रम को पुनसंरजचत/पुनरा जचत कर समय-समय पर यथासंिोजधत ईपाजधयों के जिजिटताीकरण के संबंध म ें जिश्वजिद्यालय ऄनुदान अयोग ऄजधसूचना, 2014 के ऄनुसार पुनः नामकरण भी कर सकते ह।ै आस प्रकार की कायािाही के संबंध में मूल जिश्वजिद्यालय को जिजधित रूप से सूजचत दकया जाएगा। हालांदक, पाठ्यक्रम(पाठ्यक्रमों) का यह नामकरण जपछल े बैचों पर लाग ूनहीं होगा। 11. परीक्षा प्रकोष्ठ 11.1 स्ट्िायत्त महाजिद्यालय में एक परीक्षा प्रकोष्ठहोगा र िह जिद्याथी मूल्यांकन र परीक्षाओं के सभी ऄजभलेखों का रख-रखाि करेगा। 12. स्ट्िायत्त महाजिद्यालय की िासन प्रणाली 12.1 िैक्षजणक, जित्तीय र सामान्य प्रिासजनक मामलों के ईजचत प्रबंधन को सुजनजित करने के जलए स्ट्िायत्त महाजिद्यालय में जनम्नजलजखत सजं िजधक जनकाय होंगे: (क) िासी जनकाय (ख) ऄकादजमक पठरर्द (ग) ऄध्ययन मंडल (घ) जित्तसजमजत (िासी जनकाय,न्यासी मंडल/प्रबंधन मंडल/कायाकारी सजमजत/प्रबंधन सजमजत से ऄलग होता ह।ै ) 12.2 आसके ऄजतठरि,स्ट्िायत्त महाजिद्यालय में गरै संजिजधक सजमजतयो जैसे, योजना तथा मूल्यांकन सजमजत, जिकायत जनिारण सजमजत, परीक्षा सजमजत, प्रिेि सजमजत, पुस्ट्तकालय सजमजत, जिद्याथी कल्याण सजमजत, अंतठरक जिकायत सजमजत, पाठ्येतर दक्रयाकलापोसे संबंजधतसजमजततथा, ऄकादजमकलेखापरीक्षा सजमजत, आकृयादद होंगी। 12.3 िासी जनकाय: क. न्यास /सजमजत द्वारा संचाजलत महाजिद्यालयों के िासी जनकाय की संरचना संख्या श्रेणी स्ट्िरूप 5 सदस्ट्य ईनमें प्रबंधन मूल जनकाय द्वारा ऄपने संजिधान या ईपजनयमों के ऄनुसार मनोनीत सेएकऄध्यक्ष होगा 2 सदस्ट्य महाजिद्यालय के जिक्षक प्राचाया द्वारा क्रमािती रूपसेिठरष्ठता के अधार पर नामजनर्ददटता 1 सदस्ट्य महाजिद्यालय का प्रिासजनक प्रिासजनक राज्य सरकार द्वारा नामजनर्ददटता 1 सदस्ट्य जिश्वजिद्यालय में कायारत प्रोफेसर जिश्वजिद्यालय द्वारा नामजनर्ददटता 1 सदस्ट्य महाजिद्यालय के प्राचाया सदस्ट्य सजचि ग. जिश्वजिद्यालय द्वारा संचाजलत संघटक महाजिद्यालयों के िासी जनकाय की संरचना संख्या श्रेणी स्ट्िरूप 3 सदस्ट्य जिक्षाजिद,् ईद्योगपजत, पेिेिर जिश्वजिद्यालय द्वारा नाजमत, कम से कम स्नातकोत्तर स्ट्तर की जजसमे एक योयतयता रखन े िाले जसद्ध िैक्षजणक ऄजभरूजच िाले व्यजि ऄध्यक्ष होगा 2 सदस्ट्य महाजिद्यालय के जिक्षक प्राचाया द्वारा क्रमािती रूप से िठरष्ठता के अधार पर नामजनर्ददटता 1 सदस्ट्य महाजिद्यालय का प्रिासजनक कमाचारी प्रिासजनक ऄजधकारी/िठरष्ठ प्रिासजनक कमाचारी 1 सदस्ट्य राज्य सरकार का नाजमजत राज्य सरकार द्वारा नामजनर्ददटता 1 सदस्ट्य जिश्वजिद्यालय में कायारत प्रोफेसर जिश्वजिद्यालय द्वारा नामजनर्ददटता 1 सदस्ट्य महाजिद्यालय के प्राचाया सदस्ट्य सजचि कायका ाल: िासी जनकाय का हर पांचिर्ा में पुनगाठन दकया जाएगा। बठै कें: िासी जनकाय की बैठकें हर छह महीन े में कम स ेकम एक बार अयोजजत की जाएंगी। कोरम: न्यनू तम 50% सदस्ट्यों की ईपजस्ट्थजत कोरम होगी। िासी जनकाय के काय:ा संबंजधत स्ट्िायत्त महाजिद्यालय के ईपजनयमों में ितामान ईपबंधो के ऄधीन र राज्य सरकार / मलू जिश्वजिद्यालय द्वारा जनधााठरत जनयमों के ऄधीन, िासी जनकायजनम्नित् काया करेगाः- • जजन ईद्देश्यों के जलए महाजिद्यालय को स्ट्िायत्त दजाा ददया गया है, ईन्ह ें पूण ा करने के जलए स्ट्िायत्त महाजिद्यालय कोददिाजनदेि देगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 9 • ऄकादजमक पठरर्द की जसफाठरिों के ऄनुसार संस्ट्थान की छात्रिृजत्त, ऄध्येतािृजत्त, स्ट्टुडेंटजिप, पदक, पुरस्ट्कार र प्रमाण पत्र अरंभ करना। • ऄध्ययन के नए कायाक्रमों कोऄनुमोददत करना जजससे ईपाजध ऄथिा जडप्लोमा प्रदान दकए जा सकें। • समय-समय पर जिश्वजिद्यालय ऄनुदान अयोग र राज्य सरकार द्वारा जनधााठरत नीजतयों के ऄनुरूप िासी जनकाय/राज्य सरकार द्वारा सभी जिक्षण संकाय/प्राचायों की भर्थतयां करना। • स्ट्िायत महाजिद्यालय के िार्थर्क बजट को ऄनुमोददत करना। • सभी ऄन्य काया जनष्पाददत करना तथा सजमजतयां बनाना जजन्हेंस्ट्िायत्त महाजिद्यालय के समुजचत जिकास के जलए अिश्यक र ईजचत समझा जाएं। 12.4 ऄकादजमक पठरर्द: ऄकादजमक पठरर्द की सरं चना: 1. प्राचाया (ऄध्यक्ष) 2. स्ट्ििासी महाजिद्यालय के समस्ट्त जिभागाध्यक्ष 3. स्ट्िायत्त महाजिद्यालय म ें सेिारतिठरष्ठता के अधार पर क्रमािती रूप स े िैजक्षकस्ट्टाफ केजिजभन्न श्रेजणयों का प्रजतजनजधकृि करन े िाले 4 जिक्षक 4. ईद्योग, िाजणज्य, जिजध, जिक्षा, जचदककृसा, आंजीजनयररग, जिज्ञान आकृयादद जैसे क्षेत्रों का प्रजतजनजधकृि करने िाल े स्ट्िायत्त महाजिद्यालय के बाहर के कम से कम चार जििेर्ज्ञ/जिक्षाजिदजजन्ह ें िासी जनकाय द्वारा नाजमत दकया जाएगा। 5. जिश्वजिद्यालय के तीन नाजमजत जो कम से कम प्रोफेसर के स्ट्तर के हों। 6. स्ट्िायत्त महाजिद्यालय के परीक्षा जनयंत्रक 7. प्राचाया NOTIFICATION New Delhi, the 3rd April, 2023 University Grants Commission (Conferment of Autonomous Status Upon Colleges and Measures for Maintenance of Standards in Autonomous Colleges) Regulations, 2023 Preamble F. No. 1-18/2021 (CPP-II)—Whereas the University Grants Commission (UGC) is mandated to coordinate and determine the standards of higher education in universities; Whereas college autonomy is instrumental in promoting broad-based quality education and excellence; Whereas the Commission, in exercise of its powers conferred by Section 26 of the UGC Act, 1956, has notified the University Grants Commission (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards in Autonomous Colleges) Regulations, 2018; And whereas there is a need to promote the autonomy of colleges so as to enhance the quality of higher education in the country. Now, therefore, in supersession of the University Grants Commission (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards in Autonomous Colleges) Regulations, 2018 and in exercise of the powers conferred by clause (j) of Section 12 read with clauses (f) and (g) of sub-section (1) of Section 26 of the University Grants Commission Act,1956, the University Grants Commission hereby makes the following Regulations: — 1. Short title, application, and commencement: — 1.1 These Regulations shall be called the University Grants Commission (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards in Autonomous Colleges) Regulations, 2023. 1.2 These Regulations shall apply to all Colleges/Institutions affiliated to or are constituent colleges of Universities in the country seeking the conferment of Autonomous College status. 1.3 These Regulations shall come into force from the date of their notification in the Official Gazette. 2. Definitions: - In these Regulations, unless the context otherwise requires— 2.1 “Academic Council” means the Academic Council of the Autonomous College 2.2 “Act” means the University Grants Commission Act,1956 2.3 “Board of Studies” means the Board of Studies of a Department of the Autonomous College 2.4 “College” means any institution (affiliated College or constituent College), whether known as such or by any other name, which provides for undergraduate and/or postgraduate and/or Ph.D. programmes for obtaining any qualification from a university and which, in accordance with the rules and regulations of such University, is recognized as competent to provide for such programmes/courses of study and present students undergoing such courses of study for the12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] examination for the award of such qualification 2.5 “Commission” means the University Grants Commission (UGC) 2.6 “Finance Committee” means the Finance Committee of the Autonomous College 2.7 “Governing Body” means the Governing Body of the Autonomous College, which is different from the Trust Board or the Board of Management or the Executive Committee or the Management Committee 2.8 “Parent Body” means the Society registered under the Societies Registration Act 1860, or a body corporate, established or incorporated under a Central or State Act for the time being in force, or a Trust or a Company registered under Section 8 of the Companies Act, 2013; the Government or local authority or any University (for college/institution run by them) 2.9 “Notification” means a notification issued by the parent University declaring a college as an autonomous one after the conferment of autonomous status by the UGC 2.10 “Parent University” means the University to which the College concerned is affiliated or of which the College concerned is a constituent 2.11 “Statutory body” means a statutory body of the Autonomous College 2.12 “Statutory Council” means a body constituted under any law for the time being in force for determining or maintaining standards of quality in the relevant areas of higher education, such as the All India Council for Technical Education (AICTE), National Medical Commission (NMC), Dental Council of India (DCI), National Council for Teacher Education (NCTE), Bar Council of India (BCI), Indian Nursing Council (INC), or any other such body established under an Act of Parliament 2.13 Standing Committee means a Committee comprising of 3 or more Members 2.14 IQAC means Internal Quality Assurance Cell established by an Autonomous College in accordance with the UGC Regulations made by the Commission and the guidelines on IQAC issued by the Commission, as may be amended from time to time 3. ROLE, TERMS AND CONDITIONS OF AN AUTONOMOUS COLLEGE: - The role, terms and conditions of an Autonomous College in general and subject to the provisions of Regulations will be as under: 3.1 Review existing courses/programmes and, restructure, redesign and prescribe its own courses/programmes of study and syllabi. 3.2 To formulate new courses/programmes within the nomenclature specified by UGC as per the Specification of Degrees 2014 as amended from time to time. 3.3 Evolve methods of assessment of students‟ performance, conduct of examinations, and notification of results. 3.4 To announce results, issue mark sheets, and other certificates; however, the degree shall be awarded by the parent University with the name of the College on the degree certificate. 3.5 Autonomous colleges need not pay affiliation fees to the parent University. 3.6 Prescribe rules for admission in consonance with the reservation policy of the state government/national policy. 3.7 Autonomous Colleges may fix fees as per the norms of the State Government/ Statutory Council(s) at their own level, as applicable. 3.8 Constitute own Governing Body, Academic Council, Finance Committee, and Board of Studies. 3.9 The teaching staff and Principal in all the Autonomous Colleges shall be appointed as per the University Grants Commission (Minimum Qualifications for Appointment of Teachers and other Academic Staff in Universities and Colleges and other Measures for the Maintenance of Standards in Higher Education) Regulations, 2018 as amended from time to time or any regulations notified by UGC in this regard from time to time. 3.10 Autonomy granted to the College is at the institutional level and is not partial and shall cover the programmes at all levels of U.G. and P.G. offered by the College. The courses introduced by the College after the conferment of autonomous status shall automatically come under the purview of autonomy. 3.11 Ph.D. programmes shall be offered strictly as per the UGC Regulations notified in this regard from time to time.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 13 3.12 Autonomous status shall be granted initially for a period of five or ten years as per Clause 7 of these regulations. 3.13 Further extension of autonomy shall be for a period of five or ten years as per Clause 8 of these regulations. 4. ROLE OF THE PARENT UNIVERSITY: - The role of the parent University in general and subject to the provisions of Regulations will be as under: 4.1 To examine the application of the College for autonomous status on the UGC portal and give its recommendations, along with reasons/ justification, within 30 working days on the UGC portal. If the parent University does not respond on the UGC portal within 30 working days, it shall be presumed that the parent University has no objection to the processing of the application by the UGC for conferment of autonomous status. 4.2 Issue notification within 30 days for a college to function as an autonomous entity once the autonomous status is conferred on the College by UGC. 4.3 The College, on attaining autonomous status will continue to be affiliated with the parent University but will enjoy the privileges of autonomy. 4.4 To provide nominees on various Statutory Bodies of the Autonomous College. 4.5 To facilitate the implementation of these regulations. 5. ROLE OF THE STATE GOVERNMENT 5.1 To provide nominees on various Statutory Bodies of the Autonomous College. 5.2 The autonomous colleges shall continue to be eligible to receive funds from the State Government as being done before the grant of autonomous status, if any. 5.3 To make efforts to fill all sanctioned faculty positions on a regular and ongoing basis. 6. ELIGIBILITY 6.1 Affiliated or Constituent Colleges of any discipline, whether Government, aided, partially aided, or unaided/self-financing, are eligible, provided they are under Section 2(f) of the UGC Act. 6.2 The College should have at least 10 years of existence. 6.3 The College must be accredited either by NAAC; or by NBA for at least three programme(s); or from a UGC-empanelled accreditation agency. However, if the number of programme(s) being run by the College is less than three, then each of the eligible programme must be accredited as per NBA norms. Accreditation status must be valid for at least one year at the time of application. The constituent colleges shall also undergo independent accreditation. 6.4 The Commission may exempt a college from Clauses 6.2 and 6.3 of these Regulations, if it offers programmes in any of the following focus areas:  unique discipline(s), e.g., special education, Indian knowledge system, yoga, defence studies  addressing the strategic needs of the country  engaged in the preservation of Indian cultural heritage  preservation of the environment  dedicated to Skill Development, Sports, languages  any other discipline(s)/ field(s) so determined by the Commission. 7. CONFERMENT OF AUTONOMOUS STATUS 7.1 A College fulfilling the eligibility as per clause 6 of these regulations, intending to become autonomous, shall submit the application on the UGC portal anytime during the year. However, in the case of proposals for the grant of autonomy/extension of autonomy, which have already been received and are under consideration by UGC before the notification of these regulations, no fresh application will be required, and UGC will consider all such pending proposals as per these Regulations, subject to the condition that the accreditation status is valid for six months at the time of notification of these Regulations or has applied for reaccreditation in case the validity of accreditation is less than six months.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 7.2 The parent University will examine the application of the College for autonomous status on the UGC portal and give its recommendations along with reasons/justification within 30 working days from the date of submission of the application on the UGC portal. If the parent University does not respond on the UGC portal within 30 working days, it shall be presumed that the parent University has no objection to the processing of the application by the UGC for conferment of autonomous status. 7.3 A Standing Committee of UGC shall examine the application of the College for conferment of autonomous status. The recommendations of the Standing Committee shall be considered by the Commission and its decision may be communicated to the parent University and the College. 7.4 Autonomous status shall be granted initially for a period of five years from the commencement of an academic session in case the College is accredited either by NAAC; or by NBA for at least three programme(s); or from a UGC-empanelled accreditation agency. However, if the number of programme(s) being run by the College is less than three, then each of the eligible programme must be accredited as per NBA norms. Accreditation status must be valid for at least one year at the time of application submission; 7.5 Autonomous status shall be granted initially for a period of ten years from the commencement of an academic session in case the College is accredited either by NAAC with a minimum „A‟ Grade (with a score of 3.01 and above on a 4-point scale of NAAC) or by NBA for at least three programme(s) with a minimum score of 675 individually, or a corresponding accreditation Grade/score from a UGC empanelled accreditation agency. However, if the number of programme(s) being run by the College is less than three, then each of the eligible programme as per NBA norms, should secure 675 or more marks. Accreditation status must be valid for at least one year at the time of application submission; 7.6 If the application of a College for the conferment of autonomous status is rejected by the UGC for any reason whatsoever, the College shall be eligible to reapply on UGC portal, but not before one year from the date of rejection of its earlier application. 7.7 An autonomous College can merge with another autonomous college(s)/institution(s) run by the same Parent Body of the Autonomous Colleges, with the prior approval of the Parent University/Universities. 8. EXTENSION OF AUTONOMOUS STATUS 8.1 If an autonomous college has accreditation either by NAAC; or by NBA for at least three programme(s); or from a UGC-empanelled accreditation agency; (if the number of programme(s) being run by the College is less than three, then each of the eligible programme should be accredited as per NBA norms) on the last day of completion of Autonomy period, the College shall be eligible for grant of an extension of autonomous status for further five years, provided that the College has followed the procedure stipulated in clause 8.3 below. The College shall apply for extension of autonomous status on the UGC portal at least three months before the completion of the autonomy period. The Autonomous College shall also inform the Parent University about its application for the extension of autonomous status. Standing Committee of UGC shall examine the application of the Autonomous College for extension of autonomous status. The recommendations of the Standing Committee shall be considered by the Commission and its decision may be communicated to the parent University and the Autonomous College. 8.2 If an autonomous college has NAAC with a minimum „A‟ Grade with a score of 3.01 and above on a 4-point scale of NAAC or by NBA for at least three programme(s) with a minimum score of 675 individually or a corresponding accreditation Grade/score from a UGC empanelled accreditation agency (if the number of programme(s) being run by the College is less than three, then each of the eligible programme as per NBA norms should secure 675 or more marks) on the last day of completion of Autonomy period, the College shall be eligible for grant of an extension of autonomous status for further ten years, provided that the College has followed the procedure stipulated in clause 8.3 below. The College shall apply for extension of autonomous status on the UGC portal at least three months before the completion of the autonomy period. The Autonomous College shall also inform the parent University about its application for the extension of autonomous status. Standing Committee of UGC shall examine the application of the Autonomous College for extension of autonomous status. The recommendations of the Standing Committee shall be considered by the Commission and its decision may be communicated to the parent University and the Autonomous College. 8.3 Autonomous colleges are required to apply for reaccreditation six months before the end of the cycle of accreditation period as mentioned in the Accreditation Certificate issued by National Assessment and Accreditation Council/NBA/UGC empanelled accreditation agency. For[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15 Autonomous Colleges which have applied for reaccreditation six months before the end of the cycle of accreditation period, in case there is a delay in the accreditation process by the accrediting body, the delay period between two consecutive accreditations shall be condoned. Autonomous colleges that have not applied for reaccreditation six months before the end of the accreditation period should get the accreditation within one year from the end of the last accreditation cycle, failing which the autonomy automatically stands withdrawn. 8.4 In case Autonomous College fails to obtain the required accreditation Grade/score as per clauses 8.1, 8.2 and 8.3 above, the autonomy to such College stands automatically withdrawn, and no fresh admissions will be done under autonomy mode after withdrawal of autonomous status. No communication from the parent University and/or UGC will be needed in this regard. It will be the responsibility of the College to inform the parent University and UGC regarding the withdrawal of autonomy. However, for students admitted during autonomy period, such withdrawal shall take effect only after the last batch of students enrolled under autonomy passes out. 8.5 Such Colleges whose autonomy is withdrawn shall be eligible to apply for fresh autonomy on UGC portal, but not before one year from the effective date of withdrawal of autonomy. 9. MONITORING OF AUTONOMOUS COLLEGES 9.1 IQAC shall be established in the Autonomous College for regular monitoring of the College. The IQAC shall have an external Peer Team comprising of 2 or more members who shall be academicians of repute not below the rank of Professor. The report regarding the performance of the Autonomous College shall also be put on the public domain on the website of the College. The external peer review shall be conducted at least once in a year. 9.2 On its own or in case of an adverse report by the external peer team of IQAC or on receipt of any information/complaint, UGC may cause an inspection by constituting an Expert Committee for scrutiny and may revoke the autonomous status of the College after giving due opportunity of hearing to the management by way of notification and by passing a speaking order. 9.3 The Autonomous College shall, without fail, upload on its website, information regarding the courses offered by it, the fees for the courses, the details of the faculty along with qualification and unique ID, the admission procedure, the details of relevant infrastructures, research activities of the Autonomous College along with the details of Ph.D. students enrolled, if any, with the date of enrolment, topics and supervisor. 9.4 The Autonomous College shall also put on its website the constitution of various Committees/Cells as mandated in the various UGC Regulations notified from time to time. The Autonomous College shall conduct the meetings of the statutory bodies regularly and upload the minutes of the meetings on the college website. 9.5 The Autonomous College shall also upload such information on such web portals as may be specified by the Commission, from time to time. 10. MATTERS REGARDING STARTING OF NEW COURSES 10.1 An autonomous college is free to start certificate or diploma courses without prior approval of the parent University. The Autonomous College should inform the parent University about the introduction of such new courses. Approval of the concerned statutory bodies of the Autonomous College and Statutory Council(s)should be obtained, wherever required. Certificates and Diplomas shall be issued under the seal of the Autonomous College. 10.2 An autonomous college is free to start a new degree programme(s) at undergraduate and postgraduate levels with the approval of the Academic Council of the Autonomous College and concerned Statutory Council(s), wherever required, provided the nomenclature of the degree is in consonance with UGC Notification on Specification of Degrees, 2014 as amended from time to time. Such courses shall fulfill the minimum standards prescribed by the parent university/UGC/Statutory Council(s) in terms of number of hours, curricular content and standards, and the parent University shall be duly informed of such courses. 10.3 An autonomous college can start Ph.D. programme with the prior approval of the parent University. UGC Regulations for Ph.D. programmes as notified from time to time, must be adhered to by the parent University/Autonomous College. 10.4 An autonomous college may rename an existing course as per the UGC Notification on Specification of Degrees, 2014, as amended from time to time after restructuring/redesigning it with the approval of the Academic Council of the Autonomous College. However, this renaming of course(s) will not be applicable to previous batches. 11. EXAMINATION CELL 11.1 Autonomous College shall have an Examination Cell and should maintain all the records of the student evaluations and examinations. 12. GOVERNANCE OF AN AUTONOMOUS COLLEGE 12.1 The autonomous College shall have the following statutory bodies to ensure proper management of academic, financial, and general administrative affairs: (a) Governing Body (b) Academic Council (c) Board of Studies (d) Finance Committee (The Governing Body is different from Trust Board/ Board of Management/ Executive Committee/ Management Committee). 12.2 The Autonomous College shall in addition, have other non-statutory committees such as the Planning and Evaluation Committee, Grievance Redressal Committee, Examination Committee, Admission Committee, Library Committee, Student Welfare Committee, Internal Complaints Committee, Extra- Curricular Activities Committee and Academic Audit Committee, etc. 12.3 GOVERNING BODY: A. Meetings: Meetings of the Governing Body shall be held at least once every six months. Quorum: Presence of a minimum 50% of Members will be the quorum. Functions of the Governing Body: Subject to the existing provision in the bye-laws of the respective Autonomous College and rules laid down by the State Government/Parent University, the Governing Body shall:  Guide the Autonomous College while fulfilling the objectives for which the College has been granted autonomous status.  Institute scholarships, fellowships, studentships, medals, prizes, and certificates on the recommendations of the Academic Council  Approve new programmes of study leading to degrees and/or diplomas.  All recruitments of Teaching Faculty/Principal shall be made by the Governing Body/state government as applicable in accordance with the policies laid down by the UGC and State Government from time to time.  To approve the annual budget of the Autonomous College.  Perform such other functions and institute committees as may be necessary and deemed fit for the proper development of the Autonomous College. 12.4 ACADEMIC COUNCIL: COMPOSITION OF ACADEMIC COUNCIL: 1. The Principal (Chairman) 2. All the Heads of Departments in the Autonomous College 3. Four teachers of the Autonomous College representing different categories of teaching staff by rotation on the basis of seniority of service in the College. 4. Not less than four experts/academicians from outside the Autonomous College representing such areas as Industry, Commerce, Law, Education, Medicine, Engineering, Sciences, etc., are to be nominated by the Governing Body. 5. Three nominees of the University, not less than Professors. 6. The Controller of Examination of the Autonomous College 7. A faculty member nominated by the Principal (Member Secretary). Term: The term of the nominated members shall be three years. Meetings: Meetings of the Academic Council shall be held at least once every six months. Functions of the Academic Council:18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (a) To scrutinize and approve the proposals with or without modification of the Board of Studies with regard to courses of study, academic regulations, curricula, syllabi and modifications thereof, instructional and evaluation arrangements, methods, procedures relevant thereto, etc., provided that where the Academic Council differs on any proposal, it shall have the right to return the matter for reconsideration to the Board of Studies concerned or reject it, after giving reasons to do so. (b) To make regulations regarding the admission of students to different programmes of study in the Autonomous College, keeping in view the policy of the Government. (c) To make regulations for sports, extra-curricular activities, and proper maintenance and functioning of the playgrounds and hostels. (d) To recommend to the Governing Body proposals for the institution of new programmes of study. (e) To recommend to the Governing Body institution of scholarships, studentships, fellowships, prizes, and medals, and to frame regulations for the award of the same. (f) To advise the Governing Body on suggestions(s) pertaining to academic affairs. (g) To perform such other functions as may be assigned by the Governing Body. 12.5 BOARD OF STUDIES: Composition of Board of Studies: 1. Head of the Department concerned (Chairperson). 2. All faculty members of the Department. 3. Two subject experts from outside the parent University are to be nominated by the Academic Council. 4. One expert is to be nominated by the Vice-Chancellor from a panel of six recommended by the Autonomous College Principal. 5. One representative from industry/corporate sector/allied areas to be nominated by the Principal. 6. One member of the College alumni to be nominated by the Principal. 7. Experts from outside the Autonomous College, whenever special courses of studies are to be formulated, to be nominated by the Principal. Term: The term of the nominated members shall be three years. Meetings: Meetings of the Board of Studies shall be held at least once every six months. Functions: The Board of Studies shall recommend the following to the Academic Council: (a) Courses of studies; (b) Measures for the improvement of the standards of teaching and research; (c) Any other academic matter. 12.6 FINANCE COMMITTEE: Composition of Finance Committee: (a) The Principal (Chairman). (b) One person to be nominated by the Governing Body of the Autonomous College for a period of two years. (c) One senior-most faculty member of the Autonomous College to be nominated in rotation by the Principal for two years. (d) Finance Officer/Officer in-charge of Finance and Accounts of the Autonomous College (Member Secretary) Term: The term of the Finance Committee shall be three years. Meetings: Meetings of the Finance Committee shall be held at least once every six months.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19 Functions of the Finance Committee: The Finance Committee shall act as an advisory body to the Governing Body to consider: (a) Budget estimates relating to the grant received/receivable from funding agencies, income from fees, etc. and (b) Audited accounts for the above. 13. CONSEQUENCES OF VIOLATION OF REGULATIONS 13.1 The Autonomous Colleges shall at all times adhere to UGC Regulations and Guidelines made and issued by the Commission from time to time, failing which UGC may take appropriate action against the defaulting Autonomous College including revoking of autonomous status. 14. INTERPRETATION 14.1 In the event of any conflict or inconsistency with respect to these regulations, the interpretation given by the Commission shall be final and binding. 15. REMOVAL OF DIFFICULTIES 15.1 The Commission reserves the right to remove difficulty/difficulties in the course of implementation of these Regulations. Prof. MANISH JOSHI, Secy.
